R. 10320</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241206">December 6, 2024</action-date><action-desc><sponsor name-id="K000401">Mr. Kiley</sponsor> (for himself and <cosponsor name-id="F000480">Mr. Fong</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HSY00">Committee on Science, Space, and Technology</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 51, United States Code, to establish a Commercial Space Transportation Administration, and for other purposes.</official-title></form><legis-body id="H0DA3CDD4B6D249B8B46C2F8B25692FAF" style="OLC"><section id="H3B0A0F3D4A294E58ABC0BCD1D5D8D641" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>New Space Age Act of 2024</short-title></quote>. </text></section><section id="HAE2C620E967D4412AE360D88746156C9"><enum>2.</enum><header>Commercial Space Transportation Administration</header><subsection id="H3238F02100984B3999480EB1503DF592"><enum>(a)</enum><header>In general</header><text>Section 50921 of title 51, United States Code, is amended to read as follows:</text><quoted-block style="USC" id="HC5FD6A5AD2374AD7A68AD9AB70672CB1" display-inline="no-display-inline"><section id="H96A7338556F741FB8552B96A173AFCFA"><enum>50921.</enum><header>Commercial Space Transportation Administration</header><subsection id="H93B927343F804117BCF7556183D88852"><enum>(a)</enum><header>Establishment</header><text>There is established within the Department of Transportation a Commercial Space Transportation Administration to—</text><paragraph id="H9AEEF2E0A6DB4479B75F4CB133CB7FBC"><enum>(1)</enum><text>accelerate the growth of the commercial space transportation industry of the United States;</text></paragraph><paragraph id="HC6EC6842ADD8457883C67E457E96A5CE"><enum>(2)</enum><text>ensure United States technological leadership in space; and</text></paragraph><paragraph id="H154D716A2E4E484D9A905A1D02C03A93"><enum>(3)</enum><text>protect the public health and safety, safety of property, national security interests, and foreign policy interests of the United States during commercial launch and reentry activities.</text></paragraph></subsection><subsection id="H84E33B1BD3794D76813EEFF04A530EFD"><enum>(b)</enum><header>Administrator</header><text display-inline="yes-display-inline">The Commercial Space Transportation Administration shall be headed by an Administrator who is appointed by the President, by and with the advice and consent of the Senate. The Administrator shall report directly to the Secretary of Transportation. The Administrator shall have at least 5 years of experience in the space industry or in a government agency or office in the commercial space industry.</text></subsection><subsection id="H57F50EF6C18C404FBB28E2D1B86FFFB7"><enum>(c)</enum><header>Duties and responsibilities</header><text>The Administrator of the Commercial Space Transportation Administration shall—</text><paragraph id="H06124D5F2774422C811D12B259C86157"><enum>(1)</enum><text>exercise the authorities of the Secretary of Transportation with respect to commercial space launch and reentry activities, including the authorities provided under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/51/509">chapter 509</external-xref> of title 51;</text></paragraph><paragraph id="H9C1B27AD4AD84545877031F32835861B"><enum>(2)</enum><text>encourage the development of technologies and capabilities of the commercial space transportation industry of the United States;</text></paragraph><paragraph id="H0C493A156FDF4370A727CCB6D1A750F9"><enum>(3)</enum><text>maintain the competitive edge of the United States in commercial space activities;</text></paragraph><paragraph id="H5A97476527C24A1591AD9E8F73AC98E1"><enum>(4)</enum><text display-inline="yes-display-inline">coordinate activities with other agencies and departments of the Federal Government, including the Federal Communications Commission, the Department of Commerce, the National Aeronautics and Space Administration, the Federal Aviation Administration, and the Department of Defense, to streamline and expedite the approval of licenses necessary for the timely conduct of commercial space launch and reentry activities; and</text></paragraph><paragraph id="H85B899EE7B8F4BC5A833D13F39781111"><enum>(5)</enum><text>issue regulations concerning commercial space launch and reentry activities that appropriately manage—</text><subparagraph id="HCB50FC64CF1049308AA011A80E6B9CC7"><enum>(A)</enum><text>commercial requirements for timely approval or denial of license and permit applications or modifications to such applications;</text></subparagraph><subparagraph id="HD048B5D27D404537951CFAFC87EE9AE8"><enum>(B)</enum><text>advantages in technology developed or manufactured in the United States;</text></subparagraph><subparagraph id="H951E76129EF54FE6B9CD5CEA61B0C1CB"><enum>(C)</enum><text>responsiveness and readiness of commercial space launches to meet commercial and national security needs, including by minimizing delays as a result of licensing and authorization processes; and</text></subparagraph><subparagraph id="H3201C9AD948C48EFAC602B88817FFD47"><enum>(D)</enum><text>public safety concerns.</text></subparagraph></paragraph></subsection><subsection id="H18108C3E963142B08C99E92E4C208D6C"><enum>(d)</enum><header>Transfer</header><text>Not later than 180 days after the date of enactment of the <short-title>New Space Age Act of 2024</short-title>, the Secretary shall transfer the authorities to be exercised by the Administrator of the Commercial Space Transportation Administration from the Federal Aviation Administration or any other agency of the Department of Transportation.</text></subsection><subsection id="H2AC4CC94F8C54EFD853CCA74FF09E6DC"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary for the activities of the Commercial Space Transportation Administration $50,000,000 for each of fiscal years 2024 through 2028, of which not less than 75 percent of the amount appropriated—</text><paragraph id="H384B978648C2404EB464BC2A91A86BC0"><enum>(1)</enum><text>shall be reserved only for use in the timely and expeditious processing of applications for licenses and authorizations; and</text></paragraph><paragraph id="HC605F8F9C44C42F5ACEBC2F246ACFEB6"><enum>(2)</enum><text>may not be used in the development or promulgation of regulations.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H0C81D80F68A7434198CB9F4BB0FBA8D9"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for title 51, United States Code, is amended by striking the item relating to section 50921 and inserting the following:</text><quoted-block style="USC" id="HBF9289C1C26D490D891C9B7C67474EF8" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">50921. Commercial Space Transportation Administration.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HFE14A98BE6A04B76A10EB5A623B66C2F"><enum>3.</enum><header>Launch and Reentry Working Group</header><subsection id="H49CE0C462640479398905DDD9D20C816"><enum>(a)</enum><header>Disestablishment</header><text>The Common Standards Working Group established by the Department of the Air Force, the Federal Aviation Administration, and the National Aeronautics and Space Administration shall be disestablished not more than 180 days after the date of enactment of this Act. The records, responsibilities, and duties of such Working Group shall be assumed by the working group established pursuant to subsection (b).</text></subsection><subsection id="H0D591B3E591C47E4A79097E289F8031B"><enum>(b)</enum><header>Establishment</header><text>The Secretary of Transportation shall establish a working group, to be known as the <quote>Launch and Reentry Working Group</quote>, to recommend to the Secretary safety standards intended to protect the public and critical assets on Federal space launch ranges from hazards associated with space launch and reentry events.</text></subsection><subsection id="HFA0AF952439E4C30993756FBC02BEFDE"><enum>(c)</enum><header>Members</header><text>The Launch and Reentry Working Group shall be made up of—</text><paragraph id="H19C9B7777E174CBBB9015D6981BC8961"><enum>(1)</enum><text>the Administrator of the Commercial Space Transportation Administration;</text></paragraph><paragraph id="H4E940EC2654148309AA4539C8994616E"><enum>(2)</enum><text>the Chief of Space Operations;</text></paragraph><paragraph id="H80BD91649B984A8689507C004C820009"><enum>(3)</enum><text>the Administrator of the National Aeronautics and Space Administration;</text></paragraph><paragraph id="H678E68AD17E14BDF90C7BBDBAD3F199A"><enum>(4)</enum><text>representatives from commercial space launch or reentry operators with a proven history of successful launch or reentry activities licensed by the Commercial Space Transportation Administration or the Office of the Associate Administrator for Commercial Space Transportation; and</text></paragraph><paragraph id="H6D2BAA7A152A4137B034458EBCF40671"><enum>(5)</enum><text>not more than 4 non-governmental members with specific expertise in space launch and reentry, to be appointed by the Secretary of Transportation, that are not representatives of commercial space launch and reentry providers described in paragraph (4).</text></paragraph></subsection><subsection id="HD1A964AC14004B13AD392C39E4C15F7B"><enum>(d)</enum><header>Additional procedures</header><text>The Launch and Reentry Working Group shall—</text><paragraph id="H55DC7C03F940402AB98986365E934B2E"><enum>(1)</enum><text display-inline="yes-display-inline">make its methodologies for calculating risks and standards available to an operator of a launch or reentry vehicle system within 7 days of a request by such operator impacted by such methodologies;</text></paragraph><paragraph id="H2651FC37A59944C9B2BDFDF420DEE516"><enum>(2)</enum><text>in approving new risk models, data products, other safety recommendations, or in conducting other significant business—</text><subparagraph id="H93C9980ACEAA46ABB0A0D54AE7B51352"><enum>(A)</enum><text>require recorded approval from a majority of the participants of the Working Group; and</text></subparagraph><subparagraph id="H0D424409BA4148F792005A7174CACFFB"><enum>(B)</enum><text>not allow nonconcurrence or abstention by a single or multiple members of the Working Group to disrupt or delay the approval;</text></subparagraph></paragraph><paragraph id="H6F78B7C6BA924AD2BA879A6AA2946715"><enum>(3)</enum><text>make all relevant data available to space launch and reentry providers, government agencies, and other responsible bodies upon request;</text></paragraph><paragraph id="HE293E9FEFDB145C296CF2AACBBCB733E"><enum>(4)</enum><text>conduct the work of the Working Group in a timely manner, including through regularly scheduled meetings and, as required, emergency meetings; and</text></paragraph><paragraph id="HE9CAA910D83E4DB9B0D236D673F81EA7"><enum>(5)</enum><text>ensure that recommendations are based on real-world, probabilistic assessments and discount hypotheticals based on unproven assumptions or technologies.</text></paragraph></subsection></section><section id="H49126A95DEEF464888D03CDEE61CF60F"><enum>3.</enum><header>Commercial Space Transportation Advisory Committee</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Transportation shall update the charter of the Commercial Space Transportation Advisory Committee (DOT/FAA Order 1110.124I) to—</text><paragraph id="H4BD91BE8CF7A4FDE9D3DF69CC86380B0"><enum>(1)</enum><text>encourage greater participation from industry and nongovernmental experts;</text></paragraph><paragraph id="H8A98CE37FBB9441181D80FA8B3FA4401"><enum>(2)</enum><text>require that the Advisory Committee establish the agenda of the Committee independently of any requests from the Administrator of the Federal Aviation Administration;</text></paragraph><paragraph id="HDE282A9EE3694012B659896FF2CE6464"><enum>(3)</enum><text>ensure that the Administrator of the Federal Aviation Administration or, once established, the Commercial Space Transportation Administration is using the Advisory Committee to receive input from external sources in order to inform governmental activities;</text></paragraph><paragraph id="H09C9CA2703914B9BB07230D91AF99A5A"><enum>(4)</enum><text>require that the Advisory Committee transmit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Science, Space, and Technology of the House of Representatives not less than annually a report that includes all agenda items proposed by the Advisory Committee, including any agenda items that are not accepted by the Secretary; and</text></paragraph><paragraph id="H3E4E0E80022C4A92BAD541534B64D021"><enum>(5)</enum><text>require that the Secretary make available not later than December 31 of each year a public report detailing the total expenses incurred by or reasonably caused by the Advisory Committee, including the number of hours consumed by full Committee and working group meetings and in-kind contributions that may include the value of time provided by Federal Government employees, in the calendar year in which such report is prepared, as well as a cumulative accounting of all prior expenses incurred, to the maximum extent practicable.</text></paragraph></section><section id="H9D4E2380982A429C9D4CC7A7F710186F"><enum>3.</enum><header>Space-related advisory rulemaking committees</header><text display-inline="no-display-inline">Section 50903 of title 51, United States Code, is amended by adding at the end the following:</text><quoted-block id="H5F3FE7B48155473E9DF01C7FE504193A" style="OLC"><subsection id="H62513AC8EE534980BE479A267FA097FF"><enum>(e)</enum><header>FACA</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/10">Chapter 10</external-xref> of title 5 (commonly known as <quote>the Federal Advisory Committee Act</quote>) does not apply to such space-related rulemaking committees under the jurisdiction of the Secretary of Transportation as the Secretary may designate.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
