which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To expand cost-sharing reductions with respect to qualified health plans offered through an Exchange, and for other purposes.</official-title></form><legis-body id="H597BE95929394585A1717C73A018825C" style="OLC"><section id="HF5DB75A779D248A394DC450B98B0D431" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Capping Costs for Consumers Act of 2024</short-title></quote>.</text></section><section id="H109C970B59944638989D31613109BF3D"><enum>2.</enum><header>Expanding cost-sharing reductions under Exchange plans</header><subsection id="HB7F4E8227E0B4F6F95EBB361E6DB6031"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1402 of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18071">42 U.S.C. 18071</external-xref>) is amended—</text><paragraph id="H87EA0E7AED7F42F29B3674BC8347882F"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph id="H36BCEA2DE86245368C9FA60FBAE3EC9B"><enum>(A)</enum><text>in paragraph (1), by striking <quote>who enrolls</quote> and inserting <quote>subject to the last sentence of this subsection, who enrolls</quote>; and</text></subparagraph><subparagraph id="H3E2D82B5B73047D5AD53174BEAA58E27"><enum>(B)</enum><text>by adding at the end the following sentence: <quote>With respect to plan years beginning on or after January 1, 2026, paragraph (1) shall be applied as if the reference to the silver level of coverage were a reference to the gold level of coverage.</quote>; </text></subparagraph></paragraph><paragraph id="HDD74ECACDFC54108950E7DD137ADE9A0"><enum>(2)</enum><text>in subsection (c)(1)(B)(i)—</text><subparagraph id="H5DE386D0CE214CFF94BB5C84C9D0147A"><enum>(A)</enum><text display-inline="yes-display-inline">in subclause (II), by striking <quote>an eligible insured described in paragraph (2)(B)</quote> and inserting <quote>, with respect to plan years beginning before January 1, 2026, an eligible insured described in paragraph (2)(B)(i) and, with respect to plan years beginning on or after January 1, 2026, an eligible insured described in paragraph (2)(B)(ii)</quote>; and</text></subparagraph><subparagraph id="H4DD8DC870DC84685929E5868384358A9"><enum>(B)</enum><text>by amending subclauses (III) and (IV) to read as follows:</text><quoted-block style="OLC" id="HDAE00FE8CA8146049378472C4058800A" display-inline="no-display-inline"><subclause id="HC7CB1927F9D843319D966F6EA7A24901"><enum>(III)</enum><text display-inline="yes-display-inline">with respect to plan years beginning before January 1, 2026—</text><item id="H3160BC030CB04854A712506639CFE45A"><enum>(aa)</enum><text>73 percent in the case of an eligible insured whose household income is more than 200 percent but not more than 250 percent of the poverty line for a family of the size involved; and</text></item><item id="HA435BFBC05354B14BF8F666965C1A333"><enum>(bb)</enum><text>70 percent in the case of an eligible insured whose household income is more than 250 percent but not more than 400 percent of the poverty line for a family of the size involved; and</text></item></subclause><subclause id="H0DE7CEE2EAEB4A40B0FB149C8ABC9C58"><enum>(IV)</enum><text>with respect to plan years beginning on or after January 1, 2026, 85 percent in the case of an eligible insured described in paragraph (2)(C)(ii).</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H888AF7FD279844D8BD62285E959C2CD2"><enum>(3)</enum><text>in subsection (c)(2), by amending subparagraphs (B) and (C) to read as follows:</text><quoted-block style="OLC" id="H8DCC875E85B9407494B451E97C945733" display-inline="no-display-inline"><subparagraph id="H549CD444BDB24C67862ADD9FAE936347"><enum>(B)</enum><text>in the case of—</text><clause id="HFC72E5523D1048CEA5A69B0C18C830A8"><enum>(i)</enum><text>with respect to plan years beginning before January 1, 2026, an eligible insured whose household income is more than 150 percent but not more than 200 percent of the poverty line for a family of the size involved, increase the plan’s share of the total allowed costs of benefits provided under the plan to 87 percent of such costs; and</text></clause><clause id="H86CBD6FF06BE4386812C848889F04231"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to plan years beginning on or after January 1, 2026, an eligible insured whose household income is more than 150 percent but not more than 300 percent of the poverty line for a family of the size involved, increase the plan’s share of the total allowed costs of benefits provided under the plan to 87 percent of such costs; and</text></clause></subparagraph><subparagraph id="HC6CDB989DDBE4865B25568479672B5FD"><enum>(C)</enum><text>in the case of—</text><clause id="H0B29476CDC484D299A74495EF61963C2"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to plan years beginning before January 1, 2026, an eligible insured whose household income is more than 200 percent but not more than 250 percent of the poverty line for a family of the size involved, increase the plan’s share of the total allowed costs of benefits provided under the plan to 73 percent of such costs; and</text></clause><clause id="H3E93073C2B4E4BED80D6F567C9FA3EE3"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to plan years beginning on or after January 1, 2026, an eligible insured whose household income is more than 300 percent but not more than 400 percent of the poverty line for a family of the size involved, increase the plan’s share of the total allowed costs of benefits provided under the plan to 85 percent of such costs.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H820F7BF82FDB4CEF9967C95D1ECEF1F0"><enum>(4)</enum><text>by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HFC35DFEB3659434990FF8A1CB883FABB" style="OLC"><subsection id="H53028F77BF304D90AECAEE289C782033"><enum>(h)</enum><header>Funding</header><text>Out of any funds in the Treasury not otherwise appropriated, there are appropriated to the Secretary such sums as may be necessary for payments under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE4A0EDA65F314D5DA7EF3B8145FE0C4F"><enum>(b)</enum><header>Conforming amendments to State basic health programs for certain low-Income individuals</header><text display-inline="yes-display-inline">Section 1331(a)(2) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18051">42 U.S.C. 18051(a)(2)</external-xref>) is amended—</text><paragraph id="H85C2044C73184C989CD6AEBEB87098F7"><enum>(1)</enum><text>in subparagraph (A)(i), by striking <quote>the applicable second lowest cost silver plan (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B(b)(3)(B)</external-xref> of the Internal Revenue Code of 1986)</quote> and inserting <quote>, with respect to plan years beginning before January 1, 2026, the applicable second lowest cost silver plan (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B(b)(3)(B)</external-xref> of the Internal Revenue Code of 1986) and, with respect to plans years beginning on or after January 1, 2026, the applicable second lowest cost gold plan (as defined in such section)</quote>; and</text></paragraph><paragraph id="H28DFF3D2B071441596C737020D158C2F"><enum>(2)</enum><text>in the matter following subparagraph (B), by striking <quote>or the applicable second lowest cost silver plan</quote> and inserting <quote>or, with respect to plan years beginning before January 1, 2026, the applicable second lowest cost silver plan (or, with respect to plan years beginning on or after January 1, 2026, the applicable second lowest cost gold plan</quote>. </text></paragraph></subsection></section><section id="HC5136FC340CB4BE89604879E21A33509" section-type="subsequent-section"><enum>3.</enum><header>Premium assistance credit amount determined using applicable second lowest cost gold plan</header><subsection id="H2510E4E594924B37B597057CA81B4F5F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/36B">Section 36B</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H3769CE81F3524818B5FE7E3384DD7B56"><enum>(1)</enum><text>by striking <quote>silver</quote> each place it appears and inserting <quote>gold</quote>; and</text></paragraph><paragraph id="H90001BBB5057472FB5262FDC0D0A3B5F"><enum>(2)</enum><text>in the header of subsection (b)(3)(B), by striking <quote><header-in-text level="subparagraph" style="OLC">silver</header-in-text></quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">gold</header-in-text></quote>. </text></paragraph></subsection><subsection id="HAB69EB568194459A904B435AE11614D8"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to taxable years beginning after December 31, 2025.</text></subsection></section></legis-body></bill>
