R. 3396</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20241218" legis-day="20241216">December 18 (legislative day, December 16), 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To require the standardization of reciprocal fire suppression cost share agreements, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="H93C34CA29B4B4BBC890773BCCECDBCA3"><pagebreak></pagebreak><section id="H43D0CA969EF34E7EB2E268FAEC901CBD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fire Department Repayment Act of 2023</short-title></quote>.</text></section><section id="HD05A25A57B4E46FC8BEF6EC278B2C819"><enum>2.</enum><header>Requirements relating to certain fire suppression cost share agreements</header><subsection id="HBABE180719BB49BD83BCCCA21E2EEB6B"><enum>(a)</enum><header>Establishment of standard operating procedures</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Secretaries shall—</text><paragraph id="H4076BDB4EE8D4A82BC4AAD5E569C6B2C"><enum>(1)</enum><text display-inline="yes-display-inline">establish standard operating procedures relating to payment timelines for fire suppression cost share agreements established under the Act of May 27, 1955 (<external-xref legal-doc="usc" parsable-cite="usc/42/1856a">42 U.S.C. 1856a</external-xref>) (commonly known as the <quote>Reciprocal Fire Protection Act</quote>); and</text></paragraph><paragraph id="H67575EC302AF4B4A92D7CC42C72D6AE1"><enum>(2)</enum><text>with respect to each fire suppression cost share agreement in operation on such date—</text><subparagraph id="H7CFA003B49E74566AB427E3A585F4343"><enum>(A)</enum><text>review each such agreement; and</text></subparagraph><subparagraph id="H954A2AF6267F4425BD19287DAB83BB7B"><enum>(B)</enum><text>modify each agreement as necessary to comply with the standard operating procedures required under paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="HD2243B30BC2B428789DEA73581F1E53E"><enum>(b)</enum><header>Alignment of fire suppression cost share agreements with cooperative fire protection agreements</header><text display-inline="yes-display-inline">The standard operating procedures required under subsection (a)(1) shall include a requirement that each fire suppression cost share agreement be aligned with each of the cooperative fire protection agreements applicable to the entity subject to such fire suppression cost share agreement.</text></subsection><subsection id="H4E172DCA5E48487AAF5507A07AA3B0C0"><enum>(c)</enum><header>Payments pursuant to cost share agreements</header><text>With respect to payments made pursuant to fire suppression cost share agreements, the standard operating procedures required under subsection (a)(1) shall require that the Federal paying entity reimburse a local fire department if such fire department submits an invoice in accordance with cost settlement procedures.</text></subsection><subsection id="H1C621163F4B443229A69156A66DDEA71"><enum>(d)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Secretaries should carry out reciprocal fire suppression cost share agreement repayments to local fire suppression organizations as soon as practicable after fire suppression occurs but not later than 1 year after fire suppression occurs.</text></subsection><subsection id="H1644A7C541B74A27803780A066A03F58"><enum>(e)</enum><header>Secretaries defined</header><text>In this section, the term <term>Secretaries</term> means—</text><paragraph id="H6060BF0DB0B345508521A26FFE5379E7"><enum>(1)</enum><text>the Secretary of Agriculture;</text></paragraph><paragraph id="H66F182512AC4480F973A82651B4460EE"><enum>(2)</enum><text>the Secretary of the Interior;</text></paragraph><paragraph id="HC0045853899D4A2EA98054A6D1F7B9F0"><enum>(3)</enum><text>the Secretary of Homeland Security; and</text><pagebreak></pagebreak></paragraph><paragraph id="HFDDD9B2795324ED6B0F022BEBEFDE68D"><enum>(4)</enum><text>the Secretary of Defense. </text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20241217" chamber="House">Passed the House of Representatives December 17, 2024.</attestation-date><attestor display="yes">Kevin F.
