read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To require the Assistant Secretary of Commerce for Communications and Information to submit to Congress a plan for the Assistant Secretary to track the acceptance, processing, and disposal of certain Form 299s, and for other purposes.</official-title></form><legis-body id="H1DE358C0B93846BFAE93542887AD52E7" style="OLC"><pagebreak></pagebreak><section id="HCA9238070B694BFB9B8AD39AB199DB4C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Broadband Deployment Tracking Act</short-title></quote>.</text></section><section id="H03B36EB25E62422AB91A0F2DF1EBFBB6" section-type="subsequent-section"><enum>2.</enum><header>Plan for Assistant Secretary to track the acceptance, processing, and disposal of certain Form <enum-in-header>299</enum-in-header>s</header><subsection id="H60DE94617579496BB23C63E7AB605AE8"><enum>(a)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Assistant Secretary shall submit to the appropriate congressional committees a plan containing a description of—</text><paragraph id="HC37834BD07A140CFB1ECF74B4D59F20A"><enum>(1)</enum><text display-inline="yes-display-inline">the process by which the Assistant Secretary proposes to—</text><subparagraph id="H90B3F73F04244710ACF623753E022E05"><enum>(A)</enum><text>track the acceptance, processing, and disposal of each Form 299 for communications use authorization; </text></subparagraph><subparagraph id="HF72E7FE72F1B473B9D2B0168DE950657"><enum>(B)</enum><text display-inline="yes-display-inline">provide applicants additional transparency with respect to the status of the applicable Form 299 for communications use authorization; and</text></subparagraph><subparagraph id="HA654E24F56714F5EB7CAD356090893EF"><enum>(C)</enum><text display-inline="yes-display-inline">most expeditiously implement the plan; and </text></subparagraph></paragraph><paragraph id="HBBF13F894FF94D94A5CCB0A7256489F6"><enum>(2)</enum><text>any potential barriers to implementing the plan that are identified by the Assistant Secretary.</text></paragraph></subsection><subsection id="H8A350BD3BA354518A7E4866A1FE0D5CF"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H676441C7543E48198A3FFE3E27F201E6"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="H3C425E66EC8D4B1A8C86F1FED2FAA533"><enum>(A)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph><subparagraph id="H52B33ED3ABE3469C92A70357E68562BF"><enum>(B)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate.</text></subparagraph></paragraph><paragraph id="HE4C99DC5DDCD497A93BE4E83F40BA387"><enum>(2)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for Communications and Information.</text></paragraph><paragraph id="HF0422444233243A68764331A926D6A2F" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Communications facility</header><text display-inline="yes-display-inline">The term <term>communications facility</term> has the meaning given the term communications facility installation in section 6409(d) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(d)</external-xref>).</text></paragraph><paragraph id="H36A9BA9EEE0B466FB602F23DB8566E9E" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Communications use</header><text>The term <term>communications use</term> means the placement and operation of a communications facility.</text></paragraph><paragraph id="HCA1DA7E418D9401CA9762F4A0FAC6FF2" display-inline="no-display-inline" commented="no"><enum>(5)</enum><header>Communications use authorization</header><text display-inline="yes-display-inline">The term <term>communications use authorization</term> means an easement, right-of-way, lease, license, or other authorization—</text><subparagraph id="H7F1A840F2C1C4F1D845561D4EE123EA0" commented="no"><enum>(A)</enum><text>provided by the Secretary of the Interior or the Secretary of Agriculture;</text></subparagraph><subparagraph id="HB655C5EB504143E7A3172A1B2178C5C1" commented="no"><enum>(B)</enum><text>to locate or modify a communications facility on covered land; and</text></subparagraph><subparagraph id="HD0536E712A1B4C4CBCA15F514BF8F35D" commented="no"><enum>(C)</enum><text>for the primary purpose of authorizing the occupancy and use of such covered land for communications use.</text></subparagraph></paragraph><paragraph id="H4F0D224AFE0D445BB5DEC7816F4EC941"><enum>(6)</enum><header>Covered land</header><text>The term <quote>covered land</quote> means—</text><subparagraph id="H3F4C7944517C427896A3558A2E9EAFE7"><enum>(A)</enum><text>public lands; and</text></subparagraph><subparagraph id="H2174CC8AD7E04B65AE81C8DB08D2298C"><enum>(B)</enum><text>National Forest System land.</text></subparagraph></paragraph><paragraph id="H2DEC17807A0E4F18A9A7EAE7345D1A15"><enum>(7)</enum><header>Form <enum-in-header>299</enum-in-header></header><text display-inline="yes-display-inline">The term <term>Form 299</term> means the form established under section 6409(b)(2)(A) of the Middle Class Tax Relief and Job Creation Act of 2012 (<external-xref legal-doc="usc" parsable-cite="usc/47/1455">47 U.S.C. 1455(b)(2)(A)</external-xref>), or any successor form.</text></paragraph><paragraph id="HED4EF1D8C5264FF0A5A617AC818BAEF6"><enum>(8)</enum><header>National forest system</header><text display-inline="yes-display-inline">The term <quote>National Forest System</quote> has the meaning given the term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609(a)</external-xref>).</text></paragraph><paragraph id="H568490E1C218406488E3F657530834C7"><enum>(9)</enum><header>Public lands</header><text display-inline="yes-display-inline">The term <quote>public lands</quote> means land under the management of—</text><subparagraph id="H08179A5EF4134F44AE72E6B6473F9F43"><enum>(A)</enum><text>the Bureau of Land Management;</text></subparagraph><subparagraph id="HCF33067FF65A4A229687EC21B33AF000"><enum>(B)</enum><text>the National Park Service;</text></subparagraph><subparagraph id="H9BF805D67A524859B61A2B3D3DDDD5F3"><enum>(C)</enum><text>the United States Fish and Wildlife Service; or</text></subparagraph><subparagraph id="H4AB8C95070F445798D2489F6091C28F3"><enum>(D)</enum><text>the Bureau of Reclamation.</text></subparagraph></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20241216" chamber="House">Passed the House of Representatives December 16, 2024.</attestation-date><attestor display="yes">Kevin F.
