BILL</legis-type><official-title display="yes">To prohibit the award of Federal grants to applicants submitting duplicative or fraudulent applications, to require the Director of Office of Management and Budget to establish a tracking and deconfliction system for Federal grant applications, and for other purposes.</official-title></form><legis-body id="H7DF886892D02432C87F3B449B7B6421A" style="OLC"><section id="H0B5A15808A674C3D845155ABF4F46FED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Decreasing Overlapping Grants Efficiently Act</short-title></quote> or the <quote><short-title>DOGE Act</short-title></quote>. </text></section><section id="H88005A6C75C14CD792071FA65B082A80"><enum>2.</enum><header>Prohibition on award of Federal grants to applicants submitting duplicative or fraudulent applications</header><subsection id="HBC8CEBCC9BF94A80BA5C48B07B5FFFF9"><enum>(a)</enum><header>No award on basis of duplicative application</header><paragraph id="H1DB4ABC4862343178AF9ED66540BC594"><enum>(1)</enum><header>Prohibition</header><subparagraph id="H7BCE5A91ABDD4AE8A934491B0E42EC9C"><enum>(A)</enum><header>In general</header><text>Except as provided for under subparagraph (B), the head of an executive agency may not award a grant to an applicant determined by the head of the agency or the Inspector General of the agency to have received another grant from the head of another executive agency for the same or identical purpose.</text></subparagraph><subparagraph id="H52FE9CFCA19044CC97D315A788AF2CF7"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">The prohibition under subparagraph (A) related to the award of grants for the same or identical purposes shall not apply to an applicant that is an institution of higher education. </text></subparagraph></paragraph><paragraph id="H4D38A722379E43C6BFB5432ED68333E8"><enum>(2)</enum><header>Determination</header><text>In the case that the head of an executive agency or the Inspector General of the agency determines that an applicant for a grant has submitted an application for another grant from another executive agency for the same or identical purpose, the heads of such agencies shall jointly determine which agency is the appropriate agency to award the grant, if such grant is to be awarded to such applicant. </text></paragraph></subsection><subsection id="H35ABF71CD2F24797B42624AFC6A51398"><enum>(b)</enum><header>No award on basis of fraudulent application</header><text display-inline="yes-display-inline">The head of an executive agency may not award a grant to an applicant determined by the head of the agency or the Inspector General of the agency to have submitted a fraudulent application for such grant.</text></subsection></section><section id="H66937FE35F204F98B0E17EE87FCB9B15"><enum>3.</enum><header>Tracking and deconfliction system for Federal grant applications</header><subsection id="H7777716366E74BD9B740150C932C62EF"><enum>(a)</enum><header>Establishment</header><text>Not later than 1 year after the date of the enactment of this Act, the Director of the Office of Management and Budget shall make available to the heads of executive agencies, including the Inspectors General of such agencies, an electronic system through which the head of an executive agency may determine before awarding a grant, or through which an Inspector General of an executive agency may determine in conducting an audit or investigation, whether any applicant for such grant has received, or submitted an application to the head of another executive agency for, another grant for the same or identical purpose. </text></subsection><subsection id="H18289DEDB0E649EF9DB5B4128F4E933D" display-inline="no-display-inline" commented="no"><enum>(b)</enum><header>Contents of system</header><text display-inline="yes-display-inline">The system shall contain at a minimum, the name of the awardee, the principal investigator, the award period, agency point of contact, and an abstract.</text></subsection><subsection id="HDC3927733ED64A4FBB983AF6C2E85FFA" commented="no"><enum>(c)</enum><header>Essentially equivalent work</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall establish an electronic system which contains information for all federal research awards through which the head of an executive agency may determine before awarding a grant, or through which an Inspector General of an executive agency may determine in conducting an audit or investigation, whether any applicant for such award has received, or submitted an application to the head of another executive agency for, another award for essentially equivalent work.</text></subsection></section><section id="H0F6CC8C7BFB749CCAF1C6FCAAF34CEEB"><enum>4.</enum><header>Report on feasibility of leveraging artificial intelligence to identify duplicative Federal grant applications</header><text display-inline="no-display-inline">The Director of the Office of Management and Budget, in consultation with the Secretary of Energy, the Director of the National Science Foundation, and the Director of the National Institute of Standards and Technology, shall submit to the appropriate Congressional committees a report on the feasibility of leveraging artificial intelligence to rapidly identify, with respect to an application for a grant submitted to the head of an executive agency—</text><paragraph id="HCB91CD772A6B4276ADF81C0849E2071F"><enum>(1)</enum><text>whether an applicant for such grant has received, or submitted an application to the head of another executive agency for, another grant for the same or identical purpose; and</text></paragraph><paragraph id="H3479B2642B5842F9892E2E6861D5A100"><enum>(2)</enum><text>waste, fraud, and abuse.</text></paragraph></section><section id="H9C30F048E2E14855BF3AE0B518A57E2C"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H462340B65A8F4F8AB9B4E83D6E85C29F"><enum>(1)</enum><header>Applicable time period</header><text display-inline="yes-display-inline">The term <quote>applicable time period</quote> means—</text><subparagraph id="H83D404DB6ED14DC099E73B468897BEE6"><enum>(A)</enum><text>with respect to a covered application for a grant awarded after the date on which system is established under section 2(a), during the period—</text><clause id="HD864EA3569BF470BAD9DCEA2376BA744"><enum>(i)</enum><text>beginning on the date on which such application is submitted; and</text></clause><clause id="HC4F77AA26C1F4627BBDA0261D50F40F3"><enum>(ii)</enum><text>ending on the date on which amounts under the grant are no longer being expended; and</text></clause></subparagraph><subparagraph id="HC904B2E3923B49E38B76F616C08E16AD"><enum>(B)</enum><text>with respect to a covered application for a grant awarded before the date on which the system is established under section 2(a), during the period—</text><clause id="H744E469387B74F528AF5F1BC8BB00359"><enum>(i)</enum><text>beginning on that date; and</text></clause><clause id="HBC9F6EDF680F493782B77797A988B7D1"><enum>(ii)</enum><text>ending on the date on which amounts under the grant are no longer being expended.</text></clause></subparagraph></paragraph><paragraph id="HE87CE576FA5645649F4B43AC3FECFB48"><enum>(2)</enum><header>Appropriate Congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text><subparagraph id="HD49B4A5434B940BB892F1AE1207C7058"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Oversight and Accountability and the Committee on Appropriations of the House of Representatives; and</text></subparagraph><subparagraph id="H0EB804D7D7A44B8A9AD7C55884E48BC9"><enum>(B)</enum><text>the Committee on Homeland Security and Governmental Affairs and the Committee on Appropriations of the Senate. </text></subparagraph></paragraph><paragraph id="H5B72B59CE1E04D87A352AF9C02DDBD9C"><enum>(3)</enum><header>Covered application</header><text display-inline="yes-display-inline">The term <quote>covered application</quote> means an application for a grant submitted to the head of an executive agency—</text><subparagraph id="H47C0935F817F43E4BB9256F09E688E17"><enum>(A)</enum><text>after the date on which the system is established under section 2(a); and</text></subparagraph><subparagraph id="H6FC0776123AF4C12B22BEF8F65AED923"><enum>(B)</enum><text>before that date, if amounts under the grant are still being expended on such date. </text></subparagraph></paragraph><paragraph id="H57E20118F4ED46A89971ADC1C5DDD480"><enum>(4)</enum><header>Executive agency</header><text>The term <quote>executive agency</quote> means an agency in the executive branch of the Federal Government.</text></paragraph><paragraph id="H2925A0EBC1434E4D98AC6F597E49DFAA" commented="no"><enum>(5)</enum><header>Institution of higher education</header><text>The term <quote>institution of higher education</quote> has the meaning given such term in section 102 of the Higher Education Act of 1965 (20 U.S.C.1002).</text></paragraph></section></legis-body></bill>
