1.

Short title

This Act may be cited as the Magnus White Cyclist Safety Act of 2024.

2.

Cyclist safety

Not later than 3 years after the date of the enactment of this Act, the Secretary shall issue a final rule requiring that an automatic emergency braking system installed in any new covered vehicle shall be capable of—(1)operating in accordance with the maximum speed threshold described in the final rule of the National Highway Traffic Safety Administration entitled Federal Motor Vehicle Safety Standards; Automatic Emergency Braking Systems for Light Vehicles (89 Fed. Reg. 39686; published May 9, 2024);(2)detecting vulnerable road users; and(3)recognizing the entire range of colors and complexions presented by skin, clothing, and protective gear.

Compliance date

In issuing the final rule pursuant to section 2, the Secretary shall establish a date for required compliance with the final rule of not later than 2 motor vehicle model years after the model year during which the date of the issuance of the final rule occurs.

Definitions

In this Act:(1)

Automatic emergency braking system

The term automatic emergency braking system has the meaning given that term in section 127 of part 571 of title 49, Code of Federal Regulations.(2)

Covered vehicle

The term covered vehicle includes the following types of light vehicles:(A)Passenger cars.(B)Multipurpose passenger vehicles.(C)Trucks.(D)Buses.(E)Light commercial vehicles.(3)

Light commercial vehicle

The term light commercial vehicle means a motor vehicle that designed to transport goods, such as a pickup truck or minivan.(4)

Light vehicle

The term light vehicle means a motor vehicle with a gross vehicle weight rating of 4,536 kilograms or less.(5)

Micromobility user

The term micromobility user means an individual who operates a micromobility vehicle for the personal transportation of the individual.(6)

Micromobility vehicle

The term micromobility vehicle means a small, low-speed vehicle (either human-powered or electric-powered) that typically is operated at a speed below 25 kilometers per hour, including—(A)bicycles;(B)electric-assist bicycles;(C)electric scooters;(D)hoverboards;(E)segways;(F)kick scooters;(G)e-mopeds;(H)monowheels;(I)e-skateboards; and(J)classic skateboards.(7)

Multipurpose passenger vehicle

The term multipurpose passenger vehicle means a motor vehicle that—(A)is capable of carrying a maximum of 10 people; and(B)is built—(i)on a truck chassis; or(ii)with special features for occasional off-road use.(8)

Passenger car

The term passenger car means a motor vehicle that—(A)is capable of carrying a maximum of 10 people; and(B)is not a motorcycle, trailer, or multipurpose passenger vehicle.(9)

Secretary

The term Secretary means the Secretary of Transportation.(10)

Vulnerable road user

The term vulnerable road user means an individual who is on or near a roadway without the protection of the hard covering of a vehicle, including—(A)pedestrians;(B)cyclists;(C)motorcyclists;(D)micromobility users;(E)individuals with disabilities or otherwise reduced mobility and orientation;(F)highway workers on foot in a work zone;(G)individuals riding animals;(H)individuals operating a scooter, skateboard, or in-line skates;(I)individuals operating a farm tractor or other similar vehicle;(J)individuals operating an electric personal assistive mobility device; and(K)individuals operating a wheelchair.
