<section id="H94292B3BA87142B29A5BC4168C24797D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Medical Center Facility Transparency Act</short-title></quote>.</text></section> <section id="H8F0912A344C24D42828AEB7D3091AC66" section-type="subsequent-section"><enum>2.</enum><header>Information on medical facilities of the Department of Veterans Affairs</header> <subsection id="HDC1BDFC5A8E2431485641A1BBED21E41"><enum>(a)</enum><header>Fact sheets</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall ensure that each director of a medical center of the Department of Veterans Affairs submits to the Secretary, the Committees on Veterans’ Affairs of the House of Representatives and the Senate, and the appropriate Members of Congress the following:</text> 
<paragraph id="H3AFE389D43B040C698E8EEC41FA822E2"><enum>(1)</enum><text display-inline="yes-display-inline">An annual concise, easy-to-read fact sheet containing, with respect to the year covered by the fact sheet each of the following:</text> <subparagraph id="HC268018FC9594CE299F4BC3E19FE125E"><enum>(A)</enum><text>Statistics regarding—</text> 
<clause id="H84E519A982B54A8FA4D457F14CCB113A"><enum>(i)</enum><text>the number of veterans who were treated at a medical facility of the Department under the jurisdiction of the director;</text></clause> <clause id="H650E15ECE07F43B188242A67727DFF1D"><enum>(ii)</enum><text>the number of appointments conducted by each such facility;</text></clause> 
<clause id="H9D4F7FE0DD1B450E8E16CB43A99BEBC7"><enum>(iii)</enum><text>the most common illnesses or conditions for which treatment was furnished;</text></clause> <clause id="HA783C53354CF463FA0EB15A4FFC8E41F"><enum>(iv)</enum><text>the satisfaction of veterans who were treated at each such facility;</text></clause> 
<clause id="HA7AB5BBEA34B4BF2A141191F862A51F4"><enum>(v)</enum><text>how each such facility compares with other facilities with respect to the satisfaction of veterans who were treated at the facilities; and</text></clause> <clause id="HCF7D90746D2F47679EFD7499EA64FA8F"><enum>(vi)</enum><text>other matters the director determines appropriate.</text></clause></subparagraph> 
<subparagraph id="H1F8CD1ABB5BC48D9AAAED2462F076C5D" commented="no"><enum>(B)</enum><text>A description of any successes or achievements experienced by such facilities, including—</text> <clause id="H2AB3047593944BBE885873B2C77C48FD" commented="no"><enum>(i)</enum><text>actions taken to improve such facilities;</text></clause> 
<clause id="H3982BB5865F6467EB35F09F82DB14A05"><enum>(ii)</enum><text>actions taken to improve the access to and quality of the care provided at such facilities; and</text></clause> <clause id="HA2E0FF3485D448E395A473CA1703A339"><enum>(iii)</enum><text>any other accomplishments determined appropriate by the director.</text></clause></subparagraph> 
<subparagraph id="HD7C771749A7B4E44BA2C5389FFE7959F"><enum>(C)</enum><text display-inline="yes-display-inline">A description of special areas of emphasis or specialization by such facilities, such as efforts aimed at meeting the needs of women veterans, suicide prevention and other mental health initiatives, opioid abuse prevention and pain management, or special efforts on veteran homelessness, or other matters as the director determines appropriate.</text></subparagraph> <subparagraph id="H4FA48821DC104D049095C37C3E8971B0"><enum>(D)</enum><text>A description of matters concerning such facilities that have previously been identified as deficient and needing remediation that are still in need of such remediation.</text></subparagraph></paragraph> 
<paragraph id="HDC094A47DA244DCC8033EB8A71D72DC0"><enum>(2)</enum><text display-inline="yes-display-inline">A quarterly fact sheet containing, with respect to the quarter covered by the fact sheet, the average wait time for veterans to receive treatment at the medical facility of the Department under the jurisdiction of the director.</text></paragraph></subsection> <subsection id="H94DC865F088B405490D815CC1C85BE6A"><enum>(b)</enum><header>Availability</header><text display-inline="yes-display-inline">Each fact sheet under subsection (a) shall be made publicly available—</text> 
<paragraph id="H031D9FD006EF4F57A63D1223AD0776D9"><enum>(1)</enum><text>in a physical form at the relevant medical facility of the Department in a conspicuous location; and</text></paragraph> <paragraph id="HE2A6313644944D53BB51C3B3F2ECE640"><enum>(2)</enum><text>in an electronic form on the internet website of the facility.</text></paragraph></subsection> 
<subsection id="HAF111F938739466483D25DBF69F6A2C2"><enum>(c)</enum><header>Timing of fact sheets</header><text display-inline="yes-display-inline">The fact sheets under subsection (a) shall be submitted during the first fiscal year beginning after the date that is 180 days after the date of the enactment of this Act and not less frequently than—</text> <paragraph id="HECF5F99A0332463ABA8D541D25044DE2"><enum>(1)</enum><text>once each fiscal year thereafter with respect to the annual fact sheet under paragraph (1) of such subsection; and</text></paragraph> 
<paragraph id="H0EF400F9C92F4368B5A1D9DC0066286B"><enum>(2)</enum><text display-inline="yes-display-inline">once each fiscal quarter thereafter with respect to the quarterly fact sheet under paragraph (2) of such subsection.</text></paragraph></subsection> <subsection id="H9D9569D6FE6A4C49BAE2E3E442F26600"><enum>(d)</enum><header>Standardized format</header><text display-inline="yes-display-inline">The Secretary shall establish a standard format for the fact sheets under subsection (a) to ensure that each director of a medical center of the Department carries out such subsection in a consistent manner.</text></subsection> 
<subsection id="H5FE59BB9D245481A87FD685B7D294601"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H427A6149D2064C28AE422E07540032C4"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>appropriate Members of Congress</term> means, with respect to a medical facility of the Department of Veterans Affairs about which a fact sheet is submitted under subsection (a), the Senators representing the State, and the Member, Delegate, or Resident Commissioner of the House of Representatives representing the district, that includes the facility.</text></paragraph> 
<paragraph id="HFEE757AF232E4C8E82EFEF8913AFE0F7" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>State</term> means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, and any territory or possession of the United States.</text></paragraph></subsection></section> <section id="HD74863E959734D3E8915702734E6DB2F"><enum>3.</enum><header>Requirement for timely scheduling of appointments at medical facilities of Department of Veterans Affairs</header> <subsection id="H64AE6D88693D495BA70FF450A9A2EA3D"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">Chapter 17</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H0D3778AD7C534914B5AC5395B04764DC"><enum>(1)</enum><text>by redesignating section 1706A as section 1706B; and</text></paragraph> <paragraph id="H806D42BDEA6746A4ABCDD753D9E4E334"><enum>(2)</enum><text>by inserting after section 1706 the following new section:</text> 
<quoted-block style="USC" id="H8DE02445352A4782ACC8740CA0E84D68" display-inline="no-display-inline"> 
<section id="H12549E269A334C80AA5E23EA7408AA1D"><enum>1706A.</enum><header>Management of health care: timely scheduling of appointments at Department facilities</header> 
<subsection id="HA421F2AFE1FF4B5EB6661EB0AA198213"><enum>(a)</enum><header>Requirement for scheduling</header><text display-inline="yes-display-inline">In managing the provision of hospital care and medical services at medical facilities of the Department of Veterans Affairs under this chapter, the Secretary shall ensure that whenever a covered veteran contacts the Department by telephone to request the scheduling of an appointment for care or services for the covered veteran at such a facility, the scheduling for the appointment occurs during that telephone call (regardless of the prospective date of the appointment being scheduled).</text></subsection> <subsection id="H6B32C80070874F9BB20EB1AED1066C84"><enum>(b)</enum><header>Covered veteran defined</header><text display-inline="yes-display-inline">In this section, the term <quote>covered veteran</quote> means a veteran who is enrolled in the system of patient enrollment of the Department under section 1705(a) of this title.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H16D3ECDECFC242E999B60093278A467B"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by striking the item relating to section 1706A and inserting the following new items:</text> <quoted-block style="USC" id="H2254ACE7D6004EF19274937F5DFA28D3" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">1706A. Management of health care: timely scheduling of appointments at Department facilities. </toc-entry> <toc-entry level="section">1706B. Remediation of medical service lines.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HD0D4037BC1F34AD5AFA375460B5F7FCE"><enum>(c)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply with respect to requests for appointment scheduling occurring on or after the date that is 180 days after the date of the enactment of this Act.</text></subsection></section> 
<section id="HD7C3289260914C5698C3AE3C38F18850"><enum>4.</enum><header>Limitation on detail of directors of medical centers of Department of Veterans Affairs to different positions</header> 
<subsection id="HDA11318200FB42CDBCF8E9AAED97D610"><enum>(a)</enum><header>Notification</header> 
<paragraph id="HBA670DB071C54DEDB17D6DDA4FDFC428"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after detailing a director of a medical center of the Department of Veterans Affairs to a different position within the Department, the Secretary of Veterans Affairs shall notify the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives of such detail.</text></paragraph> <paragraph id="H91579531B0E04F9388730C3A43044DDA"><enum>(2)</enum><header>Matters To be included</header><text>The notification required by paragraph (1) shall include, with respect to a director of a medical center who is detailed to a different position within the Department, the following information:</text> 
<subparagraph id="HA235C24B0C2142F0856DEBDD4FB40F1B"><enum>(A)</enum><text>The location at which the director is detailed.</text></subparagraph> <subparagraph id="HFD14128E7F9846AB934D55F06DAAD561"><enum>(B)</enum><text>The position title of the detail.</text></subparagraph> 
<subparagraph id="HD244AA63B41D4A2FA8259BBC43538846"><enum>(C)</enum><text>The estimated time the director is expected to be absent from their duties at the medical center.</text></subparagraph> <subparagraph id="H0E2F5746BE54402B844C23A9795802AA"><enum>(D)</enum><text>Such other information as the Secretary may determine appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="H6ACDD65B16144B10989B97B5FE47E4A5"><enum>(b)</enum><header>Appointment of acting director</header><text>Not later than 120 days after detailing a director of a medical center of the Department to a different position within the Department, the Secretary shall appoint an individual as acting director of such medical center with all of the authority and responsibilities of the detailed director.</text></subsection> <subsection id="H997B2BC4B39E4F1895E3D6C6F5281C0B"><enum>(c)</enum><header>Update on detail</header><text>Not later than 120 days after detailing a director of a medical center of the Department to a different position within the Department, and not less frequently than every 30 days thereafter while the detail is in effect or while the director position at the medical center is vacant, the Secretary shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives an update regarding the status of the detail.</text></subsection> 
<subsection id="H7FB9C9B39A47422EA9F2107F49F53287"><enum>(d)</enum><header>Return to position or reassignment</header> 
<paragraph id="HECA3428A4AC341249C8E40901FFFC990"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), not later than 180 days after detailing a director of a medical center of the Department to a different position within the Department, for a reason other than an ongoing investigation or administrative action with respect to the director, the Secretary shall—</text> <subparagraph id="H8685579BB2AD42118841C944E63D8FD4"><enum>(A)</enum><text>return the individual to the position as director of the medical center; or</text></subparagraph> 
<subparagraph id="H20EA46FCA6F84E65A59CC7826749E24D"><enum>(B)</enum><text>reassign the individual from the position as director of the medical center and begin the process of hiring a new director for such position.</text></subparagraph></paragraph> <paragraph id="HAC3752A4351F4648A8AF4E407DE60170"><enum>(2)</enum><header>Waiver</header> <subparagraph id="H8AA813CCF34043388C8B2E708CA1F19F"><enum>(A)</enum><header>In general</header><text>The Secretary may waive the requirement under paragraph (1) with respect to an individual for successive 90-day increments for a total period of not more than 540 days from the original date the individual was detailed away from their position as director of a medical center.</text></subparagraph> 
<subparagraph id="H74D07FEF96574A5BBED3DDCF4AF6FFFD"><enum>(B)</enum><header>Notification</header><text>Not later than 30 days after exercising a waiver under subparagraph (A), the Secretary shall notify Congress of the waiver and provide to Congress information as to why the waiver is necessary.</text></subparagraph></paragraph></subsection></section> </legis-body> <endorsement display="yes"> <action-date date="20241224">December 24, 2024</action-date> <action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement> </bill>
