<official-title display="yes">To amend the Federal Credit Union Act to permit credit unions to serve certain underserved areas, and for other purposes.</official-title>

<section id="H1606C2C37B9A4FE39CF66D5DCEF1AABE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expanding Financial Access for Underserved Communities Act</short-title></quote>.</text></section> <section id="HB62595DD73B448738A2F8C83C9708910"><enum>2.</enum><header>Credit union service to underserved areas</header><text display-inline="no-display-inline">Section 109 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1759">12 U.S.C. 1759</external-xref>) is amended—</text> 
<paragraph id="H69EEC75E76C741B1A918CF70B8768205"><enum>(1)</enum><text>in subsection (c)(2)—</text> <subparagraph id="H4DED675B2DB84C7581084DF65EDD7A5A"><enum>(A)</enum><text>by striking <quote>the field of membership category of which is described in subsection (b)(2),</quote>;</text></subparagraph> 
<subparagraph id="H16C858FE6F0E465C97B540A65CF584D7"><enum>(B)</enum><text>by amending subparagraph (A) to read as follows:</text> <quoted-block style="OLC" id="HC3981DC069544D83A404A69707C17729" display-inline="no-display-inline"> <subparagraph id="HB194C049BDD841188B5B47FC7E2DFAF3"><enum>(A)</enum><text display-inline="yes-display-inline">the Board determines that the local community, neighborhood, or rural district is an underserved area; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H027FF784450E4A69873A71CA6B0BF15B"><enum>(C)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>not later than 2 years after having such underserved area added to the credit union’s charter,</quote> before <quote>the credit union</quote>; and</text></subparagraph></paragraph> <paragraph id="HA99F4DC79892490FBE926B342D0AC876"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H6356CCB3DAB74E0195CF9EC45FCD7640"><enum>(h)</enum><header>Change of field of membership To include underserved areas</header> 
<paragraph id="H27A4506C9FA64376AE988E6F5F506885"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If an existing Federal credit union applies to the Board to alter or expand the field of membership of the credit union to serve an underserved area, the credit union shall submit a business and marketing plan with such application that explains the credit union’s ability and intent to serve the population of the underserved area through the change in field of membership.</text></paragraph> <paragraph id="H5BF5A8F0063C440C880C6F802AFF5832"><enum>(2)</enum><header>Report by smaller credit unions</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which a Federal credit union with $10,000,000,000 or less in assets has an application described under paragraph (1) approved, the credit union, as part of the ordinary course of the examination cycle and supervision process, shall submit a report to the Administration that includes—</text> 
<subparagraph id="HED4E771AAE094540B7EE03C0BC7BB135" commented="no"><enum>(A)</enum><text>an estimate of the number of members of the credit union who are members by reason of the application;</text></subparagraph> <subparagraph id="H5870BFAEE2B94C66A67AB05D03747486" commented="no"><enum>(B)</enum><text>a description of the types of financial services utilized by members of the credit union who are members by reason of the application; and</text></subparagraph> 
<subparagraph id="HAF957EA9C4444378B357F84C2BE8CA7F" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">an update of the credit union’s implementation of the plan described under paragraph (1).</text></subparagraph></paragraph> <paragraph id="HADA716ADC231420EBE22D6AFE02C4156"><enum>(3)</enum><header>Additional requirements for large credit unions</header><text display-inline="yes-display-inline">With respect to a Federal credit union with more than $10,000,000,000 in assets:</text> 
<subparagraph id="HE7B8300755444C29B507D78B0A50F053"><enum>(A)</enum><header>Consumer advisory panel</header><text display-inline="yes-display-inline">If an application described under paragraph (1) is approved, the Federal credit union shall—</text> <clause id="HBB775C2D35E54F768B4B0464C5848B3F"><enum>(i)</enum><text>establish a consumer advisory panel that is representative of the population of the underserved area; and</text></clause> 
<clause id="H388BC77469D641DCB4CAA57930C447DD"><enum>(ii)</enum><text display-inline="yes-display-inline">consult with the consumer advisory panel at least once every 6 months on how the credit union can best serve the convenience and needs of the population of the underserved area.</text></clause></subparagraph> <subparagraph id="H38C6085276BE4083BCDAEC4416EB75FA"><enum>(B)</enum><header>Plan contents</header><text display-inline="yes-display-inline">A plan required to be submitted under paragraph (1) shall also include—</text> 
<clause id="HB05E0BD721814D0AAC0A37A71FA5869C"><enum>(i)</enum><text>a compliance plan that explains how the credit union’s ability and intent to serve the population of the underserved area through the change in field of membership will be done in compliance with all applicable laws and regulations, including the credit union's ability to comply with all applicable anti-discrimination and fair lending requirements; and</text></clause> <clause id="HC22A097188454AF18CA4EB657CB51ACD"><enum>(ii)</enum><text display-inline="yes-display-inline">a plan to establish a consumer advisory panel described under subparagraph (A).</text></clause></subparagraph> 
<subparagraph id="HF9B8D85CECE048CEBC66522829252470"><enum>(C)</enum><header>Approval requirements</header><text display-inline="yes-display-inline">Before approving an application described under paragraph (1), the Board shall—</text> <clause id="H8C796DBF685B42B6B08971E1C33BEBB4"><enum>(i)</enum><text>consult with the Director of the Bureau of Consumer Financial Protection; and</text></clause> 
<clause id="H799D9B773A2548948E15969084238331"><enum>(ii)</enum><text>take into account the Federal credit union’s compliance with consumer financial protection laws.</text></clause></subparagraph> <subparagraph id="H458E72941C60418B9707D635E4F3726F"><enum>(D)</enum><header>Ongoing reporting</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which the Federal credit union has an application described under paragraph (1) approved, and every 2 years thereafter, the Federal credit union shall, as part of the ordinary course of the examination cycle and supervision process, submit a report to the Administration that includes—</text> 
<clause id="H95D1C5028AE9421D95213B60B1F70E05" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text>an estimate of the number of members of the credit union who are members by reason of the application;</text></clause> <clause id="H4EBBA7AE474949BA992CC8F74E85C47C" commented="no"><enum>(ii)</enum><text>a description of the types of financial services utilized by members of the credit union who are members by reason of the application;</text></clause> 
<clause id="H0F8E78D283E74FDCA441EB6A61B98A9E" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">an update of the credit union’s implementation of the plan described under paragraph (1), including the contents described under subparagraph (B)(i); and</text></clause> <clause id="H706E3EC630C74448B83DC467A66D428D"><enum>(iv)</enum><text display-inline="yes-display-inline">a description of how the credit union has addressed issues identified by the consumer advisory panel.</text></clause></subparagraph> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HA8A2BFB2C9894599AB2460795C8B4CB0"><enum>3.</enum><header>Member business lending in underserved areas</header><text display-inline="no-display-inline">Section 107A(c)(1)(B) of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1757a">12 U.S.C. 1757a(c)(1)(B)</external-xref>) is amended—</text> <paragraph id="H63CFD6F443FA4A4182F870661169F846"><enum>(1)</enum><text>in clause (iv), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H5AAA191DFC6943E0AABBB02415B814FA"><enum>(2)</enum><text>in clause (v), by striking the period and inserting <quote>; or</quote>; and</text></paragraph> <paragraph id="H5A478E7A9CF840FEB5604F21430AFCFB"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="HB70080C8D9FA483284577DC55DDD13B8" display-inline="no-display-inline"> 
<clause id="H6BA112EA10AC4A74AF8622FF065BB4EC"><enum>(vi)</enum><text display-inline="yes-display-inline">that is made to a member or associated borrower that lives in or operates in an underserved area.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HF7C5A7DFD29B4BA4934828CD61E1B7E2"><enum>4.</enum><header>Underserved area defined</header><text display-inline="no-display-inline">Section 101 of the Federal Credit Union Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12 U.S.C. 1752</external-xref>) is amended—</text> 
<paragraph id="H3AA7AE039E2F496AAA68C6F422D2EF45"><enum>(1)</enum><text>in paragraph (8), by striking <quote>; and</quote> and inserting a period;</text></paragraph> <paragraph id="H586E7B3DDA934A188F83477577ED4C19"><enum>(2)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HB012BADDC45E456BABB3701B5E69151C"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HD7D4986744DA49E7896EEE8595B929F4" display-inline="no-display-inline"> <paragraph id="HA1E836E6C6814792A46393B112C3C3C1"><enum>(10)</enum><text display-inline="yes-display-inline">The term <quote>underserved area</quote> means a geographic area consisting of one or more population census tracts or one or more counties, that encompass or are located within—</text> 
<subparagraph id="H9A1F23DD3C5F48448270574D38BA32E9"><enum>(A)</enum><text>an investment area, as defined under section 103(16) of the Community Development Banking and Financial Institutions Act of 1994;</text></subparagraph> <subparagraph id="H8282021D7DFD424CA1EA6A0C935D028C"><enum>(B)</enum><text display-inline="yes-display-inline">groups of contiguous census tracts in which at least 85 percent individually qualify as low-income communities, as defined under <external-xref legal-doc="usc" parsable-cite="usc/26/45D">section 45D(e)</external-xref> of the Internal Revenue Code of 1986; or</text></subparagraph> 
<subparagraph id="H2EA63A63DEA64E15A721A352BAA441EE"><enum>(C)</enum><text display-inline="yes-display-inline">an area that is more than ten miles, as measured from each point along the area’s perimeter, from the nearest branch of a depository institution (as defined under section 3 of the Federal Deposit Insurance Act) or credit union.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HFD0A324C3E034FBFA39C56297AB519C1"><enum>5.</enum><header>Reports by the National Credit Union Administration</header> <text display-inline="no-display-inline">Not later than 3 years after the date of enactment of this Act, but no sooner than 2 years after the date of enactment of this Act, and every 2 years thereafter, the National Credit Union Administration shall issue a report to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate on the implementation of the amendments made by this Act.</text></section>
