which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To limit the ability of the Secretary of Agriculture and the Secretary of the Interior to penalize an owner of livestock for grazing by such livestock on certain Federal lands on which grazing is permitted on or after the date of enactment of this Act and subsequently prohibited, and for other purposes.</official-title></form><legis-body id="H3A937E5195BF4821954A4499950B5A6D" style="OLC"><section id="HC050985F1E3446EBA3D46988B8D6A7F1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Agricultural Spaces Through Effective Ranching Strategies Act</short-title></quote> or the <quote><short-title>PASTURES Act</short-title></quote>.</text></section><section id="HB8B161E26D9E494DB56D094F56156DC2"><enum>2.</enum><header>Limitation on penalties for grazing livestock on certain covered lands</header><subsection id="HF6A8289A00E14A2CA9081856F02893AA"><enum>(a)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary concerned may not impose a penalty on an owner of livestock for grazing by such livestock on covered lands on which a fence for the prevention of such grazing does not exist.</text></subsection><subsection id="H09AC8460AC204AAA86E14287B7F3DB2C"><enum>(b)</enum><header>Fence expenses</header><text display-inline="yes-display-inline">The Secretary concerned shall be responsible for any expense related to the construction or maintenance of any fence constructed or maintained on covered lands for the prevention of grazing by livestock on such covered lands.</text></subsection><subsection id="H0999CF8995E34E08A3B4AB8D1BFB8D77"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H7DAC68CE1800468EA55DCAC9810373E8"><enum>(1)</enum><header>Covered lands</header><text>The term <term>covered lands</term> means National Forest System lands, lands administered by the United States Fish and Wildlife Service, or public lands—</text><subparagraph id="HE8775012A61F42EDAFCA339A982C311C" display-inline="no-display-inline"><enum>(A)</enum><text>on which grazing is permitted by grazing permit or lease on or after the date of enactment of this Act and subsequently prohibited; and</text></subparagraph><subparagraph id="H6C7C179E66CB4305AF0E6219E28086F7"><enum>(B)</enum><text>that borders private property.</text></subparagraph></paragraph><paragraph id="H46DB1D6FF4354290AD7E8FADDFC4B4BC"><enum>(2)</enum><header>Grazing permit or lease</header><text>The term <term>grazing permit or lease</term> means—</text><subparagraph id="HF04B1545793C47C6A6C90DA1D0CDC89C"><enum>(A)</enum><text display-inline="yes-display-inline">a grazing permit as such term is defined in section 222.1 of title 36, Code of Federal Regulations (or successor regulations);</text></subparagraph><subparagraph id="HD27EA0F834F241A2BE94644DBE05D49D"><enum>(B)</enum><text display-inline="yes-display-inline">a cooperative agreement referred to in section 29.2 of title 50, Code of Federal Regulations (or successor regulations) that permits grazing; or</text></subparagraph><subparagraph id="HF529B3B6A5274057930A64143CA4ABA8"><enum>(C)</enum><text>a grazing permit or lease described in section 4130.2 of title 43, Code of Federal Regulations (or successor regulations). </text></subparagraph></paragraph><paragraph id="HE4A5F05AC4DC47A2B3BBF0548EEC101D"><enum>(3)</enum><header>Livestock</header><text display-inline="yes-display-inline">The term <term>livestock</term> includes cattle, bison, horses, sheep, and goats.</text></paragraph><paragraph id="HD0AE25E074D04969AB9578A6307A2657"><enum>(4)</enum><header>National Forest System</header><text display-inline="yes-display-inline">The term <term>National Forest System</term> has the meaning given the term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609</external-xref>).</text></paragraph><paragraph id="H6D59F29B446D43819C47CD40FE832869"><enum>(5)</enum><header>Public lands</header><text display-inline="yes-display-inline">The term <term>public lands</term> has the meaning given that term in section 103 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1702">43 U.S.C. 1702</external-xref>).</text></paragraph><paragraph id="HCA7B94F6E3F04AA2A3A4E14408F85BC3"><enum>(6)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="HD1BB46639D9947D4AC51F4117787387D"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to National Forest System lands; and</text></subparagraph><subparagraph id="H0C37B49BB6914D55A23926F021DF5502"><enum>(B)</enum><text>the Secretary of the Interior, with respect to public lands and lands administered by the United States Fish and Wildlife Service.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
