which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act and the Mutual Education and Cultural Exchange Act of 1961 to strengthen the critical minerals workforce in the United States.</official-title></form><legis-body id="H62DFF8C131A74DFEA8DD7A4C141CBBBB" style="OLC"><section id="H50668A70FD8746588DE71C290F37E2E7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Minerals Workforce Enhancement Act</short-title></quote>.</text></section><section id="HF23851AE8E6E485383178B58955B5668" section-type="subsequent-section"><enum>2.</enum><header>Engineers working in mining, refining, processing, and recycling of critical minerals</header><text display-inline="no-display-inline">Section 203(b)(2)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(2)(B)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H295B7F84D99B425294D3F53AE340C684" display-inline="no-display-inline"><clause id="HE2EBCFC60A0B4FCC989FE8B46684E55D"><enum>(iii)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security may grant a national interest waiver pursuant to clause (i) on behalf of any alien engineer with respect to whom a petition for preference classification has been filed under subparagraph (A) if the alien engineer agrees to work full-time for a business or Federal or State agency to advance the production (including extraction), processing (including refining), or recycling (including reuse) of critical minerals (as such term is defined in section 7002(a) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)</external-xref>)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H7C48D066BA56499FA9A7281B8B9560F5" section-type="subsequent-section"><enum>3.</enum><header>Multinational educational exchanges</header><text display-inline="no-display-inline">Section 102 of the Mutual Educational and Cultural Exchange Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2452">22 U.S.C. 2452</external-xref>) is amended by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" id="H8D63D42F015545059FFE32F8907695AD" display-inline="no-display-inline"><subsection id="H182EA6E8A81F4972862C82195888B2C3"><enum>(b)</enum><header>Educational exchanges relating to critical minerals</header><paragraph id="HAE01AB1FF0DB43D9AF1771DE1B1191F6"><enum>(1)</enum><header>In general</header><text>The President may support and promote educational exchanges to advance the study of the production, processing, and recycling of critical minerals, and the professional development of individuals in mining or clean energy sectors relating to the production, processing, reclamation, or recycling of critical minerals, including by—</text><subparagraph id="HE37E8DDC17B14D54A4D537D8CFD7F88F"><enum>(A)</enum><text display-inline="yes-display-inline">providing opportunities for United States citizens to study in and obtain degrees and certifications from schools and institutions of learning located outside the United States that offer specialized instruction in the production, processing, reclamation, or recycling of critical minerals; </text></subparagraph><subparagraph id="H7B84CFFAE3CC441B91CE6D74FBDD8206"><enum>(B)</enum><text display-inline="yes-display-inline">facilitating the enrollment of citizens of foreign countries in schools and institutions of learning located in the United States to pursue degrees and certifications in a field related to the production, processing, reclamation, or recycling of critical minerals; </text></subparagraph><subparagraph id="H323CE07A54F84B24AD3E5EB293692883"><enum>(C)</enum><text display-inline="yes-display-inline">supporting the development of educational partnerships and exchange programs focused on critical minerals between United States institutions and foreign institutions, including research collaborations, joint degree programs, and training initiatives to address global challenges relating to the production, processing, reclamation, or recycling of critical minerals; and</text></subparagraph><subparagraph id="HBDF3307E49BA4ADF990926851E95D8ED"><enum>(D)</enum><text display-inline="yes-display-inline">encouraging and providing funding for scholarships, fellowships, and grants for students and professionals engaged in international studies or training related to the production, processing, reclamation, or recycling of critical minerals.</text></subparagraph></paragraph><paragraph id="H2D2122B28FAD4FE39293BB6036CC5FB1"><enum>(2)</enum><header>Critical minerals defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>critical minerals</term> has the meaning given such term in section 7002(a) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
