<section section-type="section-one" id="H475EA4F7716C4D4BB71B3E2CEE5DE5BB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Agent Raul Gonzalez Officer Safety Act</short-title></quote>.</text></section> <section section-type="subsequent-section" id="H2E039E19019D4CCF9C82701630AC31A2"><enum>2.</enum><header>Criminal penalties for evading arrest or detention</header> <subsection commented="no" display-inline="no-display-inline" id="H9C4C3ADFD05749B89D29FEE9B92BA42B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/2">Chapter 2</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" display-inline="no-display-inline" id="HBD9B444831F04FD1B4E3034FE4E2AB9F"> 
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H2CD01C37B0C2412A94EC367043F8A3CA"><enum>40B.</enum><header>Evading arrest or detention while operating a motor vehicle</header> 
<subsection id="HE26EE62DD2484E74AACA9D2121E88C8E"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">A person commits an offense under this section by operating a motor vehicle within 100 miles of the United States border while intentionally fleeing from—</text> <paragraph commented="no" display-inline="no-display-inline" id="H4E7E29751CF54B0387E64C1C367F085F"><enum>(1)</enum><text display-inline="yes-display-inline">a pursuing U.S. Border Patrol agent acting pursuant to lawful authority; or</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD6972A7BEAC7483696DF6A9FECB54F1F"><enum>(2)</enum><text display-inline="yes-display-inline">any pursuing Federal, State, or local law enforcement officer who is actively assisting, or under the command of, U.S. Border Patrol.</text></paragraph></subsection> <subsection id="H2318A43F70F54D1F92D1AB5C8F211194"><enum>(b)</enum><header>Penalties</header> <paragraph id="H1C0D95F2806A48659B0D295C096A0388"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraphs (2) and (3), any person who commits an offense described in subsection (a) shall be—</text> 
<subparagraph id="H45B82526AEE841A7B4BCDBE89BCF6717"><enum>(A)</enum><text display-inline="yes-display-inline">imprisoned for a term of not more than 2 years;</text></subparagraph> <subparagraph id="HB34F42F9FF8F4C56A4C2DE6A29AF12B0"><enum>(B)</enum><text display-inline="yes-display-inline">fined under this title; or</text></subparagraph> 
<subparagraph id="HEA2620FD44DC4DF08B6F5951A8F61973"><enum>(C)</enum><text>subject to the penalties described in subparagraphs (A) and (B).</text></subparagraph></paragraph> <paragraph id="H9E917E3A60264AF488A778E5EE7FBF7E"><enum>(2)</enum><header>Serious bodily injury</header><text>If serious bodily injury results from the commission of an offense described in subsection (a), the person committing such offense shall be—</text> 
<subparagraph id="HE29C6F3A77DE439E86E73C3971157262"><enum>(A)</enum><text>imprisoned for a term of not less than 5 years and not more than 20 years;</text></subparagraph> <subparagraph id="HDE508C7DE6C24BCF880DB11FE06FA270"><enum>(B)</enum><text>fined under this title; or </text></subparagraph> 
<subparagraph id="H45B46B6C61D54FC7A9C7B985C1E2BC8A"><enum>(C)</enum><text>subject to the penalties described in subparagraphs (A) and (B).</text></subparagraph></paragraph> <paragraph id="HB40AD0231078472885FDE6DD918A17AD"><enum>(3)</enum><header>Death</header><text>If the death of any person results from the commission of an offense described in subsection (a), the person committing such offense shall be—</text> 
<subparagraph id="H2A1F08852A73496B876A312B11627985"><enum>(A)</enum><text>imprisoned for a term of not less than 10 years and up to life;</text></subparagraph> <subparagraph id="HA96CA343C9E5427396AD07B790CE35D6"><enum>(B)</enum><text>fined under this title; or</text></subparagraph> 
<subparagraph id="H9C804C18F94D401682BF4961A9246DC7"><enum>(C)</enum><text>subject to the penalties described in subparagraphs (A) and (B).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection commented="no" display-inline="no-display-inline" id="H95CE860FE66E4D38B8B36D5BD9197DA1"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/2">chapter 2</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section id="H95C86A94C28F41F4BA8811F35FC76B5C" section-type="subsequent-section" display-inline="no-display-inline"><enum>3.</enum><header>Inadmissibility, deportability, and ineligibility related to evading arrest or detention while operating a motor vehicle</header> 
<subsection id="H0101EB7410564CA79183A1A29002E63A"><enum>(a)</enum><header>Inadmissibility</header><text display-inline="yes-display-inline">Section 212(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref>) is amended by adding at the end the following: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="H46150C08EEAC429088B20D810D4E0D8C"> <subparagraph id="H27E077341F8249918FF6CD29BDA4527D"><enum>(J)</enum><header>Evading arrest or detention while operating a motor vehicle</header><text display-inline="yes-display-inline">Any alien who has been convicted of, who admits having committed, or who admits committing acts which constitute the essential elements of a violation of section 40B(a) of title 18, United States Code, is inadmissible.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9281121B29F64DDEBFE0209000ED1AA8"><enum>(b)</enum><header>Deportability</header><text display-inline="yes-display-inline">Section 237(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>) is amended by adding at the end the following: </text> <quoted-block style="OLC" display-inline="no-display-inline" id="HCEF9C6D44EA9421D96059591CCEF1EBF"> <subparagraph id="HD1128425EE2C4CDAB37B446928E3D315"><enum>(G)</enum><header>Evading arrest or detention while operating a motor vehicle</header><text display-inline="yes-display-inline">Any alien who has been convicted of, who admits having committed, or who admits committing acts which constitute the essential elements of a violation of section 40B(a) of title 18, United States Code, is deportable.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H74A6D5B7D1564CB78F10E4C8399A8C5F"><enum>(c)</enum><header>Ineligibility for relief</header><text display-inline="yes-display-inline">Chapter 2 of title II of the Immigration and Nationality Act is amended by inserting after section 208 the following: </text> <quoted-block style="OLC" id="HDEA72C96A29945E89A8BD3EEC0B94208" display-inline="no-display-inline"> <section id="HACDA5FACE68E44F48EF5CFE35D042054"><enum>208A.</enum><header>Ineligibility for relief related to evading arrest or detention while operating a motor vehicle</header><text display-inline="no-display-inline">Any alien who has been convicted of, who admits having committed, or who admits committing acts which constitute the essential elements of a violation of section 40B(a) of title 18, United States Code, shall be ineligible for relief under the immigration laws, including asylum under section 208. </text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H049CF29790F04F9E8988B073653FF627"><enum>4.</enum><header>Annual report</header><text display-inline="no-display-inline">The Attorney General, in conjunction with the Secretary of Homeland Security, shall submit an annual report to the <committee-name committee-id="">Committee on the Judiciary of the Senate</committee-name> and the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> that—</text> <paragraph commented="no" display-inline="no-display-inline" id="H87CECE10852246D8BB98996EAC0F2EE0"><enum>(1)</enum><text display-inline="yes-display-inline">identifies the number of people who committed a violation of section 40B(a) of title 18, United States Code, as added by section 2(a); and </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H91B852D5996547C0A3AD024F455D7C44"><enum>(2)</enum><text display-inline="yes-display-inline">summarizes—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H30BB2FA6A941445E8C8E94F1CF899EF8"><enum>(A)</enum><text display-inline="yes-display-inline">the number of individuals who were charged with the violation referred to in paragraph (1); </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H28817B940E6D456C93D113780E37613B"><enum>(B)</enum><text display-inline="yes-display-inline">the number of individuals who were apprehended but not charged with such violation;</text></subparagraph> <subparagraph id="H2F9F3630368A4619B056C739A74A04F5"><enum>(C)</enum><text>the number of individuals who committed such violation but were not apprehended;</text></subparagraph> 
<subparagraph id="H7E73EFFD5E234F649795F0C9D160E159"><enum>(D)</enum><text>the penalties sought in the charging documents pertaining to such violation; and</text></subparagraph> <subparagraph id="HA2D792ACAAF44819AB96442F144476DB"><enum>(E)</enum><text>the penalties imposed for such violation.</text></subparagraph></paragraph></section>
