R. 10290</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241204">December 4, 2024</action-date><action-desc><sponsor name-id="M000194">Ms. Mace</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit an entity from receiving Federal funds if such entity permits an individual to access or use a single-sex facility on the property of such entity that does not correspond to the biological sex of such person, and for other purposes.</official-title></form><legis-body id="H274A2F6A532A48EEA005FA0275383088"><section id="HC7E5A0D528F646129A4F76C90AA314A3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop the Invasion of Women’s Spaces Act</short-title></quote>.</text></section><section id="HDF5FD428D1E549049D9902B8664FCAAE"><enum>2.</enum><header>Prohibition</header><subsection id="H322B291661984FC39C89CAA6956A1A24"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, no Federal funds may be provided, directly or indirectly, to an entity if such entity permits an individual to access or use a single-sex facility on the property of such entity that does not correspond to the biological sex of such person, except as provided by subsection (c).</text></subsection><subsection id="H800D5318CAC64FE69929FEFD37406437"><enum>(b)</enum><header>Definitions</header><text>In this section—</text><paragraph id="H63FBA0232372445099287E4ACD3DB929"><enum>(1)</enum><header>Single-sex facility</header><text>The term <quote>single-sex facility</quote> means a space intended for the use of one biological sex (male or female), including a—</text><subparagraph id="H0BE88D1E9559489AB8C438600B9E9657"><enum>(A)</enum><text>restroom;</text></subparagraph><subparagraph id="H1AF4E5AE8FD243778ACF091B627D566F"><enum>(B)</enum><text>locker room; or</text></subparagraph><subparagraph id="H75047C4FC4574BACA8868E269CDA8A73"><enum>(C)</enum><text>changing room.</text></subparagraph></paragraph><paragraph id="H8FBAE060BC2C47FB9220069634F4C43F"><enum>(2)</enum><header>Property</header><text>The term <quote>property</quote> means any building, land, or other real property owned, leased, controlled, or occupied by an entity.</text></paragraph><paragraph id="H6897144DDC494F5786B19E288A58709B"><enum>(3)</enum><header>Biological sex</header><text>The term <quote>biological sex</quote> means the biological determination as to whether an individual is male or female, as such terms are defined in this section.</text></paragraph><paragraph id="H1EAAAEC1F4AC406191A8AFCF2BB022CB"><enum>(4)</enum><header>Female</header><text>The term <quote>female</quote> means an individual who naturally has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes eggs for fertilization.</text></paragraph><paragraph id="HE4391B767C964F9E99EE6A56451CBA0C"><enum>(5)</enum><header>Male</header><text>The term <quote>male</quote> means an individual who naturally has, had, will have, or would have, but for a developmental or genetic anomaly or historical accident, the reproductive system that at some point produces, transports, and utilizes sperm for fertilization.</text></paragraph><paragraph id="HBF86EB9D048846C7803CB3C5D95EB2C6"><enum>(6)</enum><header>Entity</header><text>The term <quote>entity</quote> means any private entity, non-Federal Government agency or department, or State, tribal, or local government (including a political subdivision, department, or component thereof).</text></paragraph></subsection><subsection id="H7152DA059E084A3B9DDD7368E6F8EB44"><enum>(c)</enum><header>Exception</header><text>Subsection (a) shall not apply with respect to an entity that permits an individual to access a single-sex facility on the property of such entity that does not correspond to the biological sex of such person in the circumstance of—</text><paragraph id="HD262E0B05E8D4DA68468CCCA5DE51651"><enum>(1)</enum><text>emergency medical personnel responding to a medical emergency; or</text></paragraph><paragraph id="HA7D797A667B4456882EAEB6A2BA9B79F"><enum>(2)</enum><text>a law enforcement officer in active pursuit of a suspect, or as part of an active investigation.</text></paragraph></subsection></section></legis-body></bill>
