R. 10501</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241218">December 18, 2024</action-date><action-desc><sponsor name-id="P000613">Mr. Panetta</sponsor> (for himself and <cosponsor name-id="J000298">Ms. Jayapal</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act to eliminate the annual numerical limitation on visas for certain immigrants, to require the Secretary of Homeland Security to grant work authorization to certain immigrants with a pending application for nonimmigrant status under such Act, and for other purposes.</official-title></form><legis-body id="H76C6C0429D414419A2A0705D5DD200CE" style="OLC"><section id="H53FFC3A43B6C4655BF62C8AA77936130" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Immigrant Witness and Victim Protection Act of 2024</short-title></quote>.</text></section><section id="H3573FA10253A40A197F3702AB6721EBB"><enum>2.</enum><header>Purpose; Findings; Sense of Congress</header><subsection id="H2221EE964BE14118A944CF3F0020F2A4"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to remove barriers for alien survivors of domestic violence, sexual assault, human trafficking, and other crimes who may be eligible for protections under the Violence Against Women Act of 1994 (VAWA), the Trafficking Victims Protection Act of 2000 (TVPA), and their subsequent reauthorizations.</text></subsection><subsection id="H7C3762CDD2904A26BD75B671E4847BB2"><enum>(b)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="H1DBC58DDD0104E22A81D39221103E757"><enum>(1)</enum><text display-inline="yes-display-inline">Threats of deportation are one of the most potent tools abusers and perpetrators of crime use to maintain control over and silence alien victims and to avoid criminal prosecution. Abusers and perpetrators leverage the immigration system in the abuse and exploitation of aliens they victimize.</text></paragraph><paragraph id="HEF4660165AC540C7A0B629049297EE74"><enum>(2)</enum><text>A bipartisan majority in Congress created critical immigration protections in VAWA, TVPA and their subsequent reauthorizations in recognition that alien survivors of domestic violence, sexual assault, human trafficking, and other eligible crimes often fear that reaching out for help may lead to their deportation.</text></paragraph><paragraph id="H0ECC490930354911901807498C95E75D"><enum>(3)</enum><text>Detention and removal of those with victim-based cases undermines the intent of VAWA, TVPA, and their subsequent reuauthorizations and re-traumatizes victims and their children. Deporting survivors while they await decisions on their cases discourages victims from accessing justice, undermines the usefulness of these forms of relief as tools for law enforcement that seek to keep all communities safe, separates them from their children and support networks, and eliminates the ability of local law enforcement to continue protecting and working with such crime survivors.</text></paragraph><paragraph id="H06A149EE74644EEDB785CDBA3401A1FF"><enum>(4)</enum><text display-inline="yes-display-inline">Lack of timely access to employment authorization makes victims more vulnerable and may lead to their need to endure or return to abusive relationships or exploitative conditions. Crime and abuse survivors should have access to work authorization to escape abusive situations, and gain self-sufficiency following victimization so they can support themselves and their families.</text></paragraph></subsection><subsection id="HA546608302774492AA2ED8E62A9B4B33"><enum>(c)</enum><header>Sense of Congress</header><text>It is the sense of Congress that the Secretary of Homeland Security should not deport crime victims or neglected, abused, or abandoned youth before their applications for humanitarian relief are fully adjudicated, as it undermines critical bipartisan protections created in VAWA, TVPA, and their subsequent reauthorizations.</text></subsection></section><section id="H36A7AC40CBFE423089BDE76880A30D3D"><enum>3.</enum><header>Elimination of annual numerical limitation on U visas</header><text display-inline="no-display-inline">Section 214(p) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(p)</external-xref>) is amended by striking paragraph (2).</text></section><section id="H5FAA759511784E26BCECA4F2647B9693"><enum>4.</enum><header>Elimination of annual numerical limitation on special immigrant juvenile visas</header><subsection id="H7C34004EBBBC4E2B8CF865B99EC95489"><enum>(a)</enum><header>Aliens not subject to direct numerical limitations</header><text display-inline="yes-display-inline">Section 201(b)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(1)(A)</external-xref>) is amended by striking <quote>subparagraph (A) or (B)</quote> and inserting <quote>subparagraphs (A), (B), or (J)</quote>.</text></subsection><subsection id="H76C09C4DE26D4D478D038D7860F1777A"><enum>(b)</enum><header>Per country levels</header><text>Section 202(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152(a)(2)</external-xref>) is amended by striking <quote>(5),</quote> and inserting <quote>(5), and except for special immigrants described in subparagraph (J) of section 1101(a)(27) of this title,</quote>.</text></subsection><subsection id="HC1D39A6141DF4359AB269540E17216FE"><enum>(c)</enum><header>Certain special immigrants</header><text>Section 203(b)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(4)</external-xref>) is amended by striking <quote>subparagraph (A) or (B)</quote> and inserting <quote>subparagraphs (A), (B), or (J)</quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H8DDAB16412AB4EB7B530243E5E6192EC" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Work authorization while applications and petitions are pending</header><subsection commented="no" display-inline="no-display-inline" id="H067A913D92CE4B908E25DC09EF9BA29D"><enum>(a)</enum><header display-inline="yes-display-inline">U visas</header><text display-inline="yes-display-inline">Section 214(p) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(p)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H29319AB8C460489E906BED41961D93E8"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking the last sentence; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H079244A04BA740D1AC9EFC03C06506E0"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HBD975D48118B44ABA35EAACD80DE8281" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HD720F9EA454D498FB21608BD19E13BB7"><enum>(8)</enum><header display-inline="yes-display-inline">Work authorization</header><text display-inline="yes-display-inline">Notwithstanding any provision of this Act granting eligibility for employment in the United States, the Secretary of Homeland Security shall grant employment authorization to an alien who has filed an application for nonimmigrant status under section 101(a)(15)(U) on the date that is the earlier of—</text><subparagraph commented="no" display-inline="no-display-inline" id="H63EC9216FB41484C8D2BECFF2B46E75F"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which the alien’s application for such status is approved; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC9C46A117A66456E81380DB9A8709182"><enum>(B)</enum><text display-inline="yes-display-inline">a date determined by the Secretary that is not later than 180 days after the date on which the alien filed the application.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H357C574235974B87A949C7B6F886234D"><enum>(b)</enum><header display-inline="yes-display-inline">T visas</header><text display-inline="yes-display-inline">Section 214(o) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(o)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H63F132325CDB4A06BFA43BBFC1E97EB0" style="traditional"><paragraph commented="no" display-inline="no-display-inline" id="H77D5C116C8104ACC816C0DDF0C71FC8A" indent="up1"><enum>(8)</enum><text display-inline="yes-display-inline">Notwithstanding any provision of this Act granting eligibility for employment in the United States, the Secretary of Homeland Security shall grant employment authorization to an alien who has filed a petition for nonimmigrant status under section 101(a)(15)(T) on the date that is the earlier of—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA670BC7528D647CEB631B58262D7895E"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which the alien’s petition for such status is approved; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H575A9A30B68D4FB5A5F5E22B1A78FCF7"><enum>(B)</enum><text display-inline="yes-display-inline">a date determined by the Secretary that is not later than 180 days after the date on which the alien filed the petition.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE2CBA1ED1F354F7583EB3BC4C87F96B4"><enum>(c)</enum><header>VAWA Self-Petitioners</header><text display-inline="yes-display-inline">Section 204(a)(1)(K) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(K)</external-xref>) is amended to read: </text><quoted-block style="OLC" id="H43407C1D8AA94254AF437CE6F0CC7DCC" display-inline="no-display-inline"><subparagraph id="H41C91B21CEE344F98EA336877CE88A19" indent="up2"><enum>(K)</enum><text display-inline="yes-display-inline">Notwithstanding any provision of this Act restricting eligibility for employment in the United States, the Secretary of Homeland Security shall grant employment authorization to such an alien in the United States on the date that is the earlier of—</text><clause id="HECE9EB696C3744EAA768E72945B630E3"><enum>(i)</enum><text>the date on which the alien’s petition as a VAWA self-petitioner is approved; or </text></clause><clause id="H602CCE7A44EF473E89BED61ADE2930D5"><enum>(ii)</enum><text>a date determined by the Secretary that is not later than 180 days after the date on which the alien filed the petition as a VAWA self-petitioner.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H287C869113F743D8B98FABD812794F6E"><enum>(d)</enum><header>Special immigrant juveniles</header><text display-inline="yes-display-inline">Section 245 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H6DDC4BF25FCB49E4B6B5ABA96909E06A" display-inline="no-display-inline"><subsection id="H5D121D01B1D443F183E3B6B7E7C4C561"><enum>(o)</enum><header>Work authorization for certain special immigrants</header><text display-inline="yes-display-inline">Notwithstanding any provision of this Act granting eligibility for employment in the United States, the Secretary of Homeland Security shall grant employment authorization to an alien who has filed a petition for special immigrant status under section 101(a)(27)(J) on the date that is the earlier of—</text><paragraph id="H1E2BC90F6B84447DBA0CB076D259479E"><enum>(1)</enum><text display-inline="yes-display-inline">the date on which the alien’s petition for such status is approved; or</text></paragraph><paragraph id="H27F7E00ACDCB428BA06A540B73E9AA41"><enum>(2)</enum><text>a date determined by the Secretary that is not later than 180 days after the date on which the alien filed the petition.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H005B2796DF3F42B4ABFF2E18BC0A0283"><enum>(e)</enum><header>Cancellation of removal</header><text display-inline="yes-display-inline">Section 240A(b)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)(2)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HC0108AE780BB4E22913F72DEE2A5309C" style="OLC"><subparagraph id="H45914482FFAA4FD58DF019F43A6AA005"><enum>(E)</enum><header>Work authorization</header><text display-inline="yes-display-inline">Notwithstanding any provision of this Act granting eligibility for employment in the United States, the Secretary of Homeland Security shall grant employment authorization to an alien who has filed an application for cancellation of removal under this paragraph on a date that is not later than 180 days after the date on which the alien filed the application.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H4B8567979746455EB16A51FFF09E5BEA"><enum>6.</enum><header>Stay of removal</header><subsection id="H852D4823BF1C468082E44E8765B21C01"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An alien described in subsection (b) shall not be removed from the United States under section 240 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229a">8 U.S.C. 1229a</external-xref>) or any other provision of law until there is a final denial of the alien’s application for status after the exhaustion of administrative and judicial review. </text></subsection><subsection id="H24BB4780127B423EA8F2664456E368C2"><enum>(b)</enum><header>Aliens described</header><text display-inline="yes-display-inline">An alien is described in this subsection if the alien—</text><paragraph id="H7445BD8011A44A4B83DEB5A5472A80E7"><enum>(1)</enum><text display-inline="yes-display-inline">has a pending or approved application or petition under section 101(a)(15)(T), 101(a)(15)(U), 101(a)(27)(J), 106, 240A(b)(2), or 244(a)(3) (as in effect on March 31, 1997) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>, 1229a, 1254a); or</text></paragraph><paragraph id="H99F477A854624C719B23CCA5E64B02F2"><enum>(2)</enum><text>is a VAWA self-petitioner, as defined in section 101(a)(51) of the Immigration and Nationality Act, with a pending application for relief under a provision referred to in one of subparagraphs (A) through (G) of such section.</text></paragraph></subsection></section><section id="H68AC77A2EE534302AFAA5DCBDDBAD910"><enum>7.</enum><header>Prohibition on detention of certain victims with pending or approved petition or application</header><text display-inline="no-display-inline">Section 236 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H065BC027880F4A67AD19E5BEFAA6E507" style="OLC"><subsection id="HA3B2367B74A94BEF8CB0EE24C2126AE1"><enum>(f)</enum><header>Prohibition on detention of certain victims with pending or approved petitions and applications</header><paragraph id="H9B9657BC3AEE438FB96FC5C522E7BD3A"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of this Act, there shall be a presumption that the alien described in paragraph (2) should be released from detention. The Secretary of Homeland Security shall have the duty of rebutting this presumption, which may only be shown based on clear and convincing evidence, including credible and individualized information, that the use of alternatives to detention will not reasonably ensure the appearance of the alien at removal proceedings, or that the alien is a threat to another person or the community. The fact that an alien has a criminal charge pending against the alien may not be the sole factor to justify the continued detention of the alien.</text></paragraph><paragraph id="H9DAC811C4866428198A96C6BB979A8A3"><enum>(2)</enum><header>Alien described</header><text>An alien is described in this paragraph if the alien—</text><subparagraph id="H151E9A1F275F40CABFA15D6C1B5EBB7E"><enum>(A)</enum><text display-inline="yes-display-inline">has a pending or approved application or petition under section 101(a)(15)(T), 101(a)(15)(U), 101(a)(27)(J), 106, 240A(b)(2), or 244(a)(3) (as in effect on March 31, 1997); or</text></subparagraph><subparagraph id="H24D0F97F77DE46EFB4B59C1DAEFD4B69"><enum>(B)</enum><text>is a VAWA self-petitioner, as defined in section 101(a)(51), with a pending application for relief under a provision referred to in one of subparagraphs (A) through (G) of such section.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H26D586A0364C48F0AF88DB21408A2E97"><enum>8.</enum><header>Penalties for disclosure of information</header><subsection id="HCCF7A7DF760F42999F006EF5D472F5DE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 384 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1367">8 U.S.C. 1367</external-xref>) is amended—</text><paragraph id="H69DB1933F41245C8A035936AF3B94B20"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HDDDAF1E0F9454CA4B69A135C38F00DDB"><enum>(A)</enum><text>in paragraph (1), by striking <quote>solely</quote>;</text></subparagraph><subparagraph id="H9A13BEF098584E0A9873D00ABACB40A9"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H7745DC0C82354B548765F677E65B1092"><enum>(i)</enum><text>by striking <quote>information which relates</quote> and inserting <quote>information, files, or records which relate</quote>; and</text></clause><clause id="H689ED2F089814959B340A94C3D1C48A8"><enum>(ii)</enum><text>by striking the period at the end and inserting a semicolon; and</text></clause></subparagraph><subparagraph id="H112AFFC1886E4D82AD157177974155ED"><enum>(C)</enum><text>by inserting after paragraph (2) the following new paragraph:</text><quoted-block style="OLC" id="H28E14C812DE74D6FB54F76213FAEF470" display-inline="no-display-inline"><paragraph id="H05558E167ACE4C0A876CFF2FB1DB333E"><enum>(3)</enum><text display-inline="yes-display-inline">Except as provided in this paragraph, neither the Department, nor any other official or employee of the Department, or bureau or agency thereof, nor the Department of Justice, nor any official or employee of the Department of Justice, or bureau or agency thereof, may—</text><subparagraph id="H0640E4212FA643D180F0E028860B9AE3"><enum>(A)</enum><text>use the information furnished by the applicant pursuant to an application filed under paragraph (15)(T), (15)(U), (27)(J), or (51) of section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref> (15)(T), (15)(U), (27)(J), or (51)), or section 240A(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)(2)</external-xref>), section 106 (<external-xref legal-doc="usc" parsable-cite="usc/8/1105a">8 U.S.C. 1105a</external-xref>), for any purpose other than to make a determination on the application, or for enforcement of subsection (c) of this section;</text></subparagraph><subparagraph id="HD667CBB5FE0947BB968A65227D6B83B9"><enum>(B)</enum><text>make any publication of information that identifies a particular individual; or</text></subparagraph><subparagraph id="H4D2C00DAF88A436695BBCBA12DBE8D4A"><enum>(C)</enum><text>permit anyone other than the sworn officers and employees of the Department or bureau or agency to examine individual applications. </text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HC044B9EBBED6468291B2E486EF32F7B3"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H53E0FAAA5B1E49E5B7BDDFFB1E760CF6"><enum>(A)</enum><text>in paragraph (2), by striking <quote>legitimate law enforcement purpose,</quote> and inserting <quote>a criminal investigation or prosecution,</quote>; and</text></subparagraph><subparagraph id="HF48D8AD38BF34F4286F8A7780DCBC0A0"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (4) and inserting the following new paragraph: </text><quoted-block style="OLC" id="H9DE30FE79ABA418681C5672AA7F7596A" display-inline="no-display-inline"><paragraph id="H7795EEC597EB4E19A4B75165CD4D0F51"><enum>(4)</enum><text display-inline="yes-display-inline">Paragraphs (2) and (3) of subsection (a) shall not apply if all the individuals in the case are adults and they have all waived the restrictions of such subsections.</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA889A66972284AADBB85C47D55978E26"><enum>(3)</enum><text>in subsection (d), by adding that end the following: <quote>The Attorney General, Secretary of State, and the Secretary of Homeland Security shall provide Congress with an annual report regarding training provided to officers and employees, the number of investigations opened for violations of paragraphs (1) through (3) of subsection (a), and the results of those investigations.</quote>.</text></paragraph></subsection></section></legis-body></bill>
