<section id="HC2D7FFA65CEC498DA799F5614781E5BC" section-type="subsequent-section"><enum>101.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Accreditation for College Excellence Act of 2024</short-title></quote>.</text></section> <section id="H2099719153984CC58AF456AD52F62DFC" section-type="subsequent-section"><enum>102.</enum><header>Prohibition on political litmus tests in accreditation of institutions of higher education</header> <subsection id="HEA687E86ED1D42DBA91552BD45445D4C"><enum>(a)</enum><header>Operating procedures required</header><text display-inline="yes-display-inline">Section 496(c) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1099b">20 U.S.C. 1099b(c)</external-xref>) is amended—</text> 
<paragraph id="HCC9ED350486B4CD6B779A45212623766"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (8);</text></paragraph> <paragraph id="H8C898F0B429E4CC692727D36DD9AF91F"><enum>(2)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; and</quote>; and </text></paragraph> 
<paragraph id="H234DB2E6DB734E7CBC4A061282FC48E5"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HE08377E3AEF14BCE8B84B04690B7E881" display-inline="no-display-inline"> <paragraph id="H5A7AEFDF9D85450A8A05B50FBD2361C2"><enum>(10)</enum><text display-inline="yes-display-inline">confirms that the standards for accreditation of the agency or association do not—</text> 
<subparagraph id="HB0BEF4ED6A9C4C379933AFA6352EC59D"><enum>(A)</enum><text>except as provided in subparagraph (B)—</text> <clause id="H11E3997F86E9493CAE6B8F1A1A85F1A6"><enum>(i)</enum><text display-inline="yes-display-inline">require, encourage, or coerce any institution to—</text> 
<subclause id="HEA67054644A14E3E91D018B4075B08B1"><enum>(I)</enum><text>support, oppose, or commit to supporting or opposing—</text> <item id="H7A00EFBCDC2F4F30B086A5F94DC30569" display-inline="no-display-inline"><enum>(aa)</enum><text display-inline="yes-display-inline"> a specific partisan, political, or ideological viewpoint or belief or set of such viewpoints or beliefs; or</text></item> 
<item id="H5CBD85DED8DA499883B071A179C5755B"><enum>(bb)</enum><text>a a specific viewpoint or belief or set of viewpoints or beliefs on social, cultural, or political issues; or</text></item></subclause> <subclause id="H1BF1DCF3D65947E18A74735EAC33A82F"><enum>(II)</enum><text display-inline="yes-display-inline">support or commit to supporting the disparate treatment of any individual or group of individuals on the basis of any protected class under Federal civil rights law, except as required by Federal law or a court order; or</text></subclause></clause> 
<clause id="H4C8A2324E0454EC4B44A62A1FBCA5B5D"><enum>(ii)</enum><text display-inline="yes-display-inline">assess an institution’s or program of study’s commitment to any ideology, belief, or viewpoint;</text></clause></subparagraph> <subparagraph id="H28C86F0DE19F4C20820CBD71CA3D579C" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">prohibit an institution—</text> 
<clause id="H5142A7D238F44703B86EAE5B5DBD41D3"><enum>(i)</enum><text display-inline="yes-display-inline">from having a religious mission, operating as a religious institution, or being controlled by a religious organization (in a manner described in paragraph (1), (2), (3), (4), (5), or (6) of section 106.12(c) of title 34, Code of Federal Regulations (as in effect on the date of the enactment of this paragraph)), or from requiring an applicant, student, employee, or independent contractor (such as an adjunct professor) of such an institution to—</text> <subclause id="H4CCFEC8631064116AE2C00FD264E5DED" commented="no"><enum>(I)</enum><text>provide or adhere to a statement of faith; or</text></subclause> 
<subclause id="HDAB4FDDE86D14F19902BE8AE0DAC8C66" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">adhere to a code of conduct consistent with the stated religious mission of such institution or the religious tenets of such organization; or</text></subclause></clause> <clause id="H04D17FB43DA94F34B0E98DFBB47C36A9"><enum>(ii)</enum><text>from requiring an applicant, student, employee, or contractor to take an oath to uphold the Constitution of the United States; or</text></clause></subparagraph> 
<subparagraph id="H2A44795F436241E7A6D55BDF89E1212E"><enum>(C)</enum><text display-inline="yes-display-inline">require, encourage, or coerce an institution of higher education to violate any right protected by the Constitution.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H9E8797B90DE646E493DC73ED47A39446" commented="no"><enum>(b)</enum><header>Limitation on scope of criteria</header><text display-inline="yes-display-inline">Section 496(g) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1099b">20 U.S.C. 1099b(g)</external-xref>) is amended to read as follows:</text>

<subsection id="H608E7EF6BDD74AF89BC49F9B01F7D7E7"><enum>(g)</enum><header>Limitation on scope of criteria</header> 
<paragraph id="HE145AF9C748E41CA870F5FA9480B0304"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall not establish criteria for accrediting agencies or associations that are not required by this section.</text></paragraph> <paragraph id="H6DDC53E25D1D42B0A7E3D15C3345F9D4"><enum>(2)</enum><header>Institutional eligibility</header><text display-inline="yes-display-inline">An institution of higher education shall be eligible for participation in programs under this title if the institution is in compliance with the standards of its accrediting agency or association that assess the institution in accordance with subsection (a)(5), regardless of any additional standards adopted by the agency or association for purposes unrelated to participation in programs under this title.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection></section> 
<section id="H4766A6E1C86F4274873C06E41D05BA97" display-inline="no-display-inline" section-type="subsequent-section"><enum>103.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this title prevents religious accreditors from holding and enforcing religious standards on institutions they choose to accredit.</text></section></title> <title id="H50A4E5365981436E92303A849F62B4B9"><enum>II</enum><header>Respecting the First Amendment on Campus</header> <section id="H9D979C4C05F443DA8FFD8820BABFD237" section-type="subsequent-section" commented="no"><enum>201.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Respecting the First Amendment on Campus Act</short-title></quote>. </text></section> 
<section id="HF19D4FB7FD684FCB8AF8CB8E5A00B693"><enum>202.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">The Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>) is amended by inserting after section 112 the following new section:</text> <quoted-block style="OLC" id="H6F12E0C5F2B44A6DA5FD2CDA903AB7A3" display-inline="no-display-inline"> <section id="H869DFED2852345098F8E41CC15CFF9B5"><enum>112A.</enum><header>Sense of Congress; construction; definition</header> <subsection id="H344DF76D72684E34AE5C6F761EDBA927"><enum>(a)</enum><header>Sense of Congress</header> <paragraph id="H4C3B28944511474F8B3EEDC8F4860E0E"><enum>(1)</enum><header>Adoption of Chicago Principles</header><text display-inline="yes-display-inline">The Congress—</text> 
<subparagraph id="H132AC4E6F59142B7BFFA49964C8282DB"><enum>(A)</enum><text display-inline="yes-display-inline">recognizes that free expression, open inquiry, and the honest exchange of ideas are fundamental to higher education;</text></subparagraph> <subparagraph id="HD271A013EF0C4AC680AD94D6C3054C89"><enum>(B)</enum><text>acknowledges the profound contribution of the Chicago Principles to the freedom of speech and expression; and</text></subparagraph> 
<subparagraph id="H7589EE5D631446F7A14B8E0AF6E90A86"><enum>(C)</enum><text>calls on nonsectarian institutions of higher education to adopt the Chicago Principles or substantially similar principles with respect to institutional mission that emphasizes a commitment to freedom of speech and expression on university campuses and to develop and consistently implement policies accordingly.</text></subparagraph></paragraph> <paragraph id="HB73B8C5034CD49C592F8F40A5B32F68E"><enum>(2)</enum><header>Political litmus tests</header><text display-inline="yes-display-inline">The Congress—</text> 
<subparagraph id="H8398CF1AFCA9439DBFCED7AF0E7E7F6A"><enum>(A)</enum><text display-inline="yes-display-inline">condemns public institutions of higher education for conditioning admission to any student applicant, or the hiring, reappointment, or promotion of any faculty member, on the applicant or faculty member pledging allegiance to or making a statement of personal support for or opposition to any political ideology or movement, including a pledge or statement regarding diversity, equity, and inclusion, or related topics; and</text></subparagraph> <subparagraph id="H7EA8C258F605484CA0E3E41259410CDE"><enum>(B)</enum><text display-inline="yes-display-inline">discourages any institution from requesting or requiring any such pledge or statement from an applicant or faculty member, as such actions are antithetical to the freedom of speech protected by the First Amendment to the Constitution.</text></subparagraph></paragraph></subsection> 
<subsection id="HD891227152184CA9BC61DF4F800660D8"><enum>(b)</enum><header>Construction</header><text display-inline="yes-display-inline">Nothing in sections 112B through 112E shall be construed to infringe upon, or otherwise impact, the protections provided to individuals under titles VI and VII of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>).</text></subsection> <subsection id="H18FF69BD8DFC41B28B0BC6FA7DD34BCF"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of sections 112C, 112D, and 112E, the term <quote>covered public institution</quote> means an institution of higher education that is—</text> 
<paragraph id="H68D1A76472FB4A0987008CB58D657B8B"><enum>(1)</enum><text>a public institution; and</text></paragraph> <paragraph id="HC5CA0F1E707B4C129BF86A1633E88B2F"><enum>(2)</enum><text>participating in a program authorized under title IV.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H9A301490D2DE41B59A1982B6AA24ACD1"><enum>203.</enum><header>Disclosure of free speech policies</header><text display-inline="no-display-inline">The Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>), as amended by section 202 of this title, is further amended by inserting after section 112A the following new section:</text> <quoted-block style="OLC" id="H52C963FB21AA4EEAB8C51129F672FB31" display-inline="no-display-inline"> <section id="H9BCB818D0B794F0C851C4B3030A4716E"><enum>112B.</enum><header>Disclosure of policies related to freedom of speech, association, and religion</header> <subsection id="H27A86B9685304152904DD53F41E98F62"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">No institution of higher education shall be eligible to participate in any program under title IV unless the institution certifies to the Secretary that the institution has annually disclosed to current and prospective students and faculty—</text> 
<paragraph id="H4B3DAEA232544CBD9FC4222A757D97B7"><enum>(1)</enum><text>any policies held by the institutions related to—</text> <subparagraph id="H2AF7124211994BD0B136BEBBE93F241F"><enum>(A)</enum><text>speech on campus, including policies limiting—</text> 
<clause id="H525904AE6F194EBF9278702C7B1C9E84"><enum>(i)</enum><text>the time when such speech may occur;</text></clause> <clause id="HB0708D4867A94DC4ACF6BF7984C25FFD"><enum>(ii)</enum><text>the place where such speech may occur; or</text></clause> 
<clause id="HB85A868A065A47D88FD38DF26AE4A86D"><enum>(iii)</enum><text>the manner in which such speech may occur;</text></clause></subparagraph> <subparagraph id="HF94D02992F9442ED8B7B51903ADBE8FE"><enum>(B)</enum><text>freedom of association, if applicable; and</text></subparagraph> 
<subparagraph id="HD234AACCA9DF4FCABCC3963EBE629687"><enum>(C)</enum><text>freedom of religion, if applicable; and</text></subparagraph></paragraph> <paragraph id="H81038E3D63F94C20B051AF6B7985F1D4"><enum>(2)</enum><text display-inline="yes-display-inline">the right to a cause of action under section 112E, if the institution is a public institution.</text></paragraph></subsection> 
<subsection id="H931499B23A9E49AFA662FD5292C5C70D"><enum>(b)</enum><header>Intended beneficiaries</header><text display-inline="yes-display-inline">The certification specified in subsection (a) shall include an acknowledgment from the institution that the students and faculty are the intended beneficiaries of the policies disclosed in the certification.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></section> <section id="H957926DE3CC84214A43D0D9A9ABAB6C7"><enum>204.</enum><header>Freedom of association and religion</header><text display-inline="no-display-inline">The Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>), as amended by section 203 of this title, is further amended by inserting after section 112B the following new section:</text>

<section id="HC05703833EAD482CA4AB94C503241C58"><enum>112C.</enum><header>Freedom of association and religion</header> 
<subsection id="H5A7E92CEAF9A420FB26619135D43FFC7"><enum>(a)</enum><header>Students’ bill of rights to further protect speech and association</header> 
<paragraph id="H8856773DF0E54B258EE6786AB9D49940"><enum>(1)</enum><header>Protected rights</header><text display-inline="yes-display-inline">A covered public institution shall comply with the following requirements:</text> <subparagraph id="H2C4A283446CF4B0998FA743BFE2395C5"><enum>(A)</enum><header>Recognized student organizations</header><text display-inline="yes-display-inline">A covered public institution that has recognized student organizations shall comply with the following requirements:</text> 
<clause id="H81F9DB3C79CA44E0BA90D0C974AF5E5E"><enum>(i)</enum><header>Faculty advisors</header> 
<subclause id="H518625F0DC424334B4A7285B3EC78702"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">A covered public institution may not deny recognition to a student organization because the organization is unable to obtain a faculty advisor or sponsor, if the organization meets each of the other content- and viewpoint-neutral institutional requirements for such recognition.</text></subclause> <subclause id="HE969BC7ABE2D425AAF6B711A05002E49"><enum>(II)</enum><header>Alternative</header><text>An institution described in subclause (I) shall ensure that any policy or practice related to the recognition of a student organization—</text> 
<item id="H86AA53257F0945288758EE62AB87F4FD"><enum>(aa)</enum><text display-inline="yes-display-inline">in the case of an organization that meets each of the other content- and viewpoint-neutral institutional requirements for such recognition but is unable to obtain a faculty advisor or sponsor, provides for an alternative to any requirement that a faculty or staff member serve as the faculty advisor or sponsor as a condition for recognition of the student organization, which alternative may include—</text> <subitem id="H2605F09F95FE480E9AECE1C899E4FE03"><enum>(AA)</enum><text>waiver of such requirement; or</text></subitem> 
<subitem id="H52B999C7824643C19E712F0E4523F168"><enum>(BB)</enum><text>the institution assigning a faculty or staff member to such organization; and</text></subitem></item> <item id="HF2CD2B4425A645F593AC3CE7B7E2DCF2"><enum>(bb)</enum><text display-inline="yes-display-inline">does not require a faculty or staff member of the institution assigned to serve as faculty advisor pursuant to item (aa)(BB) to participate in, or support, the organization other than by performing the purely administrative functions required of a faculty advisor. </text></item></subclause></clause> 
<clause id="H586D9F0200E44165A31600DADDFF94C1" commented="no"><enum>(ii)</enum><header>Appeal options for recognition</header> 
<subclause id="H88DCED9C91A144A3928A0E6BFA811D3E"><enum>(I)</enum><header>In general</header><text>A covered public institution shall provide an appeals process by which a student organization that has been denied recognition by the institution may appeal to an institutional appellate entity for reconsideration.</text></subclause> <subclause id="H8E66C2CB9840459A90F2C44256DE3318"><enum>(II)</enum><header>Requirements</header><text>The appeal process shall—</text> 
<item id="HE7CE3AF5D7884A43B09FE0D21999D842"><enum>(aa)</enum><text display-inline="yes-display-inline">require the covered public institution to provide a written explanation for the basis for the denial of recognition in a timely manner, which shall include a copy of all policies relied upon by the institution as a basis for the denial; </text></item> <item id="H4CF1BE7937EB4261AB3BA99D1E973AE5"><enum>(bb)</enum><text display-inline="yes-display-inline">require the covered public institution to provide written notice to the students seeking recognition of the appeal process and the timeline for hearing and resolving the appeal; </text></item> 
<item id="H8EACD9D80840492C8900DD323830FAA4"><enum>(cc)</enum><text display-inline="yes-display-inline">allow the students seeking recognition to obtain outside counsel to represent them during the appeal; and</text></item> <item id="HEC1D32385804400FBE41AD3B84C6E966"><enum>(dd)</enum><text>ensure that such appellate entity did not participate in any prior proceeding related to the denial of recognition to the student organization.</text></item></subclause></clause></subparagraph> 
<subparagraph id="HC5A6BC939DBB491386C40992931CABE5"><enum>(B)</enum><header>Distribution of funds to student organizations</header><text display-inline="yes-display-inline">A covered public institution that collects a mandatory fee from students for the costs of student activities or events (or both), and provides funds generated from such student fees to one or more recognized student organizations of the institution, shall—</text> <clause id="H829818233FAB4AD5948C5D15C0C00BEA"><enum>(i)</enum><text>establish and make publicly available clear, objective, content- and viewpoint-neutral, and exhaustive standards to be used by the institution to determine—</text> 
<subclause id="H7AC94CBD1D4A4FF4B62DC4CA2BDA9B3A"><enum>(I)</enum><text>the total amount of funds made available for allocations to the recognized student organizations; and</text></subclause> <subclause id="H230C36C794214AE4819483BDC8978EAA"><enum>(II)</enum><text>the allocations of such total amount to individual recognized student organizations; </text></subclause></clause> 
<clause id="H8C860F20E4D44D46922C571E8B774C2B"><enum>(ii)</enum><text>ensure that allocations are made to the recognized student organizations in accordance with the standards established pursuant to clause (i);</text></clause> <clause id="H57E3DA349467437FAAF2685AC4F0BAA7" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">upon the request of a recognized student organization that has been denied all or a portion of an allocation described in clause (ii), provide to the organization, in writing (which may include electronic communication) and in a timely manner, the specific reasons for such denial, copies of all policies relied upon by the institution as basis for the denial, and information of the appeals process described in clause (iv); and</text></clause> 
<clause id="H10024D0562BD4DB1B85E1634E8DDDAD9" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">provide an appeals process by which a recognized student organization that has been denied all or a portion of an allocation described in clause (ii) may appeal to an institutional appellate entity for reconsideration, which appeals process—</text> <subclause id="H7956F829624845BD9C2D073617A29E7E"><enum>(I)</enum><text display-inline="yes-display-inline">shall require the covered public institution to provide written notice to the students seeking an allocation through the appeal process and the timeline for hearing and resolving the appeal; </text></subclause> 
<subclause id="H06C591212C3B42D2889F489B2B5A8BB4"><enum>(II)</enum><text display-inline="yes-display-inline">allow the students seeking an allocation to obtain outside counsel to represent them during the appeal; and </text></subclause> <subclause id="H5FBFA4060D5F478A84806BD97E3A51A3"><enum>(III)</enum><text>require the institution to ensure that such appellate entity did not participate in any prior proceeding related to such allocation.</text></subclause></clause></subparagraph> 
<subparagraph id="H83EDBC0BDF134A8B86087CF942882BEE"><enum>(C)</enum><header>Assessment of security fees for events</header><text display-inline="yes-display-inline">A covered public institution shall establish and make publicly available clear, objective, content- and viewpoint-neutral, and exhaustive standards to be used by the institution to—</text> <clause id="HF6BF37F4B69B442E98C0C328A31E6053"><enum>(i)</enum><text display-inline="yes-display-inline">determine the amount of any security fee for an event or activity organized by a student or student organization; and</text></clause> 
<clause id="H9875FC7D8F5F4E63A527916AFD00340B"><enum>(ii)</enum><text>ensure that a determination of such an amount may not be based, in whole or in part, on—</text> <subclause id="H5E5873ADB0EC4349ACB4C2CBF1FBCF09"><enum>(I)</enum><text display-inline="yes-display-inline">the content of expression or viewpoint of the student or student organization;</text></subclause> 
<subclause id="H7F3C38298151451EA8DDCD6E2633713B"><enum>(II)</enum><text>the content of expression of the event or activity organized by the student or student organization;</text></subclause> <subclause id="H0C891B447FB44E529136D7211212FE40"><enum>(III)</enum><text>the content of expression or viewpoint of an invited guest of the student or student organization; or</text></subclause> 
<subclause id="HBA9F7DA92B954F8AA97E74CA3F3A51C2"><enum>(IV)</enum><text>an anticipated reaction by students or the public to the event. </text></subclause></clause></subparagraph> <subparagraph id="HAF002934C72F450A87080ED9A664F30C"><enum>(D)</enum><header>Protections for invited guests and speakers</header><text display-inline="yes-display-inline">A covered public institution shall establish and make publicly available clear, objective, content- and viewpoint-neutral, and exhaustive standards to be used by the institution related to the safety and protection of speakers and guests who are invited to the institution by a student or student organization.</text></subparagraph></paragraph> 
<paragraph id="HE9FBC1E7B0634725B4A134F05B69427F" commented="no"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H1117CC557F47461DADA7DBC44CE312C7" commented="no"><enum>(A)</enum><header>Recognized student organization</header><text display-inline="yes-display-inline">The term <term>recognized student organization</term> means a student organization that has been determined by a covered public institution to meet institutional requirements to qualify for certain privileges granted by the institution, such as use of institutional venues, resources, and funding. </text></subparagraph> 
<subparagraph id="H1F0F6A516BE746F292869F25CF2B8AAC" commented="no"><enum>(B)</enum><header>Security fee</header><text display-inline="yes-display-inline">The term <term>security fee</term> means a fee charged to a student or student organization for an event or activity organized by the student or student organization on the campus of the institution that is intended to cover some or all of the costs incurred by the institution for additional security measures needed to ensure the security of the institution, students, faculty, staff, or surrounding community as a result of such event or activity.</text></subparagraph></paragraph></subsection> <subsection id="H7E04948D0E77496388EE3B66A60A797A"><enum>(b)</enum><header>Equal campus access</header><text display-inline="yes-display-inline">A covered public institution shall not deny to a religious student organization any right, benefit, or privilege that is otherwise afforded to other student organizations at the institution (including full access to the facilities of the institution and official recognition of the organization by the institution) because of the religious beliefs, practices, speech, leadership standards, including standards regarding religious identity, belief, or practice, or standards of conduct of the religious student organization.</text></subsection> 
<subsection id="H6E82C1DC7E1D44A19CCF3AE4680076FA"><enum>(c)</enum><header>Freedom of association</header> 
<paragraph id="H7FCE8B554E8140AD9F33745541B5808C"><enum>(1)</enum><header>Upholding freedom of association protections</header><text display-inline="yes-display-inline">Any student (or group of students) enrolled in an institution of higher education that receives funds under this Act, including through an institution’s participation in any program under title IV, shall—</text> <subparagraph id="HCAC39F19213849B2A771B8D5CA9B7DAB"><enum>(A)</enum><text display-inline="yes-display-inline">subject to paragraph (3)(A), be able to form a single-sex social organization, whether recognized by the institution or not;</text></subparagraph> 
<subparagraph id="HCABE6126602C4B30A2F7F5C8C20E5134"><enum>(B)</enum><text display-inline="yes-display-inline">be able to apply to join any single-sex social organization; and</text></subparagraph> <subparagraph id="H83D350C501084323AB2127E64F5CCEEF"><enum>(C)</enum><text>if selected for membership by any single-sex social organization, be able to join, and participate in, such single-sex organization, subject to its standards for regulating its own membership, as provided under paragraph (3)(C).</text></subparagraph></paragraph> 
<paragraph id="HC158B06907E24CCD9A6955694E5EBBA3"><enum>(2)</enum><header>Nonretaliation against students of single-sex social organizations</header><text display-inline="yes-display-inline">An institution of higher education that receives funds under this Act, including through an institution’s participation in any program under title IV, shall not—</text> <subparagraph id="H0743EEA368DA4998B329A2DDD93742D4"><enum>(A)</enum><text display-inline="yes-display-inline">take any action to require or coerce a student or prospective student who is a member or prospective member of a single-sex social organization to waive the protections provided under paragraph (1), including as a condition of enrolling in the institution;</text></subparagraph> 
<subparagraph id="H846BC17094754B51B5635046C320C102"><enum>(B)</enum><text>take any adverse action against a single-sex social organization, or a student who is a member or a prospective member of a single-sex social organization, based on the membership practice of such organization limiting membership only to individuals of one sex; or</text></subparagraph> <subparagraph id="H9132507FB80744F3940EB9AD125FB2B4"><enum>(C)</enum><text display-inline="yes-display-inline">impose a recruitment restriction (including a recruitment restriction relating to the schedule for membership recruitment) on a single-sex social organization recognized by the institution, which is not imposed upon other student organizations by the institution, unless the organization (or a council of similar organizations) and the institution have entered into a mutually agreed upon written agreement that allows the institution to impose such restriction.</text></subparagraph></paragraph> 
<paragraph id="H9EB9FFC201054EC09F50CA00C7462F34"><enum>(3)</enum><header>Rules of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall—</text> <subparagraph id="H6DE9906A294F46C6A7B555FE3A2F1F41"><enum>(A)</enum><text>require an institution of higher education to officially recognize a single-sex social organization;</text></subparagraph> 
<subparagraph id="HB5F7412E424D4570AFE427185873CB34"><enum>(B)</enum><text>prohibit an institution of higher education from taking an adverse action against a student who organizes, leads, or joins a single-sex social organization—</text> <clause id="HEF8E579BEC484D0FA13CCBB8C1DDC05D"><enum>(i)</enum><text>due to academic or nonacademic misconduct; or</text></clause> 
<clause id="HD140CF6376D34969BEB27AC2B260D9BF"><enum>(ii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="HC188129321114D2392C1E8398BE9F6FD"><enum>(I)</enum><text display-inline="yes-display-inline">for public institutions, because the organization’s purpose is directed to inciting or producing imminent lawless action and likely to incite or produce such action; or </text></subclause> <subclause id="H72701322C20242BFB2C93AB7BDF85114" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">for private institutions, because the organization’s purpose is incompatible with the religious mission of the institution, so long as that adverse action is not based on the membership practice of the organization of limiting membership only to individuals of one sex;</text></subclause></clause></subparagraph> 
<subparagraph id="H39F766FC9AF64FE7B3B903DF4E8E9530"><enum>(C)</enum><text>prevent a single-sex social organization from regulating its own membership;</text></subparagraph> <subparagraph id="H41E191082A7E4958894CEC669623B7C8"><enum>(D)</enum><text>inhibit the ability of the faculty of an institution of higher education to express an opinion (either individually or collectively) about membership in a single-sex social organization, or otherwise inhibit the academic freedom of such faculty to research, write, or publish material about membership in such an organization; or</text></subparagraph> 
<subparagraph id="H3DA0F2456B4B48E98744058DF57BF32C"><enum>(E)</enum><text>create enforceable rights against a single-sex social organization or against an institution of higher education due to the decision of the organization to deny membership to an individual student.</text></subparagraph></paragraph> <paragraph id="H8F0A7667C9434F29B0161BDEEF26ABBC"><enum>(4)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> 
<subparagraph id="H626F5718A06B4B3BAA23C8837B886EE1"><enum>(A)</enum><header>Adverse action</header><text display-inline="yes-display-inline">The term <quote>adverse action</quote> includes the following actions taken by an institution of higher education with respect to a single-sex social organization or a member or prospective member of a single-sex social organization:</text> <clause id="HB51E2A62E7FC452DA73777EEB32C4223"><enum>(i)</enum><text>Expulsion, suspension, probation, censure, condemnation, formal reprimand, or any other disciplinary action, coercive action, or sanction taken by an institution of higher education or administrative unit of such institution.</text></clause> 
<clause id="HD7C8669E539F4A28AE6FEA84AFFD6F7A"><enum>(ii)</enum><text>An oral or written warning with respect to an action described in clause (i) made by an official of an institution of higher education acting in their official capacity.</text></clause> <clause id="HB615BC92778B4B09925A55276EFF8E07"><enum>(iii)</enum><text>An action to deny participation in any education program or activity, including the withholding of any rights, privileges, or opportunities afforded other students on campus.</text></clause> 
<clause id="HF98524C369EF48919B981F44DB79B3C8"><enum>(iv)</enum><text>An action to withhold, in whole or in part, any financial assistance (including scholarships and on-campus employment), or denying the opportunity to apply for financial assistance, a scholarship, a graduate fellowship, or on-campus employment.</text></clause> <clause id="HC6383221FF284E118795DB95B64878C4"><enum>(v)</enum><text display-inline="yes-display-inline">An action to deny or restrict access to on-campus housing.</text></clause> 
<clause id="HF3731E3413AC42D7B4CC920913D99441"><enum>(vi)</enum><text>An act to deny any certification, endorsement, or letter of recommendation that may be required by a student’s current or future employer, a government agency, a licensing board, an institution of higher education, a scholarship program, or a graduate fellowship to which the student applies or seeks to apply.</text></clause> <clause id="HC155981E459342A2AF1B3DFD7936C992"><enum>(vii)</enum><text>An action to deny participation in any sports team, club, or other student organization, including a denial of any leadership position in any sports team, club, or other student organization.</text></clause> 
<clause id="HFD977539BB5946FD806ED80A50488C1A"><enum>(viii)</enum><text>An action to withdraw the institution’s official recognition of such organization.</text></clause> <clause id="H545DC4F289B442BA896F3C09E30D86EA"><enum>(ix)</enum><text>An action to require any student to certify that such student is not a member of a single-sex social organization or to disclose the student’s membership in a single-sex social organization.</text></clause> 
<clause id="HA50ACB5618A64A1A97FE8F50E95FE7CF"><enum>(x)</enum><text>An action to interject an institution’s own criteria into the membership practices of the organization in any manner that conflicts with the rights of such organization under title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) or this subsection.</text></clause> <clause id="H4E67906729EA480792A08A779DC6E738"><enum>(xi)</enum><text display-inline="yes-display-inline">An action to impose additional requirements on advisors serving a single-sex social organization that are not imposed on all other student organizations.</text></clause></subparagraph> 
<subparagraph id="HB6A9FAF6284B41A89676AF4D75C0D367"><enum>(B)</enum><header>Single-sex social organization</header><text display-inline="yes-display-inline">The term <quote>single-sex social organization</quote> means—</text> <clause id="HB04298BF21C34AE3BB9C572575FFFF92"><enum>(i)</enum><text>a social fraternity or sorority described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 which is exempt from taxation under section 501(a) of such Code, or an organization that has been historically single-sex, the active membership of which consists primarily of students or alumni of an institution of higher education; or</text></clause> 
<clause id="H64DAF6DB1A3B4EDEA76C12625106543D"><enum>(ii)</enum><text>a single-sex private social club (including an independent organization located off-campus) that consists primarily of students or alumni of an institution of higher education.</text></clause></subparagraph></paragraph></subsection> <subsection id="H7E549261D4EB4503A0014865DB775766"><enum>(d)</enum><header>Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed to prohibit an institution of higher education from taking any adverse action (such as denying or revoking recognition, funding, use of institutional venues or resources, or other privileges granted by the institution) against a student organization based on the student organization having knowingly provided material support or resources to an organization designated as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H8398E254F8E64A1B9B84B7C718A4C9AB"><enum>205.</enum><header>Free speech on campus</header><text display-inline="no-display-inline">The Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>), as amended by section 204 of this title, is further amended by inserting after section 112C the following new section:</text> <quoted-block style="OLC" id="H5DB53BCD323740C1BAC557CAFD008845" display-inline="no-display-inline"> <section id="HF19022D8BD1B458A8BD35643238803CC"><enum>112D.</enum><header>Free speech on campus</header> <subsection id="H3F8332B4142642D89AA583CFF9BFF724"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A covered public institution shall— </text> 
<paragraph id="HFBD4DAAD174741249330657FB7500F11"><enum>(1)</enum><text>at each orientation for new and transfer students, provide students attending the orientation—</text> <subparagraph id="H66E66FB714F54F7A9D7D18FC2A619668"><enum>(A)</enum><text>a written statement that—</text> 
<clause id="H8AE02975CAC147C69AB330774C4B6E31"><enum>(i)</enum><text>explains the rights of students under the First Amendment to the Constitution;</text></clause> <clause id="H621BA997E3244981A465051B7584786C"><enum>(ii)</enum><text>affirms the importance of, and the commitment of the institution to, freedom of expression;</text></clause> 
<clause id="HCD31468D44F648C79FC08C789A9D04CC"><enum>(iii)</enum><text display-inline="yes-display-inline">explains students’ protections under title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d et seq.</external-xref>) and the procedures for filing a discrimination claim with the Office for Civil Rights of the Department of Education; and</text></clause> <clause id="H2DB47112CD1F4992BBA91B4539E2BDB2"><enum>(iv)</enum><text>includes assurances that students, and individuals invited by students to speak at the institution, will not be treated in a manner that violates the freedom of expression of such students or individuals; and</text></clause></subparagraph> 
<subparagraph id="HEC703AA462A44721973FB214B9B82A46"><enum>(B)</enum><text display-inline="yes-display-inline">educational programming (including online resources) that describes their free speech rights and responsibilities under the First Amendment to the Constitution; and</text></subparagraph></paragraph> <paragraph id="HB3516BA2C3044CF4883EDCFFACA257C3"><enum>(2)</enum><text>post on the publicly accessible website of the institution the statement described in paragraph (1)(A).</text></paragraph></subsection> 
<subsection id="HDEBCEEDDD7CE42CFBFEFA5FB32730E2B"><enum>(b)</enum><header>Campus free speech and restoration</header> 
<paragraph id="HB8FFA831BE05442C8C6798914E3954E4"><enum>(1)</enum><header>Definition of expressive activities</header><text display-inline="yes-display-inline">In this subsection, the term <quote>expressive activity</quote>—</text> <subparagraph id="H2FA28B41E51B488FA01C78E6AA3DA6B9"><enum>(A)</enum><text>includes—</text> 
<clause id="HFFA5B49F89E74F90B4325D4B08DAFD27"><enum>(i)</enum><text>peacefully assembling, protesting, speaking, or listening;</text></clause> <clause id="H44263DA6CFEE47ED81B5F277A5E7C988"><enum>(ii)</enum><text>distributing literature;</text></clause> 
<clause id="HCF18808F53E941CF841540537A13421A"><enum>(iii)</enum><text>carrying a sign;</text></clause> <clause id="H0BA3494B848D4C62BD5BCE480ACD5E95"><enum>(iv)</enum><text>circulating a petition; or</text></clause> 
<clause id="H58EAA270C1004B9BB62132E1B5B93953"><enum>(v)</enum><text display-inline="yes-display-inline">other expressive activities guaranteed under the First Amendment to the Constitution;</text></clause></subparagraph> <subparagraph id="H3833625B40C6442CB2C3C77D00D79963"><enum>(B)</enum><text display-inline="yes-display-inline">applies equally to religious expression as it does to nonreligious expression; and</text></subparagraph> 
<subparagraph id="H8BFB70D1C40C41319AE25569AF3003F7"><enum>(C)</enum><text>does not include unprotected speech (as defined by the precedents of the Supreme Court of the United States).</text></subparagraph></paragraph> <paragraph id="H454B6644DAF449C3BC2E3CBA246E908C"><enum>(2)</enum><header>Expressive activities at an institution</header> <subparagraph id="HC69AA5612F1443A596BDFB919593462A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A covered public institution may not prohibit, subject to subparagraph (B), a person from freely engaging in noncommercial expressive activity in a generally accessible area on the institution’s campus if the person’s conduct is lawful. The publicly accessible outdoor areas of campuses of public institutions of higher education shall be regulated pursuant to rules applicable to traditional public forums.</text></subparagraph> 
<subparagraph id="HA3BC5F481639436A9455677F40B10BF1"><enum>(B)</enum><header>Restrictions</header><text>A covered public institution may not maintain or enforce time, place, or manner restrictions on an expressive activity in a generally accessible area of the institution’s campus unless the restriction—</text> <clause id="H3835C20E9DC64317B04028AF7423B18B"><enum>(i)</enum><text>is narrowly tailored in furtherance of a significant governmental interest;</text></clause> 
<clause id="H9737DD79C8F74D2BADDA669D483D88A4"><enum>(ii)</enum><text>is based on published, content-neutral, and viewpoint-neutral criteria;</text></clause> <clause id="H04444700D1234D6C98BE4E39B99DB131"><enum>(iii)</enum><text>leaves open ample alternative channels for communication; and</text></clause> 
<clause id="HF47EACBCFD234304933B066C04C1BAD1"><enum>(iv)</enum><text>provides for spontaneous assembly and distribution of literature.</text></clause></subparagraph> <subparagraph id="H665727ABB06C4DBA959C47F3DD276FED"><enum>(C)</enum><header>Application</header><text>The protections provided under subparagraph (A) do not apply to expressive activity in an area on an institution’s campus that is not a generally accessible area.</text></subparagraph> 
<subparagraph id="H70FEC67892954E65A75CCDE7ED31F987"><enum>(D)</enum><header>Nonapplication to service academies</header><text>This subsection shall not apply to an institution of higher education whose primary purpose is the education of individuals for the military services of the United States, or the merchant marine.</text></subparagraph></paragraph></subsection> <subsection id="HBD5CD746375C438EA41F6B55CA650EF3"><enum>(c)</enum><header>Prohibition on use of political tests</header> <paragraph id="H2183C4F0FAC946659DF06CC161C931E4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A covered public institution may not consider, require, or discriminate on the basis of a political test in the admission, appointment, hiring, employment, or promotion of any covered individual, or in the granting of tenure to any covered individual.</text></paragraph> 
<paragraph id="H32421EF4841B4F7483FF02207E7E013D"><enum>(2)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed—</text> <subparagraph id="H066B89D57B814518955D0A4836F11D15"><enum>(A)</enum><text display-inline="yes-display-inline">to prohibit an institution of higher education whose primary purpose is the education of individuals for the military services of the United States, or the merchant marine, from requiring an applicant, student, or employee to take an oath to uphold the Constitution of the United States;</text></subparagraph> 
<subparagraph id="HE6893903ADC7447D93C56FFEDB4E6538"><enum>(B)</enum><text display-inline="yes-display-inline">to prohibit an institution of higher education from requiring a student, faculty member, or employee to comply with Federal or State antidiscrimination laws or from taking action against a student, faculty member, or employee for violations of Federal or State anti-discrimination laws, as applicable;</text></subparagraph> <subparagraph id="H34FBE1AEDC4343B7A9AAB0175BD9268A"><enum>(C)</enum><text display-inline="yes-display-inline">to prohibit an institution of higher education from evaluating a prospective student, an employee, or a prospective employee based on their knowingly providing material support or resources to an organization designated as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1189">8 U.S.C. 1189</external-xref>);</text></subparagraph> 
<subparagraph id="HE6AE6F18BD2B41F88013206DA450D089"><enum>(D)</enum><text>to prohibit an institution of higher education from considering the subject-matter competency including the research and creative works, of any candidate for a faculty position or faculty member considered for promotion when the subject matter is germane to their given field of scholarship; or</text></subparagraph> <subparagraph id="H8A4C7A922588467D83A5F86215D36960"><enum>(E)</enum><text>to apply to activities of registered student organizations.</text></subparagraph></paragraph> 
<paragraph id="HFD78818B12E34B2FBB2FD789DFCA94EA"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> <subparagraph id="HEA82273FD6D4488D87CA1262C0A54A6B"><enum>(A)</enum><header>Covered individual</header><text display-inline="yes-display-inline">The term <quote>covered individual</quote> means, with respect to an institution of higher education that is a public institution—</text> 
<clause id="H6E4A5E9463C44705B6C6528D41435BDF"><enum>(i)</enum><text>a prospective student who has submitted an application to attend such institution;</text></clause> <clause id="H7FB3FD2D6CCE44EBAD9E0B848B876837"><enum>(ii)</enum><text>a student who attends such institution;</text></clause> 
<clause id="H2A6E49FADA894B96A741A9997FE953D4"><enum>(iii)</enum><text>a prospective employee who has submitted an application to work at such institution;</text></clause> <clause id="H91DEDFEE831F4076A08A3B8F881F929B"><enum>(iv)</enum><text>an employee who works at such institution;</text></clause> 
<clause id="HC309E25D045D49D5BE254DF81224C8C1"><enum>(v)</enum><text>a prospective faculty member who has submitted an application to work at such institution; and</text></clause> <clause id="H2C4F1B47B3874606B0DE3FC956463E32"><enum>(vi)</enum><text>a faculty member who works at such institution.</text></clause></subparagraph> 
<subparagraph id="H5B77BD2CC21E4E89A8D865EF79E71990"><enum>(B)</enum><header>Material support or resources</header><text display-inline="yes-display-inline">The term <quote>material support or resources</quote> has the meaning given that term in section 2339A of title 18, United States Code (including the definitions of <quote>training</quote> and <quote>expert advice or assistance</quote> in that section).</text></subparagraph> <subparagraph id="H3E74A7BA716D4A5C90237CFD86910794"><enum>(C)</enum><header>Political test</header><text>The term <quote>political test</quote> means a method of compelling or soliciting an applicant for enrollment or employment, student, or employee of an institution of higher education to identify commitment to or make a statement of personal belief in support of any ideology or movement that—</text> 
<clause id="HACB20F26B25349F9A1856C3C6D0AC024"><enum>(i)</enum><text>supports or opposes a specific partisan or political set of beliefs;</text></clause> <clause id="HF89C316A47B14DDE9187F74D2580A1E0"><enum>(ii)</enum><text>supports or opposes a particular viewpoint on a social or political issue; or</text></clause> 
<clause id="H42645E1A6E594349890E3FCBD90B3D82"><enum>(iii)</enum><text display-inline="yes-display-inline">promotes the disparate treatment of any individual or group of individuals on the basis of race, color, religion or national origin, including—</text> <subclause id="H56F9F494A269401DBF7C3E855434D998"><enum>(I)</enum><text>any initiative or formulation of diversity, equity, and inclusion beyond upholding existing Federal law; or</text></subclause> 
<subclause id="H58E30ACB8D9E4B98844BA622E464B0E5"><enum>(II)</enum><text>any theory or practice that holds that systems or institutions upholding existing Federal law are racist, oppressive, or otherwise unjust.</text></subclause></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HFF5E2A8D36334A5DBD44810970831A72"><enum>206.</enum><header>Enforcement</header> <subsection id="H01618AF7C570410D888B593E5907DFBF"><enum>(a)</enum><header>Program participation agreement</header><text display-inline="yes-display-inline">Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H7E0AE9FE04ED4B9BAEE432AC3F0BD060"> 
<paragraph id="H86268260D73642A7B7CF61F8C9C42C72"><enum>(30)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H48AE65C6B0C24E60B8550773C6CFDC63"><enum>(A)</enum><text>The institution will comply with all the requirements of sections 112B.</text></subparagraph> <subparagraph id="HBA5B5F6066DD404292A4BD31D4F1E18B" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">An institution that fails to comply with section 112B shall—</text> 
<clause id="H65D854F01C114FF18049F0CD4BB26503"><enum>(i)</enum><text>be ineligible to participate in the programs authorized by this title for a period of not less than 1 award year; and</text></clause> <clause id="H867E3401AE6C4AF19ACDBD133BE6CFD3"><enum>(ii)</enum><text>in order to regain eligibility to participate in such programs, demonstrate compliance with all requirements of such section for not less than one award year after the award year in which such institution became ineligible. </text></clause></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subsection> 
<subsection id="H5F4CC573CEDB463185C5E8451745B801"><enum>(b)</enum><header>Cause of action</header><text display-inline="yes-display-inline">The Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>), as amended by section 205 of this title, is further amended by inserting after section 112D the following new section:</text> <quoted-block style="OLC" id="HA2E9E6DA9D9440058C71A9B3880897C3" display-inline="no-display-inline"> <section id="H21E4871B65C0488F9BDB7CF8EB4ECAAD"><enum>112E.</enum><header>Enforcement</header> <subsection id="H48E5BE9513144625BC517812B15CEF85"><enum>(a)</enum><header>Cause of action</header> <paragraph id="H681AB066DD28446DA9C9E093DA995388" commented="no"><enum>(1)</enum><header>Civil action</header><text display-inline="yes-display-inline">After exhaustion of any available appeals under section 112C(a), an aggrieved individual who, or an aggrieved organization that, is harmed by the maintenance of a policy or practice by a covered public institution that is in violation of a requirement described in section 112B, 112C, or 112D may bring a civil action in a Federal court for appropriate relief. </text></paragraph> 
<paragraph id="H4DC52316D41A42368DC1C2D379D9E22A"><enum>(2)</enum><header>Appropriate relief</header><text>For the purposes of this subsection, appropriate relief includes—</text> <subparagraph id="HBDD6AA7C7793402682E4B7CB574EDFE3" commented="no"><enum>(A)</enum><text>a temporary or permanent injunction; and</text></subparagraph> 
<subparagraph id="HD2D5C85063464E869943A94D5936472F"><enum>(B)</enum><text>awarding a prevailing plaintiff—</text> <clause id="HCE3E72F9A1D444AB81063DDB11B2B89A"><enum>(i)</enum><text>compensatory damages; </text></clause> 
<clause id="HA234E430CFC441C48868427A37113114"><enum>(ii)</enum><text>reasonable court costs; and</text></clause> <clause id="H62027C4853DC45158F78C4C1598D3FB3"><enum>(iii)</enum><text>reasonable attorney’s fees.</text></clause></subparagraph></paragraph> 
<paragraph id="H7C77E428EF1D4CD8A856445A8A192449" commented="no"><enum>(3)</enum><header>Statute of limitations</header><text display-inline="yes-display-inline">A civil action under this subsection may not be commenced later than 2 years after the cause of action accrues. For purposes of calculating the two-year limitation period, each day that the violation of a requirement described in section 112B, 112C, or 112D persists, and each day that a policy in violation of a requirement described in section 112B, 112C, or 112D remains in effect, shall constitute a new day that the cause of action has accrued. </text></paragraph></subsection> <subsection id="HE88912C08CFC460298CAA74DBA4FF34B" commented="no"><enum>(b)</enum><header>Nondefault, final judgment</header><text display-inline="yes-display-inline">In the case of a court’s nondefault, final judgment in a civil action brought under subsection (a) that a covered public institution is in violation of a requirement described in section 112B, 112C, or 112D, such covered public institution shall—</text> 
<paragraph id="H9AD40C6D12BE4007A7FE4A5F523F4F44" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 7 days after the date on which the court makes such a nondefault, final judgment, notify the Secretary of such judgment and submit to the Secretary a copy of the nondefault, final judgment; and </text></paragraph> <paragraph id="H11068CA348574A83A6C565E1EB10BBD3" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 30 days after the date on which the court makes such a nondefault, final judgment, submit to the Secretary a report that—</text> 
<subparagraph id="H001A5B92E24A4BC79FE1F6985F8504CB" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">certifies that the standard, policy, practice, or procedure that is in violation of the requirement described in section 112B, 112C, or 112D is no longer in use; and</text></subparagraph> <subparagraph id="H9F5CAD5E58D74509AA639A8578703C8C" commented="no"><enum>(B)</enum><text>provides evidence to support such certification.</text></subparagraph></paragraph></subsection> 
<subsection id="H5EA22D809D714C81993341607C19168A"><enum>(c)</enum><header>Revocation of eligibility</header><text display-inline="yes-display-inline">In the case of a covered public institution that does not notify the Secretary as required under <internal-xref idref="H9AD40C6D12BE4007A7FE4A5F523F4F44" legis-path="112A.(b)(2)(A)">subsection (b)(1) </internal-xref>or submit the report required under <internal-xref idref="H11068CA348574A83A6C565E1EB10BBD3" legis-path="112A.(b)(2)(B)">subsection (b)(2)</internal-xref>, the Secretary shall revoke the eligibility of such institution to participate in a program authorized under title IV for each award year following the conclusion of the award year in which a court made a nondefault, final judgment in a civil action brought under <internal-xref idref="H48E5BE9513144625BC517812B15CEF85" legis-path="112A.(b)(1)">subsection (a)</internal-xref> that the institution is in violation of a requirement described in section 112B, 112C, or 112D. </text></subsection> <subsection id="HA22937DFBBD14929894A28CC08BEA704"><enum>(d)</enum><header>Restoration of eligibility</header> <paragraph id="H342AA0E781554BB49E90C037D750A633"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A covered public institution that loses eligibility under <internal-xref idref="H5EA22D809D714C81993341607C19168A" legis-path="112A.(b)(3)">subsection (c)</internal-xref> to participate in a program authorized under title IV may seek to restore such eligibility by submitting to the Secretary the report described in subsection (b)(2).</text></paragraph> 
<paragraph id="H6F71D22EBA9E4159A4030654454C77C6"><enum>(2)</enum><header>Determination by the Secretary</header><text display-inline="yes-display-inline">Not later than 90 days after a covered public institution submits a report under <internal-xref idref="H342AA0E781554BB49E90C037D750A633" legis-path="112A.(b)(4)(A)">paragraph (1)</internal-xref>, the Secretary shall review such report and make a determination with respect to whether such report contained sufficient evidence to demonstrate that such institution is no longer in violation of a requirement described in section 112B, 112C, or 112D.</text></paragraph> <paragraph id="HF8B2BA31649C45C9AEC445D594895A92"><enum>(3)</enum><header>Restoration</header><text display-inline="yes-display-inline">If the Secretary makes a determination under <internal-xref idref="H6F71D22EBA9E4159A4030654454C77C6" legis-path="112A.(b)(4)(B)">paragraph (2)</internal-xref> that the covered public institution is no longer in violation of a requirement described in section 112B, 112C, or 112D, the Secretary shall restore the eligibility of such institution to participate in a program authorized under title IV for each award year following the conclusion of the award year in which such determination is made.</text></paragraph></subsection> 
<subsection id="H638C1B640B264E78B82F50E8F405ECBE"><enum>(e)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, and on an annual basis thereafter, the Secretary shall submit to the Committee on Education and the Workforce of the House of Representatives and the Senate Committee on Health, Education, Labor, and Pensions a report that includes—</text> <paragraph id="H9E488DB93EB34D5E96DCC341B848EF5D"><enum>(1)</enum><text>a compilation of—</text> 
<subparagraph id="HBA4B36C0133D46C2AB3880BF6BE86272"><enum>(A)</enum><text>the notifications of violation received by the Secretary under subsection (b)(1) in the year for which such report is being submitted; and</text></subparagraph> <subparagraph id="HBF2AFFA8476B482083C689231A606629"><enum>(B)</enum><text>the reports submitted to the Secretary under subsection (b)(2) for such year; and</text></subparagraph></paragraph> 
<paragraph id="HF648E248851B4A50BD8D02D5ED360D71"><enum>(2)</enum><text>any action taken by the Secretary to revoke or restore eligibility under subsections (c) and (d) for such year.</text></paragraph></subsection> <subsection id="H8634C2C7056641D8AD7766EA0CBBB7BD" commented="no"><enum>(f)</enum><header>Voluntary waiver of State and local sovereign immunity as condition of receiving Federal funding</header><text>The receipt, on or after the date of enactment of this section, of any Federal funding under title IV of this Act by a State or political subdivision of a State (including any municipal or county government) is deemed to constitute a clear and unequivocal expression of, and agreement to, waiving sovereign immunity under the 11th Amendment to the Constitution or otherwise, to a civil action for injunctive relief, compensatory damages, court costs, and attorney’s fees under this section.</text></subsection> 
<subsection id="H1DCBB3E752284021B42515334DC7BB41" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>nondefault, final judgment</term> means a final judgment by a court for a civil action brought under subsection (a) that a covered public institution is in violation of a requirement described in section 112B, 112C, or 112D that the covered public institution chooses not to appeal or that is not subject to further appeal.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H4B450F373B1D45C487AA7BEFFA8E8158" display-inline="no-display-inline" section-type="subsequent-section"><enum>207.</enum><header>Sense of Congress relating to acts of violence on campus</header><text display-inline="no-display-inline">It is the sense of Congress that acts of violence committed on the campus of an institution of higher education are not protected under the First Amendment to the Constitution.</text> </section></title>
