<official-title display="yes">To transfer administrative jurisdiction of certain Federal lands from the Army Corps of Engineers to the Bureau of Indian Affairs, to take such lands into trust for the Winnebago Tribe of Nebraska, and for other purposes.</official-title>

<section id="HD4F5E91082B4413387F9D0D658BB5A3E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Winnebago Land Transfer Act of 2023</short-title></quote>.</text></section> <section id="H6C5684AAD7A64A27B55B5AA172561CD7"><enum>2.</enum><header>Land to be taken into trust</header> <subsection id="H0B5EF690DB9A41A886D49CD8930ABA25"><enum>(a)</enum><header>In general</header><text>Subject to all valid existing rights, all right, title, and interest (including improvements and appurtenances) of the United States in and to the Federal lands described in subsection (b), those Federal lands—</text>
<paragraph id="H29D1012BD1974D1D8337048187DDF7BF"><enum>(1)</enum><text>are declared to be part of the Winnebago Reservation created by the Treaty between the United States and the Winnebago Tribe in 1865; and</text></paragraph> <paragraph id="H34F379404B5C42C197DF083CAB76048E"><enum>(2)</enum><text>shall be held in trust by the United States for the benefit of the Winnebago Tribe of Nebraska subject to the same terms and conditions as those lands described in the Treaty with the Winnebago Tribe, 1865 (14 Stat. 671).</text></paragraph></subsection>
<subsection id="H88D15DB078514BBBBEABC750592C34D0"><enum>(b)</enum><header>Federal lands described</header><text>The Federal lands described in this subsection are the following:</text> <paragraph id="HFAB354651DE14C1993AF968D201FAD07"><enum>(1)</enum><text>That portion of Tract No. 119, the description of which is filed in the United States District Court for the Northern District of Iowa (Western Division), Civil Case No. 70–C–3015–W, executed May 11, 1973, said tract being situated in Section 8 and the accretion land thereto, the Southwest Quarter of Section 9, the West Half of Section 16, the East Half of Section 17, Township 86 North, Range 47 West of the Fifth Principal Meridian, Woodbury County, Iowa, lying Easterly of the Nebraska/Iowa State Line and Southerly of the Easterly extension of the North line of the Winnebago Reservation.</text></paragraph>
<paragraph id="HACF13DD3254F4A2CA5E406EBBA6D2BAE"><enum>(2)</enum><text>Tract No. 210, as described in Schedule <quote>A</quote> of the <quote>Declaration of Taking, Legal Description of Tract 210 and Judgment on Stipulation and Order of Distribution</quote>, filed in the United States District Court for the Northern District of Iowa (Western Division), Civil Case No. 70–C–3015–W.</text></paragraph> <paragraph id="H1B7CF87E2F7E414F91896171BD2CF600"><enum>(3)</enum><text>Tract No. 113, as described in the <quote>Judgment on Declaration of Taking and Legal Description of Tract 113</quote>, filed in the United States District Court for the District of Nebraska, Civ. No. 03498.</text></paragraph></subsection>
<subsection id="HC327D7E9624D4E9E94D9D764B0350447"><enum>(c)</enum><header>Gaming prohibition</header><text>Class II and class III gaming under the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701 et seq.</external-xref>) shall not be allowed at any time on the land taken into trust under subsection (a).</text></subsection></section> </legis-body><attestation><attestation-group><attestation-date date="20240205" chamber="House">Passed the House of Representatives February 5, 2024.</attestation-date><attestor display="no">Cheryl L.
