<official-title display="yes">To amend title 18, United States Code, to increase the punishment for certian offenses committed in a school zone, and for other purposes.</official-title>

<section id="HB1D4BF43311C48B18629418DE9D84EF7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sheila Jackson Lee Stop Human Trafficking in School Zones Act</short-title></quote>.</text></section> <section id="H4DE9F9E5A4554542BE819713E3896F49"><enum>2.</enum><header>Increased punishment for human trafficking in school zones</header><text display-inline="no-display-inline">Section 1591 of title 18, United States Code, is amended—</text> 
<paragraph id="H984837219F624A2596CAC2A89B26680F"><enum>(1)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph> <paragraph id="HB17ED6795BF148E4AC1F0BFBDB8E8D50"><enum>(2)</enum><text>by inserting after subsection (d) the following:</text>

<subsection id="H830A02FA09954A61BAA56857BD01B240" indent="up1"><enum>(e)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H8BC91854BAF6438D89297CAF08FCC9DC" indent="down1"><enum>(1)</enum><text>Whoever violates subsection (a) knowing, or having reasonable cause to believe, that the violation is committed against a minor who, at the time of the violation—</text> <subparagraph id="H41BB7D784160406EB05ED25146D5325F" indent="up1"><enum>(A)</enum><text>is enrolled in school and is—</text> 
<clause id="HE9CD2CA6DD9042949FB4833FA3D323C1"><enum>(i)</enum><text>within a school zone; or</text></clause> <clause id="H7A2DA03D96E84E5E97FF252CDED355A9"><enum>(ii)</enum><text>on, or within 1,000 feet of, a premises on which a school-sponsored activity is taking place; or</text></clause></subparagraph> 
<subparagraph id="HF38F4A6073D542839562C008936340AD" indent="up1"><enum>(B)</enum><text>is enrolled in an institution of higher education and is on, or within 1,000 feet of, a premises owned by the institution of higher education,</text></subparagraph><continuation-text continuation-text-level="section">shall, in addition to the punishment otherwise provided under subsection (b), be imprisoned for not more than 5 years, which shall run consecutively to any term of imprisonment imposed under such subsection (b).</continuation-text></paragraph> <paragraph id="H9B413D307A8B4395B76D77F4B39500A3"><enum>(2)</enum><text>In this subsection:</text> 
<subparagraph id="H4A35A13CC1C74DDD96E1B1AA721D9425"><enum>(A)</enum><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></subparagraph> <subparagraph id="H6B5B28914ED94C01BAFC5272D1D5EACD"><enum>(B)</enum><text>The term <quote>minor</quote> means a person who has not attained 18 years of age.</text></subparagraph> 
<subparagraph id="H6667328B5CE04E98BA98117E04FECD67"><enum>(C)</enum><text>The terms <quote>school</quote> and <quote>school zone</quote> have the meanings given those terms in section 921.</text></subparagraph> <subparagraph id="H5DC8A2EDADC442D3A9573FEC9D5730AE"><enum>(D)</enum><text>The term <quote>school-sponsored activity</quote> means any activity that is produced, financed, arranged, supervised, or coordinated by a school or a State educational agency or local educational agency or is under the jurisdiction of a State educational agency or local educational agency.</text></subparagraph> 
<subparagraph id="H80847096E99F44A2A962AFB6E3724E25"><enum>(E)</enum><text>The terms <quote>State educational agency</quote> and <quote>local educational agency</quote> have the meanings given those terms under section 8101 of the Elementary and Secondary Education Act of 1965.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H0B08145553974832A644124E3BA09E02"><enum>3.</enum><header>Increased punishment for coercion and enticement in school zones</header><text display-inline="no-display-inline">Section 2422 of title 18, United States Code, is amended by adding at the end the following:</text>

<subsection id="H959927FFAC9C4B80996FD49D0AEE92DB" indent="up1"><enum>(c)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HEB16FFFE83D4409580AF1C5FA1591331" indent="down1"><enum>(1)</enum><text>Whoever violates subsection (a) or (b) knowing, or having reasonable cause to believe, that the violation is committed against a minor who, at the time of the violation—</text> <subparagraph id="H7938D64BE4C5475F852BE2303EA78DBD" indent="up1"><enum>(A)</enum><text>is enrolled in school and is—</text> 
<clause id="H7009C5ED3CC7407DA8F0A5544281352D"><enum>(i)</enum><text>within a school zone; or</text></clause> <clause id="HB70E736A50FB4CCFBE2B33F45CE131EB"><enum>(ii)</enum><text>on, or within 1,000 feet of, a premises on which a school-sponsored activity is taking place; or</text></clause></subparagraph> 
<subparagraph id="H141BF4707EAF428B81BFEADD6F88643C" indent="up1"><enum>(B)</enum><text>is enrolled in an institution of higher education and is on, or within 1,000 feet of, a premises owned by the institution of higher education,</text></subparagraph><continuation-text continuation-text-level="paragraph" indent="subsection">shall, in addition to the punishment otherwise provided under this section, be imprisoned for not more than 5 years, which shall run consecutively to any term of imprisonment imposed under this section.</continuation-text></paragraph> <paragraph id="H4D288AA70D67452F875FEF951B616D75"><enum>(2)</enum><text>In this subsection:</text> 
<subparagraph id="HCBC14CC99B0744D0BD2BE79392589785"><enum>(A)</enum><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></subparagraph> <subparagraph id="H21A50B0DAD2844B68F24CECB1C142377"><enum>(B)</enum><text>The term <quote>minor</quote> means a person who has not attained 18 years of age.</text></subparagraph> 
<subparagraph id="HDCCB44A4AC4C4DAEAF9F3C4D09443678"><enum>(C)</enum><text>The terms <quote>school</quote> and <quote>school zone</quote> have the meanings given those terms in section 921.</text></subparagraph> <subparagraph id="HCEC34004F56B4A058F68B7ED06037640"><enum>(D)</enum><text>The term <quote>school-sponsored activity</quote> means any activity that is produced, financed, arranged, supervised, or coordinated by a school or a State educational agency or local educational agency or is under the jurisdiction of a State educational agency or local educational agency.</text></subparagraph> 
<subparagraph id="H9D78DDA21FE14C7197034EEB17F174EC"><enum>(E)</enum><text>The terms <quote>State educational agency</quote> and <quote>local educational agency</quote> have the meanings given those terms under section 8101 of the Elementary and Secondary Education Act of 1965.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H294CA72CB00F4BAEA070EB7729932477"><enum>4.</enum><header>Increased punishment for transfer of obscene material to minors in a school zone</header><text display-inline="no-display-inline">Section 1470 of title 18, United States Code, is amended—</text> 
<paragraph id="HA98469C12D23419D8140F6686C5F6CB9"><enum>(1)</enum><text>by striking <quote>Whoever</quote> and inserting <quote>(a)Whoever</quote> ; and</text></paragraph> <paragraph id="H3B362A0AB95D4FA9A13B486CD1A1F546"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="HA70DBF22406B4746808B7CCBD477FF53"><enum>(b)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H20D161848F6B4A04886DE3D2F0449ED7" indent="up1"><enum>(1)</enum><text>Whoever violates this section knowing, or having reasonable cause to believe, that the violation is committed against a minor who, at the time of the violation—</text> <subparagraph id="H65DFA0C9ECF648A6935BCBE865CA571D"><enum>(A)</enum><text>is enrolled in school and is—</text> 
<clause id="H4FFFFAF3E3894CB48141BF50710E4FE7"><enum>(i)</enum><text>within a school zone; or</text></clause> <clause id="H0BD9BB276C364C4787C27B0838DC579E"><enum>(ii)</enum><text>on, or within 1,000 feet of, a premises on which a school-sponsored activity is taking place; or</text></clause></subparagraph> 
<subparagraph id="HAB71ABBD59B84D2EAA53B1455EF728E8"><enum>(B)</enum><text>is enrolled in an institution of higher education and is on or within 1,000 feet of a premises owned by the institution of higher education,</text></subparagraph><continuation-text continuation-text-level="paragraph">shall, in addition to the punishment otherwise provided under this section, be imprisoned for not more than 5 years, which shall run consecutively to any term of imprisonment imposed under this section.</continuation-text></paragraph> <paragraph id="H87E1B99D5B264DB29A74BEF9E132044C" indent="up1"><enum>(2)</enum><text>In this subsection:</text> 
<subparagraph id="HF5BC7DEBF0FF449B9F7D8532D7206926"><enum>(A)</enum><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></subparagraph> <subparagraph id="H9D214AB4770C436B8FE260B685BA3C28"><enum>(B)</enum><text>The term <quote>minor</quote> means a person who has not attained 16 years of age.</text></subparagraph> 
<subparagraph id="H0EED90A92C284EE6B8FA7EBBD7033CAF"><enum>(C)</enum><text>The terms <quote>school</quote> and <quote>school zone</quote> have the meanings given such terms in section 921.</text></subparagraph> <subparagraph id="HED5E4101D6444CE2966462BBA06ED03B"><enum>(D)</enum><text>The term <quote>school-sponsored activity</quote> means any activity that is produced, financed, arranged, supervised, or coordinated by a school or a State educational agency or local educational agency or is under the jurisdiction of a State educational agency or local educational agency.</text></subparagraph> 
<subparagraph id="H6010578F2073430F9991C2F57275E924"><enum>(E)</enum><text>The terms <quote>State educational agency</quote> and <quote>local educational agency</quote> have the meanings given those terms under section 8101 of the Elementary and Secondary Education Act of 1965.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="HBC77A5C3CF0A49F2AED2DD17E8F6B3CC"><enum>5.</enum><header>Increased punishment for trafficking in a school zone</header><text display-inline="no-display-inline">Section 1590 of title 18, United States Code, is amended by adding at the end the following:</text>

<subsection id="HF56F195001004F378B134F1CE68E77DF"><enum>(c)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HA69293676C12469095B8E854F102D93F"><enum>(1)</enum><text>Whoever violates subsection (a) or (b) knowing, or having reasonable cause to believe, that the violation is committed against a minor, who, at the time of the violation—</text> <subparagraph id="H415F53E7FBEF467F9215553709F7188C" indent="up1"><enum>(A)</enum><text>is enrolled in school and is—</text> 
<clause id="HD5414CB0AC844A65A8E18ADA3FEEB20B"><enum>(i)</enum><text>within a school zone; or</text></clause> <clause id="H05FED0C033BF49388BDB45EF189330F6"><enum>(ii)</enum><text>on, or within 1,000 feet of, a premises on which a school-sponsored activity is taking place; or</text></clause></subparagraph> 
<subparagraph id="HBC897C1CD2CD43A2833FEFCA397031BC" indent="up1"><enum>(B)</enum><text>is enrolled in an institution of higher education and is on or within 1,000 feet of a premises owned by the institution of higher education,</text></subparagraph><continuation-text continuation-text-level="paragraph">shall, in addition to the punishment otherwise provided under subsection (a), be imprisoned for not more than 5 years, which shall run consecutively to any term of imprisonment imposed under such subsection (a).</continuation-text></paragraph> <paragraph id="HEAFD3CE7F5744DB286F7997F1A887E68" indent="up1"><enum>(2)</enum><text>In this subsection:</text> 
<subparagraph id="H865D514A14FE45B18ADF33B45C629F30"><enum>(A)</enum><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></subparagraph> <subparagraph id="H9FF7958AD60E43DBB6214FA26BED2E02"><enum>(B)</enum><text>The term <quote>minor</quote> means a person who has not attained 18 years of age.</text></subparagraph> 
<subparagraph id="HA3BFFEDA7FBD4FC2B3892F8553528BD5"><enum>(C)</enum><text>The terms <quote>school</quote> and <quote>school zone</quote> have the meanings given those terms in section 921.</text></subparagraph> <subparagraph id="HA72A84F39CFA4664BC95B0DFBD1D2160"><enum>(D)</enum><text>The term <quote>school-sponsored activity</quote> means any activity that is produced, financed, arranged, supervised, or coordinated by a school or a State educational agency or local educational agency or is under the jurisdiction of a State educational agency or local educational agency.</text></subparagraph> 
<subparagraph id="H8AA2E0F52A384635AAF1BDC0CBEDA0B0"><enum>(E)</enum><text>The terms <quote>State educational agency</quote> and <quote>local educational agency</quote> have the meanings given those terms under section 8101 of the Elementary and Secondary Education Act of 1965.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HB792A50E48044DCAA052B973E432BC8E"><enum>6.</enum><header>Increased punishment for aggravated sexual abuse in a school zone</header><text display-inline="no-display-inline">Section 2241 of title 18, United States Code, is amended by adding at the end the following:</text>

<subsection id="H9BF850666E2F4CAAB5AD888A9BEE65A2"><enum>(e)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HC86A82F3284B491BBD086513A6E0848A"><enum>(1)</enum><header>Violation in school zone or institution of higher education</header><text>Whoever violates subsection (c) knowing, or having reasonable cause to believe, that the violation is committed against a minor, who, at the time of the violation—</text> <subparagraph id="H56364545CC9A413590D3D2A0D17E438C" indent="up1"><enum>(A)</enum><text>is enrolled in school and is—</text> 
<clause id="H161959ECAC9F430D8D8A924D4593DB65"><enum>(i)</enum><text>within a school zone; or</text></clause> <clause id="H90754479EFF3451DA2D5BB6416037196"><enum>(ii)</enum><text>on, or within 1,000 feet of, a premises on which a school-sponsored activity is taking place; or</text></clause></subparagraph> 
<subparagraph id="H87972DE89AFE449BA49B6B4CC7709137" indent="up1"><enum>(B)</enum><text>is enrolled in an institution of higher education and is on or within 1,000 feet of a premises owned by the institution of higher education,</text></subparagraph><continuation-text continuation-text-level="paragraph">shall, in addition to the punishment otherwise provided under such subsection (c), be imprisoned for not more than 5 years, which shall run consecutively to any term of imprisonment imposed under such subsection (c).</continuation-text></paragraph> <paragraph id="H57223CA26B4E4249A897E5B2CC64ADFC" indent="up1"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="H7AE85C683BF64FD7A200AA4A5CD6B8F0"><enum>(A)</enum><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></subparagraph> <subparagraph id="H824B1246DBAE4100B532DB600ECA0C18"><enum>(B)</enum><text>The term <quote>minor</quote> means a person who has not attained 16 years of age.</text></subparagraph> 
<subparagraph id="HF2DA871B350B4FFDA017B7E74D895EBC"><enum>(C)</enum><text>The terms <quote>school</quote> and <quote>school zone</quote> have the meanings given those terms in section 921.</text></subparagraph> <subparagraph id="HF2B3746C056E4EEB9C3059B03FD36CA0"><enum>(D)</enum><text>The term <quote>school-sponsored activity</quote> means any activity that is produced, financed, arranged, supervised, or coordinated by a school or a State educational agency or local educational agency or is under the jurisdiction of a State educational agency or local educational agency.</text></subparagraph> 
<subparagraph id="H6B59737FBC91421EB97DA7A9F3B65952"><enum>(E)</enum><text>The terms <quote>State educational agency</quote> and <quote>local educational agency</quote> have the meanings given those terms under section 8101 of the Elementary and Secondary Education Act of 1965.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H1BB882B43881499E8BD2590AD3847C02"><enum>7.</enum><header>Increased punishment for sexual exploitation of children in a school zone</header><text display-inline="no-display-inline">Section 2251 of title 18, United States Code is amended by adding at the end the following:</text>

<subsection id="HEC05F8E479604402B0C4B72C4FD7B085"><enum>(f)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H91A7D07BA2CF41DC94DB21687B0EA982"><enum>(1)</enum><text>Whoever violates subsection (a) knowing, or having reasonable cause to believe, that the violation is committed against a minor, who, at the time of the violation—</text> <subparagraph id="H20D2A7A72A0E468ABC00BCCB0486498D" indent="up1"><enum>(A)</enum><text>is enrolled in school and is—</text> 
<clause id="H3C18411D3CDB4D44BB590A6023637EAC"><enum>(i)</enum><text>within a school zone; or</text></clause> <clause id="H8AAFF9B3984F46B9B1875C6477F50120"><enum>(ii)</enum><text>on, or within 1,000 feet of, a premises on which a school-sponsored activity is taking place; or</text></clause></subparagraph> 
<subparagraph id="H8B6226A2A8F44055B10EC4177F202D97" indent="up1"><enum>(B)</enum><text>is enrolled in an institution of higher education and is on or within 1,000 feet of a premises owned by the institution of higher education,</text></subparagraph><continuation-text continuation-text-level="paragraph">shall, in addition to the punishment otherwise provided under subsection (e), be imprisoned for not more than 5 years, which shall run consecutively to any term of imprisonment imposed under such subsection (e).</continuation-text></paragraph> <paragraph id="H831F667F5FE9438AB2E3D220974F9285" indent="up1"><enum>(2)</enum><text>In this subsection:</text> 
<subparagraph id="H8E884282A53D495BBBD41E696AEC9BAB"><enum>(A)</enum><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></subparagraph> <subparagraph id="H1B81B5056AFC48CB816624CA87A1B248"><enum>(B)</enum><text>The term <quote>minor</quote> means a person who has not attained 18 years of age.</text></subparagraph> 
<subparagraph id="HD7CFD79D3CB944C4AFD7322B6A62313B"><enum>(C)</enum><text>The terms <quote>school</quote> and <quote>school zone</quote> have the meanings given those term in section 921.</text></subparagraph> <subparagraph id="H1E1AD1CB9608449DB8E087CB5ABA841D"><enum>(D)</enum><text>The term <quote>school-sponsored activity</quote> means any activity that is produced, financed, arranged, supervised, or coordinated by a school or a State educational agency or local educational agency or is under the jurisdiction of a State educational agency or local educational agency.</text></subparagraph> 
<subparagraph id="H714CB3F4EE52413EB1F1B864A3242D3F"><enum>(E)</enum><text>The terms <quote>State educational agency</quote> and <quote>local educational agency</quote> have the meanings given those terms under section 8101 of the Elementary and Secondary Education Act of 1965.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H6D79993F98FC491899DD5FEC94A9A560"><enum>8.</enum><header>Increased punishment for transportation of minors to and from a school zone to engage in criminal sexual activity</header><text display-inline="no-display-inline">Section 2423 of title 18, United States Code, is amended by adding at the end the following:</text>

<subsection id="HDDD73E3EC7D44A839B8000AB48C9351E"><enum>(j)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H7F12280F425642C5A47B739204AF4FF9"><enum>(1)</enum><header>Violation in school zone or institution of higher education</header><text>Whoever violates subsection (a) by transporting a minor—</text> <subparagraph id="H21DBE0B777F74DC684C22F1F6AA04D15" indent="up1"><enum>(A)</enum><text>who is enrolled in school—</text> 
<clause id="H9D622DC3599E4E0683D8020CF24FF968"><enum>(i)</enum><text>to or from any school; or</text></clause> <clause id="H737CB88A287441F2A6E59756C6F08B65"><enum>(ii)</enum><text>to or from a premises on which a school-sponsored activity is taking place; or</text></clause></subparagraph> 
<subparagraph id="H6FE24E6587814F44A175CA65AFB53439" indent="up1"><enum>(B)</enum><text>who is enrolled in an institution of higher education, to or from a premises owned by the institution of higher education,</text></subparagraph><continuation-text continuation-text-level="paragraph">shall, in addition to the punishment otherwise provided under such subsection (a), be imprisoned for not more than 5 years, which shall run consecutively to any term of imprisonment imposed under such subsection (a).</continuation-text></paragraph> <paragraph id="H2DA2F92C010F4D98AFEEA793EA042F38" indent="up1"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="HF2183EAC3A71402E97C543823F032527"><enum>(A)</enum><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></subparagraph> <subparagraph id="H0DC93CC91DBD41BD9E2443EB8EA73696"><enum>(B)</enum><text>The term <quote>minor</quote> means a person who has not attained 18 years of age.</text></subparagraph> 
<subparagraph id="HBE8BEAD8082E4A96AC9337E9B6B45715"><enum>(C)</enum><text>The terms <quote>school</quote> and <quote>school zone</quote> have the meanings given those terms in section 921.</text></subparagraph> <subparagraph id="H1324BD84FA874D418F594E9A0CBC4C18"><enum>(D)</enum><text>The term <quote>school-sponsored activity</quote> means any activity that is produced, financed, arranged, supervised, or coordinated by a school or a State educational agency or local educational agency or is under the jurisdiction of a State educational agency or local educational agency.</text></subparagraph> 
<subparagraph id="H7E1CF7B9DAEE4D20A32A8B06E9B9565E"><enum>(E)</enum><text>The terms <quote>State educational agency</quote> and <quote>local educational agency</quote> have the meanings given those terms under section 8101 of the Elementary and Secondary Education Act of 1965.</text></subparagraph></paragraph></subsection><after-quoted-block/></quoted-block></section> </legis-body> </bill>
