<official-title display="yes">To amend the Federal Reserve Act to prohibit the Federal reserve banks from offering certain products or services directly to an individual, to prohibit the use of central bank digital currency for monetary policy, and for other purposes.</official-title>

<section id="HA88389DE2F1340ECB61AFAD09C748044" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CBDC Anti-Surveillance State Act</short-title></quote>.</text></section> <section id="HB958BA436D3B4DED817690C2DB758D98"><enum>2.</enum><header>Prohibition on Federal reserve banks relating to certain products or services for individuals and prohibition on directly issuing a central bank digital currency</header><text display-inline="no-display-inline">Section 16 of the Federal Reserve Act is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HD174A25A7578444ABA4C47F77F8660E5" display-inline="no-display-inline"> 
<paragraph id="H32D52259CA944B1FA28CD15DD7B6F6FB"><enum>(18)</enum><text display-inline="yes-display-inline">A Federal reserve bank shall not—</text> <subparagraph id="HA44FF737EF424D0DB735FE8319F09B1E"><enum>(A)</enum><text>offer products or services directly to an individual;</text></subparagraph> 
<subparagraph id="H85695F6BE61C4D67A0DE1515B9D0227B"><enum>(B)</enum><text>maintain an account on behalf of an individual; or</text></subparagraph> <subparagraph id="H27D85910803B4BC9B0154F02600E3BD0"><enum>(C)</enum><text display-inline="yes-display-inline">issue a central bank digital currency, or any digital asset that is substantially similar under any other name or label, directly to an individual.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H3B8DEF3460484E16BBB061F6658D3011"><enum>3.</enum><header>Prohibition on Federal reserve banks indirectly issuing a central bank digital currency</header><text display-inline="no-display-inline">Section 16 of the Federal Reserve Act, as amended by section 2, is further amended by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="HD6997C59F698417FBF3A2F0E39D99A91" display-inline="no-display-inline"> <paragraph id="H8E9AE21FB9D64E068AC2D4AB85048307"><enum>(19)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="HF66598E1644C4A4EA259F1648071A3FF"><enum>(A)</enum><text display-inline="yes-display-inline">A Federal reserve bank shall not offer a central bank digital currency, or any digital asset that is substantially similar under any other name or label, indirectly to an individual through a financial institution or other intermediary.</text></subparagraph> 
<subparagraph id="HC20A072401554EB3A2F18B1D47089124" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Subparagraph (A) may not be construed to prohibit any dollar-denominated currency that is open, permissionless, and private, and fully preserves the privacy protections of United States coins and physical currency.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HF0526F16EE574FE2AA62986289033977"><enum>4.</enum><header>Prohibition on the use of central bank digital currency for monetary policy</header><text display-inline="no-display-inline">Section 16 of the Federal Reserve Act, as amended by section 3, is further amended by adding at the end the following new paragraph:</text>

<paragraph id="H2DE73AB512C744A8A60CF4603DD08D02"><enum>(20)</enum><header>Prohibition on the use of central bank digital currency for monetary policy</header><text display-inline="yes-display-inline">The Board of Governors of the Federal Reserve System and the Federal Open Market Committee shall not use any central bank digital currency, or any digital asset that is substantially similar under any other name or label, to implement monetary policy.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H7C0DAA5D46804588A84BDA3FADF8CFC5"><enum>5.</enum><header>Central bank digital currency</header> <subsection id="HC95BC84BEA834D52AF75E2EC3FD272C5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal Reserve Act (<external-xref legal-doc="usc" parsable-cite="usc/12/221">12 U.S.C. 221 et seq.</external-xref>) is amended by inserting after section 16 the following:</text>

<section id="H62A733595ABC4E1E80761A55E98DF80B"><enum>16A.</enum><header>Central bank digital currency</header> 
<subsection id="HE68CEE47A12343FA8A157F2D984561E2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Board of Governors of the Federal Reserve System may not, absent Congressional authorization, design, build, develop, establish, or issue a central bank digital currency.</text></subsection> <subsection id="HD59011FA8EB74872AD4B34C0B2591502"><enum>(b)</enum><header>Central bank digital currency defined</header><text display-inline="yes-display-inline">In this section, the term <term>central bank digital currency</term> means a form of digital money or monetary value, denominated in the national unit of account, that is a direct liability of the Federal Reserve System.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF40FAC9981484BC7AAA07BAA1295875B"><enum>(b)</enum><header>Treasury</header><text>Chapter 3 of subtitle I of title 31 of the United States Code is amended by inserting after section 316 the following:</text> <quoted-block style="OLC" id="H17744FE9175F4418BDEB1681A36735F1" display-inline="no-display-inline"> <section id="H66D9B579F83443FFA1C609FB88D0C10B"><enum>317.</enum><header>Central bank digital currency</header> <subsection id="HBB2FFB2E81CF449399C00D51B26E0178"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of the Treasury may not, absent Congressional authorization, direct the Board of Governors of the Federal Reserve System to design, build, develop, establish, or issue a central bank digital currency.</text></subsection> 
<subsection id="HBE2375E15FE54C30842D9E014B916678"><enum>(b)</enum><header>Central Bank Digital Currency defined</header><text display-inline="yes-display-inline">In this section, the term <term>central bank digital currency</term> means a form of digital money or monetary value, denominated in the national unit of account, that is a direct liability of the central bank.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H1837844230E241F7B780AFCC2A76EFEB"><enum>6.</enum><header>Protection for open, permissionless, and private currency</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall not apply to any dollar-denominated currency that is open, permissionless, and private, and fully preserves the privacy protections of United States coins and physical currency.</text></section> 
<section id="H1AF0DD886E8D4354BE5B41DFBF8D51BB"><enum>7.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the Board of Governors of the Federal Reserve System should not be permitted to develop, create, or implement a central bank digital currency, or use any such tool to implement monetary policy.</text></section> <section id="HA5735F656AB64B4C9B19A0B86484E1A6"><enum>8.</enum><header>Prohibition on central bank digital currency testing</header><text display-inline="no-display-inline">Section 16A of the Federal Reserve Act, as added by section 5, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HCD2225250D3449EAA8316C84D69ED6E2" display-inline="no-display-inline"> 
<subsection id="HF342680C622B4860A90B648C60BC7B8E"><enum>(C)</enum><header>Prohibition on central bank digital currency testing</header><text display-inline="yes-display-inline">Unless authorized by an Act of Congress enacted after the date of the enactment of this Act, the Board of Governors of the Federal Reserve System and the Federal reserve banks may not establish, carry out, or approve a program intended to test the practicability of issuing a central bank digital currency, including by partnering or coordinating with a private sector entity to carry out such a program.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body> <attestation><attestation-group><attestation-date date="20240523" chamber="House">Passed the House of Representatives May 23, 2024.</attestation-date><attestor display="no">Kevin F.
