R. 10404</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241212">December 12, 2024</action-date><action-desc><sponsor name-id="S001190">Mr. Schneider</sponsor> (for himself and <cosponsor name-id="S001199">Mr. Smucker</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title IV of the Higher Education Act of 1965 to provide program eligibility for distance education programs offered by foreign institutions of higher education.</official-title></form><legis-body id="H4480E22C4A9247CF9599BEC765244E38" style="OLC"><section section-type="section-one" id="H1F4678E5CA22492D9837CDB2CD546628"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Providing Distance Education for Foreign Institutions Act</short-title></quote>.</text></section><section id="H95C9B3C6636842579759C6A6B12C8002"><enum>2.</enum><header>Eligibility of distance education programs offered by foreign institutions of higher education</header><text display-inline="no-display-inline">Section 481(b) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1088">20 U.S.C. 1088(b)</external-xref>) is amended—</text><paragraph id="H283CAD2EEDDF475AB13E8767D2C20083"><enum>(1)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></paragraph><paragraph id="H17C205349FCD48A4AFEC6E4B44C28FC6"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0B853AE70F78412E8CE113D015440C5A"><paragraph id="H1057647A26A14F0C931026BB49B6E792" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H3DD529FE5269402687CB116C27B4FC83"><enum>(A)</enum><text>An otherwise eligible program that is offered by a foreign institution and is offered in part through distance education is eligible for the purposes of this title if—</text><clause id="HBC02A6BC05234269A61B455A3B0E232E" indent="up1"><enum>(i)</enum><text>not more than 12.5 percent of such program consists of courses offered principally through distance education;</text></clause><clause id="H3EFF2C7A8C6C468698975D5B7B85C4C8" indent="up1"><enum>(ii)</enum><text>the foreign institution has been evaluated and determined by an outside oversight entity, such as an accrediting agency or association or government entity, to have the capability to effectively deliver distance education programs; and</text></clause><clause id="H4E8DD3F68E7B4D38888026A68771058B" indent="up1"><enum>(iii)</enum><text>the students receiving aid under this title are physically present in the country where the foreign institution is located during the distance education instruction.</text></clause></subparagraph><subparagraph id="H47F2849BD5C041FAA83AD2301416B3D8" indent="up1"><enum>(B)</enum><text>In calculating the percentage of a program offered through distance education for purposes of clause (i) of subparagraph (A), any course that is part of such a program that requires a student’s regular in-person attendance for more than 50 percent of the instruction, but also includes one or more distance education components as part of the course, shall not be considered to be offered principally through distance education.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
