<section id="H1E9B261E86094144AE3AD1478834A2E4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Use it or Lose it Leases Act</short-title></quote> or the <quote><short-title>FULL Act</short-title></quote>. </text></section> <section id="H2808D021F16A4839B87C54E35B055066"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HE1F6A4866F82489F9180CA7DDF756D51"><enum>(1)</enum><header>Actual utilization</header><text display-inline="yes-display-inline">The term <quote>actual utilization</quote> means the percentage of capacity used based on the space utilization rate. </text></paragraph> <paragraph id="H47F40A1FF6144A2AA8F921DCF782D61D"><enum>(2)</enum><header>Capacity</header><text display-inline="yes-display-inline">The term <quote>capacity</quote> means a usable office space calculated by the square feet of such space divided by 150.</text></paragraph> 
<paragraph id="H9D7091DD058049FE9B581544AD289F4E"><enum>(3)</enum><header>Executive agency</header><text display-inline="yes-display-inline">The term <quote>Executive agency</quote> has the meaning given the term in section 105 of title 5, United States Code.</text></paragraph> <paragraph id="HE0C59EF0F60A4233ABD6ED823E9C4A92"><enum>(4)</enum><header>Federal tenant</header><text display-inline="yes-display-inline">The term <quote>Federal tenant</quote>—</text> 
<subparagraph id="H4832FB7923E74D2EB927A64C7035B6E7"><enum>(A)</enum><text>means an Executive agency that has an occupancy agreement with the Administrator of General Services to occupy a commercial lease for office space secured by the Administrator on behalf of the Federal Government; and</text></subparagraph> <subparagraph id="H501EDFFCFB434231A14640523231BA7C"><enum>(B)</enum><text>does not include an element of the intelligence community.</text></subparagraph></paragraph> 
<paragraph id="H3DBD8280903548D5AFEA7EFEDA88966D"><enum>(5)</enum><header>Intelligence community</header><text display-inline="yes-display-inline">The term <quote>intelligence community</quote> has the meaning given that term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text></paragraph> <paragraph id="H6016CAEE7B6E4978ACB197DAF5CB45B6"><enum>(6)</enum><header>Occupancy</header><text display-inline="yes-display-inline">The term <quote>occupancy</quote> means the total number of employees performing his or her duties in-person, in office space, at least 5 days per week on a recurring basis.</text></paragraph> 
<paragraph id="H0C6BDB7D26B9482BA8CF5F27F983C863"><enum>(7)</enum><header>Space utilization rate</header><text display-inline="yes-display-inline">The term <quote>space utilization rate</quote> means total usable square feet divided by occupancy.</text></paragraph></section> <section id="H636F9BE0E308481CA763E2B2FCF80BAB"><enum>3.</enum><header>Reporting of space utilization and occupancy data for office space</header><text display-inline="no-display-inline">An occupancy agreement between the Administrator of General Services and a Federal tenant for office space shall—</text> 
<paragraph id="H561563C124D34591BDB3B26A903351A1"><enum>(1)</enum><text>include language that requires the Federal tenant to submit to the Administrator an annual report for the duration of the agreement containing data on—</text> <subparagraph id="H95DFC6691D9541E2BFB4DA8C67488B84"><enum>(A)</enum><text>monthly total occupancy of such office space;</text></subparagraph> 
<subparagraph id="H9A0EA3FC49394F658DD8A4A904842669"><enum>(B)</enum><text>the actual utilization of such office space;</text></subparagraph> <subparagraph id="HC200900EF68C4D6DBB0F6956CD784819"><enum>(C)</enum><text>monthly space utilization rates; and</text></subparagraph> 
<subparagraph id="H3D30C8B34331499D90E4F19AB3C3FA73"><enum>(D)</enum><text>any other office space utilization data considered important by the Administrator; and</text></subparagraph></paragraph> <paragraph id="HAFBE1B99CE654C9788B1551AAC0D0DB2"><enum>(2)</enum><text display-inline="yes-display-inline">include language that requires the Federal tenant to have written procedures in place governing the return of office space to the Administrator if the occupancy of the Federal tenant falls below a 60 percent space utilization rate for 6 months within any 1-year period, beginning on the date on which the agreement takes effect.</text></paragraph></section> 
<section id="H69C4AFFD5F3F49AF97617611BF2B2046"><enum>4.</enum><header>Requirements for Federal agencies with independent leasing authorities</header><text display-inline="no-display-inline">The head of any agency with independent leasing authorities with leases for office space shall submit to the Committee on Transportation and Infrastructure of the House of Representatives, the Committee on Environment and Public Works of the Senate, and each congressional committee of jurisdiction of the applicable independent leasing authority an annual report for the duration of such agreement containing data on—</text> <paragraph id="H83B83752E1024864B6FDD9B8239442ED"><enum>(1)</enum><text>monthly total occupancy of the office space;</text></paragraph> 
<paragraph id="H283F355917B5406C8DD20216D6A8EEDA"><enum>(2)</enum><text>the actual utilization of such office space;</text></paragraph> <paragraph id="HC143A1960B9F4936B9212CE76977E08C"><enum>(3)</enum><text>monthly space utilization rates; and</text></paragraph> 
<paragraph id="H4E40DD35E5A54946A08FEC600EE80C1E"><enum>(4)</enum><text>any other office space utilization data considered important for collection by Congress.</text></paragraph></section> <section id="HDFE598F1A0B14585B094FC2761326DF3"><enum>5.</enum><header>Exceptions to reporting and occupancy agreement requirements</header><text display-inline="no-display-inline">This Act shall not apply to properties used by an element of the intelligence community.</text></section> 
<section id="H1E2ECD37E1A14692A36BEA48697839A2"><enum>6.</enum><header>Applicability</header><text display-inline="no-display-inline">The requirements of this Act shall apply to any occupancy or novation agreement entered into on or after the date that is 6 months after the date of enactment of this Act.</text></section> </legis-body> <endorsement display="yes"> <action-date date="20241126">November 26, 2024</action-date> <action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement> </bill>
