which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of the Treasury to mint coins in commemoration of the semiquincentennial anniversary of the establishment of the United States.</official-title></form><legis-body id="H3C2AE28F5D354900B32D2076A76187B6" style="OLC"><section id="HB64A139977994A268FB02A5FDC564749" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Semiquincentennial Commemorative Coin Act</short-title></quote>.</text></section><section id="H25362342A6634454B7442C1DF8BAB25A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="HEA1907B088CF43F8B3B66FCCD25E7119"><enum>(1)</enum><text>July 4, 1776, was the date on which the unanimous declaration of the thirteen United States of America was passed, declaring the Nation as independent.</text></paragraph><paragraph id="HA072E3ADBBA848078C6B7EE122F39466"><enum>(2)</enum><text>July 4, 2026, will mark the 250th anniversary of us declaring our independence.</text></paragraph><paragraph id="H7B5B673BB9D148DE9BBABAA876BB37DD"><enum>(3)</enum><text>It is common practice to celebrate moments such as this in the history of our country through the minting of a commemorative coin.</text></paragraph></section><section id="HF099A5316F2843C4B588BFC9288AD7F3"><enum>3.</enum><header>Coin specifications</header><subsection id="HD57FFDCBFC85471689CC85BE90605E5A"><enum>(a)</enum><header>Denominations</header><text>The Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coins in commemoration of the semiquincentennial anniversary of the establishment of the United States:</text><paragraph id="H829E81B50C104162B37DAD294CAFA9EA"><enum>(1)</enum><header>$25.00 Gold Coins</header><text>Not more than 100,000 $25.00 coins, which shall—</text><subparagraph id="HFF3E333F855948FAAE95BB0208ABF315"><enum>(A)</enum><text>weigh 8.359 grams;</text></subparagraph><subparagraph id="H4054506D2A19435AA32A686A2CA0240D"><enum>(B)</enum><text>have a diameter of 0.850 inches; and</text></subparagraph><subparagraph id="HE510420792604479B0924A0408B91899"><enum>(C)</enum><text>contain 90 percent gold and 10 percent alloy.</text></subparagraph></paragraph><paragraph id="H537E355BBE9D42698BE4AE5C2ABE57EE"><enum>(2)</enum><header>$2.50 Silver Coins</header><text>Not more than 500,000 $2.50 coins, which shall—</text><subparagraph id="H807D74ACB6A141F581BD16C11B83A8F6"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph><subparagraph id="H4CCB04D887F34A7EB24C6664706A55EA"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph><subparagraph id="HDFDD9E5BCFE74D2D9686DB0C5D0D2F13"><enum>(C)</enum><text>contain not less than 90 percent silver.</text></subparagraph></paragraph><paragraph id="HFCF091BE6E35481DA4140DAA9CB3D4BF" commented="no"><enum>(3)</enum><header>25-cent clad coins</header><text>Not more than 750,000 quarter dollar coins, which shall—</text><subparagraph id="H66515E5C5BF443AF949271A2D4292E77" commented="no"><enum>(A)</enum><text>weigh 5.67 grams;</text></subparagraph><subparagraph id="HB404A8847EA44144B6FF998EFF30F0EC" commented="no"><enum>(B)</enum><text>have a diameter of 0.955 inches; and</text></subparagraph><subparagraph id="H5833A6F8FF194B93AFFCEB70A90B6D84" commented="no"><enum>(C)</enum><text>be minted to the specifications for quarter dollar coins, contained in section 5112(b) of title 31, United States Code.</text></subparagraph></paragraph><paragraph id="HA3870B27D96C402FB1DDA3478AE79642"><enum>(4)</enum><header>Proof silver $2.50 coins</header><text>The Secretary shall mint and issue not more than 100,000 proof silver $2.50 coins, each of which shall—</text><subparagraph id="H8AF87702193F44FFA3E3DF2B734813F6"><enum>(A)</enum><text>weigh 5 ounces;</text></subparagraph><subparagraph id="H77BDFFD868604752A5D44EABED5B4AF2"><enum>(B)</enum><text>have a diameter of 3 inches; and</text></subparagraph><subparagraph id="HB37B680360254048B3667CFE88F887EA"><enum>(C)</enum><text>contain .999 fine silver.</text></subparagraph></paragraph></subsection><subsection id="H243FCD5C083C4F27BA929AB95F1B33CF"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in section 5103 of title 31, United States Code.</text></subsection><subsection id="HF51A7D8F7034446AB04C2ACB1BFCFC2D"><enum>(c)</enum><header>Numismatic items</header><text>For purposes of sections 5134 and 5136 of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection><subsection id="HD69091E829FF4B2EB5DDF5A1AB065DC9"><enum>(d)</enum><header>Mintage limit exception</header><text display-inline="yes-display-inline">If the Secretary determines, based on independent, market based research conducted by the designated recipient organization identified in section 7(b) that the mintage levels described under this subsection are not adequate to meet public demand, the Secretary may increase the mintage levels as the Secretary determines is necessary to meet public demand.</text></subsection></section><section id="HD63C0CFCE95042CDA401D15F137BEC2D"><enum>4.</enum><header>Designs of coins</header><subsection id="HEA54344A495C4466932FD84D25EF3E47"><enum>(a)</enum><header>Design requirements</header><paragraph id="H4320DD38F87344E5AB739C95104EABCC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The designs of the coins minted under this Act shall be emblematic of the semiquincentennial anniversary of the establishment of the United States of America and celebrate 250 years of our Nation.</text></paragraph><paragraph id="H7415444133D9437AAEE18E08D5B6AF3E"><enum>(2)</enum><header>Designation and inscriptions</header><text>On each coin minted under this Act, there shall be—</text><subparagraph id="H0BDBA027C1D74125AB07A61AA9BDF131"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph><subparagraph id="H5E1C62F7F2B74C11987EC154DC266203"><enum>(B)</enum><text>an inscription of the years <quote>1776–2026</quote>; and</text></subparagraph><subparagraph id="HEBC7A3F7F50A4EAB9B37907F0844B6D9"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph></subsection><subsection id="H14019935C4CD4691B28907536A7CFDDF"><enum>(b)</enum><header>Selection</header><text display-inline="yes-display-inline">The designs for the coins minted under this Act shall be—</text><paragraph id="HF4CE955CDDB34D598C423006C2E13B9E"><enum>(1)</enum><text>selected by the Secretary, after consultation with the Semiquincentennial Commission, the America 250 Foundation, and the Commission of Fine Arts; and</text></paragraph><paragraph id="H73F4F8E291D446BD89255E0D1025A2AE"><enum>(2)</enum><text>reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section><section id="H1FBA3A81596049FB8C64737CDA335139"><enum>5.</enum><header>Issuance of coins</header><subsection id="H0AA6C0ED09F740D2B60BE6A22EDC3926"><enum>(a)</enum><header>Quality of coins</header><text>Coins minted under this Act shall be issued in uncirculated and proof qualities.</text></subsection><subsection id="H3B3BC7209AED49A39A852D3EBC9DD8B1" commented="no"><enum>(b)</enum><header>Mint facilities</header><text>Only 1 facility of the United States Mint may be used to strike any particular quality of the coins minted under this Act.</text></subsection><subsection id="H665289265B7B420F8A6798414042C594"><enum>(c)</enum><header>Period for issuance</header><text>The Secretary may issue coins under this Act only during the period beginning on January 1, 2026, and ending on December 31, 2026.</text></subsection></section><section id="H63621F0D999F4B46AD09485F371016BF"><enum>6.</enum><header>Sale of coins</header><subsection id="H4DCE3B4C39C946B4BFC41DFBB731A7B5"><enum>(a)</enum><header>Sale price</header><text>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text><paragraph id="HFA55F650BDF244E0B248030B1560FB7B"><enum>(1)</enum><text>the face value of the coins;</text></paragraph><paragraph id="H85A79DE43C2F49C0AED368C42D879E0F"><enum>(2)</enum><text>the surcharge provided in section 7(a) with respect to such coins; and</text></paragraph><paragraph id="HA00F7EE307324CD192315B8393539AC0"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection><subsection id="H7EDA156BB02A4D379EA4C264C04EA9D0"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection><subsection id="H11C2D756DF97485C953CE09620F2A876"><enum>(c)</enum><header>Prepaid orders</header><paragraph id="H8008AAFB82544249B42729F4BC97FC52"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph><paragraph id="H3CCF1565240045EB8AD7268840A084DF"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section><section id="H15004998D0FB4C3CABA00B74F711AAFB"><enum>7.</enum><header>Surcharges</header><subsection id="H69EA6BACEA8F4DD6B9ED1990E5517B49" commented="no"><enum>(a)</enum><header>In general</header><text>All sales of coins issued under this Act shall include a surcharge as follows:</text><paragraph id="H9A7013D44B8A40F3A6C020942084E616" commented="no"><enum>(1)</enum><text>A surcharge of $35 per coin for the gold coins.</text></paragraph><paragraph id="HA0FFE50E7CF04C71BE54C485CC146246" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">A surcharge of $10 per coin for the silver coins.</text></paragraph><paragraph id="H9EAA8180C2724B4399A2AAABFE9F5A26"><enum>(3)</enum><text>A surcharge of $5 per coin for the quarter dollar coins.</text></paragraph><paragraph id="H27158BA59945435EB0BFD98042204C13"><enum>(4)</enum><text>A surcharge of $50 per coin for the $2.50 5 ounce proof silver coins.</text></paragraph></subsection><subsection id="H78C28B08BFD54D689281547129CC2F72"><enum>(b)</enum><header>Distribution</header><text display-inline="yes-display-inline">Subject to section 5134(f) of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be paid to the America 250 Foundation to fund the restoration, rehabilitation, and interpretation of units of America’s National Park System and its related areas, as a legacy of the United States Semiquincentennial commemoration.</text></subsection><subsection id="HDF54867B7D2147B3B5EF4F7B5F3E694A"><enum>(c)</enum><header>Audits</header><text display-inline="yes-display-inline">The America 250 Foundation shall be subject to the audit requirements of section 5134(f)(2) of title 31, United States Code, with regard to the amounts received under subsection (b).</text></subsection><subsection id="HD5B7EEB680FD4086ABD72E9D4A0A08A2" commented="no"><enum>(d)</enum><header>Limitation</header><text>Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual 2 commemorative coin program issuance limitation under section 5112(m)(1) of title 31, United States Code. The Secretary of the Treasury may issue guidance to carry out this subsection.</text></subsection></section><section id="HFF0BF078A6ED445599F52764375D73C6"><enum>8.</enum><header>Financial assurances</header><text display-inline="no-display-inline">The Secretary shall take such actions as may be necessary to ensure that—</text><paragraph id="HCC5B62C802144D72BDEFDB5E9BB9C503"><enum>(1)</enum><text>minting and issuing coins under this Act will not result in any net cost to the United States Government; and</text></paragraph><paragraph id="H35F38C03CFA74BE7B566A085A3BE261A"><enum>(2)</enum><text>no funds, including applicable surcharges, shall be disbursed to any recipient designated in section 7(b) until the total cost of designing and issuing all of the coins authorized by this Act (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping) is recovered by the United States Treasury, consistent with sections 5112(m) and 5134(f) of title 31, United States Code.</text></paragraph></section></legis-body></bill>
