<official-title display="yes">To direct the Secretary of State to avoid or minimize the acquisition or lease of a consular or diplomatic post built or owned by an entity owned or controlled by the Government of the People’s Republic of China, and for other purposes.</official-title>

<section id="HC3A746E587FF4AB98F1A802C671A17D3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Embassy Construction Integrity Act of 2023</short-title></quote>.</text></section> <section id="H2E9CA38E9B8A4AB18799995065B3F1D9"><enum>2.</enum><header>Restrictions on consular and diplomatic posts built or owned by certain entities</header> <subsection id="H15270228D3134D0DB0DEF0E1BB4FD3F7" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State (in this section referred to as the <quote>Secretary</quote>) shall take such steps as may be necessary to avoid or minimize—</text> 
<paragraph id="HDA0344772CE04600A42DF1FA7496E8FB"><enum>(1)</enum><text display-inline="yes-display-inline">acquiring or leasing a covered building—</text> <subparagraph id="H8BC09641CBE449AF9DB57678193652BB"><enum>(A)</enum><text>with respect to which a covered entity performed covered construction on or after January 1, 1949; or</text></subparagraph> 
<subparagraph id="H2384A40DB0494B7EBB2515C97EE6BA5E"><enum>(B)</enum><text>in which a covered entity has an ownership interest; or</text></subparagraph></paragraph> <paragraph id="HEEAAA22F8F7E42AB99CF8DF377935BE2"><enum>(2)</enum><text display-inline="yes-display-inline">entering into or renewing a contract or other agreement with a covered entity to perform covered construction with respect to a covered building.</text></paragraph></subsection> 
<subsection id="H0159BB3D921A4885AE5811B0E10748D0"><enum>(b)</enum><header>Notification of inconsistent action</header> 
<paragraph id="HE220F3C40D624D63806B17F6AC2A73A4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall notify the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate—</text> <subparagraph id="H9FAEF35A21FA41CAA4A3B25B0D5A87DC"><enum>(A)</enum><text>not later than 7 days before entering into an acquisition, lease, or agreement after the date of enactment of this Act that the Secretary is aware is inconsistent with the restriction under subsection (a); and</text></subparagraph> 
<subparagraph id="H97C3B9593E504BC8A813D0AD9480092F"><enum>(B)</enum><text>not later than 7 days after becoming aware of an acquisition, lease, or agreement occurring after the date of enactment of this Act that is inconsistent with the restriction under subsection (a).</text></subparagraph></paragraph> <paragraph id="H7C7740FEB8524DFA905B4D6C9B63A115"><enum>(2)</enum><header>Determination of national security interest</header><text>The notification required under paragraph (1) shall also include, to the extent applicable—</text> 
<subparagraph id="H03C8F6401D044789B3274D0204070636"><enum>(A)</enum><text>a determination of whether the inconsistent acquisition, lease, or agreement is in the national security interest of the United States;</text></subparagraph> <subparagraph id="H47E5B3B8F0ED4B5788B9F6B0BD52B012"><enum>(B)</enum><text>an identification of the interest advanced by such inconsistent action;</text></subparagraph> 
<subparagraph id="HCFE2BB9E9F8D4CC28A699AAD3287A64F"><enum>(C)</enum><text>a detailed explanation for such determination; and</text></subparagraph> <subparagraph id="H2F49E870654A4581A5195E7439923D59"><enum>(D)</enum><text>any action the Secretary has taken or intends to take to mitigate national security vulnerabilities that may be posed by such inconsistent action. </text></subparagraph></paragraph></subsection> 
<subsection id="HA8AF3F5C634542CEA88A1240F5F58E3E"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H2E5969AB538E4BB3945CF6958A1DB73B"><enum>(1)</enum><header>Covered building</header><text display-inline="yes-display-inline">The term <quote>covered building</quote> means a building that is used or intended to be used by personnel, or for a function, of a consular or diplomatic post located outside of the United States.</text></paragraph> 
<paragraph id="H98BBF6C9FEC947A7ADF82E9EE73CAB29" display-inline="no-display-inline"><enum>(2)</enum><header>Covered construction</header><text display-inline="yes-display-inline">The term <quote>covered construction</quote>—</text> <subparagraph id="HB10A1A77D4864F0585C083A2C4C0A72E"><enum>(A)</enum><text>means any construction, development, conversion, extension, alteration, repair, or maintenance performed with respect to a building; and</text></subparagraph> 
<subparagraph id="H980668F58ED144F3A8DDD096BE5EE1F8"><enum>(B)</enum><text>includes the installation or maintenance of electrical, plumbing, heating, ventilation, air conditioning, communication, fire protection, and energy management systems with respect to such building.</text></subparagraph></paragraph> <paragraph id="H49D14026B94F4DC3B5C73FBBF098E84F"><enum>(3)</enum><header>Covered entity</header><text display-inline="yes-display-inline">The term <quote>covered entity</quote> means an entity with respect to which the Government of the People’s Republic of China, or an agent or instrumentality of the Government of the People’s Republic of China, directly or indirectly, including through any contract, arrangement, understanding, or relationship—</text> 
<subparagraph id="H94DDBB27F8E94720ABB63E2280C6FEE2"><enum>(A)</enum><text>owns or controls a significant percent of the ownership interest; or</text></subparagraph> <subparagraph id="H6DAC761F09494DF9AD56CCAF00203760"><enum>(B)</enum><text>otherwise exercises substantial control.</text></subparagraph></paragraph></subsection></section>
