R. 5658</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20241119">November 19, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend title 39, United States Code, to require mail-in ballots to use the Postal Service barcode service, and for other purposes.</official-title></form><legis-body id="HF0F3C73A897042D38CBA75A567116BDC" style="OLC"><pagebreak></pagebreak><section id="HE3CE9555AE0A42C7B1F4629900E10199" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vote by Mail Tracking Act</short-title></quote>.</text></section><section id="HD4B8FF5531B745538FC246A792F0172F"><enum>2.</enum><header>Mail-in ballots and Postal Service barcode service</header><subsection id="HA718B9F1F56C4685BFDE203F27BCFC91"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title 39, United States Code, is amended by inserting after chapter 30 the following new chapter:</text><quoted-block style="USC" id="H3F8D884CF2744019A80F4C3F33B2BCC7" display-inline="no-display-inline"><chapter id="H8D4951F1DC8E4A9A9E5C36D162E47F9C"><enum>31</enum><header>Election Mail</header><toc container-level="chapter-container" quoted-block="no-quoted-block" lowest-level="section" idref="H8D4951F1DC8E4A9A9E5C36D162E47F9C" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry idref="HE0B5A7B02C124D46895906170C5681F4" level="section">Sec.</toc-entry><toc-entry idref="HE0B5A7B02C124D46895906170C5681F4" level="section">3101. Trackable election mail.</toc-entry></toc><section id="HE0B5A7B02C124D46895906170C5681F4"><enum>3101.</enum><header>Trackable election mail</header><subsection id="H5A6E0FE2C7BB48E1B77087E2B178E874"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No entity of government shall furnish a ballot envelope for the purpose of being carried or delivered by mail unless such envelope—</text><paragraph id="HF8CFA9587EE044938E680765D3EEBA4B"><enum>(1)</enum><text display-inline="yes-display-inline">contains a Postal Service barcode (or successive service or marking) that enables tracking of each individual ballot consistent with parameters that the Postal Service may promulgate by regulation;</text></paragraph><paragraph id="H57B9E1809634491080424783D871B5A8"><enum>(2)</enum><text>satisfies requirements for ballot envelope design that the Postal Service may promulgate by regulation;</text></paragraph><paragraph id="HD5B6989695FD4B3D94CC6BCDA539366D"><enum>(3)</enum><text>satisfies requirements for machineable letters that the Postal Service may promulgate by regulation; and</text></paragraph><paragraph id="HD05609F6BDEC432D9BE2376AAECF1C99"><enum>(4)</enum><text>includes the Official Election Mail Logo (or any successor label that the Postal Service may establish for ballots).</text></paragraph></subsection><subsection id="H47AAC6B36B5C46CA8FB9C8F1614B1C1A"><enum>(b)</enum><header>Application</header><text>Subsection (a) does not apply to a Federal write-in absentee ballot under section 103 of the Uniformed and Overseas Citizens Absentee Voting Act (<external-xref legal-doc="usc" parsable-cite="usc/52/20303">52 U.S.C. 20303</external-xref>).</text></subsection><subsection id="H3076587BC7864B5ABBB86B7F5BC9EC84"><enum>(c)</enum><header>Information</header><text display-inline="yes-display-inline">Not later than June 1 of each calendar year, the Postmaster General shall provide, to the entities described in the matter preceding paragraph (1) of subsection (a), the information necessary to comply with the requirements of this subsection, including how to access Postal Service tools to assist in generating the barcode or successive marking required by subsection (a)(1).</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC3B5E184DC814C0090115AEDE86E3565"><enum>(b)</enum><header>Clerical amendment</header><text>The table of chapters for part IV of title 39, United States Code, is amended by adding after the item relating to chapter 30 the following:</text><quoted-block display-inline="no-display-inline" id="HEDF70555D41D417BA90118D395E46390" style="USC"><toc regeneration="no-regeneration"><multi-column-toc-entry bold="on" level="chapter"><toc-enum>31.</toc-enum><level-header level="chapter">Election Mail</level-header><target>3101</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H12A255FBC92E4BF28F162293CC532CA0"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply to any election for Federal office occurring in 2026 and any succeeding year.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20241118" chamber="House">Passed the House of Representatives November 18, 2024.</attestation-date><attestor display="yes">Kevin F.
