which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><action display="yes"><action-date date="20240405">April 5, 2024</action-date><action-desc>Additional sponsors: <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="C001130">Ms. Crockett</cosponsor>, <cosponsor name-id="N000002">Mr. Nadler</cosponsor>, <cosponsor name-id="M001225">Mr. Mullin</cosponsor>, <cosponsor name-id="O000172">Ms. Ocasio-Cortez</cosponsor>, <cosponsor name-id="A000376">Mr. Allred</cosponsor>, <cosponsor name-id="M001188">Ms. Meng</cosponsor>, <cosponsor name-id="B000574">Mr. Blumenauer</cosponsor>, <cosponsor name-id="L000600">Mr. Langworthy</cosponsor>, <cosponsor name-id="W000822">Mrs. Watson Coleman</cosponsor>, <cosponsor name-id="C001072">Mr. Carson</cosponsor>, <cosponsor name-id="C001125">Mr. Carter of Louisiana</cosponsor>, <cosponsor name-id="M001137">Mr. Meeks</cosponsor>, <cosponsor name-id="M000317">Ms. Malliotakis</cosponsor>, and <cosponsor name-id="M001221">Mr. Molinaro</cosponsor></action-desc></action><action display="yes"><action-date date="20240405">April 5, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on March 24, 2023</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Consumer Product Safety Commission to promulgate a consumer product safety standard with respect to rechargeable lithium-ion batteries used in micromobility devices, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HIF00" reported-display-style="italic" id="H26C24EE20F4840BBB2E3C9E869F16E58"><section id="H8FFE9875574943A7A95EB70355C076F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Setting Consumer Standards for Lithium-Ion Batteries Act</short-title></quote>. </text></section><section id="H205A21482A284C6BB89A2521EFDA9908"><enum>2.</enum><header>Consumer product safety standard for certain batteries</header><subsection id="H6B1E30E9CB2248F4ACDC3DC8BCB39ED3"><enum>(a)</enum><header>Consumer product safety standard required</header><paragraph id="H335A6932F0544ADE9F55786158E2D484"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the Consumer Product Safety Commission shall promulgate, under section 553 of title 5, United States Code, a final consumer product safety standard for rechargeable lithium-ion batteries used in micromobility devices, including electric bicycles and electric scooters, to protect against the risk of fires caused by such batteries.</text></paragraph><paragraph id="H3C76F9DD5B3644E98E800F0C0FE4824A"><enum>(2)</enum><header>Inclusion of related equipment</header><text display-inline="yes-display-inline">The standard promulgated under paragraph (1) shall include requirements with respect to equipment related to or used with rechargeable lithium-ion batteries used in micromobility devices, including battery chargers, charging cables, external terminals on battery packs, external terminals on micromobility devices, and free-standing stations used for recharging. </text></paragraph></subsection><subsection id="HAE5214FABF0B44D5B264FC2B35C2DBC6"><enum>(b)</enum><header>CPSC determination of scope</header><text display-inline="yes-display-inline">In promulgating the standard under subsection (a), the Commission shall determine the types of products subject to the standard and shall ensure that such products are—</text><paragraph id="H382A994F8B174B80B413FC742E0E3F41"><enum>(1)</enum><text>within the jurisdiction of the Commission; and</text></paragraph><paragraph id="H0813972B1BEE48CD8978C21448B04F7D"><enum>(2)</enum><text>reasonably necessary to include to protect against the risk of fires.</text></paragraph></subsection><subsection id="H3FC45BE9574F4FEEA85F6D95344DD3BB"><enum>(c)</enum><header>Modifications</header><text display-inline="yes-display-inline">At any time after the promulgation of the standard under subsection (a), the Commission may, through a rulemaking under section 553 of title 5, United States Code, modify the requirements of the standard.</text></subsection><subsection id="H0F6795401B774E168F2450B121E0CB53"><enum>(d)</enum><header>Treatment of standard</header><text display-inline="yes-display-inline">A standard promulgated under this section, including a modification of such standard, shall be treated as a consumer product safety rule promulgated under section 9 of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2058">15 U.S.C. 2058</external-xref>).</text></subsection></section></legis-body><endorsement display="yes"><action-date date="20240405">April 5, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
