which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office to establish and carry out a pilot program to expedite the examination of applications for certain patents, and for other purposes.</official-title></form><legis-body id="H69D2FBED213A468BA02B0DE8BBD66DFF" style="OLC"><section id="H3CE67E5B9FA64DC681CCCB4E42651D79" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Leadership in Critical and Emerging Technologies Act</short-title></quote> or the <quote><short-title>Leadership in CET Act</short-title></quote>.</text></section><section id="H0EE262D799F846C083CDEB68921E0A9E"><enum>2.</enum><header>Pilot program for expediting examination of certain critical and emerging technology patent applications</header><subsection id="H7572DA65FBFC4850AA78DFCE66A51828"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H1D5EDDFA2BAA4E4E9761F265406ABBA9"><enum>(1)</enum><header>Covered application</header><text>The term <term>covered application</term> means an application for patent with respect to an eligible critical or emerging technology.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9DAC78E3BCBC465E8CAD80195CBDF8C7"><enum>(2)</enum><header display-inline="yes-display-inline">Director</header><text>The term <term>Director</term> means the Under Secretary of Commerce for Intellectual Property and Director of the Office.</text></paragraph><paragraph id="HEEE96012FD754C93A7156C3E4D6458EA"><enum>(3)</enum><header>Eligible critical or emerging technology</header><text>The term <term>eligible critical or emerging technology</term> means—</text><subparagraph id="HE3587837B92846FD82125027AEF3908D"><enum>(A)</enum><text>artificial intelligence, as defined in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>);</text></subparagraph><subparagraph id="HAB91EE3611C24B37AFC224D6ED4DF870"><enum>(B)</enum><text>microelectronics, as defined in section 10731(a) of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19331">42 U.S.C. 19331(a)</external-xref>); or</text></subparagraph><subparagraph id="H4DE6DC0FC259495FA9FD7D0211D2F0A9" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>quantum information science, as defined in section 2 of the National Quantum Initiative Act (<external-xref legal-doc="usc" parsable-cite="usc/15/8801">15 U.S.C. 8801</external-xref>). </text></subparagraph></paragraph><paragraph id="HD7AA271021D74F4B9319DEAC400C6E00"><enum>(4)</enum><header>Expedite</header><text>The term <term>expedite</term> means, with respect to a covered application, to advance that covered application out of turn through the use of a petition to make special.</text></paragraph><paragraph id="HE3E595212E7D4D449FD59DA1D718B0E0"><enum>(5)</enum><header>Office</header><text>The term <term>Office</term> means the United States Patent and Trademark Office.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H36395FFDA4E44CBBAB7EBF5343DE93A3"><enum>(6)</enum><header display-inline="yes-display-inline">Pilot program</header><text>The term <term>pilot program</term> means the pilot program established under subsection (b). </text></paragraph></subsection><subsection id="H6DD2ACA6FF234B198A9301E7C3F0E39C"><enum>(b)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Director shall establish a pilot program to expedite the examination, under section 131 of title 35, United States Code, of covered applications.</text></subsection><subsection id="H453EDECC9A02472C88B5AEE20163300E"><enum>(c)</enum><header>Purpose</header><text>The purpose of the pilot program shall be to encourage innovation by, and the leadership of, the United States with respect to critical or emerging technologies by ensuring that covered applications receive prompt consideration.</text></subsection><subsection id="HF58FF7B9911441A6A33343916CD46D4C"><enum>(d)</enum><header>Implementation</header><text>In carrying out the pilot program, the Director—</text><paragraph id="H5E90EB8CD7A44539BCBD3280F590F29D"><enum>(1)</enum><text>shall establish the process by which covered applications are expedited;</text></paragraph><paragraph id="H04C4DE0E11134488A23703D0070A42AD"><enum>(2)</enum><text>may waive— </text><subparagraph commented="no" display-inline="no-display-inline" id="H10E31EB9BA5F4236967B1274CAB91AF9"><enum>(A)</enum><text display-inline="yes-display-inline">the petition fee described in section 1.102(d) of title 37, Code of Federal Regulations, or any successor regulation; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7B3914474F0944E49CB19E83F7E0056E"><enum>(B)</enum><text display-inline="yes-display-inline">any other requirement of the Office relating to the accelerated examination program or the prioritized examination program; and</text></subparagraph></paragraph><paragraph id="H8D7D31663F214763B89A448260E6F760"><enum>(3)</enum><text>may establish reasonable limitations on the number of covered applications that an applicant may submit for expedited examination under the pilot program.</text></paragraph></subsection><subsection id="H99AAFA46FBF84FE8BCA3A287286A498B"><enum>(e)</enum><header>Qualifying applications</header><text>To best achieve the purpose of the pilot program, the Director shall ensure that a covered application satisfies the following requirements to qualify for the pilot program:</text><paragraph id="HC68CFA8D02E04693BE4093D0E227835D"><enum>(1)</enum><text>The applicant submitting the covered application is— </text><subparagraph commented="no" display-inline="no-display-inline" id="H5C75AE8F01214A0BB6D3FFCDAF657F0E"><enum>(A)</enum><text display-inline="yes-display-inline">an entity that is incorporated in the United States; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF380432F4D304BD6986B03595BAFF679"><enum>(B)</enum><text display-inline="yes-display-inline">an inventor who resides in the United States.</text></subparagraph></paragraph><paragraph id="H7882C1F27ED645D5933A5B8FC9BAEE84"><enum>(2)</enum><text>The covered application shall be a noncontinuing, original, and nonprovisional patent application.</text></paragraph></subsection><subsection id="HA0BFB4D379A44546B5E227298FE5F01C"><enum>(f)</enum><header>Termination</header><paragraph id="HBBBDBA9F18B1444C940C1EFB290A536E"><enum>(1)</enum><header>In general</header><text>The pilot program shall terminate on the earlier of the following:</text><subparagraph id="H6D6F053AAC314112B239A1DC4AC3F0B5"><enum>(A)</enum><text>The date that is 5 years after the date on which the Director first issues a patent for an invention claimed in a covered application that is expedited under the pilot program.</text></subparagraph><subparagraph id="H9F3E8446098A43D891D1748546AEC5B2"><enum>(B)</enum><text>The date on which the Director has accepted [10,000] covered applications for participation in the pilot program, without regard to whether those covered applications have been expedited under the pilot program.</text></subparagraph></paragraph><paragraph id="H7861503ACE3442A1B6922DD42211F094"><enum>(2)</enum><header>Renewal</header><text>If the pilot program terminates under paragraph (1)(B), the Director may renew the pilot program for the shorter of the following:</text><subparagraph id="H693395DDC44841B68E1C79BCFEFD2C5B"><enum>(A)</enum><text>An additional 5-year period.</text></subparagraph><subparagraph id="HC45AD1014955418497612312EB273241"><enum>(B)</enum><text>An additional period—</text><clause id="H1D5C45939E67419DBF16EC529A5EAF6D"><enum>(i)</enum><text>beginning on the date on which the pilot program terminates under paragraph (1)(B); and</text></clause><clause id="HCD1851CB287E4D29876DA45DC5F9EAD5"><enum>(ii)</enum><text>ending on the date on which the Director has accepted an additional [10,000] covered applications for participation in the pilot program, without regard to whether those covered applications have been expedited under the pilot program.</text></clause></subparagraph></paragraph><paragraph id="H9254113A3AE149FD8E3043727459CECD"><enum>(3)</enum><header>Notice of renewal</header><text>The Director shall notify Congress of the intent of the Director to renew the pilot program under paragraph (2) not later than the date that is the earlier of the following:</text><subparagraph id="HA286CEDA57D2428F909878CA6743ADB1"><enum>(A)</enum><text>The date that is 60 days before the date described in paragraph (1)(A).</text></subparagraph><subparagraph id="H7774CFA788914CA2B67ADAD98AA77CBA"><enum>(B)</enum><text>The date that is 30 days after the date on which the Director has accepted [8,000] covered applications for participation in the pilot program, without regard to whether those covered applications have been expedited under the pilot program.</text></subparagraph></paragraph></subsection><subsection id="H2C9A18D83DA6418F97D4C0B21AFCC663"><enum>(g)</enum><header>Public availability of information</header><text>The Director shall make publicly available in an easily accessible location on the website of the Office information about the pilot program, including—</text><paragraph id="HB51122E4CFDC4D85BCAF19176C0E6647"><enum>(1)</enum><text>the number of covered applications received by the Director for participation in the pilot program;</text></paragraph><paragraph id="H7708B06A5E69423EBDD8CF9DE4407D64"><enum>(2)</enum><text>the number of covered applications described in paragraph (1) that the Director has accepted for participation in the pilot program; and</text></paragraph><paragraph id="H08AF0C3A5B004BE6A6C3CEF796F95125"><enum>(3)</enum><text>the number of patents that have been issued for inventions claimed in covered applications expedited under the pilot program.</text></paragraph></subsection><subsection id="H658DD91626AD40578083582A7A35F0DA"><enum>(h)</enum><header>Report to Congress</header><paragraph commented="no" display-inline="no-display-inline" id="HCEC08474FE6645E78EE5654081618C1E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 180 days after the date on which the pilot program terminates (including any renewal of the pilot program under subsection (f)(2)), the Director shall submit to Congress a report that assesses the impact and effectiveness of the pilot program based on all available data. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7842A3EF70574ADE91BCA300A0FF47F7"><enum>(2)</enum><header>Applicability</header><text display-inline="yes-display-inline">The collection of any data for the purposes of carrying out paragraph (1) shall be exempt from subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly referred to as the <quote>Paperwork Reduction Act</quote>).</text></paragraph></subsection></section></legis-body></bill>
