which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><action display="yes"><action-date date="20240319">March 19, 2024</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require coordination among Federal agencies on regulatory actions that affect the reliable operation of the bulk-power system.<pagebreak></pagebreak></official-title></form><legis-body id="H49F97A3EEE734702BD1FDC8AD4BADDAB" style="OLC"><section id="H60603CA8FA7946BDACFA0E9F8D0D5E8F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guaranteeing Reliable Infrastructure Development Act</short-title></quote> or the <quote><short-title>GRID Act</short-title></quote>.</text></section><section id="H84DA7C5B6C0D4666A3E70460B16FF0DD"><enum>2.</enum><header>Coordination process to protect electric reliability</header><text display-inline="no-display-inline">Section 215 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o</external-xref>) is amended—</text><paragraph id="H8F6B4EBCBC08462D963C170965757262"><enum>(1)</enum><text>by redesignating subsections (h) through (k) as subsections (i) through (l), respectively; and</text></paragraph><paragraph id="HF06626D4D9B547B1A8B59B947CA2AD71"><enum>(2)</enum><text>by inserting after subsection (g) the following:</text><quoted-block style="OLC" id="H13DC5A703ED34C27A24FAFDC92D01B52" display-inline="no-display-inline"><subsection id="H12064E3B504A42EFB175B18225C6A361"><enum>(h)</enum><header>Commission review and comment for proposed covered agency actions</header><paragraph id="H665B7F23E49E4046A292E4C89D43DE13" commented="no"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">If the Commission or a State commission determines, on its own motion or on a request from another Federal agency, that a covered agency action proposed by a Federal agency other than the Commission is likely to have a significant negative impact on the reliability and adequacy of the bulk-power system in North America, the agency head with respect to such proposed covered agency action shall provide to the Commission such proposed covered agency action for review and comment—</text><subparagraph id="H2CD9885504C449EEADFE42095D45420D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">on the first date on which such proposed covered agency action is provided to the Office of Management and Budget or any other Federal agency for review and comment; or</text></subparagraph><subparagraph id="H3978C2AAF7FA40FEAEDEA49F78D8AE9F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">if such proposed covered agency action is not provided to the Office of Management and Budget or any other Federal agency for review and comment, not later than 90 days before the date on which the agency head publishes in the Federal Register or otherwise makes available for public inspection or comment such proposed covered agency action.</text></subparagraph></paragraph><paragraph id="HB634E421BBFA40FC80F0CDE014711DC1"><enum>(2)</enum><header>Commission comments</header><text display-inline="yes-display-inline">The Commission, in consultation with the ERO, shall, by order, provide to the agency head that provides a proposed covered agency action to the Commission under paragraph (1) comments on such proposed covered agency action.</text></paragraph><paragraph id="H0AE4C21C5190453F8AA712E96E47E7F7"><enum>(3)</enum><header>Agency response</header><text display-inline="yes-display-inline">An agency head may not finalize a proposed covered agency action for which a determination is made under paragraph (1)—</text><subparagraph id="H67DE9AF7388A48E59FB21F3FD9DE4D3F"><enum>(A)</enum><text>until the agency head has responded in writing to the Commission with an explanation of how the agency head has modified, or why the agency head has determined not to modify, such proposed covered agency action in response to each comment provided by the Commission under paragraph (2); or</text></subparagraph><subparagraph id="H351289274400452CB28D9BAEE19FDD1F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">if the Commission finds that the agency head has not modified such proposed covered agency action based on the comments provided by the Commission under paragraph (2) to prevent a significant negative impact on the reliability and adequacy of the bulk-power system in North America.</text></subparagraph></paragraph><paragraph id="HA7A647FAF1A5414DAAA55C0D7FE10315" commented="no"><enum>(4)</enum><header>Public availability of comments and responses</header><text display-inline="yes-display-inline">An agency head shall include the comments and responses for the proposed covered agency action in the proposed agency action as—</text><subparagraph id="HE45861DE206A4068BDFFFD113C684F2E" commented="no"><enum>(A)</enum><text>submitted to the Federal Register for publication; or</text></subparagraph><subparagraph id="H9A225413E7744D40BC184800AFE23ADC" commented="no"><enum>(B)</enum><text>otherwise made available for public inspection or comment.</text></subparagraph></paragraph><paragraph id="H426D69FF21D34B138514B51E7A33D282"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H48719C2071E54806876718AEE4A82B25" commented="no"><enum>(A)</enum><header>Agency head</header><text display-inline="yes-display-inline">The term <term>agency head</term> means the head of a Federal agency that proposed a covered agency action.</text></subparagraph><subparagraph id="H0A03556DAC054F08A27A8510195C2D84" display-inline="no-display-inline" commented="no"><enum>(B)</enum><header>Covered agency action</header><text>The term <term>covered agency action</term> means a rule, regulation, standard, criteria document, deadline, or determination.</text></subparagraph><subparagraph id="HC52E454D3A24451186E01D10D1117DED"><enum>(C)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> means an Executive department (as that term is defined in section 101 of title 5, United States Code) or any other Executive agency that is in the President’s cabinet.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><endorsement display="yes"><action-date date="20240319">March 19, 2024</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
