Raimondo; and</text></paragraph><paragraph id="HBF43461AE64847C0B3BE2D7086EDD890"><enum>(2)</enum><text><italic></italic>effective steps for improving the efficiency and proper management of rules that exceed agency authority and had previously been upheld by the Chevron deference is imposed in order to prove Congress an opportunity for a review of unlawful statutes.</text></paragraph></section><section id="H55C8729C53E348CDA9F770D18C57563F"><enum>3.</enum><header>Provision of information for congressional review of certain rules</header><subsection id="HDF5D296B0AE14C109DF7B9AAF41595F1"><enum>(a)</enum><header>Provision of information by agency</header><text>Not later than 30 days after the introduction of a joint resolution described in section 4(a), the head of the agency that made the rule shall make available to Congress and the Comptroller General of the United States, upon request—</text><paragraph id="H325BC01582494C599814B50E0B80FF9D"><enum>(1)</enum><text>a complete copy of the cost-benefit analysis of the rule, if any;</text></paragraph><paragraph id="H4069890314334DD78F4FB00E5AFA49A2"><enum>(2)</enum><text display-inline="yes-display-inline">the agency’s actions under sections 202, 203, 204, and 205 of the Unfunded Mandates Reform Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1532">2 U.S.C. 1532 et seq.</external-xref>);</text></paragraph><paragraph id="H45761B640FFB44BAA3000133E911DFB6"><enum>(3)</enum><text>any and all actions the agency has taken related to the rule after implementing the rule; and</text></paragraph><paragraph id="H6BF75C5107A04985BAF7EE6C4506200B"><enum>(4)</enum><text display-inline="yes-display-inline">any other relevant information or requirements related to the rule under any other Act and any relevant Executive order. </text></paragraph></subsection><subsection id="HDCE4807B89264D9F9081C8B2121B0169"><enum>(b)</enum><header>Provision to Committees</header><text>Upon receipt of the information described in subsection (a), each House of Congress shall provide copies of such information to the Chairman and Ranking Member of each committee with jurisdiction over the subject matter of the rule. </text></subsection><subsection id="H60E639DB33E3480A82328FCCD9E285BB"><enum>(c)</enum><header>Reporting by the Comptroller General</header><text>Not later than 30 days after the introduction of a joint resolution described in section 4(a), the Comptroller General shall submit to—</text><paragraph id="HDB923AD35AA145A7972B15CBDBC8A715"><enum>(1)</enum><text>Congress a report on the rule that is the subject of the joint resolution; and</text></paragraph><paragraph id="HB302D722F8764B198099053BA25F9082"><enum>(2)</enum><text display-inline="yes-display-inline">the sponsor of the joint resolution and the Chairman and Ranking Member of each committee with jurisdiction over the subject matter of the rule, an analysis of the copy of the cost-benefit analysis of the rule made available under subsection (a)(1).</text></paragraph></subsection><subsection id="H6F30D29B1DC447639252670B8A1A0AF7"><enum>(d)</enum><header>CRS report</header><text display-inline="yes-display-inline">Not later than 30 days after the introduction of a joint resolution described in section 4(a), the Director of the Congressional Research Service shall submit to the sponsor of the joint resolution and the Chairman and Ranking Member of each committee with jurisdiction over the subject matter of the rule a summary of litigation with respect to the rule, if applicable.</text></subsection><subsection id="HB8183735922C4F82BC6371461E2BD1BC"><enum>(e)</enum><header>CBO report</header><text display-inline="yes-display-inline">Not later than 30 days after the introduction of a joint resolution described in section 4(a), the Director of the Congressional Budget Office shall submit to the sponsor of the joint resolution and the Chairman and Ranking Member of each committee with jurisdiction over the subject matter of the rule an analysis on the cost of the rule to the economy and projected economic impact if the rule ceases to be in effect.</text></subsection><subsection id="H8130AAFBC55B477F86D7B2D533CDA69C"><enum>(f)</enum><header>Rules upheld or promulgated based on Chevron</header><paragraph id="H1C76F49FF4E74A4EBCD2B441DB1E1567"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">This Act applies to rules with respect to which—</text><subparagraph id="H9BC0AB9A0E3840F38EB2B5D410D0C103"><enum>(A)</enum><text>the agency explicitly relied on Chevron deference in the notice of proposed rulemaking; or</text></subparagraph><subparagraph id="H0FC3786627E64540B205560516215727"><enum>(B)</enum><text>a Federal court upheld the rule based on Chevron deference.</text></subparagraph></paragraph><paragraph id="HB7DB3C8AF55E4A898B2997683FBE2384"><enum>(2)</enum><header>Nullification of rules disapproved by congress</header><text>Any rule that is disapproved under section 4 shall be treated as though such rule had never taken effect. </text></paragraph><paragraph id="H45AD99F921AF43A49F0868E6D7A0414D"><enum>(3)</enum><header>No inference to be drawn where rules not disapproved</header><text>If a joint resolution is not enacted under section 4, no court or agency may infer any intent of Congress from any action or inaction of Congress with regard to such rule, related statute, or joint resolution of disapproval.</text></paragraph></subsection></section><section id="H6C0A55D3CFF7410A928D4766CC8BFCB5"><enum>4.</enum><header>Congressional Disapproval Procedure</header><subsection id="HB0D6B096E76E497CB0D6190BC6AFE23A"><enum>(a)</enum><header>Joint resolution defined</header><text display-inline="yes-display-inline">For the purposes of this section, the term <term>joint resolution</term> means only a joint resolution, the matter after the resolving clause of which is as follows: <quote>That Congress disapproves the rule submitted by the ___ relating to ___, with respect to which [the agency explicitly relied on Chevron deference in the notice of proposed rulemaking _______/ a Federal court upheld the rule based on Chevron deference in ______.</quote> (the blank spaces are appropriately filled in).</text></subsection><subsection id="H7D04819D1AB84BFC9023DA9E6AF6A564"><enum>(b)</enum><header>Referral</header><text display-inline="yes-display-inline">A joint resolution described in subsection (a) shall be referred to the committees in each House of Congress with jurisdiction.</text></subsection><subsection id="HFA8D58FB587A4D4888E87425FA5719BE"><enum>(c)</enum><header>Discharge</header><text>If the committee to which is referred a joint resolution described in subsection (a) has not reported such joint resolution (or an identical resolution) at the end of 20 calendar days after the submission or introduction of legislation to disapprove the rule, such committee may be discharged from further consideration of such joint resolution and placed on the appropriate calendar of the House involved—</text><paragraph id="HB93493488E484D95B1A43A9754DD302E"><enum>(1)</enum><text>in the Senate, upon a petition supported in writing by 30 Members of the Senate; and</text></paragraph><paragraph id="HF28D87C165654E1B9EDA4981BE16561F"><enum>(2)</enum><text>in the House of Representatives, upon a petition supported in writing by one-fourth of the Members duly sworn and chosen, or by motion of the Speaker supported by the Minority Leader. </text></paragraph></subsection><subsection id="H4B24911B64D64DFFA01F67A499A0F6AC"><enum>(d)</enum><header>Floor consideration</header><paragraph id="H420C0D6EE3BF4C34B21168EB85D18695"><enum>(1)</enum><header>In general</header><text>When the committee to which a joint resolution is referred has reported, or when a committee is discharged (under subsection (c)) from further consideration of, a joint resolution described in subsection (a), it is at any time thereafter in order (even though a previous motion to the same effect has been disagreed to) for a motion to proceed to the consideration of the joint resolution, and all points of order against the joint resolution (and against consideration of joint resolution) are waived. The motion is not subject to amendment, to a motion to postpone, or to a motion to proceed to the consideration of other business. A motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order. If a motion to proceed to the consideration of the joint resolution is agreed to, the joint resolution shall remain the unfinished business of the respective House until disposed of.</text></paragraph><paragraph id="H48A0A5E10DBB4F7CB7B2C1E6A2BDA65E"><enum>(2)</enum><header>Debate</header><text>Debate on the joint resolution, and on all debatable motions and appeals in connection therewith, shall be limited to not more than 10 hours, which shall be divided equally between those favoring and those opposing the resolution. A motion further to limit debate is in order and not debatable. An amendment to, or a motion to postpone, or a motion to proceed to the consideration of other business, or a motion to recommit the resolution is not in order.</text></paragraph><paragraph id="HC25F782D994B47EA82083BF1882AEFA7"><enum>(3)</enum><header>Final passage</header><text>Immediately following the conclusion of the debate on a resolution described in subsection (a), and a single quorum call at the conclusion of the debate if requested in accordance with the rules of the appropriate House, the vote on final passage of the resolution shall occur.</text></paragraph><paragraph id="HF8C28E8444A94D3880DA1F4C65935FF2"><enum>(4)</enum><header>Appeals</header><text>Appeals from the decisions of the Chair relating to the application of the rules of the Senate or the House of Representatives, as the case may be, to the procedure relating to a resolution described in subsection (a) shall be decided without debate.</text></paragraph><paragraph id="H0307952BC1404D61B4B8E60F24385CA1"><enum>(5)</enum><header>Treatment if other House has acted</header><text>If, before the passage by one House of a resolution of that House described in subsection (a), that House receives from the other House a resolution described in subsection (a), then the following procedures shall apply:</text><subparagraph id="H98EB1C0A75CA4ACD9B0388E166A65349"><enum>(A)</enum><header>Nonreferral</header><text>The resolution of the other House shall not be referred to a committee.</text></subparagraph><subparagraph id="H4EA73DFD8CCD4354A76FAFB1CC531CF6"><enum>(B)</enum><header>Final passage</header><text>With respect to a resolution described in subsection (a) of the House receiving the resolution—</text><clause id="HB7B9556C2C394B0886702B0B40980302"><enum>(i)</enum><text>the procedure in that House shall be the same as if no resolution had been received from the other House; but</text></clause><clause id="H224BEEC3B4CE48159F137B138838DB3F"><enum>(ii)</enum><text>the vote on final passage shall be on the resolution of the other House.</text></clause></subparagraph></paragraph></subsection><subsection id="H0A897D5E561A40A9BA82F79B6ABBAB9A"><enum>(e)</enum><header>Constitutional authority</header><text display-inline="yes-display-inline">This section is enacted by Congress—</text><paragraph id="H10477AFD77754DDA83D2BB753B8C5D41"><enum>(1)</enum><text display-inline="yes-display-inline">as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and as such it is deemed a part of the rules of each House, respectively, but applicable only with respect to procedure to be followed in this section, and it supersedes other rules only to the extent that it is inconsistent with such rules; and</text></paragraph><paragraph id="H91E6F780B8544D5D938A46349B8F83D9"><enum>(2)</enum><text>with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text></paragraph></subsection></section><section id="HA4BFEA67F448406EBA3FB33E36790162"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text><paragraph id="H189A304078824E1CADA8FEBB479F2B30"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given such term in section 551(1) of title 5, United States Code. </text></paragraph><paragraph id="HB647929FDA57422D9E78AA8AA585D929"><enum>(2)</enum><header>Rule</header><text>The term <term>rule</term> has the meaning given such term in section 804 of title 5, United States Code, except that such term does not include any rule related to monetary policy made by Board of Governors of the Federal Reserve System or the Federal Open Market Committee. </text></paragraph><paragraph id="HE275F61FF46C4521B8F89DCD3A16FB3F"><enum>(3)</enum><header>Chevron deference</header><text>The term <term>Chevron deference</term> means the legal doctrine of judicial deference under Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc. (467 U.S. 837 (1984)).</text></paragraph></section><section id="HF4C4085F98294F18B212345BE7653412"><enum>6.</enum><header>Judicial review</header><text display-inline="no-display-inline"> No determination, finding, action, or omission under this Act shall be subject to judicial review.</text></section><section id="HD36C8F2CA6114BEDA87EDB2C3A42109C"><enum>7.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the application of any provision of this Act to any person or circumstance, is held invalid, the application of such provision to other persons or circumstances, and the remainder of this Act, shall not be affected thereby.</text></section></legis-body></bill>
