<official-title display="yes">To amend the Veterans’ Benefits Improvements Act of 1996 and the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 to improve the temporary licensure requirements for contract health care professionals who perform medical disability examinations for the Department of Veterans Affairs, and for other purposes.<pagebreak/></official-title>

<section id="H09639844E9DC4D04AD8048C514386D6D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Exam Expansion Act of 2023</short-title></quote>.</text></section> <section id="H8A1D98AB4E964E458B3FCDD8C4D7DA96" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Improvements to temporary licensure requirements for contract health care professionals who perform medical disability examinations for the Department of Veterans Affairs</header> <subsection id="HE41BD506C67E4499A9FF82572492BB8E" commented="no"><enum>(a)</enum><header>Expansion</header> <paragraph id="H242507BA81B44933AE78A92DE139DBFF" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 504(c)(2) of the Veterans’ Benefits Improvements Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/275">Public Law 104–275</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/5101">38 U.S.C. 5101</external-xref> note), as amended by paragraph (1) of subsection (a) of section 2002 of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/5101">38 U.S.C. 5101</external-xref> note), is further amended, subject to the sunset in paragraph (4) of such subsection—</text> 
<subparagraph id="H11D42CBAA6CB4B8698474B5356E604A0"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>or psychologist</quote> and inserting <quote>psychologist, podiatrist, dentist, optometrist, or other health care professional specified in regulations prescribed by the Secretary</quote>; and</text></subparagraph> <subparagraph id="H06CB85549B7846799DCFC79A4E362794"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>the physician, physician assistant, nurse practitioner, audiologist, or psychologist, as the case may be</quote> and inserting <quote>such health care professional</quote>.</text></subparagraph></paragraph> 
<paragraph id="H2BD4E47C868F4A8FB1152B7659515C6E" commented="no"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 2002(a)(2) of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/5101">38 U.S.C. 5101</external-xref> note) is amended by striking <quote>physicians assistants, nurse practitioners, audiologists, and psychologists</quote> and inserting <quote>health care professionals</quote>.</text></paragraph></subsection> <subsection id="H1C1A461A6D2743C88FF131799490B39C"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 15 months after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report regarding the use of the authority under section 504 of the Veterans’ Benefits Improvements Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/275">Public Law 104–275</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/5101">38 U.S.C. 5101</external-xref> note), as temporarily amended by section 2002(a)(1) of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/5101">38 U.S.C. 5101</external-xref> note) and by subsection (a). Such report shall include, with respect to the one-year period after the date of the enactment of this Act, the following elements:</text> 
<paragraph id="HC3C92DDD18AF42D593CEB051CC2DB58C"><enum>(1)</enum><text display-inline="yes-display-inline">The number of examinations conducted pursuant to a contract under such authority.</text></paragraph> <paragraph id="H644B0148F3DB41E8A570CF24A2D22A11"><enum>(2)</enum><text display-inline="yes-display-inline">The number of such examinations conducted in each State, the District of Columbia, or a Commonwealth, territory, or possession of the United States.</text></paragraph> 
<paragraph id="H1470073712F4498D9E0D23165905FA60"><enum>(3)</enum><text>The numbers of each kind of health care professionals who conducted such examinations.</text></paragraph> <paragraph id="H468476F6DE3B40C1A8CAD3C2A8F24477"><enum>(4)</enum><text display-inline="yes-display-inline">The number of examinations that were erroneously conducted by a health care professional—</text> 
<subparagraph id="H6715AB69E0AF4628A5C11A7EC58F9266"><enum>(A)</enum><text>without such a contract; or</text></subparagraph> <subparagraph id="H3E129C8FD84F4A9B831446B86B92B35A"><enum>(B)</enum><text>unauthorized to enter into such a contract.</text></subparagraph></paragraph>
