<official-title display="yes">To amend the Energy Policy Act of 2005 to direct the Secretary of Energy to carry out a research, development, and demonstration program with respect to abandoned wells, and for other purposes.</official-title>

<section id="H4586B1D0CAD84D639F94D3F0B5B7C2E8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Abandoned Well Remediation Research and Development Act</short-title></quote>.</text></section> <section id="H1EDE9069044D4250B98C605A87A72EDF"><enum>2.</enum><header>Amendment to the Energy Policy Act of 2005</header> <subsection id="H63C52028AF2C4C059D27E7CC88F09DA1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Energy Policy Act of 2005 is amended—</text> 
<paragraph id="H1D7D7CE6547445E28F81262EC9CC216E"><enum>(1)</enum><text display-inline="yes-display-inline">by adding at the end of subtitle F of title IX (<external-xref legal-doc="usc" parsable-cite="usc/42/16291">42 U.S.C. 16291 et seq.</external-xref>) the following new section: </text> <quoted-block id="HE254E68B7C7C43B5910DF24F3C7E729A" style="OLC"> <section id="HD3F7333AF92845B2A075FC61CEFD0E68"><enum>969E.</enum><header>Abandoned wells research, development, and demonstration program</header> <subsection id="H309B373EDB9D47B9B11E2042DB9B1ABC"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this section, the Secretary of Energy shall, in coordination with relevant Federal and state agencies and entities, establish a research, development, and demonstration program to improve—</text> 
<paragraph id="HFDBC370F96C44AB791BD06B6FF57DCA9"><enum>(1)</enum><text>data collection on the location of abandoned wells; </text></paragraph> <paragraph id="H7DB7B0D9E2A34CF9BB75DAA0294C5322"><enum>(2)</enum><text>the plugging, remediation, reclamation, and repurposing of abandoned wells; and</text></paragraph> 
<paragraph id="H500FC74697E44765B6546D821FA8E9FB"><enum>(3)</enum><text display-inline="yes-display-inline">strategies to mitigate potential environmental impacts of documented and undocumented abandoned wells.</text></paragraph></subsection> <subsection id="HEA970972CA734E15855FE59DEF67AA82"><enum>(b)</enum><header>Activities</header><text>The research, development, and demonstration under subsection (a) shall include activities to improve—</text> 
<paragraph id="H45C8B2A4B255482B8EC45FCCB2483DDA"><enum>(1)</enum><text>remote sensor capabilities, LiDAR capabilities, optical gas imaging, magnetic survey technology, and any other technologies relevant to the efficient identification of abandoned wells; </text></paragraph> <paragraph id="H305B45F7B3DB4B089198394BCD89084F"><enum>(2)</enum><text>understanding of how certain parameters of abandoned wells affect methane emission rates of such wells, including parameters such as well age, well depth, geology, construction, case material, and geographic region;</text></paragraph> 
<paragraph id="H3E236B10FE1B48429797C7EE15D73BA9"><enum>(3)</enum><text>the efficiency and cost-efficacy of processes for plugging, remediating, reclaiming, and repurposing abandoned wells, including—</text> <subparagraph id="H53EC4B009FB440F6911718B75BF51C14"><enum>(A)</enum><text>improvement of processes and technologies for the unique challenges associated with plugging remote abandoned wells;</text></subparagraph> 
<subparagraph id="H78F027B61A314EDA904EADFDD8AE69DF"><enum>(B)</enum><text>use of low carbon, lightweight cement or use of alternative materials and additives for plugging purposes; and</text></subparagraph> <subparagraph id="H11115720F7534063B34F692CA46A91DE"><enum>(C)</enum><text>repurposing of abandoned wells for alternative uses, including geothermal power production or carbon capture, utilization, and storage; and</text></subparagraph></paragraph> 
<paragraph id="HD5B6E8BC76454B7483581C1C7941A0F4"><enum>(4)</enum><text display-inline="yes-display-inline">understanding of the impacts of abandoned wells on groundwater quality and contamination.</text></paragraph></subsection> <subsection id="HA8E80F7ED53E49B682AA66BC7ADA5129"><enum>(c)</enum><header>Coordination</header><text display-inline="yes-display-inline">In carrying out the program established under subsection (a), the Secretary shall ensure coordination of these activities with State and local governments, institutions of higher education, the Department of Energy National Laboratories, the private sector, and impacted communities, including landowners within such communities.</text></subsection> 
<subsection id="HDBABE0C780AC4BB0A193B50064ACDF76" commented="no"><enum>(d)</enum><header>Abandoned well defined</header><text display-inline="yes-display-inline">In this section, the term <quote>abandoned well</quote> means a well originally drilled in connection with oil and gas operations that is not being used, has not been plugged, and has no anticipated use in oil and gas operations.</text></subsection> <subsection id="H64A23E1EBD7B4A959FA35E36EE03E00C"><enum>(e)</enum><header>Funding</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section amounts authorized pursuant to section 10771 of subtitle O of title VI of the Research and Development, Competition, and Innovation Act (enacted as division B of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref>), as follows:</text> 
<paragraph id="H49355828DFAF457D8523929E9A99FC22"><enum>(1)</enum><text display-inline="yes-display-inline">For fiscal year 2024, $30,000,000.</text></paragraph> <paragraph id="HE5E00F05F23C42288CD31FC9B08EBF7A"><enum>(2)</enum><text>For fiscal year 2025, $31,250,000.</text></paragraph> 
<paragraph id="H38C0A6663DAC453C9CE0E06527435976"><enum>(3)</enum><text>For fiscal year 2026, $32,500,000.</text></paragraph> <paragraph id="HC82E4BAAB33B4C119FA11E48225BE161"><enum>(4)</enum><text>For fiscal year 2027, $33,750,000.</text></paragraph> 
<paragraph id="HD8FC0860420241E7B99988AC9344EE31"><enum>(5)</enum><text>For fiscal year 2028, $35,000,000.</text></paragraph></subsection> <subsection id="HFC7DCDD6645346258B4B43CB06A10908"><enum>(f)</enum><header>Sunset</header><text display-inline="yes-display-inline">This section shall terminate five years after the date of the enactment of this section.</text></subsection> </section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H91CFD536D524457DA0851A9D8A3D39B5"><enum>(2)</enum><text>in the table of contents in section 1(b) (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref> note), by inserting after the matter relating to section 969D the following new item: </text> <quoted-block style="OLC" id="H9CDF9C94B58A45BD826CB96CED737735" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">Sec. 969E. Abandoned wells research, development, and demonstration program. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H3287885379434C98AA3D0ADF55AE7DD5"><enum>(b)</enum><header>Conforming amendment</header><text>Paragraph (6) of section 10771 of subtitle O of title VI of the Research and Development, Competition, and Innovation Act (enacted as division B of <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref>) is amended—</text> 
<paragraph id="HB4FFE0D1007C43F49566A209F3802A2D"><enum>(1)</enum><text>in the matter preceding subparagraph (A), by striking <quote>2026</quote> and inserting <quote>2028</quote>;</text></paragraph> <paragraph id="H708E52D1A44649098464FC337A98D537"><enum>(2)</enum><text>in subparagraph (A), by striking <quote>$600,000,000</quote> and inserting <quote>$507,500,000</quote>;</text></paragraph> 
<paragraph id="H3DB4E976DA6748938C574FAFB3A13CA8"><enum>(3)</enum><text>in subparagraph (B), by striking <quote>and</quote> after the semicolon;</text></paragraph> <paragraph id="H07AB0EBDC49B4D65824BD2182E7D0C50"><enum>(4)</enum><text>in subparagraph (C)—</text> 
<subparagraph id="H38C1FBD82C4B4523A8FAD3877CF18C98"><enum>(A)</enum><text>by striking <quote>$1,000,000,000</quote> and inserting <quote>$930,000,000</quote>; and</text></subparagraph> <subparagraph id="HE0ECAA956F684D4681F9E834D9CA786B"><enum>(B)</enum><text>by striking the period and inserting <quote>; and</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H2B0752704CB046BABED96FFBB557AA5D"><enum>(5)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" id="H355BAA23382248C0A5116FC00892ABCC" display-inline="no-display-inline"> <subparagraph id="HF6D260C0A7314FA6B21671FF66582CE9"><enum>(D)</enum><text display-inline="yes-display-inline">$162,500,000 to carry out abandoned wells research, development, and demonstration activities under section 969E of the Energy Policy Act of 2005, in accordance with such section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
