R. 115</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20241218" legis-day="20241216">December 18 (legislative day, December 16), 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/8">chapter 8</external-xref> of title 5, United States Code, to provide for en bloc consideration in resolutions of disapproval for <quote>midnight rules</quote>, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="HFBB0036795134E92984448B34B0DA778"><pagebreak></pagebreak><section id="H4063F231D4FC4F71A81D5E02F247DEF9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Midnight Rules Relief Act</short-title></quote>.</text></section><section id="H24923F2FD4934A8E89CF316D08D28295"><enum>2.</enum><header>En bloc consideration of resolutions of disapproval pertaining to <quote>midnight rules</quote></header><subsection id="H0AF213F131044B5083956579AAA538F5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 801(d) of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HEA659EAEEFFA4E388644DFAA3F4F6D1D" style="USC"><paragraph id="HA693AE5B31E042209A1AD7D01D766F1A" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In applying section 802 to rules described under paragraph (1), a joint resolution of disapproval may contain one or more such rules if the report under subsection (a)(1)(A) for each such rule was submitted during the final year of a President’s term.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9FA1673A4D084BFEBE5E802FC4FE7FE4"><enum>(b)</enum><header>Text of resolving clause</header><text display-inline="yes-display-inline">Section 802(a) of title 5, United States Code, is amended—</text><paragraph id="H988044958AB74549A68C56E5B2EF99E2"><enum>(1)</enum><text>by inserting after <quote>resolving clause of which is</quote> the following: <quote>(except as otherwise provided in this subsection)</quote>; and</text></paragraph><paragraph id="H5E39FA66E4184485B17A9549B45F1CE9"><enum>(2)</enum><text>by adding at the end the following: <quote>In the case of a joint resolution under section 801(d)(4), the matter after the resolving clause of such resolution shall be as follows: <quote>That Congress disapproves the following rules: the rule submitted by the __ relating to __; and the rule submitted by the __ relating to __. Such rules shall have no force or effect.</quote> (The blank spaces being appropriately filled in and additional clauses describing additional rules to be included as necessary).</quote>.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20241217" chamber="House">Passed the House of Representatives December 17, 2024.</attestation-date><attestor display="yes">Kevin F.
