Health Service Act to reauthorize the program of payments to children’s hospitals that operate graduate medical education programs, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HIF00" reported-display-style="italic" id="H49FECA86E56E4409A7CB14289E2FD8DA"><section id="HB3C4B0E88F974107BBD4022E697734D2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Children’s Hospital GME Support Reauthorization Act of 2023</short-title></quote>.</text></section><section id="H33E449C2178346E09EDF7DDCFD6A955C"><enum>2.</enum><header>Program of payments to children's hospitals that operate graduate medical education programs</header><text display-inline="no-display-inline">Section 340E of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/256e">42 U.S.C. 256e</external-xref>) is amended—</text><paragraph id="H15AC947D05634CCCB8DB58546C9A579D"><enum>(1)</enum><text>in subsection (a), by striking <quote>2023</quote> and inserting <quote>2028</quote>;</text></paragraph><paragraph commented="no" id="HF6F868BE716444ACA8B858DC6910EB29"><enum>(2)</enum><text>in subsection (b)(3)(D), by inserting <quote>and the end of fiscal year 2028,</quote> after <quote>fiscal year 2022,</quote>;</text></paragraph><paragraph id="HC7A53C94744945278E88BD8374742096"><enum>(3)</enum><text>in subsection (e), by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H4A268739F1C44E6C8447A03888F11DA6" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="H683597DCEFA14D8FB42B9E718F3D7F35"><enum>(4)</enum><header>Prohibition on payments to hospitals furnishing specified procedures and drugs to minors</header><subparagraph id="HAE71B3996BCE4E4DBAFAD9AD9E28A125"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, no payment may be made under this section to a children’s hospital for a fiscal year (beginning with fiscal year 2024) if, at any point during the preceding fiscal year, such hospital furnished specified procedures and drugs (as defined in subsection (g)) to an individual under 18 years of age.</text></subparagraph><subparagraph id="H80F18DA6AD404B0998EF7826BA4B2A8D"><enum>(B)</enum><header>Special rule for fiscal year 2024</header><text>In applying subparagraph (A) with respect to payments described in such subparagraph for fiscal year 2024—</text><clause id="H3BF77F57A1B4412FB935F067912BFC69"><enum>(i)</enum><text>the reference to <quote>for a fiscal year</quote> shall be treated as a reference to <quote>for any portion of fiscal year 2024 occurring after December 31, 2023</quote>; and </text></clause><clause id="H4CFFC83580C443C98BCD4A69306FAEA2"><enum>(ii)</enum><text>the reference to <quote>the preceding fiscal year</quote> shall be treated as a reference to <quote>the period beginning on September 1, 2023, and ending on December 31, 2023</quote>.</text></clause></subparagraph><subparagraph id="H4B537043C49348CE89A388CA986298E8"><enum>(C)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be construed as prohibiting payments for a fiscal year (or, in the case of payments for fiscal year 2024, during the portion of such fiscal year described in subparagraph (B)(i)) to a hospital that, during the preceding fiscal year (or, in the case of payments for fiscal year 2024, during the period described in subparagraph (B)(ii)), furnished mental or behavioral health services to individuals under 18 years of age for the treatment of gender dysphoria not consisting of specified procedures and drugs.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H4595E9D581244CA091A974D0BFCA15E5"><enum>(4)</enum><text>in subsection (f)—</text><subparagraph id="HA4CE95611E77451C8AB8DAFC890E2F7A"><enum>(A)</enum><text>in paragraph (1)(A)—</text><clause id="H50832D25D1904C78B234D5BA0D74FBEA"><enum>(i)</enum><text>in clause (v), by striking <quote>and</quote> at the end;</text></clause><clause id="H9DF67A9D90464694BD3C84FBAA83641E"><enum>(ii)</enum><text>in clause (vi), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="H6910C7E0FF1743B88553BED9A2B2B96B"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H1B046F23C11F425FA55B42B1CD0C867F" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><clause id="H0E52BF0DCDE54B35B47AEAB01380BCF2"><enum>(vii)</enum><text display-inline="yes-display-inline">for each of fiscal years 2024 through 2028, $124,000,000.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H52D1544711E54D9091600EF6053A4A5A"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H1AA167DFC05045EE92081F769263E509"><enum>(i)</enum><text>in subparagraph (E), by striking <quote>and</quote> at the end;</text></clause><clause id="H6E3D9640D14E465CA7B4CA26F424EBDD"><enum>(ii)</enum><text>in subparagraph (F), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="H77EFFB9F4C024F468FD5F67B1B10717B"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HAB656C6577184F28B92D5B14BF9C5041" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><subparagraph id="H94FA160FDBD447CC9D80E4F40B80B725"><enum>(G)</enum><text display-inline="yes-display-inline">for each of fiscal years 2024 through 2028, $261,000,000.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="H921DEF59474040F0B82EFE9F4D449E2C"><enum>(5)</enum><text>in subsection (g), by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H7AC5E4F9DC5045C69780278BB18F1246" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="H258A7B193EF94CEE8A18F6FDE668B243"><enum>(4)</enum><header>Specified procedures and drugs</header><subparagraph id="H3DFD60AA85064E0EB318549FF69E7D65"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the term <term>specified procedures and drugs</term> means, with respect to an individual, any of the following:</text><clause id="HA0A4F647F92B47A4B4A9FF007CD7180D"><enum>(i)</enum><text display-inline="yes-display-inline">Performing any surgery for the purpose of changing the body of such individual to correspond to a sex that differs from their biological sex, including—</text><subclause id="H9D53F887121442FC89924B25DD273578"><enum>(I)</enum><text>castration;</text></subclause><subclause id="H92261159591445E3AA01C6B4A6C74170"><enum>(II)</enum><text>orchiectomy;</text></subclause><subclause id="H1F6F0826A00C42DEA63962229DBFFC09"><enum>(III)</enum><text>scrotoplasty;</text></subclause><subclause id="HA101238B802E478585D70D11542904DC"><enum>(IV)</enum><text>vasectomy;</text></subclause><subclause id="H76DB8ACCFADC48B5903290E49A125A43"><enum>(V)</enum><text>hysterectomy;</text></subclause><subclause id="HCCD5759961B14627B38A131024EB97A1"><enum>(VI)</enum><text>oophorectomy;</text></subclause><subclause id="H5AA3ED871FA04A4EA4FCB8922E04EB5F"><enum>(VII)</enum><text>ovariectomy;</text></subclause><subclause id="H78DEC6732E314AE8A1E98783ADC193AE"><enum>(VIII)</enum><text>metoidioplasty; </text></subclause><subclause id="H03CA800CB1F5439391DC2ED5B2987C1B"><enum>(IX)</enum><text>penectomy; </text></subclause><subclause id="H6F910188A304453A9B17E6A89EE63246"><enum>(X)</enum><text>phalloplasty; </text></subclause><subclause id="H83ECF1A12444404C82D3A39244228949"><enum>(XI)</enum><text>vaginoplasty; </text></subclause><subclause id="H7815A0F12B8C4857974312BA5B049C90"><enum>(XII)</enum><text>vaginectomy; </text></subclause><subclause id="H1617550B59CC4CEE8F1DE8CDB75B4A15"><enum>(XIII)</enum><text>vulvoplasty; </text></subclause><subclause id="HF792572DF70A421288D40E56931E35A4"><enum>(XIV)</enum><text>reduction thyrochondroplasty;</text></subclause><subclause id="HC6AFD497570D4AE884253396049A39A6"><enum>(XV)</enum><text>chondrolaryngoplasty; and</text></subclause><subclause id="H87984D1EAFEE4916BA795D4246BFC2BC"><enum>(XVI)</enum><text>mastectomy.</text></subclause></clause><clause id="H071249F9506F476981D1B6920A0E6296"><enum>(ii)</enum><text>Any plastic surgery that feminizes or masculinizes the facial features for the purposes described in clause (i).</text></clause><clause id="HC66FAF5270364DF7B5390F72AF7FFBB5"><enum>(iii)</enum><text display-inline="yes-display-inline">Any placement of chest implants to create feminine breasts for the purposes described in clause (i).</text></clause><clause id="H60134E1BC7754246907723AC49D3B2CA"><enum>(iv)</enum><text display-inline="yes-display-inline">Any placement of fat or artificial implants in the gluteal region for the purposes described in clause (i).</text></clause><clause id="H4C17EA1BEDEF4316A47C0BB6D079531F"><enum>(v)</enum><text display-inline="yes-display-inline">Administering, supplying, prescribing, dispensing, distributing, or otherwise conveying to an individual medications for the purposes described in clause (i), including—</text><subclause id="H9BD535BB776342CB9F149B5DEE75C39B"><enum>(I)</enum><text>gonadotropin-releasing hormone (GnRH) analogues or other puberty-blocking drugs to stop or delay normal puberty;</text></subclause><subclause id="H4A2BB5B2A7644331809F1CE1FA8FDC28"><enum>(II)</enum><text>testosterone or other androgens to biological females at doses that are supraphysiologic to the female sex; and</text></subclause><subclause id="HBEA174ED69EA4C0BB5C81C5D8F75FD33"><enum>(III)</enum><text>estrogen to biological males at doses that are supraphysiologic to the male sex.</text></subclause></clause></subparagraph><subparagraph id="H5BD4F8DAABC246D1AC047753A2E036F7"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply to the following individuals:</text><clause id="H9B3C878F644F4530BD11D35880E8C7EE"><enum>(i)</enum><text display-inline="yes-display-inline">An individual with both ovarian and testicular tissue.</text></clause><clause id="H1FDA287051ED48CC94D13F449618D3F4"><enum>(ii)</enum><text>An individual with respect to whom a physician has determined through genetic or biochemical testing that the individual does not have normal sex chromosome structure, sex steroid hormone production, or sex steroid hormone action.</text></clause><clause id="H200AE5B421AD4EFDB847D15FB494C9EC"><enum>(iii)</enum><text>An individual experiencing infection, disease, injury, or disorder caused or exacerbated by previous medical procedures as defined in subsection (g)(4)(A).</text></clause><clause id="HB98C0C0AA3974981B8233DDB78F3E0F6"><enum>(iv)</enum><text>An individual suffering from a physical disorder, physical injury, or physical illness that would, as certified by a physician, place the individual in imminent danger of death or impairment of a major bodily function unless the procedure is performed.</text></clause></subparagraph><subparagraph id="HDB414ABD09244F92B06D210D6B7473E9" display-inline="no-display-inline"><enum>(C)</enum><header>Biological sex</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the term <term>biological sex</term> means the indication of male or female sex by reproductive potential or capacity, sex chromosomes, naturally occurring sex hormones, gonads, or internal or external genitalia present at birth.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><endorsement display="yes"><action-date date="20241120">November 20,
