<section id="HC92FA57AF81744E396F9D4E6B3EEF0CB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veteran Fraud Reimbursement Act</short-title></quote>. </text></section> <section id="H70770448B06842FA8E7998225A723204" section-type="subsequent-section"><enum>2.</enum><header>Improvement to repayment by Secretary of Veterans Affairs of certain misused benefits</header><text display-inline="no-display-inline">Section 6107 of title 38, United States Code, is amended to read as follows:</text>

<section id="HB84D5E828461442085BE88F8724E48F7"><enum>6107.</enum><header>Reissuance of benefits</header>
<subsection id="H2EAB49CD04BE40359A84C5019254DBC8"><enum>(a)</enum><header>Reissuance of misused benefits</header>
<paragraph commented="no" display-inline="yes-display-inline" id="HC39282EC0D544C08B46700456BD9E56E"><enum>(1)</enum><text>In any case in which a fiduciary misuses all or part of an individual’s benefit paid to such fiduciary, the Secretary shall pay to the beneficiary or the beneficiary’s successor fiduciary an amount equal to the amount of such benefit so misused.</text></paragraph> <paragraph id="H640D50B6571C480C9EAD77DF8D137176" indent="up1"><enum>(2)</enum><text>In any case in which the Secretary reissues a benefit payment (in whole or in part) under paragraph (1), the Secretary shall make a good faith effort to obtain recoupment from the fiduciary to whom the payment was originally made.</text></paragraph>
<paragraph id="HA4B47C8983E04E63A337DA083FBE65B9" indent="up1"><enum>(3)</enum><text>In any case in which the Secretary obtains recoupment from a fiduciary who has misused benefits, the Secretary shall promptly remit payment of the recouped amounts to the beneficiary or the beneficiary’s successor fiduciary, as the case may be, to the extent that such amounts have not been paid under paragraph (1).</text></paragraph></subsection> <subsection id="H51116720B9714A8B83574BFB24C38DC5"><enum>(b)</enum><header>Limitation on total amount paid</header><text display-inline="yes-display-inline">The total of the amounts paid to a beneficiary or the beneficiary's successor fiduciary under this section may not exceed the total benefit amount misused by the fiduciary with respect to that beneficiary.</text></subsection>
<subsection id="H8D5BD26FA75A462C9E8C45A4CE00834B"><enum>(c)</enum><header>Oversight of negligence</header>
<paragraph commented="no" display-inline="yes-display-inline" id="H440457BF9C8E48FEAD52E179DDC3877E"><enum>(1)</enum><text>The Secretary shall establish methods and timing with respect to determining whether an instance of misuse by a fiduciary, of all or part of an individual’s benefit paid to such fiduciary, is the result of negligence by the Secretary.</text></paragraph> <paragraph id="H31B2E31BD9BA42DC84AB5C28FD242978" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may not withhold the reissuing of a benefit payment under subsection (a)(1) by reason of a pending determination under paragraph (1).</text></paragraph>
