which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Export Control Reform Act of 2018 to prevent the People’s Republic of China from exploiting items such as black mass and certain other products produced in the United States.</official-title></form><legis-body id="H8AC45CF84E7A46BCA7372C24FDB41C9D" style="OLC"><section id="H7A6F6B4329DC4A9DA4B9D51C15DA6513" section-type="section-one"><enum>1.</enum><header>Export controls to prevent the People’s Republic of China from exploiting items such as black mass and certain other products produced in the United States</header><subsection id="H513A2EF5CD954EBCBEAE46E9C752A0E1"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is to facilitate resilient critical mineral supply chains and promote the development of domestic processing, sustainable recycling and recovery of critical materials from spent lithium-ion batteries, limit predatory price inflation by the People’s Republic of China, and encourage a domestic battery recycling and recycled material processing industry.</text></subsection><subsection id="HBC443BEA041C4AC0A7CE1C8F776729F3"><enum>(b)</enum><header>Amendments</header><paragraph id="HF17EA497A35A4B4F924C2934067EA861"><enum>(1)</enum><header>In general</header><text>Part I of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4811">50 U.S.C. 4811 et seq.</external-xref>) is amended by inserting after section 1758 the following:</text><quoted-block style="OLC" id="H5FBB87594C274B93B5E2E568C9E22152" display-inline="no-display-inline"><section id="HBFCDCCECAAEA43BEB599B57BD6788EE1"><enum>1758A.</enum><header>Export controls to prevent the People’s Republic of China from exploiting items such as black mass and certain other products produced in the United States</header><subsection id="HFACD87E2015240F69FAAAF60FE2BB31B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this section, the Secretary shall require a license for the export, reexport, or in-country transfer of covered items if the end-user is a foreign adversary or foreign adversary entity.</text></subsection><subsection id="HA5085F384D7D41D9B71B25912E64A04D"><enum>(b)</enum><header>Licensing requirements</header><text>The Secretary shall deny any license application for the export, re-export, or in-country transfer of black mass if the end-user is a foreign adversary or a foreign adversary entity.</text></subsection><subsection id="H1FCD0DACAB004C74885EB196611BBF05"><enum>(c)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HFEC1D0FE8CF84AB18B722621C8C18719"><enum>(1)</enum><text>the term <term>black mass</term>—</text><subparagraph id="H13C2AF5743A945E68DB29101C3940048"><enum>(A)</enum><text>means intermediate material produced from the mechanical processing of spent lithium-ion batteries, cathode active material, and anode active material that includes a mixture of lithium, cobalt, nickel, and manganese, and graphite; and</text></subparagraph><subparagraph id="H5F7BE47FBEEA4615B0C6BC352F270341"><enum>(B)</enum><text>does not include intact batteries, partially disassembled batteries, or any component of the battery that has not been subjected to mechanical processing;</text></subparagraph></paragraph><paragraph id="H1A35E246C5914B829F9E9612BE388D13"><enum>(2)</enum><text>the term <term>covered item</term> means—</text><subparagraph id="HD91A4C4487014370988ED0A4686744DB"><enum>(A)</enum><text>black mass; and</text></subparagraph><subparagraph id="HE621F1FC366D4FE2A03F82EF2845842D"><enum>(B)</enum><text>swarf;</text></subparagraph></paragraph><paragraph id="H51D0A4423E9A4A9D9E4FB0EC4E44A0CA"><enum>(3)</enum><text>term <term>foreign adversary</term> means—</text><subparagraph id="HBDE8C60202344848B176B456E6E122E2"><enum>(A)</enum><text>the People’s Republic of China, including all Special Administrative Regions;</text></subparagraph><subparagraph id="H198FDDD12FBF40F089D70EC3EA9F4B26"><enum>(B)</enum><text>the Republic of Cuba;</text></subparagraph><subparagraph id="H148551380E44416C985446FC2A2563CD"><enum>(C)</enum><text>the Islamic Republic of Iran;</text></subparagraph><subparagraph id="H204213338844445E892FFD3A8C076E01"><enum>(D)</enum><text>the Democratic People’s Republic of Korea; </text></subparagraph><subparagraph id="H8B0B100BCB764F7B83417125F80CA857"><enum>(E)</enum><text>the Russian Federation; and</text></subparagraph><subparagraph id="H41473277910F484EB58C03E15E607EE7"><enum>(F)</enum><text display-inline="yes-display-inline">any country determined by the Secretary, in consultation with other relevant Federal officials, to have engaged in a long-term pattern or serious instances of conduct significantly adverse to the national security of the United States or security and safety of United States persons;</text></subparagraph></paragraph><paragraph id="H58E6666CAE984ABCA84DFBD63BCD1909"><enum>(4)</enum><text>the term <term>foreign adversary entity</term> means—</text><subparagraph id="H41202CC703854984BACCD986FD84ED29"><enum>(A)</enum><text>a foreign entity subject to the jurisdiction of, or organized under the laws of, a foreign adversary;</text></subparagraph><subparagraph id="H5EEEE5CA9A9841BE9670FB830F9951A3"><enum>(B)</enum><text display-inline="yes-display-inline">a foreign entity that is more than 25 percent owned, directed, controlled, financed, or influenced directly or indirectly by the Government of the People’s Republic of China, the Chinese Communist Party, or the Chinese military, including any entity for which the Government of the People’s Republic of China, the Chinese Communist Party, or the Chinese military has the ability, through ownership of a majority or a dominant minority of the total outstanding voting interest in the entity, board representation, proxy voting, a special share, contractual arrangements, formal or informal arrangements to act in concert, or other means, to determine, direct, or decide for the entity in an important manner; or</text></subparagraph><subparagraph id="HED4E89B85583493195AD846218E69CE6"><enum>(C)</enum><text display-inline="yes-display-inline">a foreign entity owned, directed, or controlled by a foreign entity described in subparagraph (A) or (B);</text></subparagraph></paragraph><paragraph id="H19C8E812C99347589A56B1FD55755D99"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>permanent magnet</term> means Neodymium Iron Boron magnets and Samarium Cobalt magnets; and</text></paragraph><paragraph id="H2BEB6C88720E451984EEA523928439B2"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>swarf</term> means intermediate material produced from the mechanical processing to shape and produce permanent magnets with a composition that includes Neodymium Iron Boron, Samarium Cobalt, Aluminum Nickel Cobalt, or end-of-life permanent magnet waste materials.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H4B0592B024CD470B8A72AE387467837D" commented="no"><enum>(2)</enum><header>Clerical amendments</header><text>The tables of contents in section 2(b) and title XVII of division A of <external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref> are each amended by inserting after the item relating to section 1758 the following:</text><quoted-block style="OLC" id="H967E5E27729F48A887CF0B1DC75EF5F1" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 1758A.
