R. 10152</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20241118">November 18, 2024</action-date><action-desc><sponsor name-id="E000235">Mr. Ezell</sponsor> (for himself and <cosponsor name-id="K000388">Mr. Kelly of Mississippi</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HSY00">Committee on Science, Space, and Technology</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To allow the Administrator of the National Aeronautics and Space Administration to enter into agreements with private and commercial entities and State governments to provide certain supplies, support, and services.</official-title></form><legis-body id="H01C2059AB7364B92915427C498DCD1A8" style="OLC"><section id="H72960E17CA8841A6B109F0E726F1C442" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Contracts and Obligations Modernization for Efficient Terms of Service Act</short-title></quote> or the <quote><short-title>COMETS Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HD8DC48397466445A9A382B99B80F1368"><enum>2.</enum><header>National Aeronautics and Space Administration agreements with private and commercial entities and State governments to provide certain supplies, support, and services</header><text display-inline="no-display-inline">Section 20113 of title 51, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4B73D3A4FBE2477FBA7FAE7BF1440E21"><subsection id="H43C4F42CFFE94361BE53F33CEA606093"><enum>(o)</enum><header>Agreements with commercial entities and State governments</header><text>The Administration—</text><paragraph id="H63FFDAA894484D449A47751DD33156D8"><enum>(1)</enum><text>may enter into an agreement with a private or commercial entity or a State government to provide the entity or State government with supplies, support, and services related to private, commercial, or State government space activities carried on at a property owned or operated by the Administration; and</text></paragraph><paragraph id="H186FCD5D11F3498CB2660266FBB76316"><enum>(2)</enum><text>on request by such an entity or State government, may include such supplies, support, and services in the requirements of the Administration if—</text><subparagraph id="H48459453F8D746CE96EAB464FAB51751"><enum>(A)</enum><text>the Administrator determines that the inclusion of such supplies, support, or services in such requirements—</text><clause id="HD11EAC285AA543A68ACA3418E8B091DC"><enum>(i)</enum><text>is in the best interest of the Federal Government;</text></clause><clause id="H564EEAE46964414EA31C2D6D53F43362"><enum>(ii)</enum><text>does not interfere with the requirements of the Administration; and</text></clause><clause id="H8CE80E025D6D48CB9BCFEACBC6CE7A59"><enum>(iii)</enum><text>does not compete with the commercial space activities of other such entities or State governments; and</text></clause></subparagraph><subparagraph id="HC5C51FCF2C4349DB9A742191407A96ED"><enum>(B)</enum><text>the Administration has full reimbursable funding from the entity or State government that requested such supplies, support, and services before making any obligation for the delivery of the supplies, support, or services under an Administration procurement contract or any other agreement.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
