R. 5770</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240709">July 9, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To reauthorize certain United States Geological Survey water data enhancement programs.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="HBF6262F26B2343F29DF2008AD4939DAA"><pagebreak></pagebreak><section id="HB2A40E1EFBD34FC29A21CF3326D11121" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Water Monitoring and Tracking Essential Resources (WATER) Data Improvement Act</short-title></quote>.</text></section><section id="HEE4E1C62B3E8411FAC39566646A6FE24"><enum>2.</enum><header>Water data enhancement by United States Geological Survey</header><text display-inline="no-display-inline">Section 9507 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/42/10367">42 U.S.C. 10367</external-xref>) is amended—</text><paragraph id="HFA7D94DCC6F442339BF602B0D982D67E"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H28C07FAE15D74B619E634DFB3373A754"><enum>(A)</enum><text>by striking the heading and inserting <quote><header-in-text level="subsection" style="OLC">Federal priority streamgage program</header-in-text></quote>;</text></subparagraph><subparagraph id="HE5F30500F61E4B16A327DB2AE21F90CE"><enum>(B)</enum><text>in paragraph (1), by striking <quote>national streamflow information program, as reviewed by the National Research Council in 2004</quote> and inserting <quote>Federal priority streamgage program</quote>;</text></subparagraph><subparagraph id="H976D336384FA4538BC015CCF133390F4"><enum>(C)</enum><text>in paragraph (2), by striking <quote>national streamflow information program</quote> each place it appears and inserting <quote>Federal priority streamgage program</quote>;</text></subparagraph><subparagraph id="HA1CF6D9BA97A4A33B42A47E90DCBEFA3"><enum>(D)</enum><text>in paragraph (4)—</text><clause id="H85F40BC77E5242E3976AF2D794BFEE0E"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="H6089DB93809F407398DE5C6E2776C5EC"><enum>(I)</enum><text>by striking <quote>2009</quote> and inserting <quote>2023</quote>; and</text></subclause><subclause id="H48AD20A0828647769ACAAC817352EF66"><enum>(II)</enum><text>in clause (ii), by inserting <quote>precipitation</quote> before <quote>water-quality sensors</quote>; and </text></subclause></clause><clause id="HEDBE9724EB9A42219BC73BAC1EE54DA7"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>National Streamflow Information Program as reviewed by the National Research Council.</quote> and inserting <quote>Federal needs established through regular solicitation of feedback, such as that documented in the report titled <quote>Re-prioritization of the U.S. Geological Survey Federal Priority streamgage program, 2022</quote> (Open-file Report 2023-1032).</quote>;</text></clause></subparagraph><subparagraph id="H2A30730439DE46558ACA91C200774AF2"><enum>(E)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>national streamgaging network</quote> each place it appears and inserting <quote>Federal priority streamgage network</quote>; and</text></subparagraph><subparagraph id="H33780105EBBD4A10AABF2555565B85D5"><enum>(F)</enum><text>in paragraph (6)—</text><clause id="HA571BB4A0D6A46739A834E778B097B2B"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="HFD22C3CCB43F4ACB89FC7A51A07CAE7A"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>national streamflow information program</quote> and inserting <quote>Federal priority streamgage program</quote>; and </text></subclause><subclause id="HF7D82127181C4955A10CF15ECBFB2823"><enum>(II)</enum><text>by striking <quote>2023</quote> and inserting <quote>2028</quote>; and</text></subclause></clause><clause id="H96A3BF2E95054AC6B04D251AEED66725"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>2019</quote> and inserting <quote>2028</quote>;</text></clause></subparagraph></paragraph><paragraph id="H7E8862DCD97349FA9B9AABF5FF6F0951"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph id="H71667511E1864416A58E5AA976C85883"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="H94733BC5C6A646128AB0303D9EB9DF3A"><enum>(i)</enum><text>in subparagraph (B), by inserting <quote>and Tribes</quote> after <quote>agencies</quote> and</text></clause><clause id="H320BEB177BAE444CA420B845C2D113B2"><enum>(ii)</enum><text>in subparagraph (C)—</text><subclause id="H2F226CEBF47F4F50A3ECCDFAEB610E29"><enum>(I)</enum><text>by inserting <quote>or Tribal lands</quote> after <quote>within a State</quote>; and</text></subclause><subclause id="HEBADD2A60AF64AD98C90B2FE64B22CEC"><enum>(II)</enum><text>by inserting <quote>or Tribe</quote> after <quote>water resource agency</quote>;</text></subclause></clause></subparagraph><subparagraph id="H80987BC94AB2459C869337887362D737"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (6), by inserting <quote>, a Tribe</quote> after <quote>a State</quote>; and</text></subparagraph><subparagraph id="H56AA670847E54C31BEB645522BE13FC8"><enum>(C)</enum><text>in paragraph (7)—</text><clause id="HE3B77038EFDB4A2E9838DE34B912513F"><enum>(i)</enum><text>by striking <quote>such sums as are necessary</quote> and inserting <quote>$4,000,000 per fiscal year</quote>; and </text></clause><clause id="HAE9FD449666E44E8934F3AFA8A6E3A4C"><enum>(ii)</enum><text>by striking <quote>2009 through 2023</quote> and inserting <quote>2023 through 2028</quote>;</text></clause></subparagraph></paragraph><paragraph id="H90F657265D9248AE8996E7FC936BA7C8"><enum>(3)</enum><text>by striking subsection (c);</text></paragraph><paragraph id="H9898390E3E1C469CA5F063A81256C9EA"><enum>(4)</enum><text>by redesignating subsection (d) as subsection (c);
