which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Energy to establish a program for the interim storage of high-level radioactive waste and spent nuclear fuel, and for other purposes.</official-title></form><legis-body id="H3A9129F95A914D4095B54E7087C0B039" style="OLC"><section id="H3E35F9D8A10A444EBAB8AE8802360737" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Storage and Transportation Of Residual and Excess Nuclear Fuel Act of 2024</short-title></quote>, or the <quote><short-title>STORE Nuclear Fuel Act of 2024</short-title></quote>.</text></section><section id="HE2EDA65948974660860C24CD7235AC4B"><enum>2.</enum><header>Interim storage</header><subsection id="H1770B031F6AD40B79ED8135B8B898BF4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title I of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10121">42 U.S.C. 10121 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF2CD3B4E6E194262A0EDD468FF628651" style="OLC"><subtitle id="H6C697041958C43D48AB3BF9F89C10985"><enum>I</enum><header>Interim Storage</header><section id="HAA72ACE946964926A17570E8219936E6"><enum>190.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="HB2060E8656DE466088FA545885D663F5"><enum>(1)</enum><header>Contract holder</header><text display-inline="yes-display-inline">The term <term>contract holder</term> means any person who—</text><subparagraph id="H25CC559CD74045CAB798B6ABC2D16D8B"><enum>(A)</enum><text display-inline="yes-display-inline">generates or holds title to spent nuclear fuel and high-level radioactive waste generated at a civilian nuclear power reactor; and</text></subparagraph><subparagraph id="H1D24A7015A5849A48D33825D60F23DD8"><enum>(B)</enum><text display-inline="yes-display-inline">has entered into a contract for the disposal of spent nuclear fuel and high-level radioactive waste under section 302(a).</text></subparagraph></paragraph><paragraph commented="no" id="H97D71ABA5C1E4E4BA78C25C1EBD8A1DD"><enum>(2)</enum><header>Emergency delivery</header><subparagraph commented="no" id="H12EA25887EC54AB49BE890BC0D38159E"><enum>(A)</enum><header>In general</header><text>The term <term>emergency delivery</term> means spent nuclear fuel and high-level radioactive waste accepted by the Secretary for storage prior to the date provided in the contractual delivery commitment schedule of the standard contract for disposal of spent nuclear fuel and radioactive waste pursuant to section 302(a).</text></subparagraph><subparagraph commented="no" id="HB4F5E898EB8844D0B82CE4828A078BD7"><enum>(B)</enum><header>Inclusion</header><text display-inline="yes-display-inline">The term <term>emergency delivery</term> may include, at the discretion of the Secretary, spent nuclear fuel and high-level radioactive waste generated by an atomic energy defense activity that is required to be removed from a Department of Energy facility—</text><clause id="H8CEF435B8E234784B3AEF3E52124EC77"><enum>(i)</enum><text>pursuant to a compliance agreement; or</text></clause><clause id="H9EE49543885343E88100CB7CB8F72431"><enum>(ii)</enum><text>to eliminate an imminent and serious threat to the health and safety of the public or the common defense and security.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC0E0283326904CEB81726DFCA63758EF"><enum>(3)</enum><header>Priority waste</header><text display-inline="yes-display-inline">The term <term>priority waste</term> means—</text><subparagraph commented="no" id="H2A2FC31335ED41038027B0AD74DE0D10"><enum>(A)</enum><text>any emergency delivery; and</text></subparagraph><subparagraph commented="no" id="H7C45CF4BC3EF40169CF0492B89813B17"><enum>(B)</enum><text>spent nuclear fuel or high-level radioactive waste from a civilian nuclear power reactor that has been permanently shut down.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA7C38567ADD44A12973A4FA4C089E07C"><enum>(4)</enum><header>Storage facility</header><text display-inline="yes-display-inline">The term <term>storage facility</term> means a facility for the consolidated storage of spent nuclear fuel and high-level radioactive waste from multiple contract holders or the Secretary pending the disposal of the spent nuclear fuel and high-level radioactive waste in a repository.</text></paragraph></section><section id="HA8520DFE433B414C8F2BC2276BF6D877"><enum>191.</enum><header>Program for storage facilities</header><subsection id="H51B13A9260814920A331719E93CCBE0E"><enum>(a)</enum><header>Establishment of program</header><text display-inline="yes-display-inline">The Secretary shall establish a program under which the Secretary may—</text><paragraph id="HC6910F1BD1914683999D71348B0CDA73"><enum>(1)</enum><text display-inline="yes-display-inline">site, construct, and operate one or more storage facilities licensed by the Commission under the Atomic Energy Act of 1954; and</text></paragraph><paragraph id="H0910683F23844DEDA632B32E80DE51F6"><enum>(2)</enum><text display-inline="yes-display-inline">store, pursuant to a storage contract, high-level radioactive waste or spent nuclear fuel at a storage facility for which a non-Federal entity holds a license issued by the Commission under such Act.</text></paragraph></subsection><subsection id="HE358A469F0784B6198639B96BE80FFE5"><enum>(b)</enum><header>Interim storage agreements authorized</header><paragraph id="H6874BEF7B5B1490C91B813A6B825775E"><enum>(1)</enum><header>In general</header><text>The Secretary may enter into an agreement with any contract holder for acceptance of title pursuant to section 302(a), subsequent transportation, and interim storage of high-level radioactive waste or spent nuclear fuel (including to expedite such acceptance of title, transportation, and storage of such waste or spent fuel from facilities that have ceased commercial operation) at a storage facility under this section.</text></paragraph><paragraph id="HF8E93F4C82424E29B4BABFE6D894386C" commented="no"><enum>(2)</enum><header>Priority waste</header><text>In entering into agreements under paragraph (1), the Secretary shall prioritize acceptance of priority waste.</text></paragraph></subsection><subsection id="HA23593AE583E4604ACD6E725EF08F12E"><enum>(c)</enum><header>Request for proposals</header><paragraph id="H34CF19FD60EF450F81D7F221ADD2C593"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this subtitle, the Secretary shall issue a request for proposals for storage authorized under subsection (a).</text></paragraph><paragraph id="HF8F1414D2C5243FBBC0342955F8D826E"><enum>(2)</enum><header>Guidelines</header><subparagraph id="H45C9F271BBC84545BD9016DCE81E2E3F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The request for proposals under paragraph (1) shall include general guidelines for storage facilities consistent with each requirement of section 112(a) that the Secretary determines to be applicable to storage under this section.</text></subparagraph><subparagraph id="H50843953175647EAA01B0B291C145EA6"><enum>(B)</enum><header>Revisions</header><text display-inline="yes-display-inline">The Secretary may revise the general guidelines as necessary, consistent with this section.</text></subparagraph></paragraph></subsection><subsection id="H50BD67F94B4642EA83C3D383091A39E0"><enum>(d)</enum><header>Review of proposals</header><text>The Secretary shall review each proposal submitted pursuant to subsection (c) to evaluate—</text><paragraph id="HA916F88BD9064B00A9D1D2A444D0A88B"><enum>(1)</enum><text>the extent to which the applicable States, affected units of local government, and affected Indian tribes support the proposal;</text></paragraph><paragraph id="HCDA0AA8C1A1044459E6A629403A1AC44"><enum>(2)</enum><text>the likelihood that the proposed site for the storage facility is suitable for site evaluation under the guidelines included under subsection (c)(2);</text></paragraph><paragraph id="HCD12D3E75D764AA490F0C8D08FA1CD7B"><enum>(3)</enum><text>a reasonable comparative evaluation of the proposed site and other proposed sites;</text></paragraph><paragraph id="H958F63E4D3994CCE95233AD8C26B039E"><enum>(4)</enum><text display-inline="yes-display-inline">the extent to which spent nuclear fuel and high-level radioactive waste are, or are planned to be, stored or disposed of within the State;</text></paragraph><paragraph id="HB11C1D2866294F338139871C168AEC97"><enum>(5)</enum><text display-inline="yes-display-inline">the extent to which the proposal would—</text><subparagraph id="HE7AA3DF833BB4339B7EA5BFB8EA8728A"><enum>(A)</enum><text>enhance the reliability and flexibility of the system for the disposal of spent nuclear fuel and high-level radioactive waste, including co-location with a proposed repository; and</text></subparagraph><subparagraph id="HB9D1700ED18540D591B788E65C137906"><enum>(B)</enum><text>minimize the effects on the public of transportation and handling of spent nuclear fuel and high-level radioactive waste;</text></subparagraph></paragraph><paragraph id="H2F61CDAACF824888ADD90EF75C2C7CFE"><enum>(6)</enum><text>potential conflicts with—</text><subparagraph id="H38ED5949923F469B91A23BAEEE7D3B57"><enum>(A)</enum><text>any compliance agreement requiring removal of spent nuclear fuel and high-level radioactive waste from a site; or</text></subparagraph><subparagraph id="H098D30514DC94DBD9B50123ABE72B8C9"><enum>(B)</enum><text display-inline="yes-display-inline">a statutory prohibition on the storage or disposal of spent nuclear fuel and high-level radioactive waste at a site; and</text></subparagraph></paragraph><paragraph id="HB433796837D94882A364B88E107D20F0"><enum>(7)</enum><text>any other criteria, including criteria relating to technical or safety specifications, that the Secretary determines to be appropriate.</text></paragraph></subsection><subsection id="HBAE6965530304EB6A47917383B875D18"><enum>(e)</enum><header>Site selection</header><paragraph id="H3F89079477874A3F94C5539DCFC9BB19"><enum>(1)</enum><header>Determination of suitability</header><text>After conducting a review under subsection (d) and any additional site investigation that the Secretary determines to be appropriate, the Secretary shall determine whether a site is suitable for site evaluation under the guidelines included under subsection (c)(2).</text></paragraph><paragraph id="HDAA51868B22B414280E5802511B8AF09"><enum>(2)</enum><header>Selection of site for evaluation</header><text>From the sites determined to be suitable for site evaluation under paragraph (1), the Secretary shall select at least 1 site for site evaluation, giving priority to sites that have been proposed to be co-located with a repository, after—</text><subparagraph id="HE2A4207AEB624664AC02A83D5F6C1D5A"><enum>(A)</enum><text>holding a public hearing in the vicinity of each site; and</text></subparagraph><subparagraph id="H35376D2A281E4A2399E0C1C2450463E7"><enum>(B)</enum><text>notifying Congress.</text></subparagraph></paragraph><paragraph id="HAE80EDC59AF74F76B3BF6C129E117AE6"><enum>(3)</enum><header>Cooperative agreement</header><text>On selection of a site for evaluation under paragraph (2), the Secretary may enter into a cooperative agreement with the State, affected units of local government, and affected Indian tribes, as applicable, that includes—</text><subparagraph id="H213B6A94674C4281A2D7A2C28CA10279"><enum>(A)</enum><text>terms of financial and technical assistance to enable each applicable unit of government to monitor, review, evaluate, comment on, obtain information on, make recommendations on, and mitigate any effects from, site evaluation activities; and</text></subparagraph><subparagraph id="H134B0C1E94AC403C9F98187045E24FAE"><enum>(B)</enum><text>any other term that the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H8264B773027844AAADA7CDEFA2371E82"><enum>(4)</enum><header>Consent-based approval</header><subparagraph id="H0F14F0A12A924638B5AD22CB4FF7C0A2"><enum>(A)</enum><header>In general</header><text>If the Secretary determines, based on site evaluation under this subsection, that a site is suitable for developing a storage facility, the Secretary may select the site for developing such a facility if the Secretary enters into a consent agreement with—</text><clause id="H70E96C09EA3F429F99AE96A83E46CC21"><enum>(i)</enum><text>the State in which the site is proposed to be located;</text></clause><clause id="HC816513112894509B6BDE8B2F8035C8C"><enum>(ii)</enum><text>each affected unit of local government; and</text></clause><clause id="HFDFEF0A6582948BA9DBEEC4D3D433590"><enum>(iii)</enum><text>any affected Indian tribe.</text></clause></subparagraph><subparagraph id="HC8D7953FB99144D796F1A6C3607D8890"><enum>(B)</enum><header>Binding effect</header><text>A consent agreement entered into under subparagraph (A)—</text><clause id="H90F01171E3214D55AA12BE8EFEC1B2D3"><enum>(i)</enum><text>shall be binding on the parties; and</text></clause><clause id="HC804CFECD93B41F98AB0C15AE4749EC8"><enum>(ii)</enum><text>shall not be amended or revoked except by mutual agreement of the parties.</text></clause></subparagraph></paragraph></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF3393B9CE1F143C090FDBB1C51721F67"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">The table of contents for the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref> note) is amended by adding after the item relating to section 180 the following:</text><quoted-block display-inline="no-display-inline" id="H1153DE78B8B9477895E6344666152E67" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="subtitle">SUBTITLE I—INTERIM STORAGE</toc-entry><toc-entry level="section">Sec. 190. Definitions.</toc-entry><toc-entry level="section">Sec. 191. Program for storage facilities.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HDD5BC91A94A9413282DBCE129349DB1B"><enum>3.</enum><header>Limitation on collection of fees</header><text display-inline="no-display-inline">Section 302(a)(4) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(a)(4)</external-xref>) is amended—</text><paragraph id="H2562D7EA82CA474EAC58B53880E8F381"><enum>(1)</enum><text>in the first sentence, by striking <quote>(4) Not later than</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="HB08B4F35EE8646DE8114F1A2C4A6ABED" style="OLC"><paragraph id="H13280825FBB24DEFB753D8E72E8A9FAF"><enum>(4)</enum><header>Collection and payment of fees</header><subparagraph id="H247968B071B045889A1FC1A0F5B78BA9"><enum>(A)</enum><header>In general</header><text>Not later than</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HA991C652AC8046C39BB2C30ED62B8320"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H6BEBF03C27A645EB99300BF745A7F7F6" style="OLC"><subparagraph id="HD4528B7F763A495CBFD972D444E8AFA4"><enum>(B)</enum><header>Limitation on collection</header><text display-inline="yes-display-inline">The Secretary may not collect a fee established under paragraph (2), including a fee established under paragraph (2) and adjusted pursuant to subparagraph (A), until the date on which the Commission issues a final decision approving or disapproving the issuance of a construction authorization for a repository under section 114(d).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H3972F6D0336343EB8F8105808D39BC42"><enum>4.</enum><header>Funding</header><text display-inline="no-display-inline">Section 302(d) of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10222">42 U.S.C. 10222(d)</external-xref>) is amended—</text><paragraph id="H21A7871EAA634DC594A199A08E974371"><enum>(1)</enum><text>in paragraph (5), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="H03068110C1244425AE198E323A66C508"><enum>(2)</enum><text>in paragraph (6), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="HC2C73C52357348F3837D1EE4A7535385"><enum>(3)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block display-inline="no-display-inline" id="HB382F3BED5604E1D80E1143EF87EF392" style="OLC"><paragraph id="H16D16B60CA614B11BFB0A61C4121FD61"><enum>(7)</enum><text display-inline="yes-display-inline">carrying out subtitle I of title I, other than consent agreements under section 191(e)(4), except that the Secretary may not expend for such purpose in a fiscal year amounts totaling more than 25 percent of the interest generated by the Fund in such fiscal year; and</text></paragraph><paragraph id="H3ADE6A0ECB204DCFAB0E94AD5095F920"><enum>(8)</enum><text display-inline="yes-display-inline">consent agreements under section 191(e)(4).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
