R. 10311</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241205">December 5, 2024</action-date><action-desc><sponsor name-id="S001145">Ms. Schakowsky</sponsor> (for herself, <cosponsor name-id="J000288">Mr. Johnson of Georgia</cosponsor>, and <cosponsor name-id="H001068">Mr. Huffman</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide a private right of action for persons harmed by violations of the Franchise Rule of the Federal Trade Commission, and for other purposes.</official-title></form><legis-body id="HDA0E0EF3680347D2B9D777E5A5104105" style="OLC"><section id="H386A72BCE67848C482B376A002BDC549" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Franchisee Freedom Act</short-title></quote>. </text></section><section id="H3CF26FF6A0204174B307BE4D2A1C79DE"><enum>2.</enum><header>Private right of action</header><subsection id="H4D6BEE257026422BADA3E681F05369B1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any person found to have committed any violation of part 436 of title 16, Code of Federal Regulations, shall be liable to any person harmed by such violation for—</text><paragraph id="HC53642A2441A4D6AADD0A488EB2A8C6C"><enum>(1)</enum><text>actual damages;</text></paragraph><paragraph id="HA467CF51F9CA448E9FFD340144004D82"><enum>(2)</enum><text display-inline="yes-display-inline">additional equitable relief, including rescission of any contract and such other equitable relief as a court may find appropriate; and</text></paragraph><paragraph id="HED5754848DFC484DB55358040FE3E3D6"><enum>(3)</enum><text display-inline="yes-display-inline">reasonable attorneys’ fees and costs.</text></paragraph></subsection><subsection id="HD437475DC56C40F5BD7637E5C04A79FC"><enum>(b)</enum><header>Jurisdiction and venue</header><text display-inline="yes-display-inline">Jurisdiction and venue of a civil action under this section shall be concurrent and may be commenced in—</text><paragraph id="H2E595DE8CBAD442A827A5E62C85F7918"><enum>(1)</enum><text>the United States District Court in the district in which the claimant resides; or</text></paragraph><paragraph id="H2EEC2E2ECC234D9D9A8C5E707F54EDA0"><enum>(2)</enum><text>in a State court of competent jurisdiction in the State in which the claimant resides.</text></paragraph></subsection></section></legis-body></bill>
