R. 10335</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241210">December 10, 2024</action-date><action-desc><sponsor name-id="B001300">Ms. Barragán</sponsor> (for herself and <cosponsor name-id="T000481">Ms. Tlaib</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Water Pollution Control Act to increase certain criminal fines, and for other purposes.</official-title></form><legis-body id="H7469E4216517498F907FC3FFB9C6CF75" style="OLC"><section id="HEA32636ACAD043958A30780D305DE4D1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Water Justice Act</short-title></quote>.</text></section><section id="H8AB9EC9497DD45CCA8C017F636C3AE0F"><enum>2.</enum><header>Criminal penalties</header><text display-inline="no-display-inline">Section 309(c)(2) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1319">33 U.S.C. 1319(c)(2)</external-xref>) is amended, in the matter following subparagraph (B)—</text><paragraph id="HB71DEFF8411C48A5BC54E175C99070F4"><enum>(1)</enum><text>by striking <quote>$5,000</quote> and inserting <quote>$25,000 (subject to adjustments under this paragraph)</quote>;</text></paragraph><paragraph id="HC239B4854E7943DB9DA21F3FE3172324"><enum>(2)</enum><text>by striking <quote>$50,000</quote> and inserting <quote>$250,000 (subject to adjustments under this paragraph)</quote>;</text></paragraph><paragraph id="H9707D4C991204B9FBD4858E773A9626C"><enum>(3)</enum><text>by striking <quote>$100,000</quote> and inserting <quote>$500,000 (subject to adjustments under this paragraph)</quote>; and</text></paragraph><paragraph id="H378B070FF2D64918B18BC60C8D53FB18" commented="no"><enum>(4)</enum><text>by adding at the end the following: <quote>The Administrator shall annually adjust the maximum penalties under this paragraph by the percentage (if any) by which the Consumer Price Index for all-urban consumers published by the Department of Labor for the month of October preceding the date of the adjustment exceeds such Consumer Price Index for the month of October in the preceding year, and shall publish each such adjustment in the Federal Register. An adjustment shall apply only with regard to a violation committed after the date of such publication.</quote>.</text></paragraph></section></legis-body></bill>
