<legis-type>AN ACT</legis-type> 
<official-title display="yes">To authorize the Secretary of the Interior, through the Coastal Program of the United States Fish and Wildlife Service, to work with willing partners and provide support to efforts to assess, protect, restore, and enhance important coastal landscapes that provide fish and wildlife habitat on which certain Federal trust species depend, and for other purposes.</official-title>

<section id="H30265E80FF964438B11C17B11CF5D15E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coastal Habitat Conservation Act of 2023</short-title></quote>.</text></section> <section id="H9A789D0D54C3493094691FE3DC05F7BC"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to legislatively authorize the Coastal Program of the Service in effect as of the date of the enactment of this Act to conduct collaborative landscape-level planning and on-the-ground coastal habitat assessment, coastal habitat protection, coastal habitat restoration, and coastal habitat enhancement projects in priority coastal landscapes to conserve and recover Federal trust species.</text></section> 
<section id="H5BA04C8DB79949AAA07B51C393F7823C"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="H4A4A8474D2DF446EAD94E8CB5C4081D6"><enum>(1)</enum><header>Coastal ecosystem</header><text>The term <term>coastal ecosystem</term> means a biological community of organisms interacting with each other and their habitats in a coastal landscape.</text></paragraph> 
<paragraph id="H2EAB4B59A57D4FBCB20F29FED338A62E"><enum>(2)</enum><header>Coastal habitat assessment</header><text>The term <term>coastal habitat assessment</term> means the process of evaluating the physical, chemical, and biological function of a coastal site to determine the value of the site to fish and wildlife.</text></paragraph> <paragraph id="H736F18A25AC141D79FADCCD02C5A2972"><enum>(3)</enum><header>Coastal habitat enhancement</header><text>The term <term>coastal habitat enhancement</term> means the manipulation of the physical, chemical, or biological characteristics of a coastal ecosystem to increase or decrease specific biological functions that make the ecosystem valuable to fish and wildlife.</text></paragraph> 
<paragraph id="H2B8215C9528B4282A6F9A78C64172DA4"><enum>(4)</enum><header>Coastal habitat planning</header><text>The term <term>coastal habitat planning</term> means the process of developing a comprehensive plan that—</text> <subparagraph id="H2B0F6184C82F41968FF8D89072681A17"><enum>(A)</enum><text>characterizes a coastal ecosystem;</text></subparagraph> 
<subparagraph id="H0433FAA814F74032A8F7D1D40E67C12C"><enum>(B)</enum><text>sets protection, restoration, or enhancement goals and identifies the priorities of those goals;</text></subparagraph> <subparagraph id="H05727137D2E449FE99DEACC6CE98C237"><enum>(C)</enum><text>describes conservation strategies and methodologies;</text></subparagraph> 
<subparagraph id="HDAFB8E1F7AF94569A41EE27F2A665283"><enum>(D)</enum><text>establishes a timetable for implementation of the plan; and</text></subparagraph> <subparagraph id="HC90C47EABF714BD898D3279A2D82F345"><enum>(E)</enum><text>identifies roles of participants and stakeholders.</text></subparagraph></paragraph> 
<paragraph id="H30149110AAC94D7FA988CD7C769B3AD8"><enum>(5)</enum><header>Coastal habitat protection</header> 
<subparagraph id="H63C8EB73261E438DA9708EC3268A41E2"><enum>(A)</enum><header>In general</header><text>The term <term>coastal habitat protection</term> means a long-term action to safeguard habitat of value to fish and wildlife in a coastal ecosystem.</text></subparagraph> <subparagraph id="H7F88E5CDF95A4FB4B0C9F7EF26ADE175" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Inclusion</header><text>The term <term>coastal habitat protection</term> includes activities to support establishment of a conservation easement or fee title acquisition by Federal and non-Federal partners.</text></subparagraph></paragraph> 
<paragraph id="HCF59D65027604C39A3A1C91E162C4EEE" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header>Coastal habitat restoration</header><text>The term <term>coastal habitat restoration</term> means the manipulation of the physical, chemical, or biological characteristics of a coastal ecosystem with the goal of returning, to the maximum extent practicable, the full natural biological functions to lost or degraded native habitat.</text></paragraph> <paragraph id="H0018F6559C854B00AED47145F616117C"><enum>(7)</enum><header>Coastal landscape</header><text>The term <term>coastal landscape</term> means a portion of a coastal ecosystem within or adjacent to a coastal State that contains various habitat types, including—</text> 
<subparagraph id="H15B486544C2B49FAB635169C72B913EC"><enum>(A)</enum><text>a fresh or saltwater wetland in a coastal watershed;</text></subparagraph> <subparagraph id="HED68B830F217441B8ED892126E96D7EC"><enum>(B)</enum><text>a coastal river, stream, or waterway;</text></subparagraph> 
<subparagraph id="H7BEC12651917470F8CAE16BBF1C6A872"><enum>(C)</enum><text>a coastal bay or estuary;</text></subparagraph> <subparagraph id="H46A9703305F84A058E8E66A924287340"><enum>(D)</enum><text>a seagrass bed, reef, or other nearshore marine habitat;</text></subparagraph> 
<subparagraph id="H2FBC465C4FE24E8F9CAED67A8A6EDA97"><enum>(E)</enum><text>a beach or dune system;</text></subparagraph> <subparagraph id="H0EE8B99250F04D72B1906032FC5CE16B"><enum>(F)</enum><text>a mangrove forest; and</text></subparagraph> 
<subparagraph id="H72C26E07D52549EEB4CE0DCCC6C6026B"><enum>(G)</enum><text>an associated coastal upland. </text></subparagraph></paragraph> <paragraph id="H1B23AE3ED96A4D498B46A1C6D11C05C6" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header>Coastal State</header><text>The term <term>coastal State</term> means—</text> 
<subparagraph id="H3E9AC16954B24D359D5C1E2498F6697D"><enum>(A)</enum><text>a State in, or bordering on, the Atlantic, Pacific, or Arctic Ocean, the Gulf of Mexico, the Long Island Sound, or 1 or more of the Great Lakes;</text></subparagraph> <subparagraph id="H484CEB80FE604C95B299A379CEAD1856"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph> 
<subparagraph id="HE5D3D2A397404AA38662C2F809796794"><enum>(C)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph> <subparagraph id="H2D26A761F7814FD7860D391FB788ABA2"><enum>(D)</enum><text>Guam;</text></subparagraph> 
<subparagraph id="H22231980A5FA47AFB57440A464E3ADF7"><enum>(E)</enum><text>American Samoa;</text></subparagraph> <subparagraph id="H64EC7DC857564DE2AF6524570669ABB2"><enum>(F)</enum><text>the Commonwealth of the Northern Mariana Islands;</text></subparagraph> 
<subparagraph id="H9C4129BDF4554965B54D108E8F2EA13F" commented="no"><enum>(G)</enum><text>the Federated States of Micronesia;</text></subparagraph> <subparagraph id="H2894B4619363409EB132C141BB04C8E2" commented="no"><enum>(H)</enum><text>the Republic of the Marshall Islands;</text></subparagraph> 
<subparagraph id="H85C2A9B55D214300983583DA7591ABFC" commented="no"><enum>(I)</enum><text>the Republic of Palau; and</text></subparagraph> <subparagraph id="H9EBA30B172404C04BCD91469CE87FF52"><enum>(J)</enum><text>the United States Virgin Islands.</text></subparagraph></paragraph> 
<paragraph id="H4DACAFD5C5F644E6B3BF82E4803CD9BA"><enum>(9)</enum><header>Federal trust species</header><text>The term <term>Federal trust species</term> means migratory birds, threatened species or endangered species listed under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>), interjurisdictional fish, and marine mammals for which the Secretary has management authority.</text></paragraph> <paragraph id="H61B80EB1215741D488B84D2D488D397D"><enum>(10)</enum><header>Financial assistance</header><text display-inline="yes-display-inline">The term <term>financial assistance</term> means Federal funding provided to Federal, State, local, or Tribal governments, nongovernmental institutions, nonprofit organizations, and private individuals and entities through a grant or cooperative agreement.</text></paragraph> 
<paragraph id="H7665BD0788784DC7B7EC9C0372A1759F"><enum>(11)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> <paragraph id="H70A493CDE30E42D3A42768AEF86C6002"><enum>(12)</enum><header>Service</header><text>The term <term>Service</term> means the United States Fish and Wildlife Service.</text></paragraph> 
<paragraph id="HB6A42B5F5C244375A24745782F486D81"><enum>(13)</enum><header>Technical assistance</header><text>The term <term>technical assistance</term> means a collaboration, facilitation, or consulting action relating to a coastal habitat planning, coastal habitat assessment, coastal habitat protection, coastal habitat restoration, or coastal habitat enhancement project or initiative in which the Service contributes scientific knowledge, skills, and expertise to the project or initiative.</text></paragraph></section> <section id="H0B895E21141743F2BC8E535928F2C20A"><enum>4.</enum><header>Coastal program</header><text display-inline="no-display-inline">The Secretary shall carry out the Coastal Program within the Service to—</text> 
<paragraph id="H5D2E9C30EEB249D2B00781D5863D4918"><enum>(1)</enum><text>identify the leading threats to priority coastal landscapes and conservation actions to address those threats in partnership with Federal, State, local, and Tribal governments, nongovernmental institutions, nonprofit organizations, and private individuals and entities; </text></paragraph> <paragraph id="HF4BA77EE985741868BBDFCC5EC086665"><enum>(2)</enum><text display-inline="yes-display-inline">provide technical assistance and financial assistance through partnerships with Federal, State, local, and Tribal governments, nongovernmental institutions, nonprofit organizations, and private individuals and entities to conduct voluntary coastal habitat planning, coastal habitat assessment, coastal habitat protection, coastal habitat restoration, and coastal habitat enhancement projects on public land or private land;</text></paragraph> 
<paragraph id="H443BDD2BC9D74E8FB99377EF22A275A2"><enum>(3)</enum><text>ensure the health and resilience of coastal ecosystems through adaptive management procedures based on the best available science;</text></paragraph> <paragraph id="H3219CA95BFAC4CF9BBA29EB8E231A35F"><enum>(4)</enum><text display-inline="yes-display-inline">build the capacity of Federal, State, local, and Tribal governments, nongovernmental institutions, nonprofit organizations, and private individuals and entities to carry out environmental conservation and stewardship measures;</text></paragraph> 
<paragraph id="HDD94386AC9E14DDA897C522F86A336AB"><enum>(5)</enum><text>assist in the development and implementation of monitoring protocols to ensure the success of coastal ecosystem restoration and coastal ecosystem enhancement measures; and</text></paragraph> <paragraph id="H5DF36B83D6BC4CD8BC29991DA59D6089"><enum>(6)</enum><text>collaborate and share information with partners and the public relating to best management practices for the conservation, restoration, and enhancement of coastal ecosystems.</text></paragraph></section> 
<section id="H9DC290325C6C452F8244A7328B56F1B0"><enum>5.</enum><header>Reports</header> 
<subsection id="H2417CFE5F65D45E498BF308AD80E1C05"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary, acting through the Director of the Service, shall submit to the Committees on Appropriations and Natural Resources of the House of Representatives and the Committees on Appropriations and Environment and Public Works of the Senate, and make available to the public on the website of the Service, a report on the Coastal Program carried out under this Act.</text></subsection> <subsection id="H2FF4E25DA5094834A703AA81E216ECE4" commented="no"><enum>(b)</enum><header>Requirements</header><text>Each report submitted under subsection (a) shall assess on regional and nationwide bases—</text> 
<paragraph id="H2D783744625B4D9DB03F3C3DB8D91855" commented="no"><enum>(1)</enum><text>Coastal Program work on coastal ecosystems;</text></paragraph> <paragraph id="H3589E9D78A6E49BE91DCB758B650992C" commented="no"><enum>(2)</enum><text>progress made by the Coastal Program toward identifying the leading threats to priority coastal landscapes and conservation actions to address those threats; and</text></paragraph> 
<paragraph id="H78B9EED478F34555A2E5A322E905A204" commented="no"><enum>(3)</enum><text>prospects for, and success of, protecting, restoring, and enhancing coastal ecosystems.</text></paragraph></subsection> <subsection id="H610DD278256348ECBDB39870B7F754DA" commented="no"><enum>(c)</enum><header>Inclusions</header><text>Each report submitted under subsection (a) shall include—</text> 
<paragraph id="HDC7E2892E9EE4886ABD78D217EB5B3DA" commented="no"><enum>(1)</enum><text>quantitative information on coastal landscapes protected, restored, or enhanced;</text></paragraph> <paragraph id="HED7B42FC8F7F42E694BB500ED4F78C8F" commented="no"><enum>(2)</enum><text>funds appropriated to the Coastal Program that have been expended or leveraged;</text></paragraph> 
<paragraph id="H6503CA9B68804BD7A8921CBD54D1498B" commented="no"><enum>(3)</enum><text>a description of adaptive management practices implemented; and</text></paragraph> <paragraph id="H6EB7D26387B145328F97BE8B444C77E4" commented="no"><enum>(4)</enum><text>a description of emerging challenges or data gaps that hinder the ability of the Coastal Program to achieve the purpose of this Act.</text></paragraph></subsection></section> 
<section id="H9E7403C04C644822BDAC94F1BFB24731" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act $16,957,000 for each of fiscal years 2024 through 2028.</text></section> </legis-body> <attestation><attestation-group><role>Speaker of the House of Representatives.</role></attestation-group><attestation-group><role>Vice President of the United States and President of the Senate.</role></attestation-group></attestation> </bill>
