which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for international protection of digital freedom, and for other purposes.</official-title></form><legis-body id="H689343F13073445E9FCC352C5A521B82" style="OLC"><section id="HDCB788F9FA5940FA9E8E0E828D6EB517" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advancing Digital Freedom Act of 2024</short-title></quote>.</text></section><section id="HF58A22E49ACA4C97A34D80353640585B"><enum>2.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="H7CEE44C4A905443AA1C751E4A93F76C7"><enum>(1)</enum><text>to ensure that technology is developed, deployed, and governed in accordance with universal human rights, the rule of law, and democratic values;</text></paragraph><paragraph id="HC1B10595F54C4D41A250D925AB9366C2"><enum>(2)</enum><text>to protect and promote digital freedom as a cornerstone of United States foreign policy and prioritize digital freedom to the highest extent possible in diplomatic engagements with foreign countries;</text></paragraph><paragraph id="H3A24DF19ACD24BBBB0E3970FD45C201F"><enum>(3)</enum><text>to cooperate and engage with like-minded countries committed to developing, deploying, and using technology in a manner that respects democracy, the rule of law, and human rights; and</text></paragraph><paragraph id="H7E2196D7DD9E4CEEA911BF6E91BB8C34"><enum>(4)</enum><text>to lead global efforts to protect digital freedom, counter disinformation and misinformation, and advance democratic governance in the digital space consistent with guidelines outlined in the United States International Cyberspace and Digital Policy Strategy.</text></paragraph></section><section id="HA146BBBDF8A641649060CB35DF13871B"><enum>3.</enum><header>Coordinator for Digital Freedom defined</header><text display-inline="no-display-inline">In this Act, the term <term>Coordinator for Digital Freedom</term> means the Coordinator for Digital Freedom in the Bureau of Cyberspace and Digital Policy in the United States Department of State. </text></section><section id="HA72BA2C77771459F94E63C6DB5C9F9B8"><enum>4.</enum><header>Role of the Coordinator for Digital Freedom</header><subsection id="HE2E617CEEA2E4B62AF11A7097E5721F0"><enum>(a)</enum><header>Central objective</header><text>The central objective of the Coordinator for Digital Freedom shall be to promote efforts that—</text><paragraph id="H57EB36305D674B4A80D78B6A0A4EBD23"><enum>(1)</enum><text>improve the state of digital freedom globally;</text></paragraph><paragraph id="HE1EC0679A8434DD8A852C033ADEFFB29"><enum>(2)</enum><text>ensure digital freedom remains a foremost foreign policy priority of the United States Government; and</text></paragraph><paragraph id="H0082BA9F46514557B06286238D439331"><enum>(3)</enum><text>coordinate responses to concerning trends impacting digital freedom.</text></paragraph></subsection><subsection id="H4B25D21A234B4053AB1B7AAA58CE05BC"><enum>(b)</enum><header>Duties and responsibilities</header><text>The Coordinator shall—</text><paragraph id="H0BE290B305F94AC59C004DA8703F1E8D"><enum>(1)</enum><text>engage foreign governments, nongovernmental organizations, and other actors to coordinate efforts to defend digital freedom against digital authoritarianism and other authoritarian approaches to governance and usage of technology;</text></paragraph><paragraph id="H98F66783CF1148A4A328B9AC346AEEF4"><enum>(2)</enum><text>support multilateral efforts to protect and reinforce information integrity within the context of respect for freedom of expression;</text></paragraph><paragraph id="H266FE6B9E2E143F1862B847412C6306A"><enum>(3)</enum><text>advance the development and maintenance of technology that is designed, governed, and deployed in manners consistent with democracy, the rule of law, and human rights;</text></paragraph><paragraph id="HD3F6B4E0198248AB807431459C69D26F"><enum>(4)</enum><text>promote digital inclusion across the digital space;</text></paragraph><paragraph id="HFD20C2BAE5C64463BE158ED4EEE56BB0"><enum>(5)</enum><text>engage and advance discussions to promote the democratic governance of artificial intelligence and the implications of artificial intelligence governance on human rights and democracy;</text></paragraph><paragraph id="H9BAFE972CFCD4D5FA50CFC9F77940C19"><enum>(6)</enum><text>lead efforts within the Department of State to continue publishing guidelines for protecting digital freedom across the cyberspace, including through the Risk Management Profile for Artificial Intelligence and Human Rights, as well as the Roadmap for Building Civil Resilience to the Global Digital Information Manipulation Challenge; and</text></paragraph><paragraph id="H6C8049F24808436185FF1D7BC910D17D"><enum>(7)</enum><text>make recommendations regarding opportunities to advance digital freedom internally within the Department of State, as well as through diplomatic engagements with foreign countries.</text></paragraph></subsection><subsection id="HFDA248DDC9A143B1A4003468442C95BE"><enum>(c)</enum><header>Additional duties</header><text>In addition to the duties and responsibilities specified in subsections (a) and (b), the Coordinator may carry out other duties that the Secretary of State may assign.</text></subsection></section><section id="H46C3DD5443E7405B88D55C59057AC83E"><enum>5.</enum><header>Annual report on state of digital freedom in the world</header><subsection commented="no" display-inline="no-display-inline" id="H91D25356B79E4D38A0442EBF91ECF66E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Bureau of Cyberspace and Digital Policy shall submit to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives a report on the state of global digital freedom. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="H1698168DFF4A431AB6FBC570740F05BB"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">The report required under subsection (a) shall include—</text><paragraph id="HB5E0406AD0A845C99629618A2FA6B378"><enum>(1)</enum><text>an analysis of concerning trends impacting digital freedom globally, including—</text><subparagraph id="H8E66927701F442AF802BD5ECB6254E47"><enum>(A)</enum><text>digital authoritarianism and threats to democracy;</text></subparagraph><subparagraph id="H4A19A99B608049A9A853C768C9835C84"><enum>(B)</enum><text>censorship and propaganda;</text></subparagraph><subparagraph id="HD11EA73DEA5A46CFA020DC72173D5C66"><enum>(C)</enum><text>threats to information integrity;</text></subparagraph><subparagraph id="H3AC807B372C143E3BC82B27DC3576BD1"><enum>(D)</enum><text>threats to digital inclusion;</text></subparagraph><subparagraph id="H701E2A19693147D094090A67C10B1AAD"><enum>(E)</enum><text>threats to privacy in the digital space; and</text></subparagraph><subparagraph id="HE6A7C5A9AC42403CB009DAD81E6BB7A0"><enum>(F)</enum><text>risks to responsible management of artificial intelligence and democratic governance of artificial intelligence;</text></subparagraph></paragraph><paragraph id="HB71C8894FB58457EBA3B1105E8733656"><enum>(2)</enum><text>a discussion of particular regions or countries of concern that are experiencing the greatest threats to digital freedom; and</text></paragraph><paragraph id="H4AA97B8BAEE3487594896FE8F0427938"><enum>(3)</enum><text>recommendations for how to protect and promote digital freedom in response to these concerning trends. </text></paragraph></subsection></section></legis-body></bill>
