R. 5917</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>April 17, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Sanctioning the Use of Civilians as Defenseless Shields Act to modify and extend that Act, and for other purposes.</official-title></form><legis-body id="H2C1CB5E8E742471596017DB5F9DDDBAD" style="OLC"><section id="H29675CE39D2F4CAD907E1831694DC7E7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Tools to Counter the Use of Human Shields Act</short-title></quote>.</text></section><section id="H557C4D9F337B4640B871563DB7D9A06E" section-type="subsequent-section"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It shall be the policy of the United States to fully implement and enforce sanctions against terrorist organizations and other malign actors that use innocent civilians as human shields.</text></section><section id="H764A883F685E47C287D9B45E614A29AE"><enum>3.</enum><header>Modification and extension of Sanctioning the Use of Civilians as Defenseless Shields Act</header><subsection id="H6BEB1F0A0881498C940A0053B4039FEC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3 of the Sanctioning the Use of Civilians as Defenseless Shields Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/348">Public Law 115–348</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text><paragraph id="H3BBBBA37C9614CD9BB037EFD3F92331F"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H28D15A3BCE2E4AC4BB8762EA808E0A44"><enum>(A)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></subparagraph><subparagraph id="H306D93902D35431EA7D24C099E4502A2"><enum>(B)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" id="H831A5AC270ED4E9AA0772C15307A6804" display-inline="no-display-inline"><paragraph id="H3C31789585D64904A4B02E828A4E4B55"><enum>(3)</enum><text display-inline="yes-display-inline">Each foreign person that the President determines, on or after the date of the enactment of the Strengthening Tools to Counter the Use of Human Shields Act—</text><subparagraph id="H0EA411F78E37419DA932F13317D7AB36"><enum>(A)</enum><text>is a member of Palestine Islamic Jihad or is knowingly acting on behalf of Palestine Islamic Jihad; and </text></subparagraph><subparagraph id="HBB3B954F61EE4944936415AD30ED260B"><enum>(B)</enum><text>knowingly orders, controls, or otherwise directs the use of civilians protected as such by the law of war to shield military objectives from attack.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H069A0452432045CAAEA43BB3899DC7F7"><enum>(2)</enum><text>by redesignating subsections (e), (f), (g), (h), and (i) as subsections (f), (g), (h), (i), and (j), respectively; and</text></paragraph><paragraph id="HA0BD9733D82945F4874598A5CE21E7FA"><enum>(3)</enum><text>by inserting after subsection (d) the following:</text><quoted-block style="OLC" id="H484325562DC54A10AF13B42CAAD2CECA" display-inline="no-display-inline"><subsection id="H0FFE4ED62C2C4116B19791CBF3A1D2F4"><enum>(e)</enum><header>Congressional requests</header><text display-inline="yes-display-inline">Not later than 120 days after receiving a request from the chairman and ranking member of one of the appropriate congressional committees with respect to whether a foreign person meets the criteria of a person described in subsection (b) or (c), the President shall—</text><paragraph id="H4C13ACB1315943978299BE283C141ABC"><enum>(1)</enum><text>determine if the person meets such criteria; and </text></paragraph><paragraph id="HE3CA9A8DA3464B7693FE7B65EBCAC9E8"><enum>(2)</enum><text>submit a written justification to the chairman and ranking member detailing whether or not the President imposed or intends to impose sanctions described in subsection (b) or (c) with respect to such person.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H21E65843F6404A8E97E12BC6E1267E2E"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 4 of the Sanctioning the Use of Civilians as Defenseless Shields Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/348">Public Law 115–348</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended—</text><paragraph id="H6EB19D5A2D6645AE9E808DE19A99AB5F"><enum>(1)</enum><text>by redesignating paragraph (7) as paragraph (8); and</text></paragraph><paragraph id="H733E8D7EC24743508A632E2616F3D7BF"><enum>(2)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block style="OLC" id="H154C189143E1451BAC553711A9E308FE" display-inline="no-display-inline"><paragraph id="HA060D8214BE04CB6BE82C7F0E1ED7945"><enum>(7)</enum><header>Palestine Islamic Jihad</header><text display-inline="yes-display-inline">The term <term>Palestine Islamic Jihad</term> means—</text><subparagraph id="H3D0B3C62A98A4A638F302922773B9C00"><enum>(A)</enum><text>the entity known as Palestine Islamic Jihad and designated by the Secretary of State as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>); or </text></subparagraph><subparagraph id="H17F397E873C2414A8309938346C3D258"><enum>(B)</enum><text>any person identified as an agent or instrumentality of Palestine Islamic Jihad on the list of specially designated nationals and blocked persons maintained by the Office of Foreign Asset Control of the Department of the Treasury, the property or interests in property of which are blocked pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>). </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H527D5BD10CF844229DB03617E62C2497"><enum>(c)</enum><header>Sunset</header><text display-inline="yes-display-inline">Section 5 of the Sanctioning the Use of Civilians as Defenseless Shields Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/348">Public Law 115–348</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended by striking <quote>December 31, 2023</quote> and inserting <quote>December 31, 2030</quote>.</text></subsection><subsection id="HCB745B57B35D41779ACDC1B7BFFA5160"><enum>(d)</enum><header>Severability</header><text display-inline="yes-display-inline">The Sanctioning the Use of Civilians as Defenseless Shields Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/348">Public Law 115–348</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HC49D2306848A40A0B4925DE2E1E10069" display-inline="no-display-inline"><section id="H52BCFDFDB8F44667A07CB1B1183F7A28"><enum>6.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the application of such provision to any person or circumstance, is found to be unconstitutional, the remainder of this Act, or the application of that provision to other persons or circumstances, shall not be affected.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H644618A767B34E4BB3156272B185DB79"><enum>4.</enum><header>Report on countering the use of human shields</header><subsection id="H716128BE27E849409DA02B0650DBC6AB" commented="no"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Defense shall submit to the congressional defense committees, the Committee on Foreign Affairs of the House of Representatives, and the Committee on Foreign Relations of the Senate a report that contains the following:</text><paragraph id="H220DDB56C68746F2A2F4CF2066C5FC44" commented="no"><enum>(1)</enum><text>A description of the lessons learned from the United States and its allies and partners in addressing the use of human shields by terrorist organizations such as Hamas, Hezbollah, Palestine Islamic Jihad, and any other organization as determined by the Secretary of Defense.</text></paragraph><paragraph id="H030DFF40CFEA4954BFDBAE0DF529EF2F" commented="no"><enum>(2)</enum><text>A description of a specific plan and actions being taken by the Department of Defense to incorporate the lessons learned as identified in paragraph (1) into Department of Defense operating guidance, relevant capabilities, and tactics, techniques, and procedures to deter, counter, and address the challenge posed by the use of human shields and hold accountable terrorist organizations for the use of human shields.</text></paragraph><paragraph id="HEA6EF5E79A994243B57C3A817770413D" commented="no"><enum>(3)</enum><text>A description of specific measures being developed and implemented by the United States Government to mobilize and leverage allied nations, including member nations of the North Atlantic Treaty Organization (NATO), to deter, counter, and hold accountable terrorist organizations for the use of human shields.</text></paragraph><paragraph id="H518DF809D63143D19918B338B7D20254" commented="no"><enum>(4)</enum><text>The current status of joint exercises, doctrine development, education, and training on countering the use of human shields in multinational centers of excellence.</text></paragraph><paragraph id="H775F64B7B14B4CD594A52519D2DC219D" commented="no"><enum>(5)</enum><text>The current status of participation of members of the Armed Forces and Department of Defense civilian personnel in any multinational center of excellence for the purposes of countering the use of human shields.</text></paragraph><paragraph id="H2411E8C4690F47F581C21B2CC2E82D81" commented="no"><enum>(6)</enum><text>The feasibility and advisability of beginning or continuing participation of members of the Armed Forces and Department of Defense civilian personnel to promote the integration of joint exercises, doctrine development, education, and training on countering the use of human shields into multinational centers of excellence.</text></paragraph></subsection><subsection id="H290DA11FD58E454C8D118FE7B3B6FA99"><enum>(b)</enum><header>Definition</header><text>In this section, the term <term>multinational center of excellence</term> has the meaning given that term in section 344 of title 10, United States Code.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20240416" chamber="House">Passed the House of Representatives April 16, 2024.</attestation-date><attestor display="yes">Kevin F.
