which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Housing and Urban Development to award grants to States to develop and expand the industrialized construction of innovative residential dwelling units, and for other purposes.</official-title></form><legis-body id="H5D863489D6154C27BF9C2345B65DDF0E" style="OLC"><section id="H5ACD2E93FE704AC596D9DA767BD16827" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Innovative Housing Solutions and Affordability Act</short-title></quote>.</text></section><section id="HEBB85DBE546241CD91F12FB42224257C"><enum>2.</enum><header>Grants to develop and expand the industrialized construction of innovative residential dwelling units</header><subsection id="HBEE24F65759E47B9BA0F87A2F6884B9E"><enum>(a)</enum><header>Grants from the Secretary</header><paragraph id="HF5E98DF633264AB2878EB163766F89A7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development (referred to in this section as the <quote>Secretary</quote>) shall, not later than 1 year after the date of the enactment of this section, establish a program to award grants on a competitive basis to States to develop and expand the industrialized construction of innovative residential dwelling units.</text></paragraph><paragraph id="HCC2D9B26BB2D45B2811AA8988771AE5B"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">A State that seeks a grant under this subsection shall submit to the Secretary an application at such time and in such manner that the Secretary may require, and the application shall contain the following information:</text><subparagraph id="H216F85DC53C74A079B42CC014257FBFB"><enum>(A)</enum><text>A plan for the State to provide subgrants under subsection (b).</text></subparagraph><subparagraph id="HE787668E91D64A0BB733625777B6DA90"><enum>(B)</enum><text>If the State intends to coordinate the provision of subgrants under subsection (b) with a Federal, State, or local program that is not established under this section, a plan for the State to coordinate the provision of the subgrants with the Federal, State, or local program.</text></subparagraph><subparagraph id="HB39AF6FA29644A1CA612CD1565361F8D"><enum>(C)</enum><text display-inline="yes-display-inline">The ability of the State to match the grant by making available non-Federal funds to provide subgrants under subsection (b).</text></subparagraph><subparagraph id="HA7E68AEC52AE41C0928EB66E0611B7B4"><enum>(D)</enum><text>Any other information that the Secretary may require.</text></subparagraph></paragraph></subsection><subsection id="H33917B776B17462BAAE8501B8F4D220C"><enum>(b)</enum><header>Subgrants</header><paragraph id="HDF590AAD6DE8496089BEE34CED2A8283"><enum>(1)</enum><header>In general</header><text>A State that has received a grant under subsection (a) shall provide subgrants on a competitive basis to eligible entities for any of the following purposes:</text><subparagraph id="H75D9FFCF0E3846FDA934201F0B3F3C4E"><enum>(A)</enum><text>To reimburse not more than $350,000 of the operating expenses of an eligible entity.</text></subparagraph><subparagraph id="H73F372501F174C908A228E7573F84B1E"><enum>(B)</enum><text display-inline="yes-display-inline">To provide, for each innovative residential dwelling unit that is constructed by an eligible entity, an incentive in an amount determined by the State—</text><clause id="HE6C23494301B4DC68D060196A9DC55BC"><enum>(i)</enum><text>that is not greater than $6,000 for each such unit that is not a unit of affordable housing and an energy-efficient unit; and</text></clause><clause id="HFF5E5CA5A4A24C9C9A7A2075B260FD34"><enum>(ii)</enum><text>that is greater than the incentive described in clause (i) for each such unit that is a unit of affordable housing and an energy-efficient unit.</text></clause></subparagraph><subparagraph id="H3DECA6271E864E268488202B7401E2D9"><enum>(C)</enum><text>To provide a fixed incentive of $50,000 if an eligible entity agrees to construct not less than 10 percent of the innovative residential dwelling units under a subgrant of the State as affordable housing.</text></subparagraph><subparagraph id="HDC3E0C1568DC4D2683FD6A4B2177FB4D"><enum>(D)</enum><text display-inline="yes-display-inline">Any other purpose that, as determined by the Secretary, would develop or expand the industrialized construction of innovative residential dwelling units.</text></subparagraph></paragraph><paragraph id="HB47E928496C34463B6EEC8DDDA67744D"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity that seeks a subgrant from a State under this subsection shall submit to the State an application at such time and in such manner as the State may require, and the application shall contain any information that the State may require.</text></paragraph><paragraph id="H15C111674887490588FF74C8203ACB07"><enum>(3)</enum><header>Limitation on subgrant recipients</header><subparagraph id="H4C99E26B8D3049E7AEACAB72282D593C"><enum>(A)</enum><header>Deadline</header><text>Not later than 2 years after the date on which an eligible entity receives a subgrant under this subsection, the eligible entity shall complete each activity for which the eligible entity received the subgrant.</text></subparagraph><subparagraph id="H71633730B56A47719870A72F0434EBB4"><enum>(B)</enum><header>Postponement</header><text>The Secretary may, on a case-by-case basis, postpone the deadline for an eligible entity to complete an activity under subparagraph (A).</text></subparagraph><subparagraph id="HE76072A721A647EB855CD45614985400"><enum>(C)</enum><header>Sanctions</header><text>If the Secretary determines, after reasonable notice and opportunity for a hearing, that an eligible entity has failed to complete an activity under subparagraph (A) by the deadline under subparagraph (A) or subparagraph (B) (whichever is applicable), the Secretary may—</text><clause id="H4B44161131664D67B346A138E2B9B18B"><enum>(i)</enum><text>impose a civil monetary penalty on the entity;</text></clause><clause id="H7E0EFC0B514C46F7852CADCF6D24778A"><enum>(ii)</enum><text>prohibit the entity from receiving another subgrant under this subsection for a period of time determined by the Secretary; or</text></clause><clause id="H050B6CB075BE457DAF55AA4EF6E76EF8"><enum>(iii)</enum><text>take a combination of the actions described in clauses (i) and (ii).</text></clause></subparagraph><subparagraph id="HF4A86F2414B5413196AAFBD16860ECA2"><enum>(D)</enum><header>Considerations</header><text>In determining the extent of any penalty or prohibition to be imposed under subparagraph (C), the Secretary shall consider the severity of the eligible entity’s violation under this paragraph.</text></subparagraph></paragraph></subsection><subsection id="H0C9C00B149724ED89851DFBC9FB41CA7"><enum>(c)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which a State first provides a subgrant under subsection (b), the State shall submit to the Secretary a report that includes the following information with respect to the subgrants:</text><paragraph id="HC9A19DDAB882431D8AA3F54249EEE94B"><enum>(1)</enum><text>The number of applications that the State has received for a subgrant.</text></paragraph><paragraph id="H59D588CE731A4F48B0F308FC437EB30B"><enum>(2)</enum><text>The average cost to construct an innovative residential dwelling unit under a subgrant of the State.</text></paragraph><paragraph id="HB75FDDD24D7841BFB1337828AD3FFAF7"><enum>(3)</enum><text>The average cost to purchase such a unit.</text></paragraph><paragraph id="H98F1C381A0514B478B5EA6C3B1196AF9"><enum>(4)</enum><text>The number of such units.</text></paragraph><paragraph id="H12469D4C85234ADC9D68CB53DF376EEA"><enum>(5)</enum><text>The number of such units that are affordable housing.</text></paragraph><paragraph id="H30A1FC41F9F248DEAEB3B7C44E6E245E"><enum>(6)</enum><text display-inline="yes-display-inline">Any other information that the Secretary may require.</text></paragraph></subsection><subsection id="HB92ED1DCEA0D49F8A91E02D9A5FABA89"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary $75,000,000 for fiscal years 2025 through 2029 to carry out this section.</text></subsection><subsection id="HCD73542C841B41089FEC434F0D4690B3"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H51BE1E4FB5E24AA19AFB41BBB22BE7A5"><enum>(1)</enum><header>Affordable housing</header><text display-inline="yes-display-inline">The term <term>affordable housing</term> means housing that is 1 or more of the following:</text><subparagraph id="H286CD66120D14287A42AFD63309E3B00"><enum>(A)</enum><text>Compliant with the conditions set forth in section 215 of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12745">42 U.S.C. 12745</external-xref>).</text></subparagraph><subparagraph id="H25AD08DF88E04220A809A391A6C9C4CE"><enum>(B)</enum><text display-inline="yes-display-inline">Eligible for financing under subparagraph (A) or (B) of section 10(j)(2) of the Federal Home Loan Bank Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1430">12 U.S.C. 1430(j)(2)</external-xref>).</text></subparagraph></paragraph><paragraph id="H436A6201C09D41A4B36747C6D687EA90"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an entity that—</text><subparagraph id="H8EA7F6C1DE5A47CB9FDEAA165EFEFE27"><enum>(A)</enum><text>employs fewer than 500 individuals; and</text></subparagraph><subparagraph id="H069919B898E74F5E8B382FF082456FBE"><enum>(B)</enum><text>carries out—</text><clause id="HB1ACAF7A73E64586AA8DF17E8DD3AF94"><enum>(i)</enum><text>industrialized construction of innovative residential dwelling units;</text></clause><clause id="H74A87DA4E9284D27AD80000B1BB308AE"><enum>(ii)</enum><text>an innovative technology or process that significantly reduces the on-site time and labor necessary to construct residential dwelling units, as determined by the Secretary; or</text></clause><clause id="H4390E642008E42F9AD1DB4B1AE6FCA6D"><enum>(iii)</enum><text>a combination of the activities described in clauses (i) and (ii).</text></clause></subparagraph></paragraph><paragraph id="HBDEA73E63EC2431ABA8AD17798505A39"><enum>(3)</enum><header>Energy-efficient unit</header><text display-inline="yes-display-inline">The term <term>energy-efficient unit</term> means a residential dwelling unit for which the annual household site energy consumption is designed to be less than the average annual household site energy consumption for the corresponding type of residential dwelling unit in the census region where the residential dwelling unit is located, as measured by the most recent Residential Energy Consumption Survey of the Energy Information Administration.</text></paragraph><paragraph id="H6E4B9B714BF14D0E9BCB8B8F3DBB4EF1"><enum>(4)</enum><header>Innovative residential dwelling unit</header><text>The term <term>innovative residential dwelling unit</term> means a residential dwelling unit that—</text><subparagraph id="HA333102D9D3449B8A0B8D3956C0C99FF"><enum>(A)</enum><text>is modular, panelized, constructed with 3–D printing technology, or constructed under a process approved by a State; and</text></subparagraph><subparagraph id="HF7B8F723D0C449229E281E871AED8380"><enum>(B)</enum><text>is compliant with each building code that applies to the site on which the residential dwelling unit is to be located.</text></subparagraph></paragraph><paragraph id="HF06795ABBDE640CAAF7C1619D61AB01F"><enum>(5)</enum><header>Modular</header><text>The term <term>modular</term> means, with respect to a residential dwelling unit, being composed of not less than 2 modules built in a factory, transported to the site of the residential dwelling unit, and attached to the foundation of the residential dwelling unit.</text></paragraph><paragraph id="H3696769A9C664D589C357D8248185680"><enum>(6)</enum><header>Panelized</header><text>The term <term>panelized</term> means, with respect to a residential dwelling unit, being composed of panels built in a factory, transported to the site of the residential dwelling unit, and attached to the foundation of the residential dwelling unit.</text></paragraph><paragraph id="H53727BD252E14CBFB3D0C6B2FDC37BC7"><enum>(7)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State, each federally recognized Indian Tribe, the District of Columbia, and each territory or possession of the United States.</text></paragraph></subsection></section></legis-body></bill>
