R. 10434</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241216">December 16, 2024</action-date><action-desc><sponsor name-id="O000175">Mr. Ogles</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Consumer Product Safety Act to increase reliance by the Consumer Product Safety Commission on voluntary consumer product safety standards, and for other purposes.</official-title></form><legis-body id="H630C046C5E9E496DADF5D77A321A1E80" style="OLC"><section id="HD62653FDA53742AE91022EEEEF746FA8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer Product Sanity Act</short-title></quote>.</text></section><section id="H09A71BF948DF42CFB4381D91850066D1"><enum>2.</enum><header>Increasing reliance by Commission on voluntary consumer product safety standards</header><text display-inline="no-display-inline">Section 7(b) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2056">15 U.S.C. 2056(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HE7AD5ADC29094AEC866F3291C66E6799" display-inline="no-display-inline"><paragraph id="HCA2527F0794C4D909AD68C1636CCFA1C" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In any case in which the Commission determines that compliance with a voluntary consumer product safety standard would eliminate or adequately reduce the risk of injury addressed, but determines substantial compliance with such voluntary standard is not likely, the Commission may promulgate a consumer product safety standard addressing such risk of injury only if—</text><subparagraph id="H9D9F65F7557743AEA44ADE4FBAAF9B8A"><enum>(A)</enum><text display-inline="yes-display-inline">such consumer product safety standard is identical to such voluntary standard; or</text></subparagraph><subparagraph id="H14D8D20919F643C0A20C15317FD70411"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a consumer product safety standard that allows for compliance in more than one manner, at least one such manner of compliance is identical to such voluntary standard.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
