R. 5390</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240515">May 15, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To direct the Secretary of Commerce to conduct a study on the feasibility of manufacturing in the United States products for critical infrastructure sectors, and for other purposes.</official-title></form><legis-body id="H0DB4A37983F94575BE334B6DA17DED66" style="OLC"><pagebreak></pagebreak><section id="HBA2492559F624BF1BB991A9096BD4E24" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Infrastructure Manufacturing Feasibility Act</short-title></quote>. </text></section><section id="HF21BED3D26F8462B936EF5B03DFCFB31"><enum>2.</enum><header>Study on critical infrastructure manufacturing in the United States</header><subsection id="HEBB0EB5BC7AD41C08187810489931534"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary of Commerce shall conduct a study to—</text><paragraph id="H1A4DC8E03DD048F4B5FB16D02C8E3829"><enum>(1)</enum><text>identify, within each critical infrastructure sector, any product that is in high demand and is being imported due to a manufacturing, material, or supply chain constraint in the United States;</text></paragraph><paragraph id="H226D54297CB84990B0CF89F9B550F41B"><enum>(2)</enum><text display-inline="yes-display-inline">analyze the costs and benefits of manufacturing in the United States any product identified under paragraph (1), including any effects on—</text><subparagraph id="H0B88D542D83F413E87B46BA1E21F8096"><enum>(A)</enum><text display-inline="yes-display-inline">jobs, employment rates, and labor conditions in the United States; and</text></subparagraph><subparagraph id="HE92B9A27965846249F3233910F3F4028"><enum>(B)</enum><text>the cost of the product;</text></subparagraph></paragraph><paragraph id="H8D5D77D6BACB4E4FBE548C49B6F046D8"><enum>(3)</enum><text>identify any product identified under paragraph (1) that feasibly may be manufactured in the United States; and</text></paragraph><paragraph id="HA1B6047A474547D394BC4FD41A1694EF"><enum>(4)</enum><text>analyze the feasibility of, and any impediments to, manufacturing any product identified under paragraph (3) in—</text><subparagraph id="H8F486A78D8C744448C079A5DB835018F"><enum>(A)</enum><text>a rural area;</text></subparagraph><subparagraph id="H22814C65F2B949A89F0E23FB20E2E1B7"><enum>(B)</enum><text>an industrial park; or</text></subparagraph><subparagraph id="H836793E9E47C44D9A6F3DFD6C11DDB7A"><enum>(C)</enum><text>an industrial park in a rural area.</text></subparagraph></paragraph></subsection><subsection id="HEFE3BF5CE7FF45D4B8B8166E1E91EF90"><enum>(b)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Secretary shall—</text><paragraph id="HEAC12D592F3B4F9DAC08E41CBC49BFF2"><enum>(1)</enum><text display-inline="yes-display-inline">submit to Congress a report containing the results of the study required by subsection (a), with recommendations relating to manufacturing in the United States products identified under subsection (a)(3); and</text></paragraph><paragraph id="H284BB151E097425E83AA10FEF74D0216"><enum>(2)</enum><text>make the report available to the public on the website of the Department of Commerce.</text></paragraph></subsection><subsection id="HCDE777BB74314092ACCEE3B4FCFC532A"><enum>(c)</enum><header>Limitation on authority</header><text display-inline="yes-display-inline">This section may not be construed to provide the Secretary of Commerce with authority to compel a person to provide information described in this section.</text></subsection><subsection id="H2603CA183E1F413085BBA7ED5BD466E5"><enum>(d)</enum><header>Definition of critical infrastructure sector</header><text display-inline="yes-display-inline">In this section, the term <term>critical infrastructure sector</term> means each of the 16 designated critical infrastructure sectors identified in Presidential Policy Directive<pagebreak></pagebreak> 21 of February 12, 2013 (Critical Infrastructure Security and Resilience).</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20240514" chamber="House">Passed the House of Representatives May 14, 2024.</attestation-date><attestor display="yes">Kevin F.
