which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To authorize the Secretary of Agriculture to administratively transfer covered parcels of National Forest System land to the Secretary of the Interior to be held in trust for the benefit of Indian Tribes.</official-title></form><legis-body id="HABE596B0A1274C39A82949EA1662DCDD" style="OLC"><section id="H37879FCA9BC54C98893B671CEB8343D3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Tribal Forest Restoration Act of 2024</short-title></quote>. </text></section><section id="H5551522DA78B419080DADCAE879C1AFA" display-inline="no-display-inline"><enum>2.</enum><header>Administrative transfer of covered parcels to be held in trust</header><subsection id="H5029B56463744AEA8983CAAFC9781203"><enum>(a)</enum><header>Transfers authorized</header><text display-inline="yes-display-inline">The Secretary is authorized to administratively transfer a covered parcel described in subsection (b) to the Secretary of the Interior to be held in trust for the benefit of an Indian Tribe in accordance with this section.</text></subsection><subsection id="H9EB320B10E0A4366A5CBFC5FBEF4A95E"><enum>(b)</enum><header>Covered parcels</header><text>A covered parcel that may transferred under subsection (a) is a parcel of National Forest System land—</text><paragraph id="H8016BDB691E64FFE8AA3EB5B9D8C5673"><enum>(1)</enum><text>for which an Indian Tribe submits to the Secretary a request for an administrative transfer to the Secretary of the Interior;</text></paragraph><paragraph id="H9ED960F8CB774F4BB1337336EA5CF2A0"><enum>(2)</enum><text>that is less than or equal to 640 acres; and</text></paragraph><paragraph id="H9BDB765696D54F7CB9B998D770EE98BD"><enum>(3)</enum><text>that the Secretary determines—</text><subparagraph id="H31825CF6C83849329582378C4ED5AE1B"><enum>(A)</enum><text>the transfer of which under subsection (a) would be in the public interest; and </text></subparagraph><subparagraph id="HEAA9BAA791F1453EACB48625E76DDDA6"><enum>(B)</enum><text>to—</text><clause id="H0D5100D93FC8434F9909190C0E68B0F7"><enum>(i)</enum><text>be physically isolated from other Federal land;</text></clause><clause id="H3A09392AA2A7480BAA03726587D532EA"><enum>(ii)</enum><text>be inaccessible; </text></clause><clause id="H65DF09CE35804F638454F1FD03728D0B"><enum>(iii)</enum><text>have lost natural character; or</text></clause><clause id="H5CD9DE5746CF4D4DA050839C5420D33F"><enum>(iv)</enum><text>be in need of restoration.</text></clause></subparagraph></paragraph></subsection><subsection id="H8AAC6B3DBA9C42BA80906AA5B359613B"><enum>(c)</enum><header>Placement of land</header><paragraph id="H21716B458B2144AEB86E21471F8893D2"><enum>(1)</enum><header>Land held in trust</header><text display-inline="yes-display-inline">Subject to all valid existing rights of the United States, a covered parcel transferred to the Secretary of the Interior under subsection (a) shall—</text><subparagraph id="HDBADEE9B5CAB435BB60FAE6A29575B0F"><enum>(A)</enum><text>be accepted by the Secretary of the Interior; and</text></subparagraph><subparagraph id="H9D7682B381FD4D5387E9B8A8F8EBF573"><enum>(B)</enum><text>be held in trust for the benefit of the requesting Indian Tribe and administered by the Secretary of the Interior in accordance with the laws and regulations generally applicable to land held in trust by the United States for an Indian Tribe.</text></subparagraph></paragraph><paragraph id="H1BFDCD49B9B344A5880C4C417A0E68C2"><enum>(2)</enum><header>Inclusion in reservation</header><text display-inline="yes-display-inline">If the Indian Tribe submitting a request under subsection (b)(1) exercises jurisdiction over a reservation, the covered parcel placed in trust under paragraph (1)(B) may be declared part of the reservation at the request of the Indian Tribe.</text></paragraph></subsection><subsection id="H202E786A3A38482EA909C67D6F1C1FA2"><enum>(d)</enum><header>Notification of use of authority</header><paragraph id="H7D5667F734124E9380B233A562A6FA34"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this section, the Secretary shall establish a process to make administrative transfers under subsection (a).</text></paragraph><paragraph id="H8C542B372AD54F159A02CC1F3700E1FB"><enum>(2)</enum><header>Elements</header><text display-inline="yes-display-inline">The process required under paragraph (1) shall include—</text><subparagraph id="H7D8EDC872FE64152B03E92EAA0CD01FD"><enum>(A)</enum><text>a 30-day public notice period that a request for a transfer submitted to the Secretary by an Indian Tribe pursuant to subsection (b)(1) has been received;</text></subparagraph><subparagraph id="H5D15CD457B804A9E8FC913108FE4678B"><enum>(B)</enum><text>notification of such a request to relevant State and local governments; and</text></subparagraph><subparagraph id="H423A79A73E18471DB43403A2C93586F0"><enum>(C)</enum><text>notification of such a request to each Indian Tribe—</text><clause id="HA11ED1E5EE774E2EBEE49B935CEBB3A4"><enum>(i)</enum><text>with land in trust that is located within 100 miles of the covered parcel for which such request was submitted; </text></clause><clause id="HA2115EDDBE1440C198949E7B213FDC29"><enum>(ii)</enum><text>that has treaty rights or interests with respect to such covered parcel; </text></clause><clause id="H43F9095BA0C5460A977F39AE44B15D4A"><enum>(iii)</enum><text>for which such covered parcel may have important cultural or historical significance; or</text></clause><clause id="HB725EB1C33BE4C6DA699A50EE2419947" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">that is served by a care service area of the Indian Health Service in which all or part of the covered parcel is located. </text></clause></subparagraph></paragraph></subsection><subsection id="H1D6C448C40584A6183F4CCC8024002C3"><enum>(e)</enum><header>Factors in determination to transfer</header><text display-inline="yes-display-inline">When determining whether to transfer a covered parcel under subsection (a), the Secretary shall consider the following: </text><paragraph id="HD6BBAECFF5A943C39A7D0218BB1132EB"><enum>(1)</enum><text display-inline="yes-display-inline">Whether the covered parcel involves a factor of direct relevance unique to the requesting Indian Tribe, including—</text><subparagraph id="H041106D65D0E447B9EF07552FC276EFC"><enum>(A)</enum><text>treaty rights or interests;</text></subparagraph><subparagraph id="HF2FC66C7AA874B93B6004F8543095990"><enum>(B)</enum><text>the exercise of hunting, fishing, or gathering privileges;</text></subparagraph><subparagraph id="H142A3FB5B54E4E7BBC11AB481BD9AD12"><enum>(C)</enum><text>biological, archaeological, historical, or cultural circumstances; or</text></subparagraph><subparagraph id="HDFDC00D9E9F94EF3944DA4CEC915F283"><enum>(D)</enum><text>public safety and emergency management responsibilities.</text></subparagraph></paragraph><paragraph id="HBB4053AF837047838D17698E2FBCE4F5"><enum>(2)</enum><text>With respect to the Indian Tribe that submits a request pursuant to subsection (b)(1) with respect to such parcel—</text><subparagraph id="H21F05857D0394CADACF8A693AE8B0A93"><enum>(A)</enum><text display-inline="yes-display-inline">whether the covered parcel is contiguous to, or within 100 miles of, the reservation or trust lands of such Indian Tribe; and</text></subparagraph><subparagraph id="HE02CCAAC45C34BD182C62842D870507D"><enum>(B)</enum><text>if the parcel is non-contiguous with the reservation or trust lands of such Indian Tribe, the anticipated benefits for the Indian Tribe from the transfer of the covered parcel.</text></subparagraph></paragraph></subsection><subsection id="HB62E15D4D300468CB6BD5C747476E279" commented="no"><enum>(f)</enum><header>Multiple claims</header><paragraph id="H9EC66FA2C01A4DA1816ADC5FEC34A105" commented="no"><enum>(1)</enum><header>Dispute resolution</header><text>If two or more Indian Tribes request the same covered parcel during the 90-day period beginning on the date public notice is first made available pursuant to subsection (d)(2)(A) with respect to such covered parcel, the Secretary may use mediation, conciliation, arbitration, and other dispute resolutions methods to establish an agreement with respect to the transfer of such parcel.</text></paragraph><paragraph id="H642F04560BF246098042F8F8D41EE67F" commented="no"><enum>(2)</enum><header>Transfer contingent on agreement</header><text>The Secretary may not transfer under subsection (a) a covered parcel described in paragraph (1) unless all Indian Tribes described in such paragraph agree to the transfer. </text></paragraph></subsection><subsection id="H36998C158A554AC68CCE690356B53F30"><enum>(g)</enum><header>Treaty rights of federally recognized tribes</header><text>Nothing in this section shall be construed to affect any treaty right of an Indian Tribe. </text></subsection><subsection id="H9F66EBE8A40F4AAB881A0EBDA756AE63"><enum>(h)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H5BB3014CDE254B1388C8A97FEDDDE9F7" commented="no"><enum>(1)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> means an Indian Tribe recognized by the Secretary of the Interior on the most recent list, as of the date of an applicable request submitted under subsection (b)(1), published in the Federal Register pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="H3386516274704BA8A8F281DCA8236AF7"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture. </text></paragraph></subsection></section></legis-body></bill>
