and </text></subparagraph><subparagraph id="HF2FADF311B0644DD993A04F5A826F126"><enum>(B)</enum><text>by inserting <quote>operator or</quote> before <quote>operator-applicant</quote> each place it appears; and</text></subparagraph></paragraph><paragraph id="H036D5C7294864149B9F2CE9481F68C22"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="H30FBFE0B04A64E25A5C20098C627F813"><enum>(A)</enum><text>by inserting <quote>or employment</quote> after <quote>preemployment</quote> each place it appears; and </text></subparagraph><subparagraph id="H457A995473B5405A962B97DB2AA10C15"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>operator or</quote> before <quote>operator-applicant</quote>.</text></subparagraph></paragraph></section><section id="H453A831D2CFA4344AA2EE5ABF040E3B6"><enum>3.</enum><header>DataQ improvement</header><text display-inline="no-display-inline">Section 31150 of title 49, United States Code, is amended—</text><paragraph id="H428A8F8A16AB41F4995E85361BF590DB"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (f); and</text></paragraph><paragraph id="H6D823D2D4B5E44FF8EFF9229AC1C0FAA"><enum>(2)</enum><text>by inserting after subsection (c) the following:</text><quoted-block id="H4603FE2915DD48B18AEFA6A9D7C4ED32" style="OLC" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H1EC14DD4E1C046B28611E37CABBDBFB9"><enum>(d)</enum><header>Data subject to review</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Motor Carrier Safety Screening Modernization Act</short-title>, the Secretary shall ensure that during any period in which a safety violation is being contested, the report on such violation is labeled in a manner that indicates such violation is being contested in the Motor Carrier Management Information System and in any other relevant databases, including the Employment Screening Program, the Safety Measurement System, and Analysis and Information Online, until the review of the contested violation is complete.</text></subsection><subsection id="HC49B0EF26890457580E20720C012AA3A"><enum>(e)</enum><header>DataQ appeals process</header><text>Not later than 1 year after the date of enactment of the <short-title>Motor Carrier Safety Screening Modernization Act</short-title>, the Secretary shall promulgate DataQ program participation guidelines that direct States and other Federal agencies receiving funds under the Motor Carrier Safety Assistance Program to provide for an appeals process by which—</text><paragraph id="H459AD6D48D2F4CD8BC160BB71882C7D7"><enum>(1)</enum><text>following the conclusion of a request for data review, an affected party may appeal the disposition of such review; and</text></paragraph><paragraph id="HDB0055FC419A4CCE8F7356FCAB8307A1"><enum>(2)</enum><text>an appeal of such disposition is adjudicated in a reasonable period of time by a person or persons other than the person that issued the violation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><endorsement display="yes"><action-date date="20241219">December 19, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
