R. 5349</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20241209">December 9, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To develop and disseminate a civic education curriculum and oral history resources regarding certain political ideologies, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="H3506DC9B330847568C4320C4F3FC6058"><pagebreak></pagebreak><section id="HCAA0208D4F9E4E49AAD0715418E2FBA2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Crucial Communism Teaching Act</short-title></quote>.</text></section><section id="HC241145276D84AA2A4E560E4D3D3177C"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are the following:</text><paragraph id="H8A379A8A2C3346A595AC8DEBA5968B63"><enum>(1)</enum><text display-inline="yes-display-inline">To help families, civic institutions, local communities, local educational agencies, high schools, and State educational agencies to prepare high school students to be civically responsible and knowledgeable adults.</text></paragraph><paragraph id="H3AC6309F10624F84979638CBA91D73AA"><enum>(2)</enum><text display-inline="yes-display-inline">To ensure that high school students in the United States—</text><subparagraph id="H7A0FD46ED3A14DB0A931AD6A3F19D64E"><enum>(A)</enum><text>learn that communism has led to the deaths of over 100,000,000 victims worldwide;</text></subparagraph><subparagraph id="HE9B50800CE1A4E869B16776C1F0A4EEF"><enum>(B)</enum><text>understand the dangers of communism and similar political ideologies; and</text></subparagraph><subparagraph id="HD1956178D83542CAA1DBFCD1BE521917"><enum>(C)</enum><text>understand that 1,500,000,000 people still suffer under communism.</text></subparagraph></paragraph></section><section id="H3033437C38AF42559E041F17850AF3CE"><enum>3.</enum><header>Development and dissemination of civic education curriculum and oral history resources</header><text display-inline="no-display-inline">The independent entity created under section 905(b)(1)(B) of the FRIENDSHIP Act (<external-xref legal-doc="usc" parsable-cite="usc/40/8903">40 U.S.C. 8903</external-xref> note; 107 Stat. 2331 note), also known as the <quote>Victims of Communism Memorial Foundation</quote>, shall—</text><paragraph id="H127375D95F224B10B51551B87B23BFE6"><enum>(1)</enum><text display-inline="yes-display-inline">develop a civic education curriculum for high school students that—</text><subparagraph id="H0C37C48E2D884D579A466B711993C18C"><enum>(A)</enum><text display-inline="yes-display-inline">includes a comparative discussion of certain political ideologies, including communism and totalitarianism, that conflict with the principles of freedom and democracy that are essential to the founding of the United States;</text></subparagraph><subparagraph id="H27AA2CB5AB5548DB818242378224F6A8"><enum>(B)</enum><text display-inline="yes-display-inline">is updated periodically to ensure the curriculum includes both past and present communist and totalitarian regimes, with a focus on—</text><clause id="H967B51E67E5A4C65959A01CA90C1DE37"><enum>(i)</enum><text display-inline="yes-display-inline">ongoing human rights abuses by such regimes, such as the treatment of Uyghurs in the Xinjiang Uyghur Autonomous Region (XUAR) by the People’s Republic of China; and</text></clause><clause id="HAD8BD098C08F4BC78A379A19C47354FD"><enum>(ii)</enum><text display-inline="yes-display-inline">aggression by such regimes against democratic nations and democracy, such as actions taken by the People’s Republic of China to deter pro-democracy protests in Hong Kong and the increasingly aggressive posture by the People’s Republic of China toward Taiwan, a democratic friend of the United States.</text></clause></subparagraph><subparagraph id="H6EBD953C9355463DBB35EBA2D7AF1F91"><enum>(C)</enum><text display-inline="yes-display-inline">is accurate, relevant, and accessible, so as to promote the understanding of such political ideologies; and</text></subparagraph><subparagraph id="HDBD685BFC11D42C388C4E25FBF38C46F"><enum>(D)</enum><text display-inline="yes-display-inline">is compatible with a variety of courses, including social studies, government, history, and economics classes;</text></subparagraph></paragraph><paragraph id="H3A279CADCB094EAE961349DBC38675CE"><enum>(2)</enum><text display-inline="yes-display-inline">develop oral history resources that may be used alongside the curriculum described in paragraph (1) and that include personal stories, titled <quote>Portraits in Patriotism</quote>, from diverse individuals who—</text><subparagraph id="H89D9D42339D9498B912B95C6F7CA7D34"><enum>(A)</enum><text>demonstrate civic-minded qualities;</text></subparagraph><subparagraph id="H932944F141194569A0E72356B9C4786E"><enum>(B)</enum><text>are victims of the political ideologies described in paragraph (1)(A); and</text></subparagraph><subparagraph id="H037E741A0D1B438F8337B04E77E5003F"><enum>(C)</enum><text display-inline="yes-display-inline">are able to compare the political ideologies described in paragraph (1)(A) with the political ideology of the United States; and</text></subparagraph></paragraph><paragraph id="H453C0247A05247C6BEEAAC48CABE7AB7"><enum>(3)</enum><text display-inline="yes-display-inline">engage with State and local educational leaders to assist high schools in using the curriculum described in paragraph (1) and the resources described in paragraph (2).</text></paragraph></section><section id="H95CAFB1C67394DCBA3E322035D54BDE7"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">The terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>) shall apply to this Act. </text></section></legis-body><attestation><attestation-group><attestation-date date="20241206" chamber="House">Passed the House of Representatives December 6, 2024.</attestation-date><attestor display="yes">Kevin F.
