<official-title display="yes">To amend the Omnibus Budget Reconciliation Act of 1993 to provide for security of tenure for use of mining claims for ancillary activities, and for other purposes.</official-title>

<section id="HB92A80EB7AA84F1C9A78A4F69E1C34B7" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mining Regulatory Clarity Act of 2024</short-title></quote>.</text></section> <section id="H7D022E695F38429F86476ED67391198F"><enum>2.</enum><header>Use of Mining Claims for Ancillary Activities</header><text display-inline="no-display-inline">Section 10101 of the Omnibus Budget Reconciliation Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/30/28f">30 U.S.C. 28f</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H31C0B7DE3B6642B486176E0B40F2DBBC"><enum>(e)</enum><header>Security of Tenure</header>
<paragraph id="HC10CA063DAB04E4DA56B37C2E655578D"><enum>(1)</enum><header>Claimant Rights</header>
<subparagraph id="H445006341175448CB1E5CEDF79E9E745"><enum>(A)</enum><header>Definition of Operations</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>operations</quote> means—</text> <clause id="HF7C9145A863A4D31A7899E4CF7C438D6"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to a locatable mineral, any activity or work carried out in connection with—</text>
<subclause id="HCDC158CCBCE144BCAF221DA9FCDBF9A0"><enum>(I)</enum><text>prospecting;</text></subclause> <subclause id="H419DF19FF719460CB89518F5DB513D6D"><enum>(II)</enum><text>exploration;</text></subclause>
<subclause id="HB9AB42A0D1EE4721B9B57DD0C3C54DA7"><enum>(III)</enum><text>discovery and assessment;</text></subclause> <subclause id="HBF1C980C29BF49A086A41667111490C9"><enum>(IV)</enum><text>development;</text></subclause>
<subclause id="HD9AF67BB0EA44C91B86E7B0868C94770"><enum>(V)</enum><text>extraction; or</text></subclause> <subclause id="HA2D3333869144604A2D712EA61895A2B"><enum>(VI)</enum><text>processing;</text></subclause></clause>
<clause id="H5C2BD97C8815486EB0E014E48003AF3C"><enum>(ii)</enum><text display-inline="yes-display-inline"> the reclamation of an area disturbed by an activity described in clause (i); and</text></clause> <clause id="HBE410AD7A2F24A4F85F75ADCD4468AF4"><enum>(iii)</enum><text display-inline="yes-display-inline">any activity reasonably incident to an activity described in clause (i) or (ii), regardless of whether that incidental activity is carried out on a mining claim, including the construction and maintenance of any road, transmission line, pipeline, or any other necessary infrastructure or means of access on public land for a support facility.</text></clause></subparagraph>
<subparagraph id="H920695EC70D947068DD49A5E404DD487"><enum>(B)</enum><header>Rights to Use, Occupation, and Operations</header><text display-inline="yes-display-inline">A claimant shall have the right to use and occupy to conduct operations on public land, with or without the discovery of a valuable mineral deposit, if—</text> <clause id="H5A55E2E37E64422994AE1B05D522B152"><enum>(i)</enum><text>the claimant makes a timely payment of—</text>
<subclause id="H2DAD0481FBB741A98E092ED5FAFA22BA"><enum>(I)</enum><text display-inline="yes-display-inline"> the location fee required by section 10102; and</text></subclause> <subclause id="H2954F4ED73AD4EC4A3B2407CCA3FA151"><enum>(II)</enum><text display-inline="yes-display-inline"> the claim maintenance fee required by subsection (a); or</text></subclause></clause>
<clause id="HE9A01A892EC343A89E046E2B44F89B6D"><enum>(ii)</enum><text display-inline="yes-display-inline"> in the case of a claimant who qualifies for a waiver of the claim maintenance fee under subsection (d)—</text> <subclause id="HEDD90292969B433EB5CAD5209BED3F37"><enum>(I)</enum><text display-inline="yes-display-inline"> the claimant makes a timely payment of the location fee required by section 10102; and</text></subclause>
<subclause id="HC87F4DB2B1AE4E64A4D3CB90E006A1A3"><enum>(II)</enum><text display-inline="yes-display-inline"> the claimant complies with the required assessment work under the general mining laws.</text></subclause></clause></subparagraph></paragraph> <paragraph id="H5AED50676C094295AB9EFBE25EF128BF"><enum>(2)</enum><header>Fulfillment of Federal Land Policy and Management Act of 1976</header><text display-inline="yes-display-inline">A claimant that fulfills the requirements of this section and section 10102 shall be deemed to satisfy any requirements under the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>) for the payment of fair market value to the United States for the use of public land and resources pursuant to the general mining laws.</text></paragraph>
<paragraph id="H01AB1BF717274F1AA9AB836F1ECB50BE"><enum>(3)</enum><header>Savings Clause</header><text>Nothing in this subsection—</text> <subparagraph id="H9AC7D8CACBBB4F37AE91966E54F772B5"><enum>(A)</enum><text display-inline="yes-display-inline"> diminishes any right (including a right of entry, use, or occupancy) of a claimant;</text></subparagraph>
<subparagraph id="HCCA81777F1B2406BA06CA8D7711632C0"><enum>(B)</enum><text display-inline="yes-display-inline"> creates or increases any right (including a right of exploration, entry, use, or occupancy) of a claimant on lands that are not open to location under the general mining laws;</text></subparagraph> <subparagraph id="H1AD4C3DF8B6E44CC80099461E79D22CE"><enum>(C)</enum><text display-inline="yes-display-inline">modifies any provision of law or any prior administrative action withdrawing lands from location or entry;</text></subparagraph>
<subparagraph id="HBF0BD96877AA47268167011796A030E8"><enum>(D)</enum><text display-inline="yes-display-inline">limits the right of the Federal Government to regulate mining and mining-related activities (including requiring claim validity examinations to establish the discovery of a valuable mineral deposit) in areas withdrawn from mining (including under—</text> <clause id="H0D65794D7BB14568BECF054E5F419A94"><enum>(i)</enum><text>the general mining laws;</text></clause>
<clause id="HC2A6B125293D4776A11101100D621F17"><enum>(ii)</enum><text display-inline="yes-display-inline"> the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1701">43 U.S.C. 1701 et seq.</external-xref>);</text></clause> <clause id="HC21B3C9E6169410C80FD195641930229"><enum>(iii)</enum><text display-inline="yes-display-inline"> the Wilderness Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1131">16 U.S.C. 1131 et seq.</external-xref>);</text></clause>
<clause id="H2DF2ED1FA43341649A1B5E50C0DCFACA"><enum>(iv)</enum><text display-inline="yes-display-inline"> sections 100731 through 100737 of title 54, United States Code (commonly referred to as the ‘Mining in the Parks Act’);</text></clause> <clause id="HFEFCDDC76B2041589D3FB1EFF2C4B647"><enum>(v)</enum><text display-inline="yes-display-inline"> the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or</text></clause>
<clause id="HCBBE840FAE5542AD9228E9487B80E042"><enum>(vi)</enum><text display-inline="yes-display-inline"> division A of subtitle III of title 54, United States Code (commonly referred to as the ‘National Historic Preservation Act’)); or</text></clause></subparagraph> <subparagraph id="H797218A8CB9844BABBCABB1A50F8A738"><enum>(E)</enum><text display-inline="yes-display-inline"> restores any right (including a right of entry, use, or occupancy, or right to conduct operations) of a claimant that existed prior to the date that the lands were closed to or withdrawn from location under the general mining laws and that has been extinguished by such closure or withdrawal.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
