<section id="H55AC8AF5D9074705ABC255E9053FC548" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Default Prevention Act</short-title></quote>. </text></section> <section id="H0C4CE422D0B14CB7B9911487541DB8AA" section-type="subsequent-section"><enum>2.</enum><header>Payment of obligations</header> <subsection display-inline="no-display-inline" id="H9D4E7B5D2D56436685725E3DB8B4FD6A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">At any time that the debt of the United States Government subject to limitation under section 3101 of title 31, United States Code, has reached the limitation imposed under such section, the Secretary of the Treasury (hereafter in this section referred to as <quote>the Secretary</quote>) shall—</text> 
<paragraph id="HAC99D888CCAE496DA017E70CA7286A3E"><enum>(1)</enum><text display-inline="yes-display-inline">pay Tier I obligations as such obligations become due,</text></paragraph> <paragraph id="H13A11C0B65B542FD8217F5419FFBE6D6"><enum>(2)</enum><text>issue such obligations under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/31">chapter 31</external-xref> of title 31, United States Code, as—</text> 
<subparagraph id="H22F41D3FBE7640BEA9EA34A3DDF2266B"><enum>(A)</enum><text>are necessary to make the payments described in paragraph (1), or</text></subparagraph> <subparagraph id="HAE2F545DB23846219EE5DF808E462D94"><enum>(B)</enum><text>are to be held exclusively by a trust fund referred to in subsection (b)(1)(A),</text></subparagraph></paragraph> 
<paragraph id="H9DA6084A970346F8804908C19B866B90"><enum>(3)</enum><text>pay Tier III obligations only to the extent that the Secretary can still pay all Tier II obligations as such obligations become due,</text></paragraph> <paragraph id="H535EFB2D340B4E4484C046B83EC22765"><enum>(4)</enum><text>pay Tier IV obligations only to the extent that the Secretary can still pay all Tier II and Tier III obligations as such obligations become due,</text></paragraph> 
<paragraph id="HEC35D48AFB6E4A04B94285936716FC18"><enum>(5)</enum><text>pay Tier V obligations only to the extent that the Secretary can still pay all Tier II, Tier III, and Tier IV obligations as such obligations become due, and</text></paragraph> <paragraph id="H35CADED6345241A1847721D9C097DCC9"><enum>(6)</enum><text display-inline="yes-display-inline">submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a weekly written report containing the information described in subsection (d).</text></paragraph></subsection> 
<subsection id="HBA3544DA588649A8989E2548E77332CD"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section—</text> <paragraph id="H2CC20E7C8E014276B90A3267A6AD5883"><enum>(1)</enum><header>Tier I obligations</header><text>The term <quote>Tier I obligations</quote> means payments necessary to provide any of the following:</text> 
<subparagraph id="H947CD88F3E41442DADBC06460581E14D"><enum>(A)</enum><text display-inline="yes-display-inline">Payment with legal tender pursuant to the authority provided under section 3123 of title 31, United States Code, of principal and interest on debt held by—</text> <clause id="H5E6F8CE588BB45F582CF13ACB8B10F44"><enum>(i)</enum><text>the public,</text></clause> 
<clause id="HF630B1E3101B417AB353BA4471CBB6FA"><enum>(ii)</enum><text>the Federal Old-Age and Survivors Insurance Trust Fund or the Federal Disability Insurance Trust Fund, or</text></clause> <clause id="H2F64F3676B9A4AD59FECAE73DA5BCE0F"><enum>(iii)</enum><text display-inline="yes-display-inline">the Federal Hospital Insurance Trust Fund or the Federal Supplementary Medical Insurance Trust Fund.</text></clause></subparagraph> 
<subparagraph id="H2558A1C88B1E406EADEEB1096DD09C74" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">Payments under the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>).</text></subparagraph></paragraph> <paragraph id="H1080B7745D4B45BABA60BDDC2FBD7924"><enum>(2)</enum><header>Tier II obligations</header><text display-inline="yes-display-inline">The term <quote>Tier II obligations</quote> means payments necessary to provide any of the following:</text> 
<subparagraph id="H6B2B844CF5E5465181553081D06F1CFD" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Any obligation of the Department of Defense. </text></subparagraph> <subparagraph id="HE3B7A7405DA240ADBD9B6342A2AD6583" commented="no"><enum>(B)</enum><text>Benefits under laws administered by the Secretary of Veterans Affairs.</text></subparagraph></paragraph> 
<paragraph id="H8CB241D21CEF4F208503B05D9A87EA4A"><enum>(3)</enum><header>Tier III obligations</header><text>The term <quote>Tier III obligations</quote> means any obligation of the United States which is not a Tier I, Tier II, Tier IV, or Tier V obligation.</text></paragraph> <paragraph id="HCC65642728FA4EE1B43EB02FB5E5578F"><enum>(4)</enum><header>Tier IV obligations</header><text>The term <quote>Tier IV obligations</quote> means any payment which constitutes any of the following:</text> 
<subparagraph id="H856E4876ED324FC1A40511FC339D6516"><enum>(A)</enum><text>Compensation for any Federal employee for official time under section 7131 of such title 5, United States Code. </text></subparagraph> <subparagraph id="H4982C27118554539AA2CDED72EE9AB93"><enum>(B)</enum><text>Any payment for travel expenses for any officer or employee of the Executive branch of Government, including the President and Vice President, unless such payment is a Tier I or Tier II obligation.</text></subparagraph> 
<subparagraph id="HABC36CBC18C34CB3A88198C0B69AE8A3"><enum>(C)</enum><text>Compensation of any officer or employee of the Executive branch of Government (other than an individual in the competitive service, as defined in section 2102 of title 5, United States Code), including the President and Vice President, unless such compensation is a Tier I or Tier II obligation.</text></subparagraph></paragraph> <paragraph id="H14D23067BE224CA39EB81D3468BF9AAA"><enum>(5)</enum><header>Tier V obligations</header><text>The term <quote>Tier V obligations</quote> means compensation of any Member of Congress (as that term is defined in section 2106 of title 5, United States Code).</text></paragraph></subsection> 
<subsection id="HE786ADFDA62045C1BC0BC307E4E23717"><enum>(c)</enum><header>Coordination with public debt limit</header><text display-inline="yes-display-inline">Obligations issued under subsection (a)(2) shall not be taken into account as subject to the limitation imposed under section 3101(b) of title 31, United States Code. The preceding sentence shall not apply with respect to any obligation after the first date (after the issuance of such obligation) on which any modification or suspension of such limitation takes effect.</text></subsection> <subsection commented="no" id="H03037921517F43E0A603F8F7C7C78FD1"><enum>(d)</enum><header>Weekly reports</header><text display-inline="yes-display-inline">The written report referred to in subsection (a)(6) shall include, with respect to the period covered by such report—</text> 
<paragraph id="HBE97930445BE4D3AA758308F0A498F33"><enum>(1)</enum><text>the amount of Tier I obligations paid under subsection (a)(1) during such period,</text></paragraph> <paragraph id="H6318B570F748495FA246312C58E493D3"><enum>(2)</enum><text>the amount of obligations issued under subsection (a)(2) during such period, and</text></paragraph> 
<paragraph id="HC29617C2D3DA459C9359BBE6ACE5E13A"><enum>(3)</enum><text>the amount of Tier II obligations, Tier III obligations, Tier IV obligations, and Tier V obligations which were paid during such period (stated separately for each tier) and the aggregate amount of such obligations which were due and unpaid as of the close of such period (stated separately for each tier).</text></paragraph></subsection> <subsection id="HB59337F98B234507A845452B381ACFA5"><enum>(e)</enum><header>No inference with respect to existing authority to prioritize payments</header><text display-inline="yes-display-inline">During any period with respect to which this section does not apply, nothing in this section shall be interpreted to restrict the authority of the Secretary to prioritize the payment of certain obligations over other obligations.</text></subsection></section>
