<subsection id="H4415019B8AA149CE95C14F4E39F3D747"><enum>(a)</enum><header>Authorization of appropriations</header><text>Section 151 of the National Telecommunications and Information Administration Organization Act is amended by striking <quote>$17,600,000 for fiscal year 1992 and $17,900,000 for fiscal year 1993</quote> and inserting <quote>$57,000,000 for fiscal year 2024 and $57,000,000 for fiscal year 2025</quote>.</text></subsection> <subsection id="H3D15A383A79B4A85B09FC1CDC03A207C"><enum>(b)</enum><header>Under secretary of commerce for communications and information</header> <paragraph id="H41D669D293B843DEBE36EBC213F6A927"><enum>(1)</enum><header>Under Secretary; Deputy Under Secretary</header> <subparagraph id="H043331900F624A219C39320FE0A0E716"><enum>(A)</enum><header>Under Secretary</header><text>The National Telecommunications and Information Administration Organization Act (47 U.S.C. 901 et seq) is amended by striking <quote>Assistant Secretary</quote> each place it appears and inserting <quote>Under Secretary</quote>.</text></subparagraph> 
<subparagraph id="H3F60B22FDA0441F591EF09C20E0A23F0"><enum>(B)</enum><header>Deputy under secretary</header><text>Section 103(a) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/902">47 U.S.C. 902(a)</external-xref>), as amended by this section, is amended by adding at the end the following:</text> <quoted-block id="H7EEC84577298461180D9612EFE95E6A2" style="OLC"> <paragraph id="HF184B832885A4D3DB4F3F244D9DA827E"><enum>(3)</enum><header>Deputy under secretary</header><text>The Deputy Under Secretary of Commerce for Communications and Information shall—</text> 
<subparagraph id="H29287CEA81954C4C89A49648AFDE7D51"><enum>(A)</enum><text>be the principal policy advisor of the Under Secretary;</text></subparagraph> <subparagraph id="HD2BC8F2D4AE745E8BB6F16472D2087B1"><enum>(B)</enum><text>perform such other functions as the Under Secretary shall from time to time assign or delegate; and</text></subparagraph> 
<subparagraph id="H2141A35722EB4BE9A855D86425AF4D9B"><enum>(C)</enum><text>act as Under Secretary during the absence or disability of the Under Secretary or in the event of a vacancy in the office of the Under Secretary.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H00AB71AF37ED41D6BF291196FEDA88DB"><enum>(2)</enum><header>Continuation of civil actions</header><text display-inline="yes-display-inline">This subsection, and the amendments made by this subsection, shall not abate any civil action commenced by or against the Assistant Secretary of Commerce for Communications and Information before the date of the enactment of this Act, except that the Under Secretary shall be substituted as a party to the action on and after such date.</text></paragraph> 
<paragraph id="H7F7EA38EB9A048BD9A7BF3E3A7C016A6"><enum>(3)</enum><header>Continuation in office</header><text display-inline="yes-display-inline">The individual serving as the Assistant Secretary of Commerce for Communications and Information and the individual serving as the Deputy Assistant Secretary of Commerce for Communications and Information on the day before the date of the enactment of this Act may serve as the Under Secretary and the Deputy Under Secretary of Commerce for Communications and Information, respectively, on and after that date without the need for renomination or reappointment.</text></paragraph> <paragraph id="HD7E56984BA7940B8B03C6D8DBD483AF9"><enum>(4)</enum><header>References</header><text>Any reference in a law, regulation, document, paper, or other record of the United States to the Assistant Secretary of Commerce for Communications and Information shall, on and after the date of the enactment of this Act, be deemed to be a reference to the Under Secretary.</text></paragraph> 
<paragraph id="H76A7F6691B2144D88F4885F5E17388E6" commented="no"><enum>(5)</enum><header>Executive schedule</header> 
<subparagraph id="HE80011A21F5E4E9BAEE87124323CECBB" commented="no"><enum>(A)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, is amended—</text> <clause id="H2662CC52B62D4C099F680EB220307B28" commented="no"><enum>(i)</enum><text>in section 5314, by adding at the end the following:</text>

<subparagraph id="H96E9EBBED63E48419B14D33F6D2BC872" commented="no"><enum>(B)</enum><header>Effective date</header><text>The amendment made by subparagraph (A) (establishing the annual rate of the basic pay of the Under Secretary) shall take effect on the first day of the first pay period beginning after the date of the enactment of this Act.</text></subparagraph></paragraph></subsection> <subsection id="HAC52855E7BD84E3688D1029FBA3FEB95" commented="no"><enum>(c)</enum><header>Authorities and responsibilities</header> <paragraph id="H05BB9A604A8E43EC9D378BE642FB5E5C" commented="no"><enum>(1)</enum><header>Coordination of executive branch views on matters before the federal communications commission</header><text>Section 105(a)(1) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/904">47 U.S.C. 904(a)(1)</external-xref>) is amended—</text> 
<subparagraph id="HD53537AE01F1425582A6B425BE421B88" commented="no"><enum>(A)</enum><text>by striking <quote>to ensure that the conduct</quote> and inserting the following: </text> <quoted-block style="OLC" id="H50C7B51097364877B6B30015DE9E6A79" display-inline="yes-display-inline"><text display-inline="yes-display-inline">to ensure that—</text>

<paragraph id="H7AD0FC64AF3B46348AEF4A8BDEBFADEB" commented="no"><enum>(2)</enum><header>Modernization of agency mission</header> 
<subparagraph id="H8B81A7B607964B4881C2641886C8195E" commented="no"><enum>(A)</enum><header>Policy</header><text>Section 102(c) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/901">47 U.S.C. 901(c)</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H66173D26CC6B48E8B992D8105295FCF9" style="OLC"> <paragraph id="H83D47808D7A045ED919DDF2F7696FDDA" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">Fostering the digital economy of the United States in order to ensure the competitiveness, future economic growth, and security of the United States.</text></paragraph> 
<paragraph id="HAD9BEAC65BC74D0ABCE833C2999DEA29" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">Working to ensure that global communications networks remain open and innovative, including without inappropriate barriers to entry or operation.</text></paragraph> <paragraph id="HA6BE15B8068C4237AC5598F59D1F9379" commented="no"><enum>(8)</enum><text display-inline="yes-display-inline">With respect to the United States, in coordination with the Commission, achieving the universal availability of and access to telecommunications service and information service (as those terms are defined in section 3 of the Communications Act of 1934) and any technology related to such service.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HDE32CB80551B48058354E82321F7EA63" commented="no"><enum>(B)</enum><header>Assigned functions</header><text>Section 103(b)(2) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/902">47 U.S.C. 902(b)(2)</external-xref>) is amended—</text> <clause id="H47D2767374244246A26D2618D2D79D8D" commented="no"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>, some of which were</quote> before <quote>transferred to the Secretary</quote>; </text></clause>

<paragraph id="H242856FB09F748DF8CA64D7F58E84DF7"><enum>(3)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in the amendments made by paragraphs (1) and (2) may be construed to expand or contract the authority of the Commission.</text></paragraph></subsection> <subsection id="HBDB34B53526D48A7ADF737D06C32DD20"><enum>(d)</enum><header>Technical and conforming amendments</header> <paragraph id="HC8B00FFCAB374647974EC30D87C4CACD"><enum>(1)</enum><header>Public Telecommunications Financing Act of 1978</header><text>Section 106(c) of the Public Telecommunications Financing Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/5/5316">5 U.S.C. 5316</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/95/567">Public Law 95–567</external-xref>) is amended by striking <quote>The position of Deputy Assistant Secretary of Commerce for Communications and Information, established in Department of Commerce Organization Order Numbered 10–10 (effective March 26, 1978),</quote> and inserting <quote>The position of Deputy Under Secretary of Commerce for Communications and Information, established under section 103(a) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/902">47 U.S.C. 902(a)</external-xref>),</quote>.</text></paragraph>

<subparagraph id="HA972D359956D4B88A0EFAC2A7A60C08D" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the publication and submission of a report as required by paragraph (1) in the first quarter of a calendar year shall be treated as satisfying any requirement to publish or otherwise make publicly available or to submit to Congress or to a committee of Congress a report described in paragraph (2) for the fiscal year ending most recently before the beginning of such quarter.</text></subparagraph> <subparagraph id="H6D339DB4D5BC4E75BFFE8DAA5857C3A6" commented="no"><enum>(B)</enum><header>Certain submission requirements</header><text>At the time when the Under Secretary submits a report required by paragraph (1) to the committees described in such paragraph, the Under Secretary shall submit any portion of such report that relates to a report described in paragraph (2)(C) to each committee of Congress not described in paragraph (1) to which such report would (without regard to subparagraph (A) of this paragraph) be required to be submitted.</text></subparagraph></paragraph>

<subsection id="HF88842BD563F41E686111864F08E44C3"><enum>(a)</enum><header>Establishment</header><text>There is established within the NTIA an Office of Spectrum Management (in this section referred to as the <quote>Office</quote>).</text></subsection> <subsection id="H16238D917A224B81B1B980AE7AA033FC"><enum>(b)</enum><header>Head of Office</header> <paragraph id="H06CB2E885C034FFF809260F9D179216E"><enum>(1)</enum><header>In general</header><text>The head of the Office shall be an Associate Administrator for Spectrum Management (in this section referred to as the <quote>Associate Administrator</quote>).</text></paragraph> 
<paragraph id="H6ECDB86824FD451BBC6B43E27AE5B21D"><enum>(2)</enum><header>Requirement to report</header><text display-inline="yes-display-inline">The Associate Administrator shall report to the Under Secretary (or a designee of the Under Secretary).</text></paragraph></subsection> <subsection id="H294904FF7D0D465594DBDCED016ABA2B"><enum>(c)</enum><header>Duties</header><text>The Associate Administrator shall, at the direction of the Under Secretary—</text> 
<paragraph id="H232E6E24107C4651BA93E170C592F28D"><enum>(1)</enum><text display-inline="yes-display-inline">carry out responsibilities under section 103(b)(2)(A) (relating to frequency assignments for radio stations belonging to and operated by the United States), make frequency allocations for frequencies that will be used by such stations, and develop and maintain techniques, databases, measurements, files, and procedures necessary for such allocations;</text></paragraph> <paragraph id="H1EC53AFAFAE94D43AFCA9F3EE5B72618"><enum>(2)</enum><text display-inline="yes-display-inline">carry out responsibilities under section 103(b)(2)(K) (relating to establishing policies concerning spectrum assignments and use by radio stations belonging to and operated by the United States) and provide Federal agencies with guidance to ensure that the conduct of telecommunications activities by such agencies is consistent with such policies;</text></paragraph> 
<paragraph id="H298E22476FA6429BBD9B60971CFBAEC3"><enum>(3)</enum><text display-inline="yes-display-inline">represent the interests of Federal agencies in the process through which the Commission and the NTIA jointly determine the National Table of Frequency Allocations, and coordinate with the Commission in the development of a comprehensive long-range plan for improved management of all electromagnetic spectrum resources;</text></paragraph> <paragraph id="H83BD6B8C8AB74C3388418574877AF8AC"><enum>(4)</enum><text display-inline="yes-display-inline">appoint the chairpersons of and provide secretariat functions for the Interdepartmental Radio Advisory Committee and the ISAC (as defined in section 107(d));</text></paragraph> 
<paragraph id="H18586AFD10FB4847B1695CFE5A293ADD"><enum>(5)</enum><text display-inline="yes-display-inline">carry out responsibilities under section 103(b)(2)(B) (relating to authorizing a foreign government to construct and operate a radio station at the seat of Government of the United States) and assign frequencies for use by such stations;</text></paragraph> <paragraph id="HB317C9B6347E4C89AF428B1CF29CEE93" commented="no"><enum>(6)</enum><text>provide advice and assistance to the Under Secretary and coordinate with the Associate Administrator for International Affairs in carrying out spectrum management aspects of the international policy responsibilities of the NTIA, including spectrum-related responsibilities under section 103(b)(2)(G);</text></paragraph> 
<paragraph id="H6F595BF110BA43DB97C560F34B5145A7"><enum>(7)</enum><text>advise and assist the Under Secretary on spectrum-related technical and policy issues regarding—</text> <subparagraph id="HBE256694F52B45DFADF11596145508AC"><enum>(A)</enum><text>the security of telecommunications in the United States; and</text></subparagraph> 
<subparagraph id="H1F011FD939EA4C2BADC1734CA5B4372A" commented="no"><enum>(B)</enum><text>systems and means to ensure such security;</text></subparagraph></paragraph> <paragraph id="HAA78CD5BFEBC486C845CA5C61FC20B89"><enum>(8)</enum><text>in coordination with the Associate Administrator for Policy Development and Cybersecurity, carry out spectrum-related responsibilities under section 103(b)(2)(H) (relating to coordination of the telecommunications activities of the executive branch and assistance in the formulation of policies and standards for such activities);</text></paragraph> 
<paragraph id="H71D6D109E5C64E1485E1CF0C61251795"><enum>(9)</enum><text display-inline="yes-display-inline">carry out spectrum-related responsibilities under section 103(b)(2)(Q) (relating to certain activities with respect to telecommunications resources);</text></paragraph> <paragraph id="H03A9425182E34161817A81BBB88FA10C"><enum>(10)</enum><text>carry out responsibilities under section 107 (relating to improving spectrum management); and</text></paragraph>

<paragraph id="HF187932F8E854662B8AB057A5BDE5A5D" commented="no"><enum>(1)</enum><header>Notice</header><text display-inline="yes-display-inline">With respect to each spectrum action, not later than the end of the period for submitting comments to the Commission in the proceeding relating to the spectrum action, the Under Secretary shall file in the public record with respect to the proceeding information (redacted as necessary if the information is protected from disclosure for a reason described in paragraph (3)) regarding—</text> <subparagraph id="H3C22003AF0514299AD9F8E1D04C2F409" commented="no"><enum>(A)</enum><text>when the Commission provided notice to the Under Secretary regarding the spectrum action, as required under the Memorandum;</text></subparagraph> 
<subparagraph id="H04F62001A4A94A6DBE75BEB41DEB0FC7" commented="no"><enum>(B)</enum><text>the Federal entities that may be impacted by the spectrum action;</text></subparagraph> <subparagraph id="H81277F05A29C40EDB8FAFFDF4A854E6E" commented="no"><enum>(C)</enum><text>when the Under Secretary provided notice to the Federal entities described in subparagraph (B) regarding the spectrum action;</text></subparagraph> 
<subparagraph id="HEF14E9CB4D2B4BE6B292E35F98F393BC" commented="no"><enum>(D)</enum><text>a summary of any general technical or procedural concerns raised by Federal entities to the Under Secretary regarding the spectrum action; and</text></subparagraph> <subparagraph id="H6B8091F09E094975991B7915EDBB804D"><enum>(E)</enum><text>any policy concerns of the Under Secretary regarding the spectrum action.</text></subparagraph></paragraph> 
<paragraph id="HAB5E4779C04C41189B0321E64EDCC782" commented="no"><enum>(2)</enum><header>Final rule</header><text>If the Commission promulgates a final rule under section 553 of title 5, United States Code, involving a spectrum action, the Commission shall prepare, make available to the public, and publish in the Federal Register along with the final rule an interagency coordination summary that describes—</text> <subparagraph id="HD4D7027CE59046EA9FA9BF7C8F72596C" commented="no"><enum>(A)</enum><text>when the Commission provided notice to the Under Secretary regarding the spectrum action, as required under the Memorandum;</text></subparagraph> 
<subparagraph id="H9B3642434F47436893FC8B17DE1229D8" commented="no"><enum>(B)</enum><text>whether the Under Secretary raised technical, procedural, or policy concerns regarding the spectrum action; and</text></subparagraph> <subparagraph id="H246A81387B8F4D5081E530EB4F08C305" commented="no"><enum>(C)</enum><text>how any concerns described in subparagraph (B) were resolved.</text></subparagraph></paragraph> 
<paragraph id="H5E7AB24A07CA4C4687530D598C832361" commented="no"><enum>(3)</enum><header>Rule of construction</header><text>Nothing in this subsection may be construed to require the disclosure of classified information, or other information reflecting technical, procedural, or policy concerns that is exempt from disclosure under section 552 of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>).</text></paragraph> <paragraph id="H368064994869488A8499FCC6B5B01A53"><enum>(4)</enum><header>FCC consideration</header> <subparagraph id="HB39984DDCCC84D91BA1FAC6DBE962EDE"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission may not consider any technical, procedural, or policy concerns of a Federal entity regarding a spectrum action unless such concerns are filed by the Under Secretary on behalf of the Federal entity in the public record, or in a classified non-public filing made in accordance with subparagraph (B), with respect to the proceeding of the Commission relating to the spectrum action.</text></subparagraph> 
<subparagraph id="HD432C4E4F06548CCA230183FD794DC1D"><enum>(B)</enum><header>Classified information</header><text>Any classified information that is filed by the Under Secretary on behalf of a Federal entity with respect to the proceeding of the Commission relating to a spectrum action shall be filed in accordance with Commission procedures and using appropriate protective measures to prevent unauthorized disclosure.</text></subparagraph></paragraph></subsection> <subsection id="H39A225F657484C6DABC5C0104B628338" commented="no"><enum>(b)</enum><header>Federal spectrum coordination responsibilities</header> <paragraph id="H8E759BEBDBBB4EFEB4605EFD15CFC5F6" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this section, the Under Secretary shall establish a charter for the ISAC.</text></paragraph> 
<paragraph id="HF7BA2C0D0669407D927565A68CCCA58F" commented="no"><enum>(2)</enum><header>ISAC representative</header> 
<subparagraph id="HEF7823C8A70A490CA4B70E437ACE2D95" commented="no"><enum>(A)</enum><header>In general</header><text>The head of each Federal entity that is reflected in the membership of the ISAC, as identified in the charter established under paragraph (1), shall appoint a senior-level employee (or an individual occupying a Senior Executive Service position, as defined in section 3132(a) of title 5, United States Code) who is eligible to receive a security clearance that allows for access to sensitive compartmented information to serve as the representative of the Federal entity to the ISAC.</text></subparagraph> <subparagraph id="HC7C5E03A2C184359B6F7E774F805ECC2" commented="no"><enum>(B)</enum><header>Security clearance requirement</header><text>If an individual appointed under subparagraph (A) is not eligible to receive a security clearance described in that subparagraph—</text> 
<clause id="HFB0BB5460B62466680AB0BCB5CE7A48A" commented="no"><enum>(i)</enum><text>the appointment shall be invalid; and</text></clause> <clause id="H4F5E69BD8A0A4062ACE5F344ED56129D" commented="no"><enum>(ii)</enum><text>the head of the Federal entity making the appointment shall appoint another individual who satisfies the requirements of that subparagraph, including the requirement that the individual is eligible to receive such a security clearance.</text></clause></subparagraph></paragraph> 
<paragraph id="H29F3A29F625F4BDF9E57EF6DFFF258A3" commented="no"><enum>(3)</enum><header>Duties</header><text>An individual appointed under paragraph (2) shall—</text> <subparagraph id="H395814982B9B4FA296DA44569757EA42" commented="no"><enum>(A)</enum><text>oversee the spectrum coordination policies and procedures of the applicable Federal entity;</text></subparagraph> 
<subparagraph id="HDBE417CBA2624BEA8E3DE1DC13E62C4D" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">be responsible for timely notification to the ISAC and to the Under Secretary of technical or procedural concerns of the applicable Federal entity regarding a spectrum action; and</text></subparagraph> <subparagraph id="H6A94173DBCF34C0BBDA2E327499326C5" commented="no"><enum>(C)</enum><text>work closely with the representative of the applicable Federal entity to the Interdepartmental Radio Advisory Committee.</text></subparagraph></paragraph> 
<paragraph id="HDA5AA024D05843AC8FEF6B3DDEA5E0DB" commented="no"><enum>(4)</enum><header>Public contact</header> 
<subparagraph id="H2DB08797C0B84D968A55184E530D5867" commented="no"><enum>(A)</enum><header>In general</header><text>The head of each Federal entity described in paragraph (2) shall list, on the website of the Federal entity, the name and contact information of the representative of the Federal entity to the ISAC, as appointed under such paragraph.</text></subparagraph> <subparagraph id="H66031B924B4941F8935D8DDA776C2539" commented="no"><enum>(B)</enum><header>NTIA responsibility</header><text>The Under Secretary shall publish on the public website of the NTIA a complete list of the representatives to the ISAC appointed under paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="HBE2C271CD01D4306B5383D49ECD8C068" commented="no"><enum>(5)</enum><header>Annual report</header><text display-inline="yes-display-inline">In the last quarter of each calendar year, each executive agency that is authorized and directed to cooperate with the NTIA under section 105(c)(2) shall submit to the Under Secretary a report, for the fiscal year ending most recently before the beginning of such quarter, describing the steps taken in such fiscal year by the executive agency to comply with such section.</text></paragraph></subsection> <subsection id="HB89D5243682847ADA674154BBC862760" commented="no"><enum>(c)</enum><header>Coordination between Commission and NTIA</header> <paragraph id="H86AE72AA45E64686A9D96A6C747EB074" commented="no"><enum>(1)</enum><header>Updates</header><text>Not later than 3 years after the date of the enactment of this section, and every 4 years thereafter or more frequently as appropriate, the Commission and the NTIA shall update the Memorandum.</text></paragraph> 
<paragraph id="HA97B6C6A91D843EABE5A2785E39F1A1F" commented="no"><enum>(2)</enum><header>Nature of update</header><text display-inline="yes-display-inline">The updates required by paragraph (1) shall reflect such changing technological, procedural, and policy circumstances as the Commission and the NTIA determine necessary and appropriate.</text></paragraph></subsection> <subsection id="HD0D8C3FCE1B44D50B4BF503D9F941709" commented="no"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H35EC085C6D434993A06A5C73498AE5AB" commented="no"><enum>(1)</enum><header>ISAC</header><text display-inline="yes-display-inline">The term <term>ISAC</term> means the interagency advisory body that, as of the date of the enactment of this section, is known as the Interagency Spectrum Advisory Council.</text></paragraph> <paragraph id="H4698BB0B1EFD4B96921BCE4DFBBC30E3"><enum>(2)</enum><header>Memorandum</header><text>The term <term>Memorandum</term> means the Memorandum of Understanding between the Commission and the NTIA (relating to increased coordination between Federal spectrum management agencies to promote the efficient use of the radio spectrum in the public interest), signed on August 1, 2022, or any successor memorandum.</text></paragraph> 
<paragraph id="HB616CEEB38624A6BA071672EBF7C8BCF" commented="no"><enum>(3)</enum><header>Spectrum action</header><text>The term <term>spectrum action</term> means a proposed action by the Commission to reallocate radio frequency spectrum that is anticipated to result in a system of competitive bidding conducted under section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) or that could potentially cause interference to the spectrum operations of a Federal entity.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H59EDD2E863A54C788B1CFE86B649EC42"><enum>203.</enum><header>Spectrum management improvements</header> <subsection id="H18B3A3C9F4FA4C679BE70A581B649E29"><enum>(a)</enum><header>Prototyping</header><text display-inline="yes-display-inline">Consistent with subparagraphs (F), (L), (P), and (U) of section 103(b)(2) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/902">47 U.S.C. 902(b)(2)</external-xref>), the Under Secretary, in coordination with the Commission and in consultation with other relevant Federal agencies, shall develop, establish, prototype, and support the implementation of common models, common methodologies, and common inputs to inform, with respect to frequencies assigned on a primary or co-primary basis to 1 or more Federal entities, electromagnetic spectrum management decisions relating to—</text> 
<paragraph id="H1BED919B66E345FE92FCB6E0678969EB" commented="no"><enum>(1)</enum><text>technologies and techniques to control radio frequency emissions and interference;</text></paragraph> <paragraph id="H7C5E475ED1DB4967A4F27A71556F47CC" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">advanced antenna arrays, and artificial intelligence systems and technologies capable of operating advanced antenna arrays, including multiple-input, multiple-output antennas, beam forming and steering technology, antenna nulling technology, and conformal arrays;</text></paragraph> 
<paragraph id="HEA13D2225BF0414C8A6C95D387A73C8F"><enum>(3)</enum><text>network sensing and monitoring technologies;</text></paragraph> <paragraph id="HFE02F3A7645E482A840462FED432B113"><enum>(4)</enum><text>advanced receivers that incorporate new technologies supporting new waveforms and multiple bands;</text></paragraph> 
<paragraph id="HC3FD5B257E494C0296504D4E2576EE46"><enum>(5)</enum><text>dynamic spectrum access technologies across wireless systems and frequencies, including local-to-the-radio and cognitive multidomain access;</text></paragraph> <paragraph id="HA3820265D48949A99C77ADBDA6EB01A0"><enum>(6)</enum><text>novel spectrum access technologies;</text></paragraph> 
<paragraph id="HF0203738E44D443E893A86C92AF6F1AD"><enum>(7)</enum><text>artificial intelligence systems to enable dynamic spectrum access, Internet of Things networks, and other advanced communications technologies; and</text></paragraph> <paragraph id="H7BD89F0D793D4C4C95886B7898BE8910"><enum>(8)</enum><text>optical and quantum communications technologies.</text></paragraph></subsection> 
<subsection id="HF9E8375F0FCF49C9A661B1094DA6E569"><enum>(b)</enum><header>Spectrum management and advanced communications technologies</header><text>Section 104 of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/903">47 U.S.C. 903</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="HA6CA31F26F0D4CFEA0626617ED9864BC" style="OLC"> <subsection id="HC9157E3325C84EA79554864D9E84B33C"><enum>(f)</enum><header>Identification and facilitation of implementation of spectrum management technologies</header><text display-inline="yes-display-inline">The Under Secretary shall identify and facilitate implementation of technologies that promote, with respect to frequencies assigned on a primary or co-primary basis to 1 or more Federal entities—</text> 
<paragraph id="HDB4368FF832643468A269546CF74E54B"><enum>(1)</enum><text>dynamic spectrum access;</text></paragraph> <paragraph id="H68086DA02025433AB984805D87CA36D8"><enum>(2)</enum><text>network sensing and monitoring; and</text></paragraph> 
<paragraph id="H9A8EEC63A6784F19ACE931847362FDD5"><enum>(3)</enum><text>optical and quantum communications.</text></paragraph></subsection> <subsection id="HC25C8CAA99B041A3A9991E38BB18DAD9"><enum>(g)</enum><header>Prototyping of advanced communications technologies</header><text display-inline="yes-display-inline">The Under Secretary shall, with respect to frequencies assigned on a primary or co-primary basis to 1 or more Federal entities—</text> 
<paragraph id="H0F4402FB4E06479694558C1BAFE4804B"><enum>(1)</enum><text display-inline="yes-display-inline">encourage the development of, and broad participation in, a skilled workforce to conduct prototyping of advanced communications technologies; and</text></paragraph> <paragraph id="HBAA7D5DBBAE84D049DE954EBD054C79E"><enum>(2)</enum><text>support partnerships among institutions to develop a skilled workforce to conduct prototyping of advanced communications technologies.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subparagraph id="H07C5AE46C77540AA89BC396FC22A60F9"><enum>(A)</enum><header>In general</header><text>In addition to any functions delegated by the Under Secretary under subparagraph (B), ITS shall serve as the primary laboratory for the executive branch of the Federal Government to—</text> <clause id="HB5190D759CF3411481CF34BF18B5671A"><enum>(i)</enum><text>study radio frequency emissions, including technologies and techniques to control such emissions and interference caused by such emissions;</text></clause> 
<clause id="H77FE68E7A14E4C45999DE6D9BFBE4254"><enum>(ii)</enum><text>determine spectrum propagation characteristics;</text></clause> <clause id="HBF645354148A4E84B625A0DD50095156"><enum>(iii)</enum><text>conduct tests on technology that enhances the sharing of electromagnetic spectrum between Federal and non-Federal users;</text></clause> 
<clause id="H123C539865924B2B8FB4C9D5E4B7843E"><enum>(iv)</enum><text>improve the interference tolerance of Federal systems operating with, or using, Federal spectrum;</text></clause> <clause id="H1799A0964DE74FDCA8902F9985AC1B4C"><enum>(v)</enum><text>promote activities relating to access to Federal spectrum by non-Federal users and the sharing of Federal spectrum between Federal and non-Federal users; and</text></clause> 
<clause id="H87DBA146CEA34E11B4124AC1FBC85D5C"><enum>(vi)</enum><text>conduct such other activities as determined necessary by the Under Secretary.</text></clause></subparagraph> <subparagraph id="HC647AB14302C4156978CE35949D38D4C"><enum>(B)</enum><header>Additional functions</header><text display-inline="yes-display-inline">The Under Secretary may delegate to ITS any of the functions assigned to the Under Secretary under section 103(b)(1). </text></subparagraph></paragraph> 
<paragraph id="H9E445C72F0264DE0ADB2A75EDB199E1A"><enum>(3)</enum><header>Agreements and transactions</header><text>In carrying out the functions described in paragraph (2), the Under Secretary, acting through the head of ITS, may enter into agreements as provided under the following authorities:</text> <subparagraph id="H5CFBA77524DD426D87709CED6C2E18B5"><enum>(A)</enum><text display-inline="yes-display-inline">Sections 11 and 12 of the Stevenson–Wydler Technology Innovation Act of 1980.</text></subparagraph> 
<subparagraph id="H4073437D9F184BD79D1842C434B39BEA"><enum>(B)</enum><text>Section 1535 of title 31, United States Code.</text></subparagraph> <subparagraph id="H362C0EEC6DFD4CE59300EAF592B5E827"><enum>(C)</enum><text>Sections 207 and 209 of title 35, United States Code.</text></subparagraph> 
<subparagraph id="H8F1EEF798A9C4CBA90AB8FD3CF528C92"><enum>(D)</enum><text>Section 103(b)(2) of this Act.</text></subparagraph> <subparagraph id="H260925EEE7244143BD6519BA932A01B2"><enum>(E)</enum><text>Section 113(g) of this Act.</text></subparagraph>

<paragraph id="H083B4C50DAC749C186A0F758FFD6F9EB" display-inline="no-display-inline"><enum>(4)</enum><header>Federal spectrum defined</header><text>In this subsection, the term <term>Federal spectrum</term> means frequencies assigned on a primary basis to a Federal entity (as defined in section 113(l)).</text></paragraph></subsection> <subsection id="H09567C71CE3648A0A2E6113A6ED7DE46"><enum>(b)</enum><header>Emergency communication and tracking technologies initiative</header> <paragraph id="H220DBBD8F03A4630B51600D8FC641226"><enum>(1)</enum><header>Establishment</header><text>The Under Secretary, acting through the head of ITS, shall establish an initiative to support the development of emergency communication and tracking technologies for use in locating trapped individuals in confined spaces, such as underground mines, and other shielded environments, such as high-rise buildings or collapsed structures, where conventional radio communication is limited.</text></paragraph> 
<paragraph id="HA20A0A03C59B46E08C73DEAC962F345F"><enum>(2)</enum><header>Activities</header><text>In order to carry out this subsection, the Under Secretary, acting through the head of ITS, shall work with private sector entities and the heads of appropriate Federal agencies, to—</text> <subparagraph id="HF8A3EAEF755D405B8B7FA82D182C72C7"><enum>(A)</enum><text>perform a needs assessment to identify and evaluate the measurement, technical specifications, and conformity assessment needs required to improve the operation and reliability of such emergency communication and tracking technologies; and</text></subparagraph> 
<subparagraph id="H1BDE3B16DFF0482C97B54AE9AB4C2220"><enum>(B)</enum><text>support the development of technical specifications and conformance architecture to improve the operation and reliability of such emergency communication and tracking technologies.</text></subparagraph></paragraph> <paragraph id="HE1AE686A380046C98E668CBDF9BA7000"><enum>(3)</enum><header>Report</header><text>Not later than 18 months after the date of the enactment of this section, the Under Secretary shall submit to Congress, and make publicly available, a report on the assessment performed under paragraph (2)(A).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H5FF38DE2EBC54826B1CC912D731A9A11"><enum>205.</enum><header>Commerce Spectrum Management Advisory Committee</header><text display-inline="no-display-inline">Part A of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/901">47 U.S.C. 901 et seq.</external-xref>), as amended by the preceding provisions of this Act, is further amended by adding at the end the following:</text> <quoted-block style="OLC" id="HE976FE2AE173471B84E3BF0F35778AF4" display-inline="no-display-inline"> <section id="H15259AD4B44543D28B165995E18622B3"><enum>109.</enum><header>Commerce Spectrum Management Advisory Committee</header> <subsection id="HE54A6FCACACF4540AAEA5528DC69EB50" commented="no"><enum>(a)</enum><header>Establishment</header> <paragraph id="H5D589C0899194DBCB01701760949066B" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this section, the Under Secretary shall establish within the NTIA a Commerce Spectrum Management Advisory Committee (referred to in this section as the <quote>CSMAC</quote>).</text></paragraph> 
<paragraph id="H246366FC627A451DB13361F04B368793" commented="no"><enum>(2)</enum><header>Existing advisory committees</header><text>A Federal advisory committee of the NTIA that is operating, on the date of the enactment of this section, under a charter for the purpose of carrying out duties substantially similar to the duties described in subsection (b), satisfies the requirements of paragraph (1) if the membership of such committee complies with subsection (c) or is modified to comply with such subsection not later than 90 days after the date of the enactment of this section.</text></paragraph></subsection> <subsection id="H9B97AC4702314181919879A19A80CD2B"><enum>(b)</enum><header>Duties</header><text>The CSMAC shall advise and make recommendations to the Under Secretary with respect to—</text> 
<paragraph id="H57B3B641C7E548CC9871BBEE5AF0E176"><enum>(1)</enum><text>developing and maintaining spectrum management policies that enable the United States to maintain or strengthen its global leadership role in the introduction of innovative communications technologies and services, including those that enable critical missions of the Federal Government; </text></paragraph> <paragraph id="HDF6062E176E04CBEA6CE74F4B4D01CFA"><enum>(2)</enum><text>objectives that advance spectrum-based innovation, including facilitating access to—</text> 
<subparagraph id="HB1B1676B049241EE99742670B3FB28D0"><enum>(A)</enum><text>wireless broadband internet access service;</text></subparagraph> <subparagraph id="H250BBE6229C64901BC841E9AFDBD0E77"><enum>(B)</enum><text>space-based services;</text></subparagraph> 
<subparagraph id="H4C7013FE36934F1CBD70C81BC5A6BED2"><enum>(C)</enum><text>non-communications services, including radiolocation services and sensing services; and</text></subparagraph> <subparagraph id="H8F47261235104ED0AD48029C811CCB5A"><enum>(D)</enum><text>other emerging technologies; </text></subparagraph></paragraph> 
<paragraph id="H0497D415CDAA46859B98B6A79714348E"><enum>(3)</enum><text>fostering increased spectrum sharing among all users;</text></paragraph> <paragraph id="H88C259F6B7A2400690A045CCD56B1FD4"><enum>(4)</enum><text>promoting innovation and rapid advances in technology that support the more efficient use of spectrum;</text></paragraph> 
<paragraph id="H40B7F7AAF2494F1CB45BF4104F983535"><enum>(5)</enum><text>authorizing radio systems and frequencies in a way that maximizes the benefits to the public;</text></paragraph> <paragraph id="HAF735E44A7774A95BF720B3CE0C0DACD"><enum>(6)</enum><text>establishing a long-range spectrum planning process and identifying international opportunities to advance the economic interests of the United States through spectrum management;</text></paragraph> 
<paragraph id="HD1CB75C30438463CA89EBC39100724DC"><enum>(7)</enum><text>how best to leverage radio frequency-related research, development, and testing and evaluation efforts;</text></paragraph> <paragraph id="H73E86864F81B4DCE92A7C9FC313BB5F3"><enum>(8)</enum><text>ways to foster more efficient and innovative uses of electromagnetic spectrum resources across the Federal Government, subject to and consistent with the needs and missions of Federal agencies;</text></paragraph> 
<paragraph id="HF55D70514C3E45148A2F719CFA20719C"><enum>(9)</enum><text display-inline="yes-display-inline">issues associated with spectrum sharing, including harmful interference and associated enforcement challenges; and</text></paragraph> <paragraph id="HDF8156D462BD4DC8899A08B7988E421C"><enum>(10)</enum><text>developing balanced policies that promote licensed, unlicensed, and other forms of access to spectrum. </text></paragraph></subsection> 
<subsection id="HB7B8F5EDAAB74B1297DB23C797FE1806"><enum>(c)</enum><header>Members</header> 
<paragraph id="H659269C04A264911A3EA612D51B41854"><enum>(1)</enum><header>Composition of Committee</header><text display-inline="yes-display-inline">To the extent practicable, the CSMAC shall be composed of not less than 10 but not more than 30 members appointed by the Under Secretary with the goal of providing a balanced representation of—</text> <subparagraph id="HCDB3971BD27140578D8BE91976E04F9F"><enum>(A)</enum><text>non-Federal spectrum users;</text></subparagraph> 
<subparagraph id="H59B5A3027DEE4237A5C288255B5AD7AA"><enum>(B)</enum><text>State government and local government; </text></subparagraph> <subparagraph id="H7EA3F06F93854BC2A3C10B9A6E52AA50"><enum>(C)</enum><text>technology developers and manufacturers;</text></subparagraph> 
<subparagraph id="H2CC58769BB874BF7B97B9C1BE0079C1E"><enum>(D)</enum><text>academia;</text></subparagraph> <subparagraph id="HD55A2989FB7F4AA9BB98507E328E3FCA" commented="no"><enum>(E)</enum><text>civil society;</text></subparagraph> 
<subparagraph id="H60EDC5897B7E4078A24F15BC408A073F" commented="no"><enum>(F)</enum><text>providers of mobile broadband internet access service and providers of fixed broadband internet access service, including—</text> <clause id="H6CA32B9304744576A9E3D096BB515156" commented="no"><enum>(i)</enum><text>providers with customers in both domestic and international markets;</text></clause> 
<clause id="H9F730F988BE14D0993AB8A1D6033041C" commented="no"><enum>(ii)</enum><text>small providers; and</text></clause> <clause id="HD947C8A9EEE6480C8184A6EA6F40EF53" commented="no"><enum>(iii)</enum><text>rural providers;</text></clause></subparagraph> 
<subparagraph id="HA60B6EEDEFD442C18D6233338699518D"><enum>(G)</enum><text display-inline="yes-display-inline">providers of communications services using satellite communications networks;</text></subparagraph> <subparagraph id="HB910393A0DB14889A9EE9607F2897760"><enum>(H)</enum><text>Federal agency spectrum users; and</text></subparagraph> 
<subparagraph id="H7409EB7590854631813FA3CDB619A312"><enum>(I)</enum><text>Tribal organizations.</text></subparagraph></paragraph> <paragraph id="H72539D8C3AA3416291BAC50CB43789DC"><enum>(2)</enum><header>Appointments</header> <subparagraph id="HBE6E994972D14F37AA85D5705A38BAD8"><enum>(A)</enum><header>In general</header><text>The Under Secretary shall appoint members to the CSMAC for up to a two-year term, except that members may be reappointed for additional terms by the Under Secretary.</text></subparagraph> 
<subparagraph id="H5B7CF3126A7A4BC8B4BB3C29DE004E0E"><enum>(B)</enum><header>Removal</header><text>Each member appointed under subparagraph (A) shall serve on the CSMAC at the pleasure and discretion of the Under Secretary. </text></subparagraph></paragraph> <paragraph id="HEA1225574E7A484E861FB4ECD890D935"><enum>(3)</enum><header>Chair</header> <subparagraph id="HC28D5FC6B16944CAA841F816CC1E5BE1"><enum>(A)</enum><header>Appointment</header><text>The Under Secretary shall appoint one or more members from among those appointed to the CSMAC to serve as Chair or Co-Chairs of the CSMAC.</text></subparagraph> 
<subparagraph id="H1C0193502BB547F0A8B782F80FBBFCFB"><enum>(B)</enum><header>Service</header><text>The Chair, or Co-Chairs, as the case may be, shall serve at the pleasure and discretion of the Under Secretary.</text></subparagraph></paragraph> <paragraph id="HF6369A26A0E94C038F54BB69F0007E50"><enum>(4)</enum><header>Vacancy</header><text>A vacancy on the CSMAC shall be filled in the manner in which the original appointment was made and the member so appointed shall serve for the remainder of the term. </text></paragraph> 
<paragraph id="H018870AA1F62473693E8528B1D34B98D"><enum>(5)</enum><header>Compensation</header><text>The members of the CSMAC shall serve without compensation. </text></paragraph></subsection> <subsection id="H01D51F04A20D4D77849DC9555CF4D543"><enum>(d)</enum><header>Subcommittees</header> <paragraph id="HBC05F1033CA54080AC9C855102F3AD26"><enum>(1)</enum><header>Authority</header><text>Subject to the approval of the Under Secretary, as the Under Secretary determines necessary for the performance by the CSMAC of the duties described under subsection (b), the CSMAC may establish subcommittees, working groups, standing committees, ad hoc groups, task groups, or other subgroups of the CSMAC.</text></paragraph> 
<paragraph id="HD521317B9C864FCD869094D6D2DCF8B3"><enum>(2)</enum><header>Limitations and additional participation</header><text>Any subcommittee, working group, standing committee, ad hoc group, task group, or other subgroup established under paragraph (1)—</text> <subparagraph id="HC18EE1F1C8C24963BEC7F43A23AFBFF0"><enum>(A)</enum><text>shall report to the CSMAC;</text></subparagraph> 
<subparagraph id="HB63E045C34FA4C9784AB43FD8FF1998D"><enum>(B)</enum><text>may not provide any advice, recommendation, or other work product directly to the Under Secretary; and</text></subparagraph> <subparagraph id="H44AA1656072B4FD0BD642694660A1704"><enum>(C)</enum><text display-inline="yes-display-inline">may seek participation by any person who is not a member of the CSMAC to inform the activity of such subcommittee, working group, standing committee, ad hoc group, task group, or other subgroup.</text></subparagraph></paragraph></subsection> 
<subsection id="H5A08682E5FE3433EAF910293B78D2759" commented="no"><enum>(e)</enum><header>Duration</header><text>Section 1013(a)(2)(B) of title 5, United States Code (relating to the termination of advisory committees) shall not apply to the CSMAC.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H5F0FF5C3FD6F4340AB894E7CC737889C"><enum>206.</enum><header>Voluntary criteria, standards, ratings, and other measures for certain radio receivers</header> <subsection id="H8DA6C0FB753F490E97355EFA66910443"><enum>(a)</enum><header>Establishment of working group</header> <paragraph id="HFB364E0C00A3448E9D2D83C1397B5C92"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Under Secretary shall convene a working group to assist the Under Secretary in developing, and periodically updating, voluntary criteria, standards, ratings, and other measures with respect to radio receivers operating in spectrum bands allocated for exclusive Federal use.</text></paragraph> 
<paragraph id="HC496A97C4DC24A3989368788589AF414"><enum>(2)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the voluntary criteria, standards, ratings, and other measures developed, and periodically updated, by the Under Secretary under this section, with the assistance of the working group, shall be to provide guidance on the design, manufacture, and sale of radio receivers designed (in whole or in part) to operate in spectrum bands allocated for exclusive Federal use—</text> <subparagraph id="H36E480A3CF9D4F7F9BC7D3770A535A35"><enum>(A)</enum><text>with respect to the incorporation of appropriate measures to mitigate, or enhance resiliency to, potential harmful interference; and</text></subparagraph> 
<subparagraph id="H6D80FBB2094F4158ADF8B9C8D4870125"><enum>(B)</enum><text>with the goal of ensuring that the reasonable current and future use of cochannel and non-cochannel spectrum, including use by non-Federal systems of spectrum designated by the Commission for commercial operations, will not result in the operation of such receivers being seriously degraded or obstructed, including such operation being repeatedly interrupted.</text></subparagraph></paragraph> <paragraph id="H47BFCE9DACC542D18E80D0607BB941A6"><enum>(3)</enum><header>Chair; members; participation by Federal entities</header> <subparagraph id="H9C2E1086F92C4647A41052CB9533EFA3"><enum>(A)</enum><header>Chair and members</header><text>The Chair of the working group shall be the Under Secretary and the working group shall include representatives from the following:</text> 
<clause id="H0541BBCB54704591ADD6C32075CE4FD7"><enum>(i)</enum><text>The Commission.</text></clause> <clause id="HB5EE92E20D644779B5E7CCA3ED261854"><enum>(ii)</enum><text>The communications industry.</text></clause> 
<clause id="H9844411FAAE24A23AC66D234292DFC87"><enum>(iii)</enum><text>Academia.</text></clause> <clause id="HB5434F15F6024312AAEA5C344158D283"><enum>(iv)</enum><text display-inline="yes-display-inline">Entities that manufacture radio receivers.</text></clause> 
<clause id="H0BE4B2CA4FE54F5CA6991A3F520B1AB6"><enum>(v)</enum><text>Entities that establish technical specifications for radio receivers.</text></clause></subparagraph> <subparagraph id="H34EF920D719C41178EF1E3187347531C"><enum>(B)</enum><header>Participation by Federal entities</header><text display-inline="yes-display-inline">The Under Secretary shall invite a representative from each Federal entity to participate in the working group. </text></subparagraph></paragraph> 
<paragraph id="HC4B8D4668BCB4A46B63630367F24859A"><enum>(4)</enum><header>Federal Advisory Committee Act exemption</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5, United States Code, shall not apply to the working group.</text></paragraph></subsection> <subsection id="H2670EB57639940ECA57837BA9D6229E3"><enum>(b)</enum><header>Publication of voluntary criteria, standards, ratings, and other measures</header><text display-inline="yes-display-inline">Not later than 18 months after the date on which the working group is convened, the Under Secretary shall publish, consistent with the protection of classified information and intelligence sources and methods, the voluntary criteria, standards, ratings, and other measures developed pursuant to subsection (a) on a publicly accessible page on the website of the NTIA and in the Federal Register.</text></subsection> 
<subsection id="H5CF060FBCECF4DE7AADE02CDCD9DCE71" commented="no"><enum>(c)</enum><header>Periodic review and update</header><text display-inline="yes-display-inline">Not less frequently than every 4 years, the Under Secretary shall review and update, if appropriate, the voluntary criteria, standards, ratings, and other measures published under subsection (b). Any such update shall be published as described in subsection (b) not later than 14 days after the date on which the update is completed.</text></subsection> <subsection id="H42BE8460FCB4405EB859D045E2EB26AC"><enum>(d)</enum><header>Consideration</header><text display-inline="yes-display-inline">In developing, and periodically updating, voluntary criteria, standards, ratings, and other measures under this section, the Under Secretary shall take into consideration the unique technical and operational characteristics of different Federal systems.</text></subsection> 
<subsection id="HAE4B73B127444B37837DD0A86EE58736"><enum>(e)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to provide authority for the establishment of any—</text> <paragraph id="HE4E9325C9B104CF98EA69A45B8977892"><enum>(1)</enum><text>mandatory criteria, standards, ratings, or other measures; or</text></paragraph> 
<paragraph id="H315EB6559C5B49E9BAD53B003B8E69C1"><enum>(2)</enum><text display-inline="yes-display-inline">voluntary criteria, standards, ratings, or other measures with technical parameters not determined by the Under Secretary.</text></paragraph></subsection> <subsection id="HAE840690112D4AFF9FC5BE30FEA51361"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HA92442A4564C460ABEA82314E63DC814"><enum>(1)</enum><header>Federal entity</header><text display-inline="yes-display-inline">The term <quote>Federal entity</quote> has the meaning given such term in section 113(l) of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/923">47 U.S.C. 923(l)</external-xref>). </text></paragraph> <paragraph id="H30C92668C471429BA00DE0C76C4FC258"><enum>(2)</enum><header>Federal system</header><text>The term <term>Federal system</term> means a system of radio stations belonging to and operated by the Federal Government that receives radio frequency signals on spectrum that is allocated exclusively for Federal use or allocated for shared Federal and non-Federal use.</text></paragraph> 
<paragraph id="H08B219B6DBCA43E7A613AFA14FD2A2C7" commented="no"><enum>(3)</enum><header>Working group</header><text>The term <quote>working group</quote> means the working group convened under subsection (a)(1).</text></paragraph></subsection></section></title> <title id="HC01CE884EF154BEF86C9E1AE8BCCFB56"><enum>III</enum><header>Office of Internet Connectivity and Growth</header> <section id="HD296955A07BD4D4AA9E3F2FCB6D8241B"><enum>301.</enum><header>National Strategy to Close Digital Divide</header> <subsection id="H849219309405403892737C1E71937D69"><enum>(a)</enum><header>National Strategy</header> <paragraph id="H30BC2E78464A454DB5CF4F2CCDC45802"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of the enactment of this Act, the Under Secretary, in consultation with the heads of the covered agencies, shall develop and submit to the appropriate committees of Congress a National Strategy to Close the Digital Divide to—</text> 
<subparagraph id="H8A7B108D7B9547C3AFA06F1745D7B1B5"><enum>(A)</enum><text>support better management of Federal broadband programs to deliver on the goal of providing high-speed, affordable broadband internet access service to all individuals in the United States;</text></subparagraph> <subparagraph id="HDD4E98C56815461097580D7A4A6B5967"><enum>(B)</enum><text>synchronize interagency coordination among covered agencies for Federal broadband programs;</text></subparagraph> 
<subparagraph id="HAD96961352FE4802A8E23CF4457F0543"><enum>(C)</enum><text>synchronize interagency coordination regarding the process for approving the grant of an easement, right of way, or lease to, in, over, or on a building or any other property owned by the Federal Government for the right to install, construct, modify, or maintain infrastructure with respect to broadband internet access service; and</text></subparagraph> <subparagraph id="H89221C7ADA5D457292A904917CA16FF8"><enum>(D)</enum><text>reduce barriers, lower costs, and ease administrative burdens for State, local, and Tribal governments to participate in Federal broadband programs.</text></subparagraph></paragraph> 
<paragraph id="HB509C172AD0D4A16896E9B574282EFA4"><enum>(2)</enum><header>Required contents</header><text>The Strategy shall—</text> <subparagraph id="HCBFEE7791DC94C31BEE7BA1DC07190F8"><enum>(A)</enum><text>list all— </text> 
<clause id="H535BBE1602424E77A404A1FD47124DBB"><enum>(i)</enum><text>Federal broadband programs; and </text></clause> <clause id="H541D1ABA5C424A07812347FA03B48D1B"><enum>(ii)</enum><text>programs known to the NTIA that exist at the State and local levels that are directly or indirectly intended to increase the deployment of, access to, the affordability of, or the adoption of broadband internet access service;</text></clause></subparagraph> 
<subparagraph id="H7A63FD7FCBAB423DA45D592BA4CA0BD5"><enum>(B)</enum><text>describe current, as of the date on which the Strategy is submitted, Federal efforts to coordinate Federal broadband programs;</text></subparagraph> <subparagraph id="H6AEA238CB55B4D81B750951613CF3FCD"><enum>(C)</enum><text>identify gaps, limitations, and requirements, including with respect to laws and data, that hinder, or may hinder, coordination across Federal broadband programs;</text></subparagraph> 
<subparagraph id="HEB702205ED8C49FD9B4D00F0D025866F"><enum>(D)</enum><text>establish clear roles and responsibilities for the heads of the covered agencies, as well as clear goals, objectives, and performance measures, for— </text> <clause id="H8A917C784EE443CBAEB50F388977E2C4"><enum>(i)</enum><text>the management of all Federal broadband programs; and </text></clause> 
<clause id="H43B240388C7B4C46AED75ED51DD43FF1"><enum>(ii)</enum><text>interagency coordination efforts with respect to Federal broadband programs;</text></clause></subparagraph> <subparagraph id="H7DB97B7D3BCB4C159543934EBB634D77"><enum>(E)</enum><text>address the sources and types of resources and investments needed by covered agencies to carry out the Strategy, and where those resources and investments should be targeted based on balancing risk reductions with costs;</text></subparagraph> 
<subparagraph id="H650E543EEB7C47138EC6E7903418846C"><enum>(F)</enum><text>address factors that increase the costs and administrative burdens for State, local, and Tribal governments with respect to participation in Federal broadband programs;</text></subparagraph> <subparagraph id="H2967C1805CC54365BD28501E3A276833"><enum>(G)</enum><text>recommend incentives, legislative solutions, and administrative actions to help State, local, and Tribal governments more efficiently—</text> 
<clause id="H7CCF5E7CA19D40AB863B6DCECA516D34"><enum>(i)</enum><text>distribute, and effectively administer, funding received from Federal broadband programs; and </text></clause> <clause id="HB8907D1691034DAE8F38C266FB95A029"><enum>(ii)</enum><text>resolve conflicts with respect to the funding described in clause (i);</text></clause></subparagraph> 
<subparagraph id="HEE03575F9C6E486BA196B152D950B299"><enum>(H)</enum><text>recommend incentives, legislative solutions, and administrative actions to— </text> <clause id="HE1905C98A9A64624A5FF4EA92F25B457"><enum>(i)</enum><text>improve the coordination and management of Federal broadband programs; and </text></clause> 
<clause id="HEF33C8EF429E45FFA3C076E684CB0E5E"><enum>(ii)</enum><text>eliminate duplication with respect to Federal broadband programs; </text></clause></subparagraph> <subparagraph id="HB8F1C0F8A72B419CBD66F64A32FC77B9"><enum>(I)</enum><text>describe current, as of the date on which the Strategy is submitted, efforts by covered agencies to streamline the process for granting access to an easement, right of way, or lease to, in, over, or on a building or any other property owned by the Federal Government for the right to install, construct, modify, or maintain infrastructure with respect to broadband internet access service; </text></subparagraph> 
<subparagraph id="HA157280D1CF2483DBADB2BBE712C3362"><enum>(J)</enum><text>identify gaps and limitations with respect to allowing regional, interstate, or cross-border economic development organizations to participate in Federal broadband programs; and</text></subparagraph> <subparagraph id="HF056BB417288460B88B32745AE79BF6F"><enum>(K)</enum><text>address specific issues relating to closing the digital divide on Tribal lands. </text></subparagraph></paragraph> 
<paragraph id="H69BC055C99274D1CAC7FE5946FD3BEE7"><enum>(3)</enum><header>Public consultation</header><text display-inline="yes-display-inline">In developing the Strategy, the Under Secretary shall consult with—</text> <subparagraph id="HB4B2509753DB4B48881AEC2139AF9B38"><enum>(A)</enum><text>groups that represent consumers or the interests of the public, including economically or socially disadvantaged individuals;</text></subparagraph> 
<subparagraph id="H5686941712F34125B77D1594A4C87D23"><enum>(B)</enum><text>subject matter experts;</text></subparagraph> <subparagraph id="H63B9E7BE5A274A9FAE2AA8464E862B19"><enum>(C)</enum><text>providers of broadband internet access service;</text></subparagraph> 
<subparagraph id="HC1535CFF40A746D3AF8E84E779DC9051"><enum>(D)</enum><text>Tribal entities; and</text></subparagraph> <subparagraph id="H85CD63E09EFD4BCB8B0CFD589E869CA2"><enum>(E)</enum><text>State and local agencies and entities.</text></subparagraph></paragraph></subsection> 
<subsection id="HE5A77B631DE2484F8A87296DB33D90E5"><enum>(b)</enum><header>Implementation Plan</header> 
<paragraph id="H6AB4E995DC5940F5B2114C39FE2A5BF8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 240 days after the date on which the Under Secretary submits the Strategy to the appropriate committees of Congress under subsection (a)(1), the Under Secretary, in consultation with the heads of the covered agencies, shall develop and submit to the appropriate committees of Congress an implementation plan for the Strategy.</text></paragraph> <paragraph id="H66CC87E90E0545C78910E071B429DDDA"><enum>(2)</enum><header>Required contents</header><text>The Implementation Plan shall, at a minimum—</text> 
<subparagraph id="H011FE577C2A348EF8711935477776828"><enum>(A)</enum><text>provide a plan for implementing the roles, responsibilities, goals, objectives, and performance measures for the management of Federal broadband programs and interagency coordination efforts identified in the Strategy;</text></subparagraph> <subparagraph id="H564CF102EE924AAD8E8EB87076600154"><enum>(B)</enum><text>provide a plan for coordinating with covered agencies on the roles, responsibilities, goals, objectives, and performance measures identified in the Strategy;</text></subparagraph> 
<subparagraph id="H201B0DC439D340149283D17DE542EA9F"><enum>(C)</enum><text>describe the roles and responsibilities of the covered agencies, and the interagency mechanisms, to coordinate the implementation of the Strategy;</text></subparagraph> <subparagraph id="H6A091346636548F7A6E47F615F5DE970"><enum>(D)</enum><text>provide a plan for regular meetings among the heads of the covered agencies to coordinate the implementation of the Strategy and improve coordination among Federal broadband programs and for permitting processes for infrastructure with respect to broadband internet access service;</text></subparagraph> 
<subparagraph id="H36DCE62C1D4F4CF2AA1A90C23B6A030D"><enum>(E)</enum><text>provide a plan for regular engagement with interested members of the public to evaluate Federal broadband programs, permitting processes for infrastructure with respect to broadband internet access service, and progress in implementing the Strategy;</text></subparagraph> <subparagraph id="HFDCE6011A2504A8C89C79ADD91CA9417"><enum>(F)</enum><text>with respect to the awarding of Federal funds or subsidies to support the deployment of broadband internet access service, provide a plan for the adoption of—</text> 
<clause id="H93E288078C444E7A95EE4DB90A95E7C9"><enum>(i)</enum><text>common data sets to use when making awards, including a requirement that covered agencies use the maps created under title VIII of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/641">47 U.S.C. 641 et seq.</external-xref>); and</text></clause> <clause id="HBADCAEDE5A784492A398AEBE3F474E1C"><enum>(ii)</enum><text>applications regarding those awards, as described in section 903(e) of the ACCESS BROADBAND Act (<external-xref legal-doc="usc" parsable-cite="usc/47/1307">47 U.S.C. 1307(e)</external-xref>);</text></clause></subparagraph> 
<subparagraph id="HA507C0204AE44DDBB8F10AE1F52D13A5"><enum>(G)</enum><text>provide a plan to monitor and reduce waste, fraud, and abuse in Federal broadband programs, including wasteful spending resulting from fragmented, overlapping, and unnecessarily duplicative programs; </text></subparagraph> <subparagraph id="H67000BA1C1704337AC2DA58331109755"><enum>(H)</enum><text>require consistent obligation and expenditure reporting by covered agencies for Federal broadband programs, which shall be consistent with section 903(c)(2) of the ACCESS BROADBAND Act (<external-xref legal-doc="usc" parsable-cite="usc/47/1307">47 U.S.C. 1307(c)(2)</external-xref>); </text></subparagraph> 
<subparagraph id="H15CC739E31964D60BA383912450CFB02"><enum>(I)</enum><text>provide a plan to—</text> <clause id="HC61F1498E8284BAA8620EA0FFFE42648"><enum>(i)</enum><text>increase awareness of, and participation and enrollment in, Federal broadband programs relating to the affordability and adoption of broadband internet access service;</text></clause> 
<clause id="HC855FE8307C0423BB84E4D741BB425D6"><enum>(ii)</enum><text display-inline="yes-display-inline">adopt common data sets to evaluate the performance of such Federal broadband programs and make such data sets available as open Government data assets; and</text></clause> <clause id="HA3CCB01FE95A43F8A204FEC48F8B9900"><enum>(iii)</enum><text display-inline="yes-display-inline">address barriers to participation in such Federal broadband programs for eligible households;</text></clause></subparagraph> 
<subparagraph id="H99450C26E3FA441485009DF39245ADDD"><enum>(J)</enum><text display-inline="yes-display-inline">provide a plan to monitor the service offerings, consistency, and quality of broadband internet access service supported by Federal broadband programs; and </text></subparagraph> <subparagraph id="HF359CB10D6D84A04B8C8BC5E2929AC42"><enum>(K)</enum><text>describe the administrative and legislative action that is necessary to carry out the Strategy.</text></subparagraph></paragraph> 
<paragraph id="HE00EB954A16649F6BA1EB64B9982D438"><enum>(3)</enum><header>Public comment</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the Under Secretary submits the Strategy to the appropriate committees of Congress under subsection (a)(1), the Under Secretary shall seek public comment regarding the development and execution of the Implementation Plan. </text></paragraph></subsection> <subsection id="HC3214410F51E421AB887712A445A2CFE"><enum>(c)</enum><header>Briefings and implementation</header> <paragraph id="H64E1119B77FC4D818D0FE8B807B3133B"><enum>(1)</enum><header>Briefing</header><text display-inline="yes-display-inline">Not later than 21 days after the date on which the Under Secretary submits the Implementation Plan to the appropriate committees of Congress under subsection (b)(1), the Under Secretary, and appropriate representatives from the covered agencies involved in the formulation of the Strategy, shall provide a briefing on the implementation of the Strategy to the appropriate committees of Congress.</text></paragraph> 
<paragraph id="H4DD7C17012E14305B076B9D0877DF5D1"><enum>(2)</enum><header>Implementation</header><text display-inline="yes-display-inline">The Under Secretary shall—</text> <subparagraph id="H83F18A4639C54FD3B99D44359F7891E8"><enum>(A)</enum><text>implement the Strategy in accordance with the terms of the Implementation Plan; and</text></subparagraph> 
<subparagraph id="H826E7B6F1E81455390A70D04926600F8"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 90 days after the date on which the Under Secretary begins to implement the Strategy, and not less frequently than once every 90 days thereafter until the date on which the Implementation Plan is fully implemented, brief the appropriate committees of Congress on the progress in implementing the Implementation Plan.</text></subparagraph></paragraph></subsection> <subsection id="H03BA224A0E1F4E9EABAACD4D8A8C9828"><enum>(d)</enum><header>Government Accountability Office study and report</header> <paragraph id="H8C90F2B657D0472E9E3CA02172DC8533"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study that shall— </text> 
<subparagraph id="HF55D0D6B591645FEBF5AB09D809D2430"><enum>(A)</enum><text display-inline="yes-display-inline">examine the efficacy of the Strategy and the Implementation Plan in closing the digital divide; and</text></subparagraph> <subparagraph id="H43BE6D85120B4AABA707DAD93362895E"><enum>(B)</enum><text display-inline="yes-display-inline">make recommendations regarding how to improve the Strategy and the Implementation Plan.</text></subparagraph></paragraph> 
<paragraph id="H7263F5CBAA49494F8556FD9331C28661"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Under Secretary submits the Implementation Plan to the appropriate committees of Congress under subsection (b)(1), the Comptroller General shall submit to the appropriate committees of Congress a report on the results of the study conducted under paragraph (1).</text></paragraph></subsection> <subsection id="HDF073552267245A8BC86572544A0A1E9"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to affect the authority or jurisdiction of the Commission or confer upon the Under Secretary or any executive agency the power to direct the actions of the Commission, either directly or indirectly. </text></subsection> 
<subsection id="H1AAACBB0F6A94824BB5F651A0DAF6D96"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H56DD611FD84047A7A34BCF54804BE533"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text> 
<subparagraph id="H09AA212E476E415EB4C18C3B53643702"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; and</text></subparagraph> <subparagraph id="H2A623E76F4954C6FBF8516A123C25E12"><enum>(B)</enum><text>the Committee on Energy and Commerce of the House of Representatives. </text></subparagraph></paragraph> 
<paragraph id="HC66C351424D946A8BD9972BE2CBA69AE"><enum>(2)</enum><header>Covered agencies</header><text>The term <term>covered agencies</term> means—</text> <subparagraph id="H6695B64AD9FB4D3C9E1A701F25028DE0"><enum>(A)</enum><text>the Commission;</text></subparagraph>

<subparagraph id="H69155AB705DB48A2B0EAF912546170AD"><enum>(N)</enum><text>the Department of the Interior. </text></subparagraph></paragraph> <paragraph id="HD25C6D80A70147F1BA58580A8AA13249"><enum>(3)</enum><header>Federal broadband program</header><text>The term <term>Federal broadband program</term> means any program administered by a covered agency that is directly or indirectly intended to increase the deployment of, access to, the affordability of, or the adoption of broadband internet access service.</text></paragraph> 
<paragraph id="HB2230E558A844D9D84D94B752EFB6C87"><enum>(4)</enum><header>Implementation plan</header><text>The term <term>Implementation Plan</term> means the implementation plan developed under subsection (b)(1).</text></paragraph> <paragraph id="H5271C6679E764CA3846EE9CCA93C259D"><enum>(5)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each State of the United States, the District of Columbia, and each commonwealth, territory, or possession of the United States.</text></paragraph> 
<paragraph id="HB75DE179E42840379D8716968E43989E"><enum>(6)</enum><header>Strategy</header><text>The term <term>Strategy</term> means the National Strategy to Close the Digital Divide developed under subsection (a)(1).</text></paragraph></subsection></section></title> <title id="HE551557B0D534D29BB53E62DD9331DD3"><enum>IV</enum><header>Office of Policy Development and Cybersecurity</header> <section id="H2CB4FBD80D03424F9E0AA657D789E612"><enum>401.</enum><header>Office of Policy Development and Cybersecurity</header> <text display-inline="no-display-inline">Part A of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/901">47 U.S.C. 901 et seq.</external-xref>), as amended by the preceding provisions of this Act, is further amended by adding at the end the following:</text>

<section id="H96BEEC90B9724A9EAFA42C970BAE6879"><enum>110.</enum><header>Office of Policy Development and Cybersecurity</header> 
<subsection id="H4403C0BDC1CD4B8EA86D18A0485379B3"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established within the NTIA an Office of Policy Development and Cybersecurity (in this section referred to as the <quote>Office</quote>).</text> </subsection> <subsection id="HEBE2F1F9F92148B1B3B5CE6B84602B5F"><enum>(b)</enum><header>Head of Office</header> <paragraph id="H2FADA46D4E254D6C953BE02D99383E17"><enum>(1)</enum><header>In general</header><text>The head of the Office shall be an Associate Administrator for Policy Development and Cybersecurity (in this section referred to as the <quote>Associate Administrator</quote>).</text></paragraph> 
<paragraph id="HBC6EFD7AF43B456287203AB0F2686F6D"><enum>(2)</enum><header>Requirement to report</header><text>The Associate Administrator shall report to the Under Secretary (or a designee of the Under Secretary).</text></paragraph></subsection> <subsection id="HC50F242CC95E403A9AFCBD431B2F8AFE"><enum>(c)</enum><header>Duties</header> <paragraph id="HB18D49CAC4A74EF2AE3F84DA961DF72A"><enum>(1)</enum><header>In general</header><text>The Associate Administrator shall, at the direction of the Under Secretary, oversee and conduct national communications and information policy analysis and development for the internet and communications technologies.</text></paragraph> 
<paragraph id="H1EFE990FA8F04B82BF31BA64CD820FF4"><enum>(2)</enum><header>Particular duties</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Associate Administrator shall, at the direction of the Under Secretary—</text> <subparagraph id="HA0A7CD8C7EDB4A199A26B16C54FF9F06"><enum>(A)</enum><text>develop, analyze, and advocate for market-based policies that promote innovation, competition, consumer access, digital inclusion, workforce development, and economic growth in the communications, media, and technology markets;</text></subparagraph> 
<subparagraph id="H5922EBB16FB048B5A1B7AA86B4C40B64"><enum>(B)</enum><text>conduct studies, as delegated by the Under Secretary or required by Congress, on how individuals in the United States access and use the internet, wireline and wireless telephony, mass media, other digital services, and video services;</text></subparagraph> <subparagraph id="H5BDA1A715E904C5486DABD00112FF607"><enum>(C)</enum><text>coordinate transparent, consensus-based, multistakeholder processes to create guidance for and to support the development and implementation of cybersecurity and privacy policies with respect to the internet and other communications networks;</text></subparagraph> 
<subparagraph id="H503E324DFB854EF4A7F7E743ABD4A5C8"><enum>(D)</enum><text>promote increased collaboration between security researchers and providers of communications services and software system developers;</text></subparagraph> <subparagraph id="H142ED758291D4CAE8017F6064EC1FD8B"><enum>(E)</enum><text>perform such duties as the Under Secretary considers appropriate relating to the program for preventing future vulnerabilities established under section 8(a) of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1607">47 U.S.C. 1607(a)</external-xref>);</text></subparagraph> 
<subparagraph id="H83F3B1E1697C4F99A147E8677CC23291"><enum>(F)</enum><text>advocate for policies that promote the security and resilience to cybersecurity incidents of communications networks while fostering innovation, including policies that promote secure communications network supply chains;</text></subparagraph> <subparagraph id="H0F447FD478B8489A9DBA305D2496716F"><enum>(G)</enum><text>present security of the digital economy and infrastructure and cybersecurity policy efforts before the Commission, Congress, and elsewhere;</text></subparagraph> 
<subparagraph id="H008E4A0AE4984DC98426D634FCE3D722"><enum>(H)</enum><text display-inline="yes-display-inline">provide advice and assistance to the Under Secretary in carrying out the policy responsibilities of the NTIA with respect to cybersecurity policy matters, including the evaluation of the impact of cybersecurity matters pending before the Commission, other Federal agencies, and Congress;</text></subparagraph> <subparagraph id="H20B98844E9B04D638CD689091198DF86"><enum>(I)</enum><text display-inline="yes-display-inline">in addition to the duties described in subparagraph (H), perform such other duties regarding the policy responsibilities of the NTIA with respect to cybersecurity policy matters as the Under Secretary considers appropriate;</text></subparagraph> 
<subparagraph id="H5479C6DEF2A941DE88C33CD82C4EBDF0"><enum>(J)</enum><text>develop policies to accelerate innovation and commercialization with respect to advances in technological understanding of communications technologies;</text></subparagraph> <subparagraph id="H59762DD17ABF42E19328433A5321E4B6"><enum>(K)</enum><text>identify barriers to trust, security, innovation, and commercialization with respect to communications technologies, including access to capital and other resources, and ways to overcome such barriers;</text></subparagraph> 
<subparagraph id="H37D38DB10AB4479AA94B665F889548A5"><enum>(L)</enum><text>provide public access to relevant data, research, and technical assistance on innovation and commercialization with respect to communications technologies, consistent with the protection of classified information;</text></subparagraph> <subparagraph id="H731C6AF1DE31468E854B8FB8F6D1F0EB"><enum>(M)</enum><text>strengthen collaboration on and coordination of policies relating to innovation and commercialization with respect to communications technologies, including policies focused on the needs of small businesses and rural communities—</text> 
<clause id="H7DD5855A62594BC08E2D62B30D8051E4"><enum>(i)</enum><text>within the Department of Commerce; </text></clause> <clause id="H5B00BF452B534AAEA4BF9A57DEFAF0A8"><enum>(ii)</enum><text>between the Department of Commerce and State government agencies, as appropriate; and</text></clause> 
<clause id="HFF2A403647A445E080686645C53576FA"><enum>(iii)</enum><text display-inline="yes-display-inline">between the Department of Commerce and the Commission or any other Federal agency the Under Secretary determines to be necessary; and</text></clause></subparagraph> <subparagraph id="HBD3776317F88496197A392E5882A09DE"><enum>(N)</enum><text display-inline="yes-display-inline">solicit and consider feedback from small and rural communications service providers, as appropriate.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H0C6519D3F7EB44AE95324691E7463F33"><enum>402.</enum><header>Economic competitiveness of information and communication technology supply chain</header> 
<subsection id="H22B35AA7DCFE4F938B3BE73E2164977F"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the information and communication technology supply chain that—</text> <paragraph id="HF8DBDDD4F9B041509EEFDE7FF24CB628"><enum>(1)</enum><text>identifies—</text> 
<subparagraph id="H98D7C730686F4E3BA0ADDA4DEB79E888"><enum>(A)</enum><text>information and communication technology critical to the economic competitiveness of the United States; and </text></subparagraph> <subparagraph id="H6828E83B06CC42ADAC234E634BC72AE0"><enum>(B)</enum><text display-inline="yes-display-inline">the industrial capacity of—</text> 
<clause id="HF0B86E7237BA4540B3FD41CD2B0D9265" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">United States vendors that produce information and communication technology identified under subparagraph (A); and </text></clause> <clause id="H4D55BBAC510640AFADBD32EB252E3505"><enum>(ii)</enum><text>trusted information and communication technology vendors that produce information and communication technology identified under subparagraph (A);</text></clause></subparagraph></paragraph> 
<paragraph id="H1735A0EB15EA46CB8B6B503B727CA5C5" commented="no"><enum>(2)</enum><text>assesses the economic competitiveness of vendors described under paragraph (1)(B); </text></paragraph> <paragraph id="H706D3546AF9741DA8934EFDCA70EC7BC"><enum>(3)</enum><text display-inline="yes-display-inline">assesses whether, and to what extent, there is a dependence by providers of advanced telecommunications capability in the United States on information and communication technology identified under paragraph (1)(A) that is not trusted;</text></paragraph> 
<paragraph id="HF1A4000F12DB42D1A3736819F477426B"><enum>(4)</enum><text>identifies—</text> <subparagraph id="H48F00F5F381E4EBFAE87D9AC12549F56"><enum>(A)</enum><text display-inline="yes-display-inline">what actions by the Federal Government are needed to support, and bolster the economic competitiveness of, trusted information and communication technology vendors; and</text></subparagraph> 
<subparagraph id="H441CFE765E4D48FD9D115B82FC4D5A25"><enum>(B)</enum><text display-inline="yes-display-inline">what Federal resources are needed to reduce dependence by providers of advanced telecommunications capability in the United States on companies that—</text> <clause id="H9300A4DC598346BD97959C093D166B06"><enum>(i)</enum><text>produce information and communication technology; and</text></clause> 
<clause id="H71D364D2FF3141A19BE76E1C024E806D"><enum>(ii)</enum><text>are not trusted; and</text></clause></subparagraph></paragraph> <paragraph id="HD7FA454480474CF29D737647E7B4D27A" commented="no"><enum>(5)</enum><text>defines lines of effort and assigns responsibilities for a whole-of-Government response to ensuring the competitiveness of the information and communication technology supply chain in the United States.</text></paragraph></subsection> 
<subsection id="HDCD14344EAC944E9B2B71E50AF2580F6"><enum>(b)</enum><header>Whole-of-Government strategy</header> 
<paragraph id="H8219BF038A4A4279A153124C4A3027FE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall develop, on the basis of the report required by subsection (a), a whole-of-Government strategy to ensure the economic competitiveness of trusted information and communication technology vendors that includes—</text> <subparagraph id="H100CDDC26C1545FD840AE9460FFCA268" display-inline="no-display-inline"><enum>(A)</enum><text>recommendations on how—</text> 
<clause id="H53E73A858B3847219299762075238D84"><enum>(i)</enum><text display-inline="yes-display-inline">to strengthen the structure, resources, and authorities of the Federal Government to support the economic competitiveness of trusted information and communication technology vendors, including United States vendors that are trusted information and communication technology vendors; and</text></clause> <clause id="H1686D422A2534DE7B98D9156380F1CC5"><enum>(ii)</enum><text display-inline="yes-display-inline">the Federal Government can address any barriers to a market-based solution for increasing the economic competitiveness of such information and communication technology vendors; </text></clause></subparagraph> 
<subparagraph id="H482186CE896642D1A158B3F9BA9E8436"><enum>(B)</enum><text>defined lines of effort and responsibilities for Federal agencies to implement the strategy; and </text></subparagraph> <subparagraph id="HD1D9EFA74AF4402A95FB8D5BF46DF688"><enum>(C)</enum><text display-inline="yes-display-inline">a description of—</text> 
<clause id="H5D83D21DDC5245B9A59D153A273CBC61"><enum>(i)</enum><text>any change to a Federal program, Federal law, or structure of the Federal Government necessary to implement any recommendation under subparagraph (A); and</text></clause> <clause id="H21063915A1AF4624A9E692FE1CBA2367"><enum>(ii)</enum><text display-inline="yes-display-inline">any additional Federal resource necessary to implement any recommendation under subparagraph (A). </text></clause></subparagraph></paragraph> 
<paragraph id="H811B3B8EEF674836991834FB8AE7FB66"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the submission of the report required by subsection (a), the Secretary shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing the strategy developed under paragraph (1).</text></paragraph></subsection> <subsection id="HF8647226F8B94F25AEC452A4DEE5514F"><enum>(c)</enum><header>Consultation required</header><text>In carrying out subsections (a) and (b), the Secretary shall consult with—</text> 
<paragraph id="H7DEDF49D85844B69AB70A1AC59BB5CDD"><enum>(1)</enum><text display-inline="yes-display-inline">a cross-section of trusted information and communication technology vendors; and</text></paragraph> <paragraph id="H6EFB77C3D0B44A1A817FCA2E2ED06FBD"><enum>(2)</enum><text>the Secretary of State, the Secretary of Homeland Security, the Attorney General, the Director of National Intelligence, the Secretary of Defense, the Chair of the Commission, and any other head of an agency the Secretary determines necessary. </text></paragraph></subsection> 
<subsection id="H34FFDC9F2F1944E5818AB2778240A2DE"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H0A8C0F8490754CB789DE6F9DE70F4F9A"><enum>(1)</enum><header>Advanced telecommunications capability</header><text display-inline="yes-display-inline">The term <quote>advanced telecommunications capability</quote> has the meaning given that term in section 706(d) of the Telecommunications Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/47/1302">47 U.S.C. 1302(d)</external-xref>). </text></paragraph> 
<paragraph id="HCE95E23330214E9C967A108B3C521A80"><enum>(2)</enum><header>Information and communication technology</header><text>The term <term>information and communication technology</term> means a technology (including software), component, or material that enables communications by radio or wire.</text></paragraph> <paragraph id="H3522F5E4F6274276B4C16A3EC3B48060"><enum>(3)</enum><header>Information and communication technology supply chain</header><text>The term <term>information and communication technology supply chain</term> means all of the companies that produce information and communication technology. </text></paragraph> 
<paragraph id="H7D78159836924B52882146712BC9E98B"><enum>(4)</enum><header>Not trusted</header><text display-inline="yes-display-inline">The term <term>not trusted</term> means, with respect to a company or information and communication technology, that the company or information and communication technology is <italic></italic>determined by the Secretary to pose an unacceptable risk to the national security of the United States or the security and safety of United States persons based solely on one or more determinations described under paragraphs (1) through (4) of section 2(c) of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1601">47 U.S.C. 1601(c)</external-xref>). </text></paragraph> <paragraph id="HCE4A5E8977CB4C108CE4AC76E4A58070"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce, acting through the Under Secretary.</text></paragraph> 
<paragraph id="H2367A03BD61E442C9AC43AFE53415EED" commented="no"><enum>(6)</enum><header>Trusted</header><text display-inline="yes-display-inline">The term <term>trusted</term> means, with respect to a company, that the Secretary has not determined that the company is not trusted.</text></paragraph> <paragraph id="H6451010B456F4640B1980763F360BE60"><enum>(7)</enum><header>Trusted information and communication technology vendor</header><text>The term <term>trusted information and communication technology vendor</term> means a company—</text> 
<subparagraph id="H0EA6DEE63922411982D7F0928175306B"><enum>(A)</enum><text>that produces information and communication technology; and </text></subparagraph> <subparagraph id="HBFCDF01CF3784216B2BFCD26BC9D8CAF"><enum>(B)</enum><text>that is trusted.</text></subparagraph></paragraph></subsection></section> 
<section id="H211862AFF8C94059BCD62D6AB5A452D6" section-type="subsequent-section"><enum>403.</enum><header>Digital Economy and Cybersecurity Board of Advisors</header><text display-inline="no-display-inline">Part A of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/901">47 U.S.C. 901 et seq.</external-xref>), as amended by the preceding provisions of this Act, is further amended by adding at the end the following:</text> <quoted-block style="OLC" id="HE342751B6CFE4A0D82BDE6B47B86A5DC" display-inline="no-display-inline"> <section id="H54E8602C95BC44C182132CDD79098182"><enum>110A.</enum><header>Digital Economy and Cybersecurity Board of Advisors</header> <subsection id="H867AEE5E6C38448194488C2F93343D5B"><enum>(a)</enum><header>Establishment</header><text>There is established within the NTIA a Digital Economy and Cybersecurity Board of Advisors (in this section referred to as the <quote>Board</quote>).</text></subsection> 
<subsection id="H89ABC11BAAA64F8793F37A190627D5B9" commented="no"><enum>(b)</enum><header>Duties</header><text display-inline="yes-display-inline">The Board shall provide to the Under Secretary recommendations (for implementation by the Under Secretary or that the Under Secretary could recommend for implementation by other appropriate entities) with respect to the following:</text> <paragraph id="HA97308D05FAF44BBBE42357BA3D3F89F" commented="no"><enum>(1)</enum><text>Technical cybersecurity best practices that enable economic growth while securing information and communications networks, including practices that Federal and non-Federal entities can implement to secure internet routing protocols, including the Border Gateway Protocol used by Federal and non-Federal entities.</text></paragraph> 
<paragraph id="H267E649DE71F46DB9EE0FB006EB7C6EE" commented="no"><enum>(2)</enum><text>Cybersecurity policies to support the development and implementation of cybersecurity practices with respect to the internet and information and communications networks.</text></paragraph> <paragraph id="HB5BD2F07B5554D668061D8F19D367FFA" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Policies that foster collaboration through public-private partnerships to promote the security and resilience to cybersecurity incidents of information and communications networks while fostering innovation, including policies that promote secure supply chains for information and communications networks.</text></paragraph> 
<paragraph id="H3759F245FB9C4192A79216A426B3B29F" commented="no"><enum>(4)</enum><text>Policies to remove barriers to trust, security, innovation, and commercialization with respect to information and communications networks.</text></paragraph></subsection> <subsection id="HAEB9425FEAAB4C939F21BA975FC22DEB"><enum>(c)</enum><header>Members</header> <paragraph id="H3C152FA5AF404A7692D86D0128B78C2A"><enum>(1)</enum><header>Composition</header> <subparagraph id="HC90BBA765A6F4B0E881D5677E6A0747D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Board shall be composed of not fewer than 5, and not more than 25, members appointed by the Under Secretary.</text></subparagraph> 
<subparagraph id="HEFDD6FA7F3074B228733597874E47725"><enum>(B)</enum><header>Expertise</header><text>Each member of the Board shall have cybersecurity or supply chain security technical expertise, cybersecurity or supply chain security policy expertise, or expertise in managing or overseeing the cybersecurity or supply chain security functions of a business.</text></subparagraph> <subparagraph id="H11037571C3254698BFFB0FEAEFD6973D" commented="no"><enum>(C)</enum><header>Representation</header><text display-inline="yes-display-inline">In appointing members of the Board under subparagraph (A), the Under Secretary shall ensure that the members appointed provide a balanced representation of the following:</text> 
<clause id="HFA081FBA795743289A7ED5C31CC787C1"><enum>(i)</enum><text display-inline="yes-display-inline">Chief cybersecurity officers or other qualified individuals employed in cybersecurity positions, representing both the public and private sectors.</text></clause> <clause id="HD029AD6AD278440389D03657FAFAC807"><enum>(ii)</enum><text display-inline="yes-display-inline">Persons who operate or maintain information and communications networks, including persons who operate or maintain small or rural information and communications networks.</text></clause> 
<clause id="H5119FB5481484156A85FDD22AE2C355F"><enum>(iii)</enum><text display-inline="yes-display-inline">Vendors that produce or provide equipment used in information and communications networks.</text></clause> <clause id="H369905D4797A47E99D13A95FDD2DA107"><enum>(iv)</enum><text display-inline="yes-display-inline">Vendors that produce or provide software used in information and communications networks.</text></clause> 
<clause id="HDA1243EDAFBE46BB948508435597D963"><enum>(v)</enum><text display-inline="yes-display-inline">Persons who operate or maintain internet applications.</text></clause></subparagraph></paragraph> <paragraph id="HD5DD27217A2A4931B518789659C2D1F2"><enum>(2)</enum><header>Terms</header> <subparagraph id="HFF2C6208EEC6487CBC5357AF9807350E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraphs (C) and (D), each member of the Board shall be appointed for a term of a length not to exceed 2 years, to be determined by the Under Secretary.</text></subparagraph> 
<subparagraph id="H2B64098DFDF74E358D7E38231006289A"><enum>(B)</enum><header>Reappointment</header><text display-inline="yes-display-inline">A member of the Board, including a member appointed to fill a vacancy as provided in subparagraph (D), may be reappointed for 1 or more additional terms by the Under Secretary.</text></subparagraph> <subparagraph id="HBCFCBB3B85834341898E59C10B32CA0E"><enum>(C)</enum><header>Removal</header><text display-inline="yes-display-inline">The Under Secretary may remove a member of the Board at the discretion of the Under Secretary.</text></subparagraph> 
<subparagraph id="H7FC9A6AE372F4FC082CB6E52978E4DED"><enum>(D)</enum><header>Vacancy</header><text display-inline="yes-display-inline">Any member of the Board appointed to fill a vacancy occurring before the expiration of the term for which the predecessor of the member was appointed shall be appointed only for the remainder of such term. A vacancy in the Board shall be filled in the manner in which the original appointment was made.</text></subparagraph></paragraph> <paragraph id="HF594F979918346D4A0BF7C9A2567B405"><enum>(3)</enum><header>Chair</header><text>The Chair of the Board shall be the Associate Administrator of the NTIA for Policy Development and Cybersecurity.</text></paragraph> 
<paragraph id="H872E524D5A6A4CF889FA04085231B2D2"><enum>(4)</enum><header>Compensation</header><text>The members of the Board shall serve without compensation.</text></paragraph></subsection> <subsection id="HF9703F7A9C8340A9811218A4EEE200DD"><enum>(d)</enum><header>Subcommittees</header> <paragraph id="H197A0D6AF87049F1821D5800CF55D6F3"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">Subject to the approval of the Under Secretary, as the Under Secretary determines necessary for the performance by the Board of the duties described in subsection (b), the Board may establish subcommittees, working groups, standing committees, ad hoc groups, task groups, or other subgroups of the Board.</text></paragraph> 
<paragraph id="HDA2D0AFDB18648988672663EA09F4607"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Any subcommittee, working group, standing committee, ad hoc group, task group, or other subgroup of the Board established under paragraph (1)—</text> <subparagraph id="H7B67B5703DA2429E8AB4AB0B073CFFDD"><enum>(A)</enum><text>shall report to the Board; and</text></subparagraph> 
<subparagraph id="HDC186E52A0A84D4E852C6DC9070CA64F"><enum>(B)</enum><text>may not provide any advice, recommendation, or other work product directly to the Under Secretary.</text></subparagraph></paragraph></subsection> <subsection id="H50CA7A4C7A114C7CA6C2DF705BCA7942"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">Notwithstanding section 1013 of title 5, United States Code, the Board shall terminate on the date that is 4 years after the date of the enactment of this section.</text></subsection> 
<subsection id="H3B83DE794BE34192BB3FCC3A0AEC652C"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H6023B46EC45B4E8E8340B68C0BF4E663"><enum>(1)</enum><header>Border Gateway Protocol</header><text>The term <quote>Border Gateway Protocol</quote> means the routing protocol used to exchange network reachability information among independently managed networks on the internet.</text></paragraph> 
<paragraph id="H896CBABD4F68403E90E161F7254E499D"><enum>(2)</enum><header>Information and communications network</header><text>The term <quote>information and communications network</quote> means a network that provides advanced telecommunications capability (as defined in section 706(d) of the Telecommunications Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/47/1302">47 U.S.C. 1302(d)</external-xref>)). </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H295452683A244395BBCEDF50219DD9BC"><enum>404.</enum><header>Cybersecurity literacy</header> <subsection id="HEDC957A4BA4F486886B61A73B1B4E98C"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that the United States has a national security and economic interest in promoting cybersecurity literacy amongst the general public.</text></subsection> 
<subsection id="HBA8476E2630A4A5B85354512DA543DB1"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">The Under Secretary shall develop and conduct a cybersecurity literacy campaign (which shall be available in multiple languages and formats, if practicable) to increase the knowledge and awareness of individuals in the United States with respect to best practices to reduce cybersecurity risks.</text></subsection> <subsection id="HEA010E4D4B934545BB1D55481BBB1507"><enum>(c)</enum><header>Campaign requirements</header><text display-inline="yes-display-inline">In carrying out subsection (b), the Under Secretary shall—</text> 
<paragraph id="H76FCAE0C196A40409935ED30DAD1F537"><enum>(1)</enum><text display-inline="yes-display-inline">educate individuals in the United States on how to prevent and mitigate cyberattacks and cybersecurity risks, including by—</text> <subparagraph id="H991CEFD310F5443BA6022809410BE9FD"><enum>(A)</enum><text>instructing such individuals on how to identify—</text> 
<clause id="HC2EFE79009E74FA48C64F78EFB4364DA"><enum>(i)</enum><text>phishing emails and messages; and</text></clause> <clause id="HF408133F0F3B4C7480DE673D9BA9FF9A"><enum>(ii)</enum><text>secure websites;</text></clause></subparagraph> 
<subparagraph id="HA09832D7B8274EFEBF0713D591C8ED41"><enum>(B)</enum><text display-inline="yes-display-inline">instructing such individuals about the benefits of changing default passwords on hardware and software technology;</text></subparagraph> <subparagraph id="HA2FAA879B8044966B2BADC282BDFB57F"><enum>(C)</enum><text>encouraging the use of cybersecurity tools, including—</text> 
<clause id="H852C07F0C96C4B2A9A1D6F9470FB1739"><enum>(i)</enum><text>multi-factor authentication;</text></clause> <clause id="H694972901C394C6F85BE0F927B733E66"><enum>(ii)</enum><text>complex passwords; </text></clause> 
<clause id="H5C20B47C7856400D8C24E81F6B52F18F"><enum>(iii)</enum><text>anti-virus software;</text></clause> <clause id="H2AAB381E96D54C4DA604BDC6CF6BE11A"><enum>(iv)</enum><text display-inline="yes-display-inline">patching and updating software and applications; and</text></clause> 
<clause id="H27B7143CCA4943D3800EAE3924717D6D"><enum>(v)</enum><text display-inline="yes-display-inline">virtual private networks;</text></clause></subparagraph> <subparagraph id="HF824DFAEEBF04035838D008D2CB961C7"><enum>(D)</enum><text>identifying the devices that could pose possible cybersecurity risks, including—</text> 
<clause id="H783F8EA4A18D4FBDA6E5509C71B0A20D"><enum>(i)</enum><text>personal computers;</text></clause> <clause id="H1D4E358BFF9B4C2DA4CF54EE250ADF7F"><enum>(ii)</enum><text>smartphones;</text></clause> 
<clause id="HE69951FAC6D04AADBF4F22A065C57385"><enum>(iii)</enum><text>tablets;</text></clause> <clause id="H4A5632F9423C4B65B2EDD87E0AAB77CC"><enum>(iv)</enum><text>Wi-Fi routers; </text></clause> 
<clause id="H6B441BDF6B01400FA36F99BA833E03F6"><enum>(v)</enum><text>smart home appliances;</text></clause> <clause id="H284B60FFDC0E4E7AA64C83AA4D0D0195"><enum>(vi)</enum><text display-inline="yes-display-inline">webcams; </text></clause> 
<clause id="HD7C07EF0790B42688EADAE02833C8ABA"><enum>(vii)</enum><text>internet-connected monitors; and</text></clause> <clause id="H201D43B3219A4E3797DD4BE0D128B38F"><enum>(viii)</enum><text>any other device that can be connected to the internet, including mobile devices other than smartphones and tablets;</text></clause></subparagraph> 
<subparagraph id="H5997D2C4B16344D4B1227DA2C54BFBD3"><enum>(E)</enum><text display-inline="yes-display-inline">encouraging such individuals to—</text> <clause id="H478AA010E6854A1C9F4920C1036B59CB"><enum>(i)</enum><text>regularly review mobile application permissions;</text></clause> 
<clause id="H16A72AE4764E458EB7FFB3F9A16F367A"><enum>(ii)</enum><text>decline privilege requests from mobile applications that are unnecessary;</text></clause> <clause id="H6A8FCC4045FE4AA7A1E3C326E2BE487B"><enum>(iii)</enum><text>download applications only from trusted vendors or sources; and </text></clause> 
<clause id="HF8527C967DDE49BB8D9071B401FB56C7"><enum>(iv)</enum><text display-inline="yes-display-inline">consider a product’s life cycle and the developer or manufacturer’s commitment to providing security updates during a connected device’s expected period of use; and</text></clause></subparagraph> <subparagraph id="H0C9E770B9723459A99CDF41D3BCF9894"><enum>(F)</enum><text>identifying the potential cybersecurity risks of using publicly available Wi-Fi networks and the methods a user may utilize to limit such risks; and</text></subparagraph></paragraph> 
<paragraph id="HED720D8984B7466A8AB1DACEF5476ECC"><enum>(2)</enum><text>encourage individuals in the United States to use resources to help mitigate the cybersecurity risks identified in this subsection.</text></paragraph></subsection></section> <section id="H4FA83C08FCEB456E9173A807F270E2A3"><enum>405.</enum><header>Understanding cybersecurity of mobile networks</header> <subsection id="H15282675B3EF4725860DEC9C49685FF4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Under Secretary, in consultation with the Department of Homeland Security, shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report examining the cybersecurity of mobile service networks and the vulnerability of such networks and mobile devices to cyberattacks and surveillance conducted by adversaries.</text></subsection> 
<subsection id="H84D42B4E55C84FF4913B030A1E1358A1"><enum>(b)</enum><header>Matters To be included</header><text>The report required by subsection (a) shall include the following:</text> <paragraph id="H931ED04FB80647E6AD8111C6256D5FD0"><enum>(1)</enum><text>An assessment of the degree to which providers of mobile service have addressed, are addressing, or have not addressed cybersecurity vulnerabilities (including vulnerabilities the exploitation of which could lead to surveillance conducted by adversaries) identified by academic and independent researchers, multistakeholder standards and technical organizations, industry experts, and Federal agencies, including in relevant reports of—</text> 
<subparagraph id="H379BF33388F2448784066D3D933F3F45"><enum>(A)</enum><text>the NTIA;</text></subparagraph> <subparagraph id="H9F8A144A511749FBA00F4208B7C54A49"><enum>(B)</enum><text>the National Institute of Standards and Technology; and</text></subparagraph> 
<subparagraph id="HCA1213D3F1674A4C8904A333FA93C222"><enum>(C)</enum><text>the Department of Homeland Security, including—</text> <clause id="H0A2954F7D9D24F26A613F40D9990A7A6"><enum>(i)</enum><text>the Cybersecurity and Infrastructure Security Agency; and</text></clause> 
<clause id="H5C34F0B7F4C548C3B66FA70AD273B749"><enum>(ii)</enum><text>the Science and Technology Directorate.</text></clause></subparagraph></paragraph> <paragraph id="H4C3F5DA6AF334AA5B8417663E92809E0"><enum>(2)</enum><text>A discussion of—</text> 
<subparagraph id="H85271337D6A54B02A12F66F481D101EE"><enum>(A)</enum><text>the degree to which customers (including consumers, companies, and government agencies) consider cybersecurity as a factor when considering the purchase of mobile service and mobile devices; and</text></subparagraph> <subparagraph id="H3C5162DE5E8F47F887E8855BE1E81F74"><enum>(B)</enum><text display-inline="yes-display-inline">the commercial availability of tools, frameworks, best practices, and other resources for enabling such customers to evaluate cybersecurity risk and price tradeoffs.</text></subparagraph></paragraph> 
<paragraph id="H3B8DAA21D92646ADA6CCD4A46E3DA4FB"><enum>(3)</enum><text>A discussion of the degree to which providers of mobile service have implemented cybersecurity best practices and risk assessment frameworks.</text></paragraph> <paragraph id="H53D31A57C12049608D30F65A01D13D0A"><enum>(4)</enum><text>An estimate and discussion of the prevalence and efficacy of encryption and authentication algorithms and techniques used in each of the following:</text> 
<subparagraph id="HD4737CE654DF4BB0BF3C20846F03BBB2"><enum>(A)</enum><text>Mobile service.</text></subparagraph> <subparagraph id="H4CBD6C9B314D4D01B9009C29C60EF77C"><enum>(B)</enum><text>Mobile communications equipment or services.</text></subparagraph> 
<subparagraph id="H049BBCF8FCF34DBB964A7D78D6BF6FD1"><enum>(C)</enum><text>Commonly used mobile phones and other mobile devices.</text></subparagraph> <subparagraph id="H5AA690245F8F4BF6820D809A45A6242A"><enum>(D)</enum><text>Commonly used mobile operating systems and communications software and applications.</text></subparagraph></paragraph> 
<paragraph id="H9D4669720EB44DE888CDBDB7208221FD"><enum>(5)</enum><text display-inline="yes-display-inline">A discussion of the barriers for providers of mobile service to adopt more efficacious encryption and authentication algorithms and techniques and to prohibit the use of older encryption and authentication algorithms and techniques with established vulnerabilities in mobile service, mobile communications equipment or services, and mobile phones and other mobile devices.</text></paragraph> <paragraph id="HAF3BD2D79E4C472587C35A4F54556A07"><enum>(6)</enum><text display-inline="yes-display-inline">An estimate and discussion of the prevalence, usage, and availability of technologies that authenticate legitimate mobile service and mobile communications equipment or services to which mobile phones and other mobile devices are connected.</text></paragraph> 
<paragraph id="H3223EBDCB96748AC8C32C7FA9C7D5C6C"><enum>(7)</enum><text display-inline="yes-display-inline">An estimate and discussion of the prevalence, costs, commercial availability, and usage by adversaries in the United States of cell site simulators (often known as international mobile subscriber identity catchers) and other mobile service surveillance and interception technologies.</text></paragraph></subsection> <subsection id="HD4A393C597A74A4BA94FFBEDE827B0C4"><enum>(c)</enum><header>Consultation</header><text>In preparing the report required by subsection (a), the Under Secretary shall, to the degree practicable, consult with—</text>

<paragraph id="HE056CBD9D9F449D292CE61FE8083F294"><enum>(3)</enum><text>the intelligence community;</text></paragraph> <paragraph id="H70493DB2781F40359DD3B94A83D671A2"><enum>(4)</enum><text>the Cybersecurity and Infrastructure Security Agency of the Department of Homeland Security;</text></paragraph> 
<paragraph id="H2E59440AEF8147268ED21D63A9803628"><enum>(5)</enum><text>the Science and Technology Directorate of the Department of Homeland Security;</text></paragraph> <paragraph id="HAE366A5AFA924B12AED0DD74E86702F0"><enum>(6)</enum><text>academic and independent researchers with expertise in privacy, encryption, cybersecurity, and network threats;</text></paragraph> 
<paragraph id="H2686F63C6186464BA9E14317D475A137"><enum>(7)</enum><text>participants in multistakeholder standards and technical organizations (including the 3rd Generation Partnership Project and the Internet Engineering Task Force);</text></paragraph> <paragraph id="H5EB9104ED93F458DB23845565C6E80DF"><enum>(8)</enum><text>international stakeholders, in coordination with the Department of State as appropriate;</text></paragraph> 
<paragraph id="HF61AF63ACBDB434AA6474440903D1BE8"><enum>(9)</enum><text display-inline="yes-display-inline">providers of mobile service, including small providers (or the representatives of such providers) and rural providers (or the representatives of such providers);</text></paragraph> <paragraph id="HDCB31BDB31234C3E96441306EB7ECAE8"><enum>(10)</enum><text>manufacturers, operators, and providers of mobile communications equipment or services and mobile phones and other mobile devices;</text></paragraph> 
<paragraph id="HCECF7FE98D2A41119F4648A7049DA1F3"><enum>(11)</enum><text>developers of mobile operating systems and communications software and applications; and</text></paragraph> <paragraph id="H52F084B1E35941868A2483A0CFE872A5"><enum>(12)</enum><text display-inline="yes-display-inline">other experts that the Under Secretary considers appropriate.</text></paragraph></subsection> 
<subsection id="HA47BB5ED4FE44B66A51D4ECC5ABAD5CE"><enum>(d)</enum><header>Scope of report</header><text display-inline="yes-display-inline">The Under Secretary shall—</text> <paragraph id="H7BFCD2C7B7014427A93E60E5D8268D63"><enum>(1)</enum><text>limit the report required by subsection (a) to mobile service networks;</text></paragraph> 
<paragraph id="H397BFC67DDCF4C0F919679FACB88597B"><enum>(2)</enum><text>exclude consideration of 5G protocols and networks in the report required by subsection (a);</text></paragraph> <paragraph id="H2789811A13DB40609599E0FE84F0D195"><enum>(3)</enum><text>limit the assessment required by subsection (b)(1) to vulnerabilities that have been shown to be—</text> 
<subparagraph id="H79B4331EE6DA43DC827BA88D5E485FD8"><enum>(A)</enum><text>exploited in non-laboratory settings; or</text></subparagraph> <subparagraph id="HDA6B149F909C46E5B11587C047FF4441"><enum>(B)</enum><text>feasibly and practicably exploitable in real-world conditions; and</text></subparagraph></paragraph> 
<paragraph id="HC72CCCA0CF0248D08295B008278EF5FB"><enum>(4)</enum><text>consider in the report required by subsection (a) vulnerabilities that have been effectively mitigated by manufacturers of mobile phones and other mobile devices.</text></paragraph></subsection> <subsection id="HCE954B3189954DC1B0C0590F4ACA1F01"><enum>(e)</enum><header>Form of report</header> <paragraph id="H19D517C5FC904453BA02561B985FF1C0"><enum>(1)</enum><header>Classified information</header><text>The report required by subsection (a) shall be produced in unclassified form but may contain a classified annex.</text></paragraph> 
<paragraph id="H66A9BD18BF1344FB992A9CE9E63F48E8" commented="no"><enum>(2)</enum><header>Potentially exploitable unclassified information</header><text display-inline="yes-display-inline">The Under Secretary shall redact potentially exploitable unclassified information from the report required by subsection (a) but shall provide an unredacted form of the report to the committees described in such subsection.</text></paragraph></subsection> <subsection id="H5873570B144847F1BED3D94E0B10CA3A"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H35FF1A8D4BCC476FA244A519BEDC6128"><enum>(1)</enum><header>Adversary</header><text>The term <quote>adversary</quote> includes—</text> <subparagraph id="HC9B1C59040E74E678D89C24820F04BC2"><enum>(A)</enum><text>any unauthorized hacker or other intruder into a mobile service network; and</text></subparagraph> 
<subparagraph id="H87426C403CC44C2E9FC3E19844799A0C"><enum>(B)</enum><text>any foreign government or foreign nongovernment person engaged in a long-term pattern or serious instances of conduct significantly adverse to the national security of the United States or security and safety of United States persons.</text></subparagraph></paragraph> <paragraph id="H9AB297B734504452BEA52358AA86CBA1"><enum>(2)</enum><header>Entity</header><text>The term <quote>entity</quote> means a partnership, association, trust, joint venture, corporation, group, subgroup, or other organization.</text></paragraph> 
<paragraph id="HBFDD155F08894E76A1F1653A9AC01321"><enum>(3)</enum><header>Intelligence community</header><text>The term <quote>intelligence community</quote> has the meaning given that term in section 3 of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3003">50 U.S.C. 3003</external-xref>).</text></paragraph> <paragraph id="HE8C6DACA78D348E78F5B55848411C1B0"><enum>(4)</enum><header>Mobile communications equipment or service</header><text>The term <quote>mobile communications equipment or service</quote> means any equipment or service that is essential to the provision of mobile service.</text></paragraph> 
<paragraph id="HC1D503CC7DFE4613A0CE23316735B1AE"><enum>(5)</enum><header>Mobile service</header><text>The term <quote>mobile service</quote> means, to the extent provided to United States customers, either or both of the following services:</text> <subparagraph id="HF09B622F59224442BBA6BF0F1193E069"><enum>(A)</enum><text>Commercial mobile service (as defined in section 332(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(d)</external-xref>)).</text></subparagraph> 
<subparagraph id="H6E7A9FDD9C7F4957AF8E8476F2CDF87C"><enum>(B)</enum><text>Commercial mobile data service (as defined in section 6001 of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1401">47 U.S.C. 1401</external-xref>)).</text></subparagraph></paragraph> <paragraph id="H1CFDFD88C60342FCB0547EE8D672B159"><enum>(6)</enum><header>Person</header><text>The term <quote>person</quote> means an individual or entity.</text></paragraph> 
<paragraph id="H733C180FBA004B2C997A9CCDA53C8182"><enum>(7)</enum><header>United states person</header><text>The term <quote>United States person</quote> means—</text> <subparagraph id="H351D326EACB94A5FAFFE7B0F57108E8F"><enum>(A)</enum><text>an individual who is a United States citizen or an alien lawfully admitted for permanent residence to the United States;</text></subparagraph> 
<subparagraph id="H075051BDCB354F798A18F34C90A2FF24"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity; or</text></subparagraph> <subparagraph id="H4A72B8FB2E7F44BD83208C48F5859A07"><enum>(C)</enum><text>any person in the United States.</text></subparagraph></paragraph></subsection></section> 
<section id="H81243A026AFD47A7B8444DB0F1020CDA"><enum>406.</enum><header>Open RAN outreach</header> 
<subsection id="HA458083D2B5546389F12CD3E585759EA"><enum>(a)</enum><header>In general</header><text>The Under Secretary shall conduct outreach and provide technical assistance to small communications network providers—</text> <paragraph id="HE01E08D81A644E24AABA5B27B29A58ED"><enum>(1)</enum><text>to raise awareness regarding the uses, benefits, and challenges of Open RAN networks and other open network architectures; and</text></paragraph> 
<paragraph id="H96232C2B71944FC996D3D0BEF203056C"><enum>(2)</enum><text display-inline="yes-display-inline">regarding participation in the grant program established under section 9202(a)(1) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/906">47 U.S.C. 906(a)(1)</external-xref>).</text></paragraph></subsection> <subsection id="H9725718B1EA4499BAD363C55C3E2C053"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H0ACF5AC0E6C64DC182AAEC465D20CA28"><enum>(1)</enum><header>Under Secretary</header><text display-inline="yes-display-inline">The term <term>Under Secretary</term> means the Under Secretary, acting through the head of the Office of Internet Connectivity and Growth.</text></paragraph> <paragraph id="HAF8D9F801A904C55ACB58E9154ECA561"><enum>(2)</enum><header>Open network architecture</header><text display-inline="yes-display-inline">The term <term>open network architecture</term> means Open RAN networks and other network elements that follow a set of published open standards for multi-vendor network equipment interoperability, including open core and open transport.</text></paragraph> 
<paragraph id="H27BE2E86437A46B5842D81164033402E" commented="no"><enum>(3)</enum><header>Open RAN network</header><text display-inline="yes-display-inline">The term <term>Open RAN network</term> means a wireless network that follows the Open Radio Access Network architecture and published open standards for multi-vendor network equipment interoperability.</text></paragraph></subsection></section></title> <title id="HF7601CAC58A14996B8A219328D6950D2"><enum>V</enum><header>Office of Public Safety Communications</header> <section id="H8C1807636A114C74B2EBF31707459C3C"><enum>501.</enum><header>Establishment of the Office of Public Safety Communications</header><text display-inline="no-display-inline">Part A of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/901">47 U.S.C. 901 et seq.</external-xref>), as amended by the preceding provisions of this Act, is further amended by adding at the end the following:</text>

<paragraph id="H15AE2537847A418C868003A310344F37" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">administer any grant program of the Federal Government related to Next Generation 9–1–1 on behalf of the Under Secretary; </text></paragraph> <paragraph id="H292D0F5B3A304BA0A469C4154035E0FA" commented="no"><enum>(2)</enum><text>analyze public safety policy communications issues, including by obtaining such analysis;</text></paragraph> 
<paragraph id="H955A50862E22407489067F015118F140"><enum>(3)</enum><text display-inline="yes-display-inline">provide to the Under Secretary advice and assistance with respect to the Under Secretary—</text> <subparagraph id="H5DE9D8AE101B4F02BE090C60C71DEC0B"><enum>(A)</enum><text>carrying out the responsibilities of the NTIA related to public safety communications policy; and</text></subparagraph> 
<subparagraph id="H8DB5E3D772C64A3BAEEE0BC3A7819EE2"><enum>(B)</enum><text display-inline="yes-display-inline">evaluating the domestic impact of public safety communications matters pending before the Commission, Congress, or other entities of the executive branch of the Federal Government;</text></subparagraph></paragraph> <paragraph id="H0D24BF17F103405A9F5D6C2CD3E87591"><enum>(4)</enum><text>carry out any duties established under section 10 of Department Organizational Order 25–7 of the Department of Commerce titled <quote>National Telecommunications and Information Administration</quote>, effective September 17, 2012;</text></paragraph> 
<paragraph id="H97AF64F821A94DB9A0A0652367AADF60"><enum>(5)</enum><text display-inline="yes-display-inline">be responsible for the oversight of the studies carried out by the Federal Government relating to enhancing public safety communications; </text></paragraph> <paragraph id="HE2BEAA30C01B497DA8D29787D09BDA44"><enum>(6)</enum><text display-inline="yes-display-inline">coordinate with the head of the Institute of Telecommunication Sciences with respect to the initiative established under section 108(b); </text></paragraph> 
<paragraph id="H90307CC1CAAA4F0994EB88006EBFEEA3" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">communicate public safety communications policies to public entities, including the Commission and Congress, or private entities; and</text></paragraph> <paragraph id="HC7D7C259350343C9AD7D8BAAD1055202"><enum>(8)</enum><text display-inline="yes-display-inline">carry out any duties regarding the responsibilities of the NTIA with respect to public safety communications policy as the Under Secretary may designate.</text></paragraph></subsection>

<paragraph id="HEC72FC8249D94D64B456D490CC66B4CA"><enum>(5)</enum><text display-inline="yes-display-inline">in coordination with the Secretary of State, coordinate NTIA and interdepartmental economic, technical, operational, and other preparations related to participation by the United States in international telecommunications and information policy conferences and negotiations;</text></paragraph> <paragraph id="H626B3BE76657467F872DE39F7643CA0E"><enum>(6)</enum><text>ensure NTIA representation with respect to international telecommunications and information policy meetings and the activities related to preparation for such meetings;</text></paragraph> 
<paragraph id="HB4D8918C1B874ABFA3CB169D790ED0A2"><enum>(7)</enum><text>coordinate with Federal agencies and private organizations engaged in activities involving international telecommunications and information policy matters and maintain cognizance of the activities of United States signatories with respect to related treaties, agreements, and other instruments;</text></paragraph> <paragraph id="HDD6C6EB07ABA466A80F01A326DD9E29C"><enum>(8)</enum><text>provide advice and assistance related to international telecommunications and information policy to other Federal agencies charged with responsibility for international negotiations, to strengthen the position and serve the best interests of the United States in the conduct of negotiations with foreign nations;</text></paragraph> 
<paragraph id="H8103227607574950984FE902B70EC3E6"><enum>(9)</enum><text>provide advice and assistance to the Under Secretary with respect to evaluating the international impact of matters pending before the Commission, other Federal agencies, and Congress;</text></paragraph> <paragraph id="HF297785642FB44EFBDCC851684F52471"><enum>(10)</enum><text display-inline="yes-display-inline">carry out, at the request of the Secretary, the responsibilities of the Secretary under the Communications Satellite Act of 1962 (<external-xref legal-doc="usc" parsable-cite="usc/47/701">47 U.S.C. 701 et seq.</external-xref>) and other Federal laws related to international telecommunications and information policy; and</text></paragraph> 
<paragraph id="H26C354ECBC4947A2A11D0CDA7479A049"><enum>(11)</enum><text>carry out any other duties of the NTIA with respect to international telecommunications and information policy that the Under Secretary may designate.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H948B03D7A60B43EFBF75CDC3C0FA99F6"><enum>602.</enum><header>Establishment of interagency national security review process</header> <subsection id="H18303F5511CD451896BBDBC101DDD506"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part A of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/901">47 U.S.C. 901 et seq.</external-xref>), as amended by the preceding provisions of this Act, is further amended by adding at the end the following:</text>

<section id="HAF008E1440734159974DC3782E66FEE2"><enum>110D.</enum><header>Establishment of interagency national security review process</header> 
<subsection id="H9E00A2806F9345FE850BF0FADD49CBA6"><enum>(a)</enum><header>Establishment and transition</header> 
<paragraph id="H3E5458A959E446A19D30CD1DB84054E7"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this section, the Under Secretary, in coordination with the head of each appropriate Federal entity, shall develop and issue procedures for, and establish, an interagency review process (which shall include each appropriate Federal entity) that considers the law enforcement and national security policy implications of the approval of a covered application that may arise from the foreign ownership interests held in the covered applicant that submitted the covered application.</text></paragraph> <paragraph id="H4B13DEA7A4E04456B8DF01DC019A479B" commented="no"><enum>(2)</enum><header>Transition</header><text display-inline="yes-display-inline">Upon establishment of the review process under paragraph (1), the Committee for the Assessment of Foreign Participation in the United States Telecommunications Services Sector, established by Executive Order 13913 (85 Fed. Reg. 19643), shall terminate.</text></paragraph></subsection> 
<subsection id="HBE0CFD24359C43139ACBA429BE7DC93B"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Any covered application pending before the Commission that was submitted by a covered applicant that meets or exceeds the threshold foreign ownership limit is subject to review under the review process established pursuant to subsection (a).</text></subsection> <subsection id="H0609C2E954244CD5808D7D082FCB87B5"><enum>(c)</enum><header>Process and procedural requirements</header> <paragraph id="HDE7F71889D97416A9B93D45E8D11308E"><enum>(1)</enum><header>Referral for review</header> <subparagraph id="H67B59D3401E2437E8EB17E02016E0342"><enum>(A)</enum><header>Requirement for FCC to refer complete application</header><text>The Commission shall refer any covered application subject to the review process established pursuant to subsection (a) to the Under Secretary promptly after the Commission determines that the covered application, under the rules and regulations of the Commission, is complete.</text></subparagraph> 
<subparagraph id="H8AB88F035F0D4ECFA4EAA70B90F705BA"><enum>(B)</enum><header>Referral of other requests</header><text display-inline="yes-display-inline">The Commission may refer for review under the review process established pursuant to subsection (a) any other request for action by the Commission for which the Commission determines review is necessary under such process.</text></subparagraph></paragraph> <paragraph id="HB4805288F7F245ACAB5D8FF3144C8935"><enum>(2)</enum><header>Interagency review deadline; determination</header> <subparagraph id="H1AA17B32A56F4425AA3ED3B4FE62C929"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date on which the Under Secretary receives a referral from the Commission pursuant to paragraph (1)—</text> 
<clause id="H3172026C8CEF429387D09D1370ED7AE6"><enum>(i)</enum><text>the review of the covered application or other request under the review process established pursuant to subsection (a) shall be completed; and</text></clause> <clause id="H072F352B9FAC42C3A1A45D3ACA1AAE92"><enum>(ii)</enum><text display-inline="yes-display-inline">the Under Secretary, in coordination with the head of each appropriate Federal entity, shall make a determination—</text> 
<subclause id="H7EDD3800D79245CAA65A7357D33BE83C"><enum>(I)</enum><text>to recommend to the Commission that the Commission grant, grant conditioned on mitigation, or deny the covered application or other request; or</text></subclause> <subclause id="HA9329CF025D945EEB94D9E77D1394ED6"><enum>(II)</enum><text display-inline="yes-display-inline">that the Under Secretary cannot make a recommendation with respect to the covered application or other request.</text></subclause></clause></subparagraph> 
<subparagraph id="H0B4EC3633ABA45169FA24C670682C736"><enum>(B)</enum><header>Presidential determination</header><text display-inline="yes-display-inline">If the Under Secretary determines under subparagraph (A)(ii)(II) that the Under Secretary cannot make a recommendation with respect to the covered application or other request, the President, not later than 15 days after the Under Secretary makes such determination, shall make a determination to recommend to the Commission that the Commission grant, grant conditioned on mitigation, or deny the covered application or other request.</text></subparagraph> <subparagraph id="H0E1B22E112B747B395C67B2C1EA52A11"><enum>(C)</enum><header>Extension</header><text display-inline="yes-display-inline">The Under Secretary, in coordination with the head of each appropriate Federal entity, may extend the deadline described in subparagraph (A) an additional 45 days.</text></subparagraph> 
<subparagraph id="H20CFB2A66ED6471784E0599A8E070F82"><enum>(D)</enum><header>Notification of extension</header><text display-inline="yes-display-inline">If the Under Secretary, in coordination with the head of each appropriate Federal entity, extends a deadline pursuant to subparagraph (C), the Under Secretary shall provide notice of the extension to the covered applicant or other requesting party, the Commission, Congress, and any executive agency the Under Secretary determines appropriate.</text></subparagraph></paragraph> <paragraph id="H9BD4DD56CCC74B07AD912BC46C6B930F"><enum>(3)</enum><header>Notification of determination</header><text display-inline="yes-display-inline">Not later than 7 days (excepting Saturdays, Sundays, and legal holidays) after the Under Secretary or the President (as the case may be) makes a determination under paragraph (2) to recommend that the Commission grant, grant conditioned on mitigation, or deny the application or other request, the Under Secretary shall notify, in writing, the Commission and the covered applicant or other requesting party of the determination.</text></paragraph> 
<paragraph id="H58372DADEFBE47659D70EFF0FED68BEF" commented="no"><enum>(4)</enum><header>Disclosure of status of review</header><text display-inline="yes-display-inline">Not later than 5 days (excepting Saturdays, Sundays, and legal holidays) after receiving an inquiry from a covered applicant or other requesting party, the Commission, Congress, or an appropriate executive agency (as determined by the Under Secretary) for an update with respect to the status of the review of a relevant covered application or other request that was referred by the Commission for review under the review process established pursuant to subsection (a), the Under Secretary, in coordination with the head of each appropriate Federal entity, shall provide, consistent with the protection of classified information and intelligence sources and methods, a complete and accurate written response to such inquiry.</text></paragraph> <paragraph id="H3DA680A95F66403390BD8DDDCF6A1387"><enum>(5)</enum><header>Standardization of information required</header><text display-inline="yes-display-inline">With respect to the review process established pursuant to subsection (a), the Under Secretary, in coordination with the Commission and the head of each appropriate Federal entity, shall establish a list of questions requesting written information from a covered applicant or other requesting party that shall be made publicly available and posted on the internet website of the NTIA. Such questions shall, to the maximum extent possible, be standardized for any potential covered applicant or other requesting party.</text></paragraph> 
<paragraph id="H6F58779B470B49CA83FDB3D2964E8FAC"><enum>(6)</enum><header>Deadline for provision of information requested</header><text display-inline="yes-display-inline">Not later than 10 days (excepting Saturdays, Sundays, and legal holidays) after the date on which the Under Secretary, in coordination with the head of each appropriate Federal entity, requests information from a covered applicant or other requesting party, the covered applicant or other requesting party shall submit, in writing, to the NTIA complete and accurate responses.</text></paragraph></subsection> <subsection id="H082A8F1A8924411FA418F38AEFBE941E" commented="no"><enum>(d)</enum><header>Confidentiality of information</header> <paragraph id="H5DD825382E5840B59CD5E8E7DD2DF5B5" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), any information or documentary material provided to the Under Secretary under the review process established pursuant to subsection (a) shall be exempt from disclosure under section 552(b)(3)(B) of title 5, United States Code, and no such information or documentary material may be made public.</text></paragraph> 
<paragraph id="HDB0F8F07505D42B68CD77B8E8EDFFB40" commented="no"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) does not prohibit disclosure of the following: </text> <subparagraph id="H9BA382BA4ED442E3A6AA9718D7FAD3B4" commented="no"><enum>(A)</enum><text>Information disclosed for purposes of an administrative or judicial action or proceeding, subject to appropriate confidentiality and classification requirements. </text></subparagraph> 
<subparagraph id="H03506D59758E40A3AEF251AB79D3B2AC" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Information disclosed to Congress or a duly authorized committee or subcommittee of Congress, subject to appropriate confidentiality and classification requirements. </text></subparagraph> <subparagraph id="H302DB06B49714F49BDE12BA4B6BDDFC9" commented="no"><enum>(C)</enum><text>Information disclosed to a domestic governmental entity, or to a foreign governmental entity of a United States ally or partner, under the exclusive direction and authorization of the Under Secretary, only to the extent necessary for national security purposes and subject to appropriate confidentiality and classification requirements, including that confidential information disclosed shall remain confidential. </text></subparagraph> 
<subparagraph id="H27602D3E436245809C65791FC2587FC3" commented="no"><enum>(D)</enum><text>Information disclosed to a third party by mutual agreement of each relevant covered applicant and the Under Secretary, in consultation with appropriate Federal entities.</text></subparagraph></paragraph></subsection> <subsection id="HA0A4359129A94688BFAD7B764E1F4333"><enum>(e)</enum><header>Rule of construction</header><text>Except as provided in subsection (d), nothing in this section may be construed as limiting, superseding, or preventing the invocation of any privileges or defenses that are otherwise available at law or in equity to protect against the disclosure of information.</text></subsection> 
<subsection id="HADF2BEA572E745B1AE3D802762B8632B"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H65E4271B30C6494BAE75B1B86CEFCFE7"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text></paragraph> 
<paragraph id="H3AC930CF08444885A9C23B59B4BC01BC"><enum>(2)</enum><header>Appropriate Federal entities</header><text>The term <term>appropriate Federal entities</term> means the following:</text> <subparagraph id="H505AEA7AA4F549E9853D9F3B5D277992"><enum>(A)</enum><text>The Department of Commerce.</text></subparagraph> 
<subparagraph id="HD38DDD3A7EAE478F89ACEC34CD2EC102"><enum>(B)</enum><text>The Department of Defense.</text></subparagraph> <subparagraph id="H549EE2136DFA47D8A500E32C211608E3"><enum>(C)</enum><text>The Department of Homeland Security.</text></subparagraph> 
<subparagraph id="H3219217BB6464A70AFEEBE242EE89914"><enum>(D)</enum><text>The Department of Justice.</text></subparagraph> <subparagraph id="HBD4952F6C77843A9878CB28B76AB29EB"><enum>(E)</enum><text>The Department of the Treasury.</text></subparagraph> 
<subparagraph id="HC8014D47FE7C46E39AF7AE4574CAA5B3"><enum>(F)</enum><text>The Department of State.</text></subparagraph> <subparagraph id="H756CD760E6B44E22B121E0CAE76DD057"><enum>(G)</enum><text>The United States Trade Representative.</text></subparagraph> 
<subparagraph id="HD1322A71B403431C947E9275CB155080"><enum>(H)</enum><text>The Executive Office of the President.</text></subparagraph> <subparagraph id="HD804598D530A4F03A4E458768B0813E3"><enum>(I)</enum><text display-inline="yes-display-inline">The Office of the Director of National Intelligence.</text></subparagraph></paragraph> 
<paragraph id="HCE2866E04AA64806BC0571B51D6B636D" commented="no"><enum>(3)</enum><header>Classified information</header><text>The term <term>classified information</term> means any information or material that has been determined by the Federal Government pursuant to an Executive order, statute, or regulation, to require protection against unauthorized disclosure for reasons of national security.</text></paragraph> <paragraph id="H66562BF3C7D64AEDB932E24B0A22CA33"><enum>(4)</enum><header>Covered applicant</header><text>The term <term>covered applicant</term> means an entity seeking approval of a covered application from the Commission.</text></paragraph> 
<paragraph id="H339C593A8C15442BAB9E84BF939A0C3D"><enum>(5)</enum><header>Covered application</header> 
<subparagraph id="H8FC14A0760A64AA3B783A36EFDEE0B8B"><enum>(A)</enum><header>In general</header><text>The term <term>covered application</term> means—</text> <clause id="H8727C62BC76D4A9ABA3929C3912DBBA7"><enum>(i)</enum><text display-inline="yes-display-inline">an application under section 214(a) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/214">47 U.S.C. 214(a)</external-xref>) for authorization to undertake the construction of a new line or of an extension of any line, or to acquire or operate any line, or extension thereof, or to engage in transmission over or by means of such additional or extended line;</text></clause> 
<clause id="H773389ADCE5D4F1BB8EBEC23CCEED1BD"><enum>(ii)</enum><text>an application under the Act titled <quote>An Act relating to the landing and operation of submarine cables in the United States,</quote> approved May 27, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/47/34">47 U.S.C. 34 et seq.</external-xref>; 42 Stat. 8) for—</text> <subclause id="HC907E77BDE134BE089FFA302736FC9C4"><enum>(I)</enum><text>a submarine cable landing license; or</text></subclause> 
<subclause id="H5BF954E52E23483DB1C92B66D889B37B"><enum>(II)</enum><text>an assignment, modification, or transfer of control of a submarine cable landing license; or</text></subclause></clause> <clause id="H3153D18BE0E6414B939CFED1196FCCF8"><enum>(iii)</enum><text>an application for a new license, or for the transfer, assignment, or disposal of an existing license under section 310(d) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/310">47 U.S.C. 310(d)</external-xref>), that is—</text> 
<subclause id="H5DB47C3C9A3049B6859471F6BEF82BD1"><enum>(I)</enum><text>subject to approval by the Commission under section 310(b)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/47/310">47 U.S.C. 310(b)(4)</external-xref>); or</text></subclause> <subclause id="H359B62C24B984EA6905646ACD824B72A"><enum>(II)</enum><text display-inline="yes-display-inline">eligible, under the rules of the Commission, for forbearance under section 10 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/47/160">47 U.S.C. 160</external-xref>) from the application of paragraph (3) of section 310(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/47/310">47 U.S.C. 310(b)</external-xref>).</text></subclause></clause></subparagraph> 
<subparagraph id="H0CAF5A2E0BF64B4EA9F7C2D324D6EBCF" commented="no"><enum>(B)</enum><header>Limitation</header><text>The term <quote>covered application</quote> does not include the following:</text> <clause id="H62291568A5C74EF992C1FA9A8EF584CA" commented="no"><enum>(i)</enum><text>An application described in subparagraph (A) with respect to which the applicant seeks to transfer, assign, or otherwise dispose of an authorization or license to an entity that—</text> 
<subclause id="H01E19543DB8A44EAB06DC439FC1C6765" commented="no"><enum>(I)</enum><text>is owned or controlled by such applicant;</text></subclause> <subclause id="H8C4359C552054AA0B80D08B839C86891" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">owns or controls such applicant; or</text></subclause> 
<subclause id="HE989EACB1D384C76ABFF2993B4566B5E" commented="no"><enum>(III)</enum><text>is under common ownership or control with such applicant.</text></subclause></clause> <clause id="H036D345DF4D84C448D939DE996702971" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">An application described in subparagraph (A) with respect to which the applicant—</text> 
<subclause id="H6AA20A3C3CE7490A80833D79C80AFB1E" commented="no"><enum>(I)</enum><text>is an applicant that has been previously approved under the review process established pursuant to subsection (a); and</text></subclause> <subclause id="H349F604D9D0D48E8A30F948F590F61CE" commented="no"><enum>(II)</enum><text>at the time of such application does not have a level of foreign ownership that is more than 10 percent greater than the level of foreign ownership of such applicant—</text> 
<item id="H4FE1AEF064734BA3891A815E0B7A0D46"><enum>(aa)</enum><text>except as provided in item (bb), at any time such applicant was previously approved under the review process established pursuant to subsection (a); or</text></item> <item id="H5EB4AF4894AC422D8D779214A8D43788" commented="no"><enum>(bb)</enum><text display-inline="yes-display-inline">if such applicant has been subjected to the review process established pursuant to subsection (a) as a result of exceeding a level of foreign ownership pursuant to this clause, at the time such applicant was most recently approved under such review process after having been subjected to such review process as a result of exceeding a level of foreign ownership pursuant to this clause.</text></item></subclause></clause> 
<clause id="H2AC33190D6834E97803F77496DC15485"><enum>(iii)</enum><text display-inline="yes-display-inline">An application described in subparagraph (A)(i) that is domestic.</text></clause> <clause id="H841BD2CBA97D47F481BA472D3FE43575"><enum>(iv)</enum><text>An application described in subparagraph (A) with respect to which the foreign ownership interests of the applicant are held by wholly owned intermediate holding companies that are controlled by—</text> 
<subclause id="H93076870F0C245BF966170E52A3A4BEB"><enum>(I)</enum><text>a citizen of the United States; or </text></subclause> <subclause id="H5EA7970B2DD94135814A4EAABF89B91C"><enum>(II)</enum><text>an entity organized under the laws of the United States.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H107D23DF80044889B6B778D35E5EFC4A"><enum>(6)</enum><header>Threshold foreign ownership limit</header><text>The term <term>threshold foreign ownership limit</term> means foreign ownership of, as applicable—</text> <subparagraph id="H72333164D89A407EB8E0A952EF2CD68A"><enum>(A)</enum><text>at least the amount determined by the Commission under section 214(a) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/214">47 U.S.C. 214(a)</external-xref>), in the case of an application described in paragraph (5)(A)(i) of this subsection;</text></subparagraph> 
<subparagraph id="H7C003E584F154D70A9F9BA1DB8124AD3"><enum>(B)</enum><text>any amount, in the case of an application described in paragraph (5)(A)(ii) of this subsection;</text></subparagraph> <subparagraph id="HDEFD818A154B46D2A42F0A1761C64F85" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">at least an amount sufficient for paragraph (3) or (4) of section 310(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/47/310">47 U.S.C. 310(b)</external-xref>) to apply, in the case of an application described in paragraph (5)(A)(iii) of this subsection; or</text></subparagraph> 
<subparagraph id="HE584AB6022C94B57A7681ABFB25D7C08" commented="no"><enum>(D)</enum><text>any amount, in the case of any application described in paragraph (5)(A) of this subsection if the foreign ownership is held by a foreign adversary (as specified in section 7.4 of title 15, Code of Federal Regulations (or a successor regulation)).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HA2FA44C45CA045C2A627C10828FF61E2"><enum>(b)</enum><header>Applicability</header><text>This section, and the amendment made by this section, shall apply to any covered application (as such term is defined in section 110D of the National Telecommunications and Information Administration Organization Act, as added by subsection (a)) filed on or after the date on which the review process is established pursuant to such section 110D.</text></subsection></section></title>
