and</text></paragraph><paragraph id="H1CEA991A8F694E5C82AFB1A3C6FAC7A0"><enum>(4)</enum><text display-inline="yes-display-inline">facility operation costs that are directly related to activities described in paragraphs (1), (2), and (3).</text></paragraph></subsection><subsection id="HF965F12CA7784D1984A26F02DE7F80C6"><enum>(d)</enum><header>Equitable distribution of funds</header><text display-inline="yes-display-inline">The Secretary shall ensure, to the extent practicable, that funds awarded under this section are distributed equitably among stranding and rehabilitation regions, taking into account—</text><paragraph id="H1120398B95BF418FAC626B5090A73C65"><enum>(1)</enum><text display-inline="yes-display-inline">the number of stranding and rehabilitation events that occurred in each stranding and rehabilitation region in the preceding 5 years; and</text></paragraph><paragraph id="H04D0FCD76DB84DFFA16C7D0CD23235BB"><enum>(2)</enum><text display-inline="yes-display-inline">the conservation priorities and recovery needs of species of marine turtles that are threatened or endangered under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></paragraph></subsection><subsection id="H2E3889321C194C76A2448106F2582746"><enum>(e)</enum><header>Application</header><text display-inline="yes-display-inline">An applicant for a grant under this section shall submit an application in such form and manner as the Secretary shall prescribe.</text></subsection><subsection id="H60FF84FB0E0440D5A8E3348865B358F1"><enum>(f)</enum><header>Grant criteria</header><paragraph id="H8F7CDC7CD78248EDB966AB945B4A13BC"><enum>(1)</enum><header>Development of criteria</header><text display-inline="yes-display-inline">The Secretary shall, in consultation with the Director of the United States Fish and Wildlife Service, establish by regulation appropriate criteria for awarding grants under this section.</text></paragraph><paragraph id="H10D8184EDFBE4892BA047E3FFD8DEB3E"><enum>(2)</enum><header>Stakeholder engagement</header><text display-inline="yes-display-inline">As part of the process for developing and finalizing criteria under paragraph (1), the Secretary shall, in consultation with the Director of the United States Fish and Wildlife Service, provide opportunities for engagement with representatives from stranding and rehabilitation regions and representatives of State governments and public and private organizations with an established record in coordination, rescue, rehabilitation, and release, as well as related scientific research, marine conservation, and forensic science, with respect to stranded marine turtles.</text></paragraph><paragraph id="H352BAC2B6B2D4F2D929781552C392D70"><enum>(3)</enum><header>Required criteria</header><text display-inline="yes-display-inline">The criteria developed under paragraph (1) shall prioritize applicants with an established record of coordination, rescuing, rehabilitation, scientific research, and forensic science with respect to stranded and rehabilitated marine turtles or conducting scientific research and forensic science on stranded and rehabilitated marine turtles.</text></paragraph></subsection><subsection id="H9985E9258BA64CDB9AE205BFCB88E30E"><enum>(g)</enum><header>Limitations</header><paragraph id="H23DDA43735D0409F8836468E76DAAD22"><enum>(1)</enum><header>Maximum amount of grant</header><text display-inline="yes-display-inline">No grant awarded under this section may exceed $150,000 in any 12-month period.</text></paragraph><paragraph id="HC34C588DADFA4A7596BEC7ACE657F747"><enum>(2)</enum><header>Matching requirement</header><text display-inline="yes-display-inline">The non-Federal share of the costs of an activity conducted with a grant awarded under the Program shall be not less than 50 percent of such costs, including in-kind services and the use of property.</text></paragraph></subsection><subsection id="HD10AFBFC65E449B5B899D55DF772638D"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HA47766FB976C44B0BC39B9EE4090C9D1"><enum>(1)</enum><header>Marine turtle</header><text display-inline="yes-display-inline">The term <quote>marine turtle</quote> means any member of the family Cheloniidae or Dermochelyidae.</text></paragraph><paragraph id="H39CED767F49F4C15B7FB75159A85BDF9"><enum>(2)</enum><header>Program</header><text display-inline="yes-display-inline">The term <quote>Program</quote> means the Sea Turtle Rescue Assistance and Rehabilitation Grant Program established under subsection (a).</text></paragraph><paragraph id="HEB59C5AEFDC44DE7B6250318ADE0A0D6"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Commerce.</text></paragraph><paragraph id="H4E74F32538C4482B8C72FDAED4FFE3CB"><enum>(4)</enum><header>Stranding</header><text>The term <quote>stranding</quote> means an event in which—</text><subparagraph id="H81926823F0DF4DB68B336CD41FB4A6BA"><enum>(A)</enum><text display-inline="yes-display-inline">a marine turtle is dead and is—</text><clause id="H281B12C494704460AF985A13F243E171"><enum>(i)</enum><text>on a beach or shore of the United States; or</text></clause><clause id="H80F3352CA5CF454F92FAAF711E8DAFDA"><enum>(ii)</enum><text>in waters under the jurisdiction of the United States (including any navigable waters); or </text></clause></subparagraph><subparagraph id="H1E657D44695E4E4897FACE0C970C749F"><enum>(B)</enum><text>a marine turtle is alive and is—</text><clause id="H51EA48A819E045D3AC5821F99185C389"><enum>(i)</enum><text>on a beach or shore of the United States and unable to return to the water;</text></clause><clause id="HABB9C9E8463747FA9E01F473AE9E6B90"><enum>(ii)</enum><text>on a beach or shore of the United States and in need of medical attention; or</text></clause><clause id="H3D53BA9D0C3C4699A80AA638C0DE4FD1"><enum>(iii)</enum><text>in waters under the jurisdiction of the United States (including any navigable waters), and in need of medical attention or other necessary intervention to aid its likelihood of survival.</text></clause></subparagraph></paragraph><paragraph id="H42439833B5134B7B848B2AC2FC3E7F56"><enum>(5)</enum><header>Stranding and rehabilitation region</header><text display-inline="yes-display-inline">The term <quote>stranding and rehabilitation region</quote> means a geographic region designated by the Secretary under subsection (b).</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date date="20240402">April 2, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
