R. 10347</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241210">December 10, 2024</action-date><action-desc><sponsor name-id="N000191">Mr. Neguse</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to issue rules enacting certain requirements relating to automatic emergency braking systems installed in new covered vehicles, and for other purposes.</official-title></form><legis-body id="HBDE6CD4AB9134E2081CB6D5843F1C523" style="OLC"><section id="H16A58A8E7D2F436D93E920D26CBB4142" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Magnus White Cyclist Safety Act of 2024</short-title></quote>.</text></section><section id="H2C07DCC0AD5541AF8EFFCFB15B6CF813"><enum>2.</enum><header>Cyclist safety</header><text display-inline="no-display-inline">Not later than 3 years after the date of the enactment of this Act, the Secretary shall issue a final rule requiring that an automatic emergency braking system installed in any new covered vehicle shall be capable of—</text><paragraph id="H11CA76B92DDF41D79E67967DC690EA7F" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">operating in accordance with the maximum speed threshold described in the final rule of the National Highway Traffic Safety Administration entitled <quote>Federal Motor Vehicle Safety Standards; Automatic Emergency Braking Systems for Light Vehicles</quote> (89 Fed. Reg. 39686; published May 9, 2024);</text></paragraph><paragraph id="H2A8E350C69044FA485C634EB86CF225E"><enum>(2)</enum><text display-inline="yes-display-inline">detecting vulnerable road users; and</text></paragraph><paragraph id="H323E86115D274366BFC4F5833DB5320E"><enum>(3)</enum><text>recognizing the entire range of colors and complexions presented by skin, clothing, and protective gear.</text></paragraph></section><section id="H48008D2629FD42CEB74A0115AE2659F7"><enum>3.</enum><header>Compliance date</header><text display-inline="no-display-inline">In issuing the final rule pursuant to section 2, the Secretary shall establish a date for required compliance with the final rule of not later than 2 motor vehicle model years after the model year during which the date of the issuance of the final rule occurs.</text></section><section id="HB9911F95FD1F49FB921A42BB98B8AF87"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H96FB9DA1435340389EEE358625FBFC85"><enum>(1)</enum><header>Automatic emergency braking system</header><text display-inline="yes-display-inline">The term <term>automatic emergency braking system</term> has the meaning given that term in section 127 of part 571 of title 49, Code of Federal Regulations.</text></paragraph><paragraph id="HBA622ADDD651476A80E262CB2CC89915" commented="no"><enum>(2)</enum><header>Covered vehicle</header><text>The term <term>covered vehicle</term> includes the following types of light vehicles:</text><subparagraph id="H70DD68AFC5144842893FE6A8D9DB4273" commented="no"><enum>(A)</enum><text>Passenger cars.</text></subparagraph><subparagraph id="H4F6CDF2F16C24B4889B1559631ADA472" commented="no"><enum>(B)</enum><text>Multipurpose passenger vehicles.</text></subparagraph><subparagraph id="H430946FABB89455F81CDB045DBA71F48" commented="no"><enum>(C)</enum><text>Trucks.</text></subparagraph><subparagraph id="HA7463C4521784469B35A670F6D011F04" commented="no"><enum>(D)</enum><text>Buses.</text></subparagraph><subparagraph id="HDF4F0D3F0B844E4E9E70ECB4D042ADC0" commented="no"><enum>(E)</enum><text>Light commercial vehicles.</text></subparagraph></paragraph><paragraph id="H73AB31CC071C4A24B5879DC865040F2D" commented="no"><enum>(3)</enum><header>Light commercial vehicle</header><text display-inline="yes-display-inline">The term <term>light commercial vehicle</term> means a motor vehicle that designed to transport goods, such as a pickup truck or minivan.</text></paragraph><paragraph id="HDDECDE0E67D7418A89CC9A27242AA9D5" commented="no"><enum>(4)</enum><header>Light vehicle</header><text display-inline="yes-display-inline">The term <term>light vehicle</term> means a motor vehicle with a gross vehicle weight rating of 4,536 kilograms or less.</text></paragraph><paragraph id="H75846B9E1571480B9579F4B77AF584E6"><enum>(5)</enum><header>Micromobility user</header><text display-inline="yes-display-inline">The term <term>micromobility user</term> means an individual who operates a micromobility vehicle for the personal transportation of the individual.</text></paragraph><paragraph id="H78DD70859E874BCCB0666C3502666572"><enum>(6)</enum><header>Micromobility vehicle</header><text display-inline="yes-display-inline">The term <term>micromobility vehicle</term> means a small, low-speed vehicle (either human-powered or electric-powered) that typically is operated at a speed below 25 kilometers per hour, including—</text><subparagraph id="HDC60667A4167438099E771CAC5FA5D38"><enum>(A)</enum><text>bicycles;</text></subparagraph><subparagraph id="H0CBE1654C9AA41EDB4EBB3E6B69111D5"><enum>(B)</enum><text>electric-assist bicycles;</text></subparagraph><subparagraph id="HEB6D7D5534AF436BB615C0B14ADA1788"><enum>(C)</enum><text>electric scooters;</text></subparagraph><subparagraph id="H175DD53CB35F4C568989A38A4920366D"><enum>(D)</enum><text>hoverboards;</text></subparagraph><subparagraph id="HEB6A8CE7CB7F4C148D56CEA201DC533B"><enum>(E)</enum><text>segways;</text></subparagraph><subparagraph id="H5EB074489CB445E7AC5EC0904B301D70"><enum>(F)</enum><text>kick scooters;</text></subparagraph><subparagraph id="H2BA0E83268D0426CB8FBDB16A028F826"><enum>(G)</enum><text>e-mopeds;</text></subparagraph><subparagraph id="H7CB0E054625F49E99FA3ACA1A59BACE6"><enum>(H)</enum><text>monowheels;</text></subparagraph><subparagraph id="H872C83F1576C49719E0F898C3C2BCBC9"><enum>(I)</enum><text>e-skateboards; and</text></subparagraph><subparagraph id="HBB813A9A4EE04DC39C3FFD1E5892DE21"><enum>(J)</enum><text>classic skateboards.</text></subparagraph></paragraph><paragraph id="H028114DEB5EE463995E0C3CC7F51DBB3" commented="no"><enum>(7)</enum><header>Multipurpose passenger vehicle</header><text display-inline="yes-display-inline">The term <term>multipurpose passenger vehicle</term> means a motor vehicle that—</text><subparagraph id="H4BBCDB3AFD874BE8B05868D66F6AC0A9" commented="no"><enum>(A)</enum><text>is capable of carrying a maximum of 10 people; and</text></subparagraph><subparagraph id="H20B08C778EF242EAA6C2DCB2C0CD2FF4" commented="no"><enum>(B)</enum><text>is built—</text><clause id="HAD0302BF80564C649486C39D612A9D07" commented="no"><enum>(i)</enum><text>on a truck chassis; or</text></clause><clause id="H70E1B159645244398B17CA94444A3A1A" commented="no"><enum>(ii)</enum><text>with special features for occasional off-road use.</text></clause></subparagraph></paragraph><paragraph id="HAB74475D8ECF4CF184EECA36CA1B0DBD" commented="no"><enum>(8)</enum><header>Passenger car</header><text display-inline="yes-display-inline">The term <term>passenger car</term> means a motor vehicle that—</text><subparagraph id="H3004C4C641FE4DDE94C4BF6E0375BACA" commented="no"><enum>(A)</enum><text>is capable of carrying a maximum of 10 people; and</text></subparagraph><subparagraph id="H505762F6D04B498A9169721E6761FE48" commented="no"><enum>(B)</enum><text>is not a motorcycle, trailer, or multipurpose passenger vehicle.</text></subparagraph></paragraph><paragraph id="HD7B76520E5124E9FA954B0069FE6E6D0"><enum>(9)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="HC77D568B5D3144AAA7B6E81C4BF7A681"><enum>(10)</enum><header>Vulnerable road user</header><text display-inline="yes-display-inline">The term <term>vulnerable road user</term> means an individual who is on or near a roadway without the protection of the hard covering of a vehicle, including—</text><subparagraph id="H45A2886658F64FEAB7FD10086F431FD6"><enum>(A)</enum><text>pedestrians;</text></subparagraph><subparagraph id="HA59E1CBC58EA48588C791B9754AAC06D"><enum>(B)</enum><text>cyclists;</text></subparagraph><subparagraph id="H51BF07FD1BB64EF484C78CF89B44E5A2"><enum>(C)</enum><text>motorcyclists;</text></subparagraph><subparagraph id="HE5608AE581D941ADBDD100BF0931C6AE"><enum>(D)</enum><text>micromobility users;</text></subparagraph><subparagraph id="HCDD8D8AAA3D049EC9B2135215BE35978"><enum>(E)</enum><text>individuals with disabilities or otherwise reduced mobility and orientation;</text></subparagraph><subparagraph id="H68B20BDE62D84A27A9FA2679B193D75F"><enum>(F)</enum><text>highway workers on foot in a work zone;</text></subparagraph><subparagraph id="HF5C3BE2859724D77B08F0A57614F275E"><enum>(G)</enum><text>individuals riding animals;</text></subparagraph><subparagraph id="H51D7E60999BE40E1801689E3BF504558"><enum>(H)</enum><text>individuals operating a scooter, skateboard, or in-line skates;</text></subparagraph><subparagraph id="HBCF4611FF3804F4C9471DC5DDC36CCA8"><enum>(I)</enum><text>individuals operating a farm tractor or other similar vehicle;</text></subparagraph><subparagraph id="HDE242B125BDC44E8A9A9543604B0A7B7"><enum>(J)</enum><text>individuals operating an electric personal assistive mobility device; and</text></subparagraph><subparagraph id="H0946B43323BF4B0C9A77E16003CF8B94"><enum>(K)</enum><text>individuals operating a wheelchair.</text></subparagraph></paragraph></section></legis-body></bill>
